High Court upholds powers conferred on Food Safety Officers

The order was passed on a petition filed by an oil trading firm

The Madras High Court Bench here has upheld the power conferred on Food Safety Officers to make surprise inspections in business establishments, seize edibles suspected to be adulterated and seal the premises pending a detailed inquiry.

Justice M. Venugopal passed the order while dismissing a writ petition filed by an oil trading company based in Karur district with a plea to restrain the Collector and officials of the Food Safety and Drug Administration department from interfering with the petitioner’s business.

Claiming to possess licences for trading in both edible and non-edible oil but doing business only with respect to non-edible oil, the petitioner’s firm had accused the Food Safety Officer of having seized its consignments and sealed the premises without prior notice.

On the other hand, Additional Government Pleader A. Muthukaruppan contended that the premises was inspected on receipt of complaints that the petitioner firm was in the habit of converting substandard edible oil into cooking oil by mixing unauthorised chemical agents.

He pointed out that the Food Safety Officer of the district had made a surprise inspection of the petitioner’s premises, seized the adulterated oil, sent the samples for chemical analysis and sealed the rest of the consignment after shifting it to one of the rooms in the oil firm.

Accepting the AGP’s contention, the judge said that Section 38 (1) to (6) of the Food Safety and Standards Act, 2006 empowers the designated officers under the law to seize any article of food which appears to have been adulterated and initiate necessary action against individuals concerned.

‘Bills not produced’

Further, pointing out that the petitioner firm had not produced the sales bills of raw materials purchased by it and other relevant documents despite a notice issued by the Food Safety Officer, the judge said: “the petitioner had also failed to establish its bona fide transaction or action.”

HC notice to FSSAI on chewing tobacco ban

Bengaluru, 

The High Court on Tuesday ordered issuance of notice to Food Safety and Standards Authority of India in a petition filed by the Cancer Patients Aid Association seeking ban on the manufacture, storage, sale and distribution of all forms of chewing tobacco, including flavoured, scented etc.

Cancer patients with bandages, pipes and wheelchairs were present before the court. The petitioners contended that the state and Union governments had failed to enforce the sale and distribution of chewing tobacco. Though Karnataka has banned gutkha, plain chewing tobacco is still sold in separate pouches. A division bench comprising Chief Justice S K Mukherjee and Justice Ravi Malimath ordered notice and adjourned the hearing.

In another batch of petitions seeking implementation of 85% of pictorial warnings on tobacco products, the division bench said that a separate division bench will be constituted to hear the petitions.

The High Court has said that whenever there are 'police excesses', the Police Complaints Authority (PCA) should take up the issue and register a complaint instead of waiting for a third person to lodge the complaint. Justice A N Venugopala Gowda said that he was very unhappy in the way PCA and the Karnataka State Human Rights Commission had reacted and dealt with the people of Yamanur, Navalgund district in Dharwad, who were beaten up by the police during the Mahadayi agitation.

The state government, in the report on the medical treatment given to the villagers, said, nearly 1,160 persons, including two pregnant women and three persons with bone injuries were treated. The judge said that the report did not mention names of the persons and the kind of treatment that was given to them. The judge sought a detailed report on the medical treatment given to the villagers and adjourned the next hearing to August 20.

ARE WE DRINKING MILK OR POISON?

ADULTERATION OF MILK AND OTHER FOOD ITEMS IS HARDLY DETECTED. WHAT IS NEEDED IS TO MAKE THE MACHINERY FOR TESTING SAMPLES AND TAKING FOLLOW-UP ACTION EFFICIENT AND FREE OF CORRUPTION.

The Supreme Court has rightly expressed serious concern over the rampant adulteration of milk in the country. It has also rightly criticised the Food Safety and Standards Authority of India (FSSAI) for its failure to take effective measures to check adulteration. The court has issued a set of guidelines to the Central and state governments and the FSSAI which are intended to help them in dealing with the problem of milk adulteration.

They include executive, regulatory and legal measures. Most of them are necessary and even essential, but the court went overboard with its prescription of life imprisonment for those who adulterate milk. It told the Central government to amend the Indian Penal Code to provide for life term in such cases. Some states like Uttar Pradesh, Odisha and Bengal have this provision. At present, most states prescribe a punishment of six months jail term and a fine. Consumption of adulterated milk is hazardous to health, and infants and children will be particularly affected by it.

But life imprisonment is an excessively harsh punishment for the offence. The existing punishment is low, but there is no need to go to the other extreme by making the punishment too stringent. That is not a case for being lenient to adulterators. Governments may consider enhancing the punishment to four or five years, which will serve the ends of justice. It does not help to take an emotional view of crime and punishment, and courts should especially take care to have a reasonable and logical view of them. The law and punishment should be the same for all kinds of adulteration which endanger the lives and health of people. It is difficult to see the legal rationale for treating milk adulteration differently from adulteration of other food items. The problem of milk adulteration is the most serious in states which provide for life term for it. At the national level, about 70 per cent of the milk being sold is adulterated.

In Odisha and Bengal it is 100 per cent and in UP it is 88 per cent. The prospect of a life term has not made any better impact in these states. It is well accepted that it is not the severity of punishment but its certainty that deters criminals. In India, offenders are in fact certain that they can get away with the offence. Adulteration of milk and other food items is hardly detected and even when cases are registered, very few are punished.

What is needed is to make the machinery for testing samples and taking follow-up action efficient and free of corruption. The court’s directives in these respects are welcome.

Controversy over food given to CM during two-day sangat darshan in Jalandhar

A controversy has erupted over the food served to chief minister (CM) Parkash Singh Badal during the two-day sangat darshan programme in Adampur.

Additional deputy commissioner (ADC) (development) Girish Dayalan, who was heading the meeting of the district health society (DHS) on Tuesday morning, quizzed the food safety officers saying that the administration had got information from the police that the food given to the CM in the sangat darshan programme was not tested.

The ADC’s remarks left the food safety officer ‘shocked’.

Dayalan told them that the SSP rural had disclosed this to him.

Moreover, the ADC said that during the sangat darshan, a man came and offered a piece of sweet from the sweets box and the CM obliged the man by eating it.

The ADC said it was really surprising and asked the food safety officers about the procedure when food and other items are being to the CM and the deputy CM.

Food safety officer Harjot Pal Singh clarified that first they take the sample for testing and then, they taste themselves the food separately. He disclosed that the food safety team had always taken the sample of every food product, being given to the CM.

The ADC told them to ensure proper testing of foods given to the CM. A senior officer said when the CM or the deputy CM remain in the district, some senior Akali leaders and MLAs bring meal from their houses and offer it to them. Whenever the food safety team asks for the test of their food, they usually get angry and do not obey the instructions of the protocol. “If we argue with them, we face awkward situation,” added the officer.

The CM was in Jalandhar for two days from August 12 to 13 for sangat darshans in various villages in Adampur constituency.

Meanwhile, the ADC said that the city would get three new primary health centres at Dhannowali, Garha and Ladhewali localities.

Week-long drive against food adulteration

Meerut: With Raksha Bandhan drawing close, the Food Safety and Drugs Administration (FSDA) department has launched a week-long anti-adulteration drive in the city.

On Tuesday, the department personnel collected samples of sweets from several shops in the city's busy markets.

"We have got instructions from the FSDA commissioner Murli Manohar Lal to start the anti-adulteration drive to keep an eye on the sweets being sold during the festive season. As part of the drive, we collected samples of sweets from nine shops on Tuesday," said JP Singh, chief food safety officer.

Meanwhile, food supplement samples were also collected from a shop in Shastri Nagar area of the city.

All the samples were sent to food testing laboratory in Lucknow, as the department feared manipulation at the city-based labs.

"However, in cases where there is a strong suspicion of contamination in the food item, we dispatch its samples to the city-based laboratories to get quick result. The sample reports from the city-based lab can be procured within 48 hours and action can be taken soon after," Singh said.
