Central govt given 3 months to frame rules restricting sale of junk food in schools

The Delhi High Court gave the Central Government three months’ time on Friday to enforce guidelines on restricting sale of junk food in and around schools.

A bench of Chief Justice G Rohini and Justice Jayant Nath told the Food Safety and Standards Authority of India (FSSAI) agreed to extend the previous deadline which lapsed on Friday after the government sought more time to implement the guidelines.

Accepting the draft guidelines for restriction on sale of junk food in and around schools, the court gave FSSAI three months’ to draw up and implement its regulations on February 25.

The bench had also directed the CBSE, under which most schools come, to consider including compliance of the guidelines as a condition for being affiliated with it.

Under the guidelines, food high in fat, salt and sugar cannot be sold within 50 metres of school premises.

The court's order came on a PIL filed in 2010 by NGO Uday Foundation flagging the easy access of junk food and carbonated drinks to children and seeking a ban on their sale in schools. The FSSAI guidelines will apply to the whole country.

Pal Hotel’s kitchen sealed for 2 days

Patna: The kitchen of Pal Hotel, located at Buddha Marg, has been sealed for two days by the food safety department owing to its unhygienic condition.

The hotel has been asked to submit a compliance report of hygiene. After its submission, food safety wing officials will inspect the hotel again and if satisfied, the kitchen will be reopened.

Food safety commissioner Anand Kishor said a raid was conducted on the hotel following complaints.

The kitchen was found to be dirty. Samples of five items — flour, red chilly powder, white flour, turmeric and cumins — have been seized and sent to a food safety lab.

If the report is adverse, action will be taken against the hotel.

In another drive, the food safety wing officials raided eight paan masala shops and seized banned tobacco products worth Rs 7,000.

The proprietors of the shops concerned will be prosecuted for the alleged violation of Section 58 of FSSA. The section invites a fine up to a maximum of Rs 2 lakh. "We will continue such drives in future too," Kishor said.

Compulsory Testing of Packaged Food Products

As per the conditions of license prescribed in the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulation, 2011, all food business operators have to ensure testing of relevant chemical and/or microbiological contaminants in food products in accordance with these regulations as frequently as required on the basis of historical data and risk assessment to ensure production and delivery of safe food through own or NABL accredited /Food Safety and Standards Authority of India (FSSAI) notified labs at least once in six months. Every food business operator in the country has to follow and comply with Food Safety and Standards Act, 2006, Rules and Regulations made there under. 

Besides, safety standards of food items have been notified in respect of around 365 categories of food products. These standards are enforced by the Food Safety Departments of the States/UTs. 

The MoS, Ministry of Health and Family Welfare, Shri Shripad Yesso Naik stated this in a written reply in the Rajya Sabha here today.

13 eateries ordered shut

The Food Safety officials on Friday closed down 13 eateries in the city for selling unsafe food.

Under Operation Ruchi, the officials conducted inspections at various restaurants, tea stalls, fruit stalls, juice centres and roadside eateries and found some of them selling food in unhygienic conditions.

Senior Food Safety Officer Abdul Majeed along with food inspectors Zakir Hussain and Jose Lawrence inspected four hotels and four juice centres at Marine Drive, all of which were asked to down shutters for using banned colouring agents and adulterants in the food. Street food vendors selling north Indian specialities were found to prepare their food in unhygienic conditions. None of them had licences either. All the eateries have been given notices to improve their sanitary conditions.

The Food Safety Officer said tea stalls were found to use adulterated tea leaves.

FSSAI gets three months to frame food guidelines

The Delhi High Court on Friday granted three months time to the Food Safety and Standards Authority of India (FSSAI) to frame and enforce guidelines for making available wholesome, nutritious and hygienic food to school children and restricting the sale of junk food in and around schools.

The Court allowed an application of FSSAI seeking extension of time following its March 17 judgment by which it had directed regulation of junk food consumption among school children through restrictions on the sale of foods high in fat, salt and sugar in and around schools.

A Division Bench, comprising Chief Justice G. Rohini and Justice Jayant Nath, asked FSSAI to create regulations within the time period. The Court had earlier accepted draft guidelines for restriction on junk food.

The Court had also directed the Central Board of Secondary Education to consider including compliance with the guidelines as a condition for schools for getting affiliation with it. Besides, directions were issued to the Delhi Government to consider issuing instructions to schools to follow the guidelines.

The judgment came on a public interest writ petition moved in 2010 by a non-government organisation, Uday Foundation, which raised the issue of easy availability of junk food and carbonated drinks to children and sought a ban on these food items in schools. Under the guidelines, food high in fat, salt and sugar cannot be sold within 50 metres of school premises.

The draft guidelines also suggested creation of a canteen policy and school health education programmes to educate students and parents about “ill-effects” of unhealthy food habits. In its judgment, the Court had refused to pass orders to the government on how to regulate the sale of junk food, while noting that the guidelines had been created by an expert panel.

The Court had also declined to define the term “junk food” after observing that the draft guidelines had not used the term “junk”, but had used the term, “high in fat, salt and sugar” (HFSS) foods. “When an expert body constituted for this very purpose and in performance of its statutory duties has framed the guidelines, without there being any specific challenge thereto, we do not consider appropriate on our part to tinker with it,” it said.

The guidelines provided a scientific background on how consumption of junk foods was linked with the growing non-communicable diseases such as obesity, diabetes and hypertension among children.

Verdict on Nestle’s plea on Monday

Interests of consumers more important, says Bombay HC.

The Bombay High Court will pass an order on Monday on the petition challenging the ban on Maggi noodles in Maharashtra, after Nestle India and regulators failed to come to a consensus on retesting.

Swiss food manufacturer Nestle India had petitioned the court seeking revocation of the ban and quashing of the order of the Food Safety and Standards Authority of India (FSSAI) which had declared the product unsafe.

The court had earlier proposed retesting in independent laboratories agreed upon by the company, food regulator and the State government. Though Nestle agreed to the proposal for retesting, the State and the FSSAI, on Thursday, did not.

The State did not give its consent to retesting as it was not in consonance with the Food Safety and Standards Act 2006. In the absence of an agreement, a Division Bench of Justices V.M. Kanade and B.P. Colabawalla reserved its order on Nestle’s petition for Monday.

HC reserves order in Maggi case

MUMBAI: The Bombay high court on Friday reserved its orderin the tussle between Nestle India and the Food Safety and Standards Authority of India (FSSAI) over the nationwide ban enforced on sale of its popular 2-minute Maggi noodles. Nestle had moved the HC against a June 5 ban imposed on sale and manufacture of Maggi noodles and a ban issued in Maharashtra on June 6 after 30 samples out of 72 tested high for lead content. 

A bench of Justices V M Kanade and B P Colabawalla had proposed to the food safety regulator FSSAI if it could do a retest of the samples. Mehmood Pracha, counsel for FSSAI CEO Yudhvir Singh told the HC that a retest was not permitted in the food safety Act and also said, if permitted, would open floodgates. 

Darius Khambata, counsel for Maharashtra food authorities, said the extra preserved samples already taken could be tested, but only in referral labs. Nestle said it would give fresh samples for a test at labs notified and accredited. 

In response to the food authority's claims that Nestle is destroying evidence, Nestle counsel Iqbal Chagla had refuted the claim, saying it had preserved 750 crates of 90 Maggi packets each for sampling. The HC posted the matter to next week as there was no consensus on fresh tests. 

Nestle has argued that its product is safe for consumption as it has always been for three decades.
