Lead Contamination - Hazardous, enforce rules

The idiom 'better late than never' appropriately applies to the country's food regulator, Food Safety and Standards Authority of India (FSSAI). It has finally decided to tighten the noose and hopefully should set focus on various food and health supplements. This could cover a range of imported food items, specially protein and other supplements sold without medical supervision. Moreover, the claims by well-known FMCG brands that their products are health drinks need to be investigated.
Experts believe that the Maggi noodle controversy is possibly the tip of the iceberg and reports would only prove the efficacy of claims. Tests may well reveal whether the MNC companies, who normally hold sway over the market, are adhering to the prevalent rules and not making false claims.
Over the years, the multinationals have more or less controlled the Indian consumer market and till a few years back, were allowed to get away with their claims. It is only in recent years that the Government has taken initiatives to ensure that national and international regulations are adhered to, but the move is unfortunately haphazard. Even today, there are various products in the market by big and powerful companies that advertise their products they can never prove from the scientific standpoint.
Unfortunately, it is the poor and the economically weaker sections that are affected and after the ailment don't have the financial resources to get treatment. Thus, the big MNCs cannot be allowed to make huge profits from the Indian consumer market. The food safety regulator should be given more powers and authority to carry out periodic checks without fear or favour and make their reports available to the State governments for compliance.
Documents so far released by the FSSAI, which works under the Health Ministry, suggest that lead and MSG (monosodium glutamate) found in excess could have devastating consequences, which could impair the mental growth of children. Research studies by health and toxicology experts from across the country have documented lead in a variety of processed and raw food products such as chocolates, milk, vegetables, fish and water.
Scientists say the primary sources of environmental lead are lead paints, backyard recycling of lead batteries and water plumbing materials among others. A Toxics Link survey from SMEs from Andhra Pradesh, Bengal, Delhi, Gujarat and Maharashtra found around 30 per cent of samples with lead values greater than 10,000 ppm though the Bureau of Indian Standards (BIS) had set a code of 90 ppm.
The practice of immersing painted idols in rivers and lakes results in lead being deposited in water, which obviously finds way to the food chain. A painted idol of just 2 kg idol could deposit at least 8 to 10 gm of lead into the water. Even traditional ayurvedic medicines are reported to contain lead, sometimes more than permissible limit power.
The most sensitive target of lead poisoning is the nervous system. In children, neurologic deficits have been documented at exposure levels once thought to cause no harmful effects. Exposure to lead can have a wide range of effects on a child's development and behavior. Even when exposed to small amounts of lead levels, children may appear inattentive, hyperactive and irritable. Children with greater lead levels may also have problems with learning and reading, delayed growth and hearing loss. At high levels, lead can cause permanent brain damage and even death.
Lead inhibits the body's ability to make hemoglobin by interfering with several enzymatic steps in the heme pathway. Ferrochelatase, which catalyzes the insertion of iron into protoporphyrin IX, is sensitive to lead. A decrease in the activity of this enzyme results in an increase of the substrate, erythrocyte (EP), in the red blood cells. Lead can induce two types of anemia. Acute high-level lead poisoning has been associated with hemolytic anemia. In chronic lead poisoning, lead induces anemia by diminishing red blood cell survival.
Lead toxicity has endocrine effects. A strong inverse correlation exists between blood lead levels and levels of vitamin D. Because the vitamin D-endocrine system is responsible in a large part for the maintenance of extra-and intra-cellular calcium homeostasis, it is likely that lead impairs cell growth and maturation and tooth and bone development.
Long back, scientists at the Bhabha Atomic Research Centre documented the presence of lead among other heavy metals in chocolates and candies. They calculated that a child who eats 20 grams of chocolate daily would on an average ingest about 270 micrograms lead in a week. Other studies detected lead in buffalo milk in Chennai and Hyderabad, vegetables in Bihar, Uttar Pradesh and Bengal, paddy grown in Odisha and several species of fish in the Cauvery.
Maggi thus is not the only food product with chemicals that can cause organ damage. Almost every ready-made or pre-packaged food - pastas, sauce, potato chips and soft drinks - comes with a host of colouring agents, artificial sweeteners and preservatives that doctors say can adversely impact health.
Only in recent times has unleaded fuel been introduced. The lead that was earlier emitted into the air settled on the earth and permeated the soil. In many metros and big cities, one can see lead acid batteries being dismantled openly, releasing lead particles into the air and soil. Experts point out, and quite rightly, that specially in urban areas there is virtually no way of escaping this contamination.
While arsenic contamination is rampant in Bengal, Bihar and Assam and the resultant effects have caused severe health hazards, the threat of lead contamination has major consequences on human health. Ingested lead may accumulate in the brain, liver, kidneys and the bones. According to toxicology experts, children are particularly vulnerable and lead poisoning can result in their intellectual deterioration. In adults, lead can increase the risk of high blood pressure while pregnant women exposed to high levels of lead face the risk of miscarriage, stillbirth and premature birth.
Excess salt, which happens to be a major preservative used in ready-to-meat meals, is a known cause of high blood pressure and is responsible for around 60 per cent of heart attacks and over 40 per cent stroke cases, according to the World Health Organization. In India, people normally consume excess salt that WHO mandated 5 gm per day and eating packaged food would increase the intake significantly.
Since it is an established fact the neurological damage caused by even low levels of lead is long term and often irreversible, the best solution to check lead poisoning is to prevent it by controlling lead hazards in the environment before the poisoning occurs. Therefore, people must be made aware of the chemically contaminated communities and must be warned of the consequences of ignoring the threat of lead both in our environment and food. There should be no short cuts.

Make laws and celebs accountable

A still from Madhuri Dixit’s television commercial for Maggi

The controversy surrounding Maggi noodles has raised several vital questions relating to the hygiene of the food we eat but we also need to look at the ethics of advertisement and the role of brand ambassadors. The entire gamut of issues calls for a dispassionate examination, not only from legalistic angle but from socio-ethical angle as well.
The Food Safety and Standards Authority of India (FSSAI), established under the Food Safety and Standards Act (FSSA), 2006, is mandated to ensure that the food people consume is safe and wholesome and for that it has to lay down science-based standards for articles of food and regulate manufacturing, processing, distribution, sale and import of food. In the prevailing scenario, with the adulteration being the order of the day, it is difficult to vouch for the purity of any food article.
There is no gainsaying the fact that lies are being sold; most of the advertisements are misleading and filmstars and sportspersons bequeath credibility by endorsing the products. Maggi noodles allegedly contain a high amount of monosodium glutamate (MSG) and lead, but when Madhuri Dixit claims that it is nutritious people tend to believe her.
The Union government has made it clear that under the FSSA action would be taken against the brand ambassadors. It was long overdue and would hopefully chasten rapacious icons, who can endorse anything for money. Their defence is that they endorse a product only after the concerned government agency certifies about its quality. This is a bland justification as endorsement is a step ahead of promotion in which the endorser lends credibility. Under Sec. 53 of FSSA, brand ambassador is liable for action if the advertisement is found to be misleading and can be fined up to Rs 10 lakh. Though this amount is a pittance compared to what s/he gets, imposing the fine will act as a deterrent.
It has been proved time and again that the celebrities endorsing any product hardly know anything about it but do it for hefty fees. In 2011, CBS News reported that in the United States, there were 10 celebrities on big pharma’s payroll. These include actress Claire Danes, hired by Allergan (AGN), who touts the eyelash lengthening drug Latisse, Sideways star Virginia Madsen who promoted Botox and Michael Welch, better known as Michael Newton of the Twilight series, who promoted Allergan’s anti-acne medication among others. The first major disadvantage of such endorsements is that prices go many notches up as endorsers are paid huge amounts. Brand ambassadors are hired only for branded medicines, not for the generic ones. Obviously, the pharmaceutical companies will earn profit at the cost of consumers.
Advertising Standard Council of India is a self-regulating body that has representatives from advertisers, advertising agencies and the media. It is a voluntary organisation that has to ensure that advertisements are not misleading. Besides, there are some laws to regulate the content of advertisements like Cable Television Networks (Regulation) Act, 1995, Press Council of India Act, 1978 and Cable Television Networks (Amendment) Rules, 2006. States are empowered under the FSSA to take action, and there is provision of imprisonment and fine up to Rs 1 lakh. But these laws have not been invoked properly. False claims are made to whiten skin despite Drugs and Cosmetics Act. There are some shortcomings in the law also. The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, provides for a fine of only Rs 500 in case of false claims. So, charlatans give a damn to it and make claims to cure virtually incurable diseases in days. Even if they are punished, it does not matter as they earn in millions.
Advertisement is not a new genre. It promotes the sale by making hyperbolic claims about the product. Street criers or peddlers, who went about selling their wares, advertised their products through word-of-mouth. Besides, political and religious leaders also advertised their views through different platforms — pulpit, street meetings, village gatherings, etc. Criers at the sale of slaves in ancient Greece, Babylon, Egypt, Rome and Carthage also made big claims.
David Ogilvy, in his Confessions of an Advertising Man, (1971) wrote, “It is flagrantly dishonest for an advertising agent to urge consumers to buy a product which he would not allow his wife to buy.” This is what advertisers are doing and brand ambassadors happily acquiesce in. Brand ambassadors’ seriousness is evident from one incident. Aamir Khan was appointed brand ambassador by the Election Commission for the Maharashtra election. He urged people to vote, but was in London on the day of polling.
The Unesco-appointed MacBride Commission submitted its report in the early 1980s, but its observations are still relevant: “Advertising undoubtedly has positive features. It is used to promote desirable social aims, like savings and investment, family planning, purchase of fertiliser to improve agricultural output, etc… Nevertheless, what distinguishes advertising from the editorial content of newspapers and from radio and television programmes is that its avowed purpose is that of persuasion; a balanced debate in advertising is a contradiction in terms. Because advertising is overwhelmingly directed towards the selling of goods and services…”
Advertisements need to be regulated and strong legal action must be taken against misleading advertisements. Celebrities also must be taken to task if they endorse the product. Icons are supposed to lead and inspire, not to mislead. They should learn from Michelle Obama who started a campaign “Let’s Move” to fight obesity and oppose the advertisements of junk food. She said in a statement, “Our classrooms should be healthy places where kids are not bombarded with ads for junk food.” Similarly, Hillary Clinton successfully ran a campaign against trans fat in New York.

922 tonnes of Maggi received

Container trucks loaded with Maggi noodles outside the ACC Cement Factory at Wadi in Kalaburagi district on Wednesday.

Of this, 600 tonnes incinerated to produce fuel
Around 600 tonnes of Maggi noodles seized from Karnataka and neighbouring States were incinerated in the ACC Cement Factory at Wadi in Chittapur taluk of Kalaburagi district in the last four days.
District Food Safety officer R.S. Biradar told The Hindu on Wednesday that the ACC Cement plant has received 922 tonnes of Maggi noodles seized from 14 States across the country in the last nine days, of which 600 tonnes of Maggi noodles has been incinerated to produce an alternate fuel. The crushing and incinerating process started from June 13, he added.
The number of trucks lined up outside the factory containing Maggi noodles was increasing every day, but the factory was unloading around 15 to 20 trucks of products every day for crushing, Mr. Biradar said. The crushed products were mixed with charcoal in the kilns and incinerated. The method of incinerating was eco-friendly, Mr. Biradar said.
Drivers of private transport companies, who were waiting to unload the products outside the factory, had to wait for a long time. Rakesh Singh and Mustakeem, truck drivers of private transport company from Uttar Pradesh, said that more than 200 drivers were waiting for their turn to unload for the last week.
“We are running out of money and it is difficult to get food in this isolated area,” said Mangiram, a truck driver from Rajasthan.

From 100 a year to 150 a month, Uttarakhand food labs unable to deal with deluge of samples to test

DEAHRDUN: At the Rudrapur-based State Food and Drugs Testing Lab, barely 100 food samples would come for testing in an entire year before the Maggi controversy broke out. In just the last month though, they have received a staggering 150 samples for testing. Around 54 samples of Maggi alone have landed at the lab in the past two months. "Testing of a single packet of Maggi takes around 10 days and with so many other products coming in for tests, it becomes very difficult for us," said Sachin Sharma, the only regular food analyst in the Rudrapur factory.
As per data provided by the food safety department, 40 samples of packed food products like noodles and pasta have been sent for testing since June 4. "The drives undertaken by food officers have simply doubled in the past month," said Rajendra Rawat, official of the food safety and standards department, Uttarakhand.
The lab staff obviously are a harried lot, and this reflects in their work. Some of them told TOI that matters are compounded further because many positions have not been filled. "There are just six analysts at our factory. 17 posts of analysts and supporting staff have been lying vacant for the past four years. As a result, it is very difficult to give out timely reports of food products," said an official working at the lab, requesting anonymity.
Officials of the food security department meanwhile claim that hiring of analysts is not in their hands. "Only the director general, health and family welfare, can do the hiring. On our part, we have forwarded the request for new staff," said a senior official.
Uttarakhand had around 6500 registered food business operators and an equivalent number which are not registered. There has been a long-standing demand for another food test lab in the Garhwal region for which an approval has reportedly been secured.

Rail passengers complain about food quality

VIJAYAWADA: Some passengers of the Trivandrum-New Delhi Kerala Express staged a protest at the railway station here on Tuesday, complaining about the quality of food being served in the train.
According to sources, a section of the passengers detrained from the Kerala Express soon after it arrived at 5 pm. "Roughly 25 to 30 people started protesting outside the station master's office. They were unhappy with the quality of food served and said that the quantity was too less but the price was way too high," a railway official told ToI.
The passengers also demanded a change in the pantry car in order to provide them with better food. "We couldn't make any changes because the train belongs to Southern Railways. However, we provided them with clean food from the Vijayawada station and the matter was settled," the official added.
Further arrangements were made and catering staff were asked to load fresh food onto the train when it reaches Gudur railway station. The protest caused half an hour delay here. The train eventually left at 5.30 pm.

FSSAI (Food Safety and Standards Authority of India)

Our milk safe, faulty samples taken before processing: Mother Dairy

The state-run processed foods giant Mother Dairy on Wednesday said its milk is safe for consumption and the two samples that were found to be sub-standard were drawn before these could be taken to its factories for quality tests and processing.
"It is unfortunate that loose milk samples, collected at village level and yet to be accepted for processing at our factory, allegedly did not pass the tests of the Uttar Pradesh Food and Drugs Administration," said S. Nagarajan, Mother Dairy managing director.
"The milk sample reported has been drawn even before reaching the chilling centre where the first level of testing happens to ascertain the quality of milk for further processing," Nagarajan told a press conference here.
He also said it was unfair to link the samples tested by the food safety authority, that were not processed, to the company. "This erodes the confidence of the consumer."
The press meet was called to explain the company's stand after two samples of Mother Dairy milk were taken and one of them tested positive for detergents. Ram Naresh Yadav, chief of the food safety body in Agra, said they were drawn from collection centres near Agra in November 2014.
"The samples were sent to the Lucknow lab which declared both of them substandard. The company challenged the results and demanded the samples be sent to the Kolkata lab which too found them defective. The Kolkata lab found one sample contained detergent," Yadav told IANS on Tuseday.
Nagarajan said the future course of action was being decided.
"We haven't received the tests from Kolkata lab yet, and we shall work with the food regulatory authority regarding the issue," he said.
Nagarajan also sought to explain the process and said milk is first pooled from farmers and then sent to chilling centres through tankers. Every can is then distilled and processed with four levels of thorough testing -- at input, processing, dispatch and even after they reach the market.
"As a responsible organisation we follow 100 percent testing protocol, not random testing."
Added Ram Mohan, the company's operations head: "For the past 45 years we have been following the same food safety procedures before they reach the market. We check for quality levels even after the products are in the market to ensure that the product available is safe for consumption."
Answering a question if there was any testing done at the collection centres, Nagarajan said the mechanisms are still being developed by its parent organisation, National Dairy Development Board (NDDB), with the company's own team to detect adulteration at that stage itself.
He said the company does not want the consumer confidence to be lost.
The NDDB-owned Mother Dairy supplies more than 35 lakh litres of milk everyday. The milk is processed in Andhra Pradesh, Maharashtra, Uttar Pradesh, Himachal Pradesh and Rajasthan.

No added MSG, but what about its variants?

A week after tests on Maggi samples in the State revealed the presence of glutamic acid, health officials are still clueless on what to infer from test results.
Although the State food safety officials wrote to the Centre seeking its guidance on what has to be done about the presence of glutamic acid, the Centre has so far been silent on the issue.
Both the officials and food safety activists said this is because the Food Safety and Standards Act (FSSA) does not specify anything about the presence of other forms of MSG (Monosodium Glutamate) such as ‘free glutamic acid’ and ‘glutamate’ derived from ‘hydrolysed vegetable protein.’
Although the label on the packets of instant food items say “No added MSG”, many food brands add “taste enhancers” indirectly through hydrolysed vegetable protein and ribonucleotide (extracted from fish and meat), which are other forms of MSG. This enhances the taste four times more than what MSG does, according to experts.
“As MSG is not allowed in noodles and pasta as per the Act, the food companies are cleverly adding hydrolysed vegetable protein which has 30 per cent to 40 per cent glutamic acid. MSG is just the salt of glutamic acid,” said Food Technologist K.C. Raghu.
The government should also include a provision in the Act to control such other avatars of MSG, he said.
Following the Maggi controversy, the Food Safety and Standards Authority of India (FSSAI) directed the State governments to draw other brands of instant noodles, pasta and macroni and test them for harmful additives and preservatives.
But ironically MSG or other forms of MSG such as hydrolysed protein or free glutamic acid do not figure in the list of parameters that the States have been asked to adopt for the tests.
State Food Safety and Standards Authority of India (FSSAI) Deputy Director H.S. Shivakumar, who confirmed that MSG was not one of the parameters for the tests, said the products were being tested only for the “listed parameters.”

Food safety panel chief wants sweeping reforms

Dr Prakash’s call for an overhaul comes after the FSSAI sought the recall of Nestle’s Maggi Noodles in the country following lab tests that showed unsafe levels of lead in some samples.
India’s food safety apparatus needs sweeping reforms to ensure that its norms are on par with international standards, including an accreditation system that not only screens labs but also its personnel on a regular basis, according to the head of a key panel of India’s national food safety authority.
”It is time we wake up and work on a science-based approach and move forward rapidly,” Dr V Prakash, who chairs the scientific panel of the Food Safety and Standards Authority of India (FSSAI) on nutritional foods and dietary supplements, told The Indian Express.
“If we have periodical evaluation in aviation for pilots, why not for analysts who test our food?” asked the former director of the Central Food Technological Research Institute (CFTRI).
“If the Directorate General of Civil Aviation (DGCA) sets guidelines, all airports and flights have to follow them — it should be the same for food analysis laboratories,” he added.
Dr Prakash’s call for an overhaul comes after the FSSAI sought the recall of Nestle’s Maggi Noodles in the country following lab tests that showed unsafe levels of lead in some samples.
On June 10, The Indian Express reported that some products from top brands such as Tata Starbucks, Kellogg’s and Venky’s figured on a list of around 500 rejected items that the FSSAI had handed over to state-level officials. Tata Starbucks on Monday said it was pulling out the ingredients on that list from its outlets.
Dr Prakash has also called for more scientists to be involved in the regulatory system, as is the case in other countries such as the US. ”The system should be run by scientists with bureaucratic support and not the other way round,” he said.
”The top regulatory body FSSAI does not have many scientists on its permanent staff. Where are the scientists in our food regulation system and what is the role of the few that are there? Ideally, scientists should be involved in monitoring at every stage, including sampling protocols, setting standards, and testing and simulation,” the senior scientist said.
Seeking an overhaul of state and central labs, Dr Prakash said reforms should cover testing standards, training of analysts, infrastructure, role of scientists in regulation, and the frequency of monitoring.
“India should not dilute the standards because many of our laboratories may not have advanced facilities for scientific analysis. We should be at par with international standards such as Codex,” said Dr Prakash, who headed the committee that standardised testing standards at the micro-level (parts per billion) for packaged water in 2008.
With no set standards in India for testing many types of food, including instant noodles and processed cheese items, Dr Prakash said:
“Standards for different kind of pathogens, including chemicals, microbial toxins, heavy metals, residues of pesticides and herbicides and fungicides, need to be set, keeping in view the average daily intake of food. These standards have to be modified from time to time with the food chain in view. Non packaged foods and fresh foods… must be put on regular surveillance to bring hygiene in the food chain.” Dr Prakash also called for state and central labs to be upgraded. “Analytical laboratories should not suffer because they are under states, and because the Centre has more money. The state labs are short of analytical personnel and ill-equipped to perform to capacity as compared to private labs which are approved by FSSAI with the condition that they need to be accredited by NABL (the national accreditation authority for labs),” he said. Dr Prakash said there was also a pressing need for the NABL system to have a separate slot for food testing laboratories instead of them being clubbed under chemical laboratories. ”The testing for chemicals and for food is completely different. The matrices are different, the recoveries are different and extraction procedures are different. For instance, if you are testing for arsenic in soil and food, the analytical method could be same but the preparation of the sample for analysis can be completely different for soil and food,” he said.

Gutka making unit unearthed in Rajahmundry

Rajahmundry: A small town in West Godavari called Jangareddygudem is becoming a hub for manufacture and export of banned gutka products.
The police found a rented house being used for manufacture of gutka under the guise of making leaf plates ‘Vistrakulu’ and seized gutka, raw materials like tobacco, beetle nut, paan masala and other ingredients and machinery being used for making, mixing and packing gutka.
The seized material and machinery is worth about Rs 10 lakhs, informed police officials. Based on the preliminary inquiry, police found that one Yashoda Prasad took his younger brother Srinivas’ house on rental basis and started the illegal business. In order to cover up his illegal activity, he set up a cottage industry to make leaf plates and familiarised himself locally in making only leaf plates.
Subsequently, he purchased machinery for making gutka from Vijayawada and started procuring the raw material. He also obtained the plastic sachet rolls of popular gutka brands and started filling up the locally made gutka into such sachets and selling them as branded gutka products to the wholesalers. Yashoda Prasad was assisted by Karpuram Vasu.
The police took both the culprits into custody for questioning. The gutka sachets were also exported from Vijayawada and the police are investigating the destination of export.
The police are on the lookout for any branches being run or any other persons involving in similar activity in the town.
Jangareddygudem DSP J. Venkata Rao said, “We are trying to find out the involvement of one of the accused Yashoda Prasad’s younger brother Srinivas as he rented out the house, for the illegal activity.
"People in the locality were shocked on finding out that a house located near the RTC bus stand turned out to be a hub for manufacture and export of banned gutka. Assistant food controller R. Nageswaraiah said, “We have booked a case under Food Safety and Standards Act, 2006 and Regulations, 2011. We will seize the stocks of gutka and raw material and produce it before adjudicating authority.”

Think twice before having panipuri this season

There's no love lost between summer and stomach troubles. So, it's best to avoid street food vendors and visit a reputed and hygienic restaurant that serves street savouries. But if you are on the road and can't resist digging into your favourite chaat, then check if your vendor is preparing those foods in a hygienic way.
  • The cart should be located in a clean and dry place; there should be no open drains or toilets near the food stall. The raw materials should be protected from dust, wind, rain, strong heat and flies.
  • Ensure the vendor keeps his garbage cans at a safe distance to avoid attracting insects and animals, such as dogs, cats and rodents.
  • Takeaway food should not be kept in contact with or packed in newspaper.
  • Sauces and chutneys should ideally be stored in foodgrade plastic/glass/steel containers with proper lids.
  • Check for tell-tale signs like dirt on the salt and pepper shaker, sticky ketchup bottles and smelly cleaning cloth.

Food dept. lifts food samples for tests

Delhi’s Food Safety Department has started lifting samples of health food, baby food and energy drinks of various brands for test-analysis as directed by the Central government.
The move comes a few days after the Delhi government banned the sale of instant Maggi noodles.
According to officials, the food samples will undergo laboratory and results will come in a week’s time. They, however, claim that it’s a routine practice.
The department will now focus on all packaged food items, including the imported ones. Several food items are launched in the market without proper food approval.

Food Safety Wing to Register Case Against KFC Outlet

COIMBATORE: The Coimbatore Unit of the Food Safety Wing will register a case against a KFC outlet, located in DB Road, RS Puram, where a bucket of chicken, bought by a customer, was found to contain dead worms, almost exactly a year ago.
In June 2014, Yasser Arafat, a businessman, had bought a bucket of the crispy chicken, and picked up some soft drinks from the outlet. He and his friends then headed home, where they began eating.
They soon noticed that the chicken contained worms. Handing over the food to the Food Safety Wing, they called the outlet and informed them of the foreign substances in the food, but the store reportedly refused to address the issue with the seriousness the case deserved.
On Tuesday, R Kathiravan, the Designated Officer of the Food Safety Wing, Coimbatore, told Express that they would file a case under Section 59(i) -- Punishment for unsafe food -- where such failure or contravention does not result in injury, with imprisonment for a term which may extend to six months and also with fine (which may extend to `1 lakh) of the Food Safety and Standards Act of 2006.
Sources said that the samples had tested positive for dead worms. Positive sample results were received around six months ago. They said that the case would be filed within the next two weeks.
When Express contacted the Kentucky Fried Chicken's head office, the company asked us to send our queries by email to a designated contact person. However, the company failed to respond to the queries.

Yet another food product in trouble

Yet another food product is in trouble as a consumer, accompanied by around 50 friends and relatives, approached Tamil Nadu Food Safety and Drug Administration Department (Food Safety Wing) office here and claimed that they found live weevils, a type of beetle, inside a baby food packet.
In his complaint, he claimed that he had purchased a packet of product from a retail outlet in Selvapuram four days ago. When he opened it on Tuesday, he found live weevils in it. Following the complaint, Food Safety Wing Designated Officer R. Kathiravan led a team and found out the batch from which this packet was sold. He traced it to the wholesale dealer and took three samples.
These would be tested at the Government Food Safety Laboratory here. Coimbatore has one of the six laboratories approved under the Food Safety and Standards Act, 2006.

Voice from Within: Did not test food items, could not use equipment, says former central lab head Satya Prakash

Dr Satya Prakash’s letters speak volumes of the disconnect between regulations and reality in food safety.

India is yet to lay down “science-based standards” to test instant noodles, and its state and central labs are ill-equipped to test a variety of common food items, including fruits and vegetables, milk, and carbonated beverages. This is the conclusion of Dr Satya Prakash, former director of the Central Food Laboratory in Kolkata, who has conveyed his concerns in a series of letters to top government officials, including one on June 12 — a week after the recall of MaggiNoodles over safety concerns — to Health Minister J P Nadda and the Prime Minister’s Office.
“The business of instant noodles is around Rs 1,700 crore and (these) are consumed basically by the children. Hence there is an urgent need to prescribe standards for noodles,” Dr Satya Prakash wrote on June 12.
Dr Satya Prakash has also pointed out that the test parameters for instant noodles sent by the Food Safety and Standards Authority of India (FSSAI) to state labs last week does not cover MSG, the flavour enhancer, microbiological examinations and pesticide residue tests.
Dr Prakash, who has also held additional charge of the Central Food Laboratory in Ghaziabad, retired in 2009. In a letter to government officials in 2011, he wrote that no standards for processed cheese products had been laid out.
When contacted, Dr Prakash responded in an email: “I stand by what I had written to authorities for improving the working of existing food laboratories… so that the country may get state-of-the-art laboratories duly accredited by NABL (National Accreditation Board for Testing and Calibration Laboratories).”
His letters speak volumes of the disconnect between regulations and reality in food safety. In a 2012 letter to then health minister Ghulam Nabi Azad, he points out that the six referral laboratories under the ministry, which are the “backbone of the food safety and standards programme”, are not equipped to test different food categories.
This is what he wrote in 2012:
Fruits and vegetables: No central or state food lab is NABL-accredited “for analysing/monitoring pesticide residues in fruits and vegetable products… as per the validated method prescribed by the Ministry of Health and Family Welfare.” He includes a list of 36 state food labs that confirmed in RTI replies that they were not testing for pesticides in fruits and vegetables.
Carbonated beverages: They were not being analysed by any central or state labs, due to a lack of “imported sophisticated instruments as required” after guidelines on tests were issued in 2008 which mandated testing at a minute level of 0.001 parts per million. The CFL in Mysore is the only centre in the country that can conduct these tests.
Milk and milk products: No labs tests are conducted for “pesticide residues, heavy metals, microbial contamination, mycotoxins, veterinary drugs and melamine… essential parameters to declare the milk safe”.
Letters in 2012 and 2013 highlighted the “working conditions” in the five central food laboratories under the health ministry. He wrote that the Ghaziabad lab was without a microbiologist since 1987, a regular director since 2007, and with no chief technical officer since 1989.
The extension lab of Kolkata in Raxaul in Bihar “is being looked after by the staff of laboratory assistant level since April 2009. Laboratory assistants are not authorised/competent to analyse the samples as per rules and their duty is to assist the analyst/chemist in analysis.” CFL Mumbai, for which Dr Prakash writes infrastructure was procured in 2008 at around Rs 17 crore, “is not functional till date.” For Sonouli extension centre of CFL Ghaziabad, the staff appointed “is posted in FSSAI”.
Dr Prakash, who also headed the Delhi state food lab for a few years, wrote in 2013 to the then health secretary that no state lab was NABL-accredited for testing pesticides.”Pure gases required for pesticide residues analysis are not available even in Kolkata; it has to be procured from Mumbai only. Thus, any one imagines the condition of State Laboratories situated in small cities/towns.” About Raxaul and Sonauli, Dr Prakash wrote, “No chemical or glass dealers are available. All the supplies are to be procured from outside to run the laboratory.” He also highlighted poor power supply in the interiors: “If electricity is available, the voltage will be so low that you cannot run the sophisticated equipment.” Service centres of suppliers of foreign sophisticated equipment are situated only in the metros, he added.
The World Bank, which sanctioned a project on Food and Drug Capacity Building from 2003-08 and granted loans of around Rs 350 crore for upgrading Indian labs, noted in its project report, “The majority of state laboratories are able to perform only basic analysis and cannot perform comprehensive testing, including analysing samples for microbiological contaminants.” In letters to health ministers in the last four years, Dr Prakash wrote that in most state and central laboratories, “highly sophisticated equipment” supplied under the World Bank project were “not opened or utilised at all… The equipments which are opened are not functional due to various difficulties…”
According to another former director of a CFL, “While the project mandated that we hire technical staff before purchasing equipment, a lot of equipment was brought in but there was no one who could use them. In our laboratory , we could not even open most of the equipment received. After five years, warranties expired.
