Interests of consumers more important, says Bombay HC.
The Bombay High Court will pass an order on Monday on the petition challenging the ban on Maggi noodles in Maharashtra, after Nestle India and regulators failed to come to a consensus on retesting.
Swiss food manufacturer Nestle India had petitioned the court seeking revocation of the ban and quashing of the order of the Food Safety and Standards Authority of India (FSSAI) which had declared the product unsafe.
The court had earlier proposed retesting in independent laboratories agreed upon by the company, food regulator and the State government. Though Nestle agreed to the proposal for retesting, the State and the FSSAI, on Thursday, did not.
The State did not give its consent to retesting as it was not in consonance with the Food Safety and Standards Act 2006. In the absence of an agreement, a Division Bench of Justices V.M. Kanade and B.P. Colabawalla reserved its order on Nestle’s petition for Monday.
