Date traders in Maharashtra launch 56-page ready reckoner on food laws

The Mumbai Dry Fruits and Dates Merchants’ Association launched a booklet to help merchants and traders to function according to the new rules and regulations. Titled ‘Food Laws at Glance’, it was a 56-page quick-reference booklet to the Food Safety and Standards Authority of India (FSSAI).
The programme was organised in the Agricultural Produce Marketing Committee (APMC) Market, Vashi. The merchant community was present in large numbers. Ganesh Naik, guardian minister, Thane District, and state excise minister, Maharashtra, felicitated Rajal Asher, managing director, Bait Al Tamur, for his contribution to the export of dates.
Present at the event were Shashikant Shinde, Maharashtra’s water resourcesminister; Narendra Patil, member of the Legislative Assembly (MLA); Mahesh Zagade, commissioner, Food and Drug Administration, Maharashtra, and Mohan Gurnani, Federation of Assocaitions of Maharashtra (FAM).
Zagade said, “There are a lot of speculations related to the food safety laws and its procedures. Traders and merchants find it problematic and have tried to oppose it many times.”
“It is a good initiative to publish a book related to the Food Safety and Standards Act (FSSA). We appreciate the effort behind this. Merchants and traders have a greater responsibility to distribute safe and standard food to our people,” he added.
“Adulteration and the excessive use of chemicals has a destructive impact on thehuman body. Awareness about the laws can also avoid corruption in the system,” the state FDA chief stated.
Shinde said, “The government would take every possible step to facilitate good trade. With increased competition and strict rules on safe food increased problems around the trading of food.”
“But these initiatives can avoid doubts and misconceptions about the topic. But food traders have to ensure the quality of food materials and discourage any corruption in the field,” he added.
The minister, who represents the Nationalist Congress Party (NCP) and who is in charge of the Krishna Valley Irrigation Corporation, said, “We will strive to make this market in international level and compete with that of global standards.”
Naik said, “Without violating any rules and regulations, traders can earn a good profit and distribute good food for the public. We have seen problems occurring due to the excessive use of high chemicals in the states of Punjab and Maharashtra.”
“Long-sighted traders would not use chemicals for instant profits, which may destroy our environment and cause healthy lifestyles to collapse,” he added.
The Mumbai Dry Fruits and Dates Merchants’ Association was represented at the event by Vijay Kumar Bhuta, its president; Chetan Mehta, its vice-president; Girish Bhandari, its general secretary; Mahesh Laud, its joint secretary; Suresh Dama, its treasurer, and Rajendra Shah, its joint treasurer.
Bhuta said, “This booklet provides easy access and quick reference to FSSAI. This is designed to reach more merchants. This will help to create awareness among the merchants as well as customers about new laws and regulations.”
“This would throw light on dealer's fundamental rights and duties. This would perform as a guideline to merchants for an easy, valid and useful understanding of the law,” he added.

Private water tankers suck residents dry

Exploitation of natural resources:Water being pumped from a well near the city
P.S. Navaraj , Water expert: “It should be made mandatory that private water tankers get a no-objection certificate from the local body before supplying water to anybody”
J. Suguna , Designated Officer, Department of Food Safety and Drug Administration: “The drivers are advised to keep the tankers clean and taught easy methods of adding chlorine”

The city has witnessed demand going up manyfold in the last couple of months
With the gap between demand for potable water and supply widening due to various reasons, the business of supply through private tankers appears to be flourishing in the city.
As most of the wells have gone dry with the groundwater table hitting abysmally low depths even in areas closer to the banks of the Vaigai, residents have turned to private water suppliers who are now cashing in on the situation.
The people, instead of relying on the Madurai Corporation tankers, choose private tankers as they can deliver water anywhere anytime.
The tankers feed the huge demands of hotels, hospitals and business establishments, besides households. There are more than 500 private water tankers operating in and around the city that has witnessed demand going up manyfold in the last couple of months alone. While some suppliers source water from the open wells of others by paying Rs.100 for each load, a few extract water from their own agricultural fields and sell it.
R. Chandran, a private supplier who sources water from Oomachikulam on the outskirts of the city, says that he receives five to six calls a day for supply from residents alone.
“Residents say that they have to depend on private tankers as the civic body’s water supply has turned erratic due to poor storage in the Vaigai dam. The demand has increased from areas like Anna Nagar, K.K. Nagar, Athikulam, DRO Colony, Narayanapuram, Gomathipuram and Pandikoil,” he says.
“In our locality, we receive piped water supply only once in four days. Due to inadequate rainfall, we have been facing water scarcity for the past five years. Hence, we prefer water supplied in lorries, which lasts up to a week, for other purposes. The tankers charge Rs.500 for 6,000 litres of water,” says P. Karventhan, a resident of Narayanapuram.
A 12,000-litre-load of water per tanker costs anywhere between Rs.1,000 to Rs.1,200 depending on the distance. Of late, customers, mostly residential/apartment complexes, prefer tanker loads with a capacity of 6,000 litres that cost Rs.500 to Rs.900, says P. Kannan, another water supplier who sources water from Kochadai. No regulation
While hundreds of private water suppliers are into the business, there is no regulation or monitoring of the quality of water supplied by them. According to sources in the Tamil Nadu Pollution Control Board (TNPCB), Public Works Department (PWD) is the authority to enforce quality norms on private water suppliers in the city while the Food Safety Department fulfils the function when it comes to corporation water tankers.
“We are creating awareness of the importance of chlorination. The drivers are advised to keep the tankers clean and taught easy methods of adding chlorine,” says J. Suguna, Designated Officer, Department of Food Safety and Drug Administration.
Further, Ms. Suguna also advises the public not to use the water supplied by private tankers for drinking or cooking.
There are about 50 tankers operated by the Corporation in the added areas of the city. The water is treated properly and then chlorinated before being supplied to the residents, according to a corporation official.
It is not just the PWD which is responsible for the regulation but also the local bodies that can play a role in monitoring the private tankers, says a TNPCB official. Lack of co-ordination between departments is a major cause for the rampant water supply business, the official adds.
Water expert P.S. Navaraj says, “Most of the private water tankers get water from open wells. It should be made mandatory that they get a no-objection certificate from the local body before supplying water to anybody.”
“As per the guidelines of the Central Groundwater Authority, they are not allowed to extract water from open wells, which may contain pollutants that can’t be filtered even by a water purifier at home. Therefore, it can impact the health of a person.
Officials of Pollution Control Board must test the quality of water supplied by these water tankers. There must be a regulatory body to monitor and provide licences to them to operate trips. The tankers must also be educated on the use of water,” Dr. Navaraj explains.

Stale Food: Firm and Food Safety Commissioner Fined

KOCHI: A man who contracted acute Hepatitis A after consuming stale food purchased from a retail outlet at Maradu, got his grievance redressed when the Ernakulam Consumer Dispute Redressal Forum asked the company and the food department store to pay monetary compensation to the victim.
The forum asked the opposite parties, Pantaloon Retail India Ltd and Food Bazaar retail outlet, Nucleus Mall, Maradu, to jointly pay the compensation worth ` 1 lakh and an additional amount of ` 2,000 towards the cost of proceedings in the forum. The Food Safety Commissioner who is the third opposite party will have to pay ` 5,000 for not carrying out his duty even after the complainant lodged a complaint.
The forum observed that the food bought by the complainant, Anand Unnikrishnan, which included pulses, cereals and vegetables from the retail outlet at Maradu were stale. The response of the Food Safety Commissioner to the complaint filed by Anand proves that both the first and second opposite parties were distributing stale food.
In his reply, the Food Safety Commissioner said that the samples from the retail outlet were collected and directions were given to the Chief Food Safety Officer, Mobile Vigilance Squad, Ernakulam to report on the action. “This is a suffice evidence,” observed the forum. Besides, the discharge summary by the hospital clearly states that Hepatitis A is transmitted orally by consuming contaminated food and the victim had to spend ` 36,414.93 towards treatment expenses.
The Forum fined the Food Safety commissioner as even after claiming that the food safety officials collected the samples, the documents pertaining to it could not be presented before the forum. “It is a blatant negligence of duty. Besides, the sale of sub-standard food or unsafe food itself is punishable under Section 51 and 59 of the Food Safety and Standards Act 2006,” the forum observed.
The members of the forums were president A Rajesh, Sheen Jose and V K Beena Kumari.

Implementation of Food Safety and Standards Act in the Isles: Landmark Judgment by Calcutta High Court

Port Blair, June 8: The Food Safety and Standards Act 2006 and Rules 2011 is being implemented in the Islands on adhoc mechanism from 5th August 2011. As per the Act the Statutory functionaries have to be appointed on Whole-Time- Regular basis, but the A&N Administration had appointed the Director of Health Services and Medical Officers on additional Charge of Commissioner Food Safety and Designated Officers (Chief Food Safety Officers).
On a Public interest Litigation Filed by Advocate K. Sabir on behalf of Island Protection Forum, the Ministry of Health and Family Welfare supported the petitioners cause. The High court expressed its displeasure on the lack of seriousness in ensuring the right to safe food. Under Article 21 of the Constitution, the Constitution Guarantees Right to live with human dignity'. It is the duty of the state to raise the level of nutrition and the standard of living and to improve public health.
The petitioner contented that no Food is being tested in the islands for the past 15 years, as there is no Food Analyst and said any food article which is hazardous or injurious to public health is a potential danger to the fundamental right to life guaranteed under Article 21 of the Constitution of India. Therefore it is mandatory to appoint all Statutory Functionaries on a Whole-time Basis.
The Hon’ble Court directed the Union Government and the UT Government to appoint all statutory functionaries (The State Food Safety Authority consisting of Whole Time Commissioner Food Safety, Whole Time Designated Officer, Whole Time Food Safety Officer and Food Analayst) to implement the Act in a proper and complete manner as per the mandatory qualification given in the Food Safety and Standards Rules.
If the Act is implemented properly as per the Hon’ble Court’s Order, it is likely to generate many Jobs apart from the post of Food Safety Officer whose qualification requires Masters in Chemistry, or Graduate in Food Science (BSc Agriculture) or Food Technology or Microbiology.

Now, whatever happened to that chilly chicken!

KOCHI: If you haven't noticed, the tomato soupserved in city restaurants is no longer creamy red in colour and the schezwan fried rice looks like ordinary vegetable fried rice. Increasing number of hotels and bakeries in the city are abstaining from using food colour and monosodium glutamate (known by its brand name Ajinomoto) in their dishes.
After recent raids conducted by food safetyofficials, the Kerala Hotel and Restaurant Association (KHRA) has issued instructions to their member hotels and bakeries to refrain from using food colours in dishes.
"Though hoteliers are permitted to use food grade colours and monosodium glutamate in some specific dishes, the association has instructed them to completely refrain from using these. It has been scientifically proven that these products contain harmful substances. The hotel owners can be fined for excess or unauthorized presence of food colours and monosodium glutamate. We no longer want to take the risk," said KHRA Ernakulam district president Shiju M P.
The association has also given directions to maintain hygiene in thekitchen, procure raw material from registered traders and keep a list of these products, practice regulations set by the Food Safety and Standards Authority of India (FSSAI) while deep freezing boiled chicken and meat, limit storage of frozen chicken and meat to a maximum of two days, appoint staff to constantly monitor the functioning of freezers, provide facilities for staff to maintain personal hygiene, and not to provide entry from kitchen to toilet.
"In fact, from last year we have been trying a phase by phase implementation of these directives. As food safety has become a major concern, the association does not want to prolong the process. Moreover, KHRA is also planning to bring in a separate agency to monitor the implementation of these directives in member hotels. Special squads functioning under these agencies will inspect the hotels and issue instructions to rectify lapses," added Shiju. There are over one lakh members, including hotels, restaurants and bakeries, under the organization. In Ernakulam, KHRA has about 50,000 members.
Meanwhile, restaurants in the city have already started following the association's directions. "There is a general feeling that hotels are not serving quality food. We want to give them good food and maintain the goodwill. The hotel owners cannot afford to lose business," said Senthil Nathan, supervisor at a city hotel.
Some restaurants say that a few of their customers are surprised at the sudden change in the taste, texture and colour of the food served. "Those who are health conscious appreciate our move while others express disappointment. As we are into food business, we have to abide by rules," saidHashim Ansari of a sandwich outlet.

Meat shops and eateries to come under police scanner

KOCHI: In the wake of seizure of huge quantity of rotten poultry meat recently, police and food safety department have decided to clamp down on illegal meat shops, besides monitoring eateries and meat shops in the city.
The inspections and surveillance activities will be carried out separately by both police and foodsafety department, according to sources.
"In the context of seizure of rotten meat, we will inspect meat shops in the city. Many of them have been operating secretly without valid licence," said K Ajith Kumar, assistant commissioner, food safety, Ernakulam. However, he refused to divulge more details.
On Friday, police and health department had seized 600kg of rotten duck meat, which was meant for supply in Ernakulam and at Kalavoor in Alappuzha district. In an earlier incident, police had seized over 300kg rotten chicken meat from a stall in Kaloor market.
But food safety department officials expressed their inability to conduct frequent raids due to shortage of staff and vehicles. "It is not possible for us to carry out checking regularly. Coordinated efforts of various agencies are required to keep a check on it. Many a time we are kept in the dark when local bodies and police conduct raids," said a food safety official.
He added that the food safety department has already sought assistance of the state intelligence to find out the suppliers and buyers of stale meat.
Police say that supply of rotten meat to restaurants and other eateries has become rampant in the city. "It's a serious issue. Police will soon conduct inspections to keep a check on the use of stale meat by restaurants," said M Ramesh Kumar, assistant commissioner, special branch, Kochi City.
Food safety officials said stale chicken seized from Kaloor market was meant mainly for migrant workers. Though the suppliers had claimed that the stale meat was not sold for human consumption but was rather meant for pet animals, food safety officials were not quite convinced and did not find a grain of truth in that statement.
Meanwhile, restaurant association and bakers' association blamed each other for the use of stale meat. "Rotten meat is not used by restaurants. Instead it is used by bakeries for preparing cutlets and puffs," said Jose Mohan, general secretary, Kerala Hotel and Restaurant Association.
However, bakeries denied the claim of restaurant association. "We don't use rotten meat in cutlets and puffs because if we use then people will immediately come to know about it due to the stench of stale meat," said P M Sankaran, president, Bakers Association Kerala (Bake).
The inspections and surveillance activities will be carried out separately by both police and food safety department, according to sources. Is it mango you are drinking?

Are you getting artificial flavours instead of real juice

If you switch on the television these days, you will get the impression that the whole country is doing nothing but guzzling glass after glass of mango juice. From happy, bouncing kids to glamorous divas, anyone and everyone can be seen selling a carton of packaged mango nectar to heat-beaten, exhausted consumers. If you can tear your eyes away from Katrina Kaif, who wants us to believe that savouring a mango drink is nothing short of an intensely sensual experience, then look at the composition and ingredients of the juice before you pick up a carton. Nutritionists insist that the choice of the brand should depend not on the superstar who endorses it but on parameters such as the amount of pulp, sugar levels and the type of preservatives that have been used.
Mango juice vs mango drink
There are four categories of packaged mango drinks available in the Indian market today. Mind it, we say 'drinks' and not juices; not all mango drinks can reach the exalted status of juices, they need to meet some parameters to be called so, starting with the composition.
If you go by the definition given by the American Academy of Pediatrics (AAP), a fruit juice is either natural or 100 per cent concentrate without added sweeteners. It further states that anything less than 100 per cent concentrate is labelled a drink, beverage or cocktail. Fruit drinks are defined as calorically sweetened beverages with a small percentage of fruit juice or juice flavouring containing carbonated water. They have less than 20 per cent concentrate and may or may not include fortifiers such as vitamin C. In India, for instance, PepsiCo offers a range of both mango juices and beverages, starting with Slice which is a 'drink' and Tropicana andTropicana 100% which are juices. "Please note that fruit juice and fruit beverage / fruit drink are standard categories under the Food Safety & Standards Authority of India Regulations. As such, Tropicana 100% is covered by standard 'fruit juice' and the remaining range of Tropicana and Slice are covered by same standard 'fruit beverage / fruit drink,' says a PepsiCo India spokesperson. Similarly, Parle Agro's Frooti and Coca-Cola's Maaza are fruit drinks, while Hector Beverages' PaperBoat Aamras, which contains 45 per cent pulp, is a juice.

Wellness expert Shikha Sharma elaborates on the categories ofdrinks and juices available:
"The first and lowest quality of mango drinks makes use of water, sugar, preservatives and fruit essence, something like Rasna. Just like vanilla essence is not made from real vanilla, the mango essence too is not derived from the fruit. Instead, it is a synthetic chemical that resembles the flavour.
Higher up the ladder comes the category that contains some part of the preserved fruit concentrate, sugar and water. These can be classified as 'juice'.
The third category composes of real fruit pulp, concentrate, water and sugar.
And the fourth is the sugar-free category like Tropicana 100% which has no added sugar but real pulp, concentrate and water. While the fruit used in the pulpy juices is very much real, it's not necessary that it will be mango. For instance, apples are often mixed with really saccharine fruit like grapes to lend an intensely sweet taste to the juice. There might be very little mango, with huge quantities of cheaper fruits like beetroot being added.
High on sugar
Of all the fad diets peddled by wellness gurus these days, the fruitarian diet seems to be the most popular. But those who think that they will go from flab to fab with packaged juices, think again! In fact, doctors believe that even fruits should be eaten in moderation, due to the high levels of fructose present in them. "More than 50 gram of fructose per day can be counter productive and can increase the risk of obesity, diabetes and heart disease," says Ishi Khosla, clinical nutritionist and founder, weightmonitor.com. She considers packaged juices low on fibre and disguised forms of fructose. "Unlike other sugars like glucose, ingestion of excessive fructose is associated with insulin resistance, thus leading to metabolic syndrome, including increased blood sugar levels, high triglycerides, high uric acid, fat deposition in the liver, weight gain and eventually obesity and Type-2 diabetes," says Khosla.
Know your brand
A fruit drink which has pulp or juice, chemicals and flavour is called synthetic. Mostly, all brands likeFrooti, Maaza, Slice and Jumpin' have flavours added to them and hence fall in this category
Pulp content varies across brands. Real and Tropicana contain over 80 per cent pulp, KDD Harvest and Amigos contains over 30 per cent pulp, while Frooti, Maaza and Minute Maid have less than 20 per cent pulp contentSuman Agarwal, Mumbai-based nutritionist and owner of Selfcare

Though high on calories, mangoes have many redeeming qualities - they are an excellent source of vitamins and are high on non-nutrient phytochemical compounds. But it is prudent to consume various variants of mango products - juices (packaged or otherwise), aampapad, etc - in small quantities.
Another issue with packaged mango juices is that they are high on simple sugars and contain very little complex sugars, which is not ideal for those with a sedentary lifestyle. What about the fresh juices churned out by your neighbourhood vendor? Are they any better? "I would say not. The hygiene levels at these places is very low. Moreover, they add syrups and concentrates to sweeten it. So again, these juices are loaded with sugars," says Sharma.
Read the fine print
While most nutritionists like Khosla don't recommend having packaged juices at all, ("Have a fruit or fresh vegetable juices. If you want to indulge yourself, then dilute 100 ml of juice with water or soda," she says) if you really MUST have it then check the pulp content, sugar levels and expiry date before you buy a juice carton from the supermarket. "Even one tablespoon of sugar is high enough. It is equivalent to 15 gram. If a fruit juice carton declares the sugar level as 20 gram then it contains five teaspoons of sugar, which is very high," says Sharma. One should also check the preservatives and stabilising agents used. "A lot of juices use soya protein to add texture and as stabilising agents. Those with soya allergy should avoid those," she adds.
Brand speak
"The fruit juice/pulp content in our fruit beverages is more than the minimum quantity prescribed in the regulations - for example Tropicana fruit juice beverages offers far higher juice content than these regulatory norms, while "Tropicana 100% Fruit juices" are simply 100 per cent juices without any added sugar, preservative, artificial colour or flavouring. All the ingredient data as well as nutritional information is provided clearly on the packs as well as on our website" - PepsiCo spokesperson
"All Paper Boat drinks are natural (though not 100 per cent natural). Aamras contains nature-identical flavouring substances and 45 per cent mango pulp. Our drinks do contain added colours or artificial flavouring substances." - Hector Beverages spokesperson

Online food licensing facility gets tepid response in Jalandhar dist

The much-hyped online facility to get food licences has received a tepid response from food-business operators so far in the district since its launch on March 26 this year.
Details gathered from the health department reveal that only 55 registrations and 47 licences have been issued in the district so far.
The manual issuing of registrations and licences has already been stopped after the online facility was started.
Officials are of the view that food-business operators such as vendors hesitate applying online since it is more complex than the manual process and also most of them are not familiar with computers.
The higher authorities have also not given computers to foodsafety officers or other staff to handle online applications, they said, adding that some of the staff had also been using their own laptops for these services.
Moreover, officials are mulling over to launch a separate counter at the suwidha centre in the district administrative complex so that people could apply easily rather than going to the civil surgeon’s office.
The food-business operators, they added, were of the opinion that the central gover nment would extend the deadline for registration and getting licences which has been fixed on August 4.
If the government did not extend the date, the department would start issuing challans to violators, officials said.
Before launching the online facility, about 1,600 eateries had got licences and some 8,200 stall holders, hotels, restaurants, canteens, dhabas, food carts, sweetshops, tea stalls, grocery stores, meat sellers and milk sellers etc had got registered with the department.
The department had organised training for its food safety officers and other health staff to help people and assured to them it would soon send computers, scanners and printers to the headquarters besides an operator who will handle online applications, but nothing has been done as yet.
About lukewarm response, district health officer Dr Balwinder Singh said, “We are trying our level best to motivate food-business operators to come for mandatory registration, but to no avail.”
For the online facility, the applicants can log on to the designated website foodlicensing.fssai.gov.in where they will have to register as users after furnishing details of their business. After this, they will have submit fee amount as per the government order. Then, the applicant will have to fill the form for seeking registration/ issuance of licence and upload scanned copies of the required documents on the website.
After getting the application online, health workers will visit the shop or the unit for physical verification.
As per the Food Safety and Standards Act, 2006, it is mandatory to have a licence for food-business operators with an annual turnover of above Rs. 12 crore a year while those earning less than this must get a registration certificate.
The registration fee is Rs. 100 and the licence fee is from Rs. 2,000, Rs. 3,000 and Rs. 5,000 depending on the category of business.
