ஈரோடு மாவட்டத்தில் தடை செய்யப்பட்ட குட்கா, பான்மசாலா விற்ற 75 பேர் மீது வழக்கு வாலிபர் கைது

தடை செய்யப்பட்ட குட்கா, பான்மசாலாவை விற்பனை செய்ததாக ஈரோடு மாவட்டத்தில் 75 பேர் மீது வழக்குப்பதிவு செய்யப்பட்டு உள்ளது. மேலும் இது தொடர்பாக வாலிபர் ஒருவர் கைது செய்யப்பட்டுள்ளார்.
பான்மசாலா, குட்காவுக்கு தடை
குட்கா, பான்மசாலா போன்ற புகையிலை பொருட்களுக்கு தடை விதித்து தமிழக அரசு உத்தரவிட்டு உள்ளது. அதைத்தொடர்ந்து கடைகளில் குட்கா, பான்மசாலாவை விற்பனை செய்யக்கூடாது என்று கடையின் உரிமையாளர்களுக்கு அறிவுறுத்தப்பட்டு உள்ளது. மேலும் தடையை மீறி புகையிலை பொருட்களை விற்பனை செய்யும் கடைகளின் உரிமையாளர்கள் மீது கடுமையான நடவடிக்கை எடுக்கப்படும் என்று அதிகாரிகள் எச்சரிக்கை விடுத்து உள்ளனர்.
இந்த நிலையில் ஈரோடு மாவட்டத்தில் உள்ள கடைகளில் குட்கா, பான்மசாலா விற்பனை செய்யப்படும் கடை உரிமையாளர்களின் மீது கடுமையான நடவடிக்கை எடுக்க வேண்டும் என்று மாவட்ட போலீஸ் சூப்பிரண்டு பொன்னி உத்தரவிட்டுள்ளார். அதன்படி ஈரோடு மாவட்டம் முழுவதும் போலீசார் தீவிர நடவடிக்கை எடுத்து வருகிறார்கள். பல்வேறு பகுதிகளில் தீவிர சோதனை நடத்தி வருகிறார்கள்.
வாலிபர் கைது
ஈரோடு டவுன் போலீஸ் இன்ஸ்பெக்டர் ரமேஷ் தலைமையில் போலீஸ் சப்இன்ஸ்பெக்டர் செல்லமுத்து மற்றும் போலீசார் நேற்று தீவிர சோதனையில் ஈடுபட்டனர். அப்போது ஈரோடு கொங்காளம்மன்கோவில் வீதியில் உள்ள ஒரு கடையில் குட்கா, பான்மசாலா போன்ற புகையிலை பொருட்களை விற்பனை செய்வதற்காக வைத்திருந்தது கண்டுபிடிக்கப்பட்டது.
அதைத்தொடர்ந்து போலீசார் கடையின் உரிமையாளரான ராஜஸ்தான் மாநிலத்தை சேர்ந்த பகவான்ஜி என்பவரின் மகன் நரியங்காராம் (வயது 26) என்பவரை கைது செய்தனர். மேலும் கடையில் இருந்த சுமார் ரூ.3 ஆயிரம் மதிப்பிலான புகையிலை பொருட்களை பறிமுதல் செய்தனர்.
75 பேர் மீது வழக்குப்பதிவு
இதேபோல் ஈரோடு மாவட்டத்தில் கடந்த 2 நாட்களில் போலீசார் நடத்திய சோதனையில் ஈரோட்டில் 7 பேர், பவானியில் 10 பேர், கோபிசெட்டிபாளையத்தில் 26 பேர், சத்தியமங்கலத்தில் 18 பேர், பெருந்துறையில் 14 பேர் என 75 பேர் மீது வழக்குப்பதிவு செய்து போலீசார் நடவடிக்கை எடுத்து உள்ளனர்.

உணவு பாதுகாப்பு மற்றும் தரச்சட்டத்தால் கிராம பொருளாதாரத்துக்கு ஆபத்து - சந்தைகள் காணாமல் போகும்


கிராமங்கள் தான் இந்தியாவின் முதுகெலும்பு என்றார் காந்தி. நம் நாட்டின் அடிப்படை பொருளாதார வளர்ச்சி கிராமங்களில் இருந்து தான் துவங்குகிறது. இப்படிப்பட்ட நிலையில் மத்திய அரசு நடைமுறைப்படுத்தியுள்ள உணவு பாதுகாப்பு மற்றும் தரச்சட்டம் கிராம பொருளாதாரத்தையே சீர் குலைக்கும் வகையில் உள்ளதாக குற்றம் சாட்டுகின்றனர் வணிகர்கள். இந்த சட்டம் தீவிரமாக நடைமுறைப் படுத்தப்படும்போது பாரம்பரியம் மிக்க கிராம சந்தைகள் காணாமல் போய்விடும் என்றும் கவலை தெரிவிக்கின்றனர்.
உணவு கலப்பட தடுப்புச் சட்டத்திற்கு மாற்றாக புதிய உணவு பாதுகாப்பு மற்றும் தர நிர்ணய சட்டம் கடந்த 2006ம் ஆண்டில் நடைமுறைப்படுத்தப்பட்டது. இதற்கான விதிகள் 2011ம் ஆண்டில் உருவாக்கப்பட்டு அனைத்து மாநில அரசுகளும் இதை அமல்படுத்த வேண்டும் என மத்திய அரசு கூறியது. மத்தியப்பிரதேச மாநிலம் இதை உடனடியாக முழுமையாக நிறைவேற்ற முடியாது, இந்த சட்டத்தில் நிறைய மாற்றங்கள் செய்ய வேண்டும். அதனால் படிப்படியாக நிறைவேற்றப்படும் என அறிவித்தது.
இச்சட்டத்தை நடைமுறைப்படுத்துவதற்காக தமிழகத்தில் ஒவ்வொரு மாவட்டத்திலும் உணவு பாதுகாப்பு அலுவலர்கள் நியமிக்கப்பட்டுள்ளனர். உணவு பொருட்களில் சட்டத்தை மீறி கலப்படம், தயாரிப்பு குறைபாடுகள், பொருட்களின் தரம் மற்றும் காலாவதியாகும் நாள் போன்றவற்றை ஆய்வு செய்து நடவடிக்கை எடுக்க இவர்களுக்கு அதிகாரம் வழங்கப்பட்டுள்ளது. விதிமுறை மீறியிருந்தால் சிறை தண்டனை மற்றும் 10 லட்சம் வரை அபராதம் விதிக்க சட்டத்தில் இடம் உள்ளது.
இந்த சட்டத்தில் ஏராளமான நடைமுறை சிக்கல்கள் இருப்பதால், அதில் கூறப்பட்டுள்ள நிபந்தனைகளுக்கு எதிர்ப்பு கிளம்பியுள்ளது. நாடு முழுவதும் உள்ள உணவு பொருள் தயாரிப்பாளர்கள், உணவு பொருள் விற்பனையாளர்கள், சிறு சில்லறை வணிகர்கள் கடுமையாக ஆட்சேபித்து வருகின்றனர். இதில் விவசாயிகளுக்கும் தீங்கு விளைவிக்கும் நிபந்தனைகள் இருப்பதால் பெரிய அளவில் அவர்களும் நஷ்டப்பட வாய்ப்புள்ளதாக கூறுகின்றனர்.
விதிக்கப்பட்ட நிபந்தனையின்படி, விவசாயிகள் தாங்கள் விளைவித்த பொருட்களை விற்பனைக்கு எடுத்து வரும் போது சட்டத்தில் குறிப்பிடப்பட்டிருக்கும் தரத்தின்படி அப்பொருட்கள் இல்லை எனில் எந்த ஒரு வணிகரும் அதை கொள்முதல் செய்ய முன்வரமாட்டார்கள். இதனால் விவசாயிகள் தங்கள் பொருட்களை வேறு வழியின்றி அழிக்க வேண்டிய நிலை ஏற்படும். அதன்பின் அந்த விவசாயியின் நிலை என்னவாகும் என்பதை இச்சட்டம் கண்டு கொள்ளவில்லை என்கின்றனர் விவசாயிகள்.
அதே போல் தயாரிப்பாளர்களுக்கும் அவரின் ஆலைகளுக்கும் விதிக்கப்பட்டுள்ள நிபந்தனைகளும் ஏற்க முடியாத வகையில் உள்ளதாக கூறுகின்றனர். சட்டத்தில் சொல்லப்படுகின்ற நிபந்தனைகளை நிறைவேற்ற வேண்டுமானால் தயாரிப்பாளர்களுக்கும், விநியோகஸ்தர்களுக்கும், வணிகர்களுக்கும் கூடுதல் முதலீடு தேவைப்படும். ஆனால் இன்றைய நிலையில் இப்படி கூடுதல் முதலீடு செய்வதற்கு வணிகர்கள் யாரும் தயாராக இல்லை.
மேலும் உணவு பொருட்கள் தயாரிக்கும் தொழிலகங்களிலும், உணவு பொருள் வணிக நிறுவனங்களிலும் வேலை செய்யும் பணியாளர்களுக்கு விதிக்கப்பட்டுள்ள நிபந்தனைகள் மிக மிக கடுமையானவை. குறிப்பாக 3 மாதத்திற்கு ஒரு முறை அந்த பணியாளர்கள் தங்கள் உடல்நிலை குறித்த மருத்துவ சான்றிதழை வழங்க வேண்டும் என சட்டம் சொல்கிறது. இது கிராமப்புறங்களில் இருந்து நகர்ப்புற தொழிலகங்களுக்கும், வணிக நிறுவனங்களுக்கும் வேலைக்கு வரும் நபர்களை பெருமளவு பாதிக்கும். இதனால் அவர்களுக்கு பொருளாதார சிதைவு ஏற்படும்.

நடைமுறைக்கு கடினமாக இச்சட்டங்களையும், விதிகளையும் அமல்படுத்துவதற்கு முன்பாக, நம் நாட்டு பொருளாதாரத்தின் அடிப்படை அம்சமான கிராமப்புற உற்பத்தி மற்றும் வணிக நடைமுறைகள் பற்றி ஆராயாமல் எடுக்கப்பட்ட அவசர முடிவாகவே இச்சட்டம் குறித்து எண்ணத் தோன்றுகிறது.
மறைமுகமாக சில்லரை வணிகத்தில் அன்னிய நேரடி முதலீட்டிற்கு ஆதரவாக எடுக்கப்பட்ட நிலையாகத்தான் இச்சட்டத்தின் நிபந்தனைகள் குறித்து எண்ண வேண்டியுள்ளது. அன்னிய நாட்டு மிகப்பெரும் பணக்கார குழுமங்களுக்கு சாமரம் வீசும் சட்டமாகவே இச்சட்டம் சிறு வணிகர்களால் நோக்கப்படுகிறது.
பேரம் பேசி தேவையான பொருட்களை வாங்க நினைக்கும் மக்கள் நிறைந்த கிராமங்களை அதிகளவில் கொண்டது நம் நாடு. இவர்கள் கிராமங்களில் வாரம் தோறும் கூடும் சந்தையை நம்பித்தான் உள்ளனர். அவர்களிடம் பொட்டலப் பொருட்களை மட்டுமே வாங்க வேண்டும். உயர்தர பாதுகாப்பு கொண்ட உணவு பொருட்களை மட்டுமே உணவுக்காக பயன்படுத்த வேண்டும் என்று எப்படி வற்புறுத்த முடியும்?
கிராமத்தில் ஒரு திறந்த வெளியில் மண் திட்டில் தற்காலிக கூடாரம் அமைத்து அதில் ஒரு நாள் வியாபாரம் செய்யும் இவர்கள் முறைப்படி கட்டப்பட்ட கட்டிடத்தில் தான் வியாபாரம் செய்ய வேண்டும். விற்பனை பொருட்கள் திறந்த நிலையில் இருக்க கூடாது. பொட்டலத்தில் அடைக்கப்பட்டு தான் விற்க வேண்டும். அதில் லேபிள், முகவரி, எம்ஆர்பி ரேட், காலாவதி தேதி அனைத்தும் இருக்க வேண்டும் என்று கூறினால் பேரம் பேசி வாங்கும் வாரச்சந்தையில் இதற்கு சாத்தியமில்லை.
கண்டிப்புடன் இச்சட்டத்தை நடைமுறைப்படுத்தினால் கிராமச் சந்தைகள் இல்லாமல் போகும். கிராமப்புற பொருளாதாரம் வீழ்ச்சி அடைந்து விடும். கிராமப்புற பொருளாதாரம் சிதைவடையத் தொடங்கினால் அது மாநில பொருளாதாரத்தை சீர் குலைக்கும். இதன் காரணமாக நாட்டின் ஒட்டு மொத்த பொருளாதாரத்தையும் அது பாதிக்கும். கிராமப்புற சந்தை வணிகம் பாதிக்கப்பட்டால் நாட்டின் ஒட்டு மொத்த உணவு தானிய வணிகம் பெரும் வீழ்ச்சியை சந்திக்கும் என்பதை மத்திய அரசு பரிசீலனைக்கு ஏற்றுள்ளதாக தெரியவில்லை. அதுமட்டுமன்றி, கிராம பொருளாதாரம் சீர் குலைந்தால் விவசாயம் வெகுவாக பாதிக்கப்படும். விவசாயிகளின் வாழ்வாதாரம் பாதிக்கப்படும்.
கிராமத்தில் இருந்து நகர்புறத்திற்கு வரும் பொருட்கள் குறையும். இதனால் விலைவாசி உயரும். விவசாயத்தில் சரியான வளர்ச்சி இல்லையென்றால் கிராம மக்கள் தங்கள் தேவைக்காக நகர்புறத்தை நாட வேண்டியிருக்கும். இதனால் நுகர்பொருட்களுக்கு தேவை அதிகமாக ஏற்பட்டு விலை உயரும். விவசாயிகளின் பொருளாதாரம் பெரிதும் பாதிக்கப்படுவதால் அது மாநிலத்தையும் பாதிக்கும்.
மக்கள் அனைவருக்கும் தரமான உணவு பொருட்கள் கிடைக்க வேண்டும் என்பதில் எவ்வித மாற்றுக்கருத்தும் இல்லை. ஆனால் அதை மாற்று வழியில் எப்படி நிறைவேற்ற வேண்டுமோ அப்படி நிறைவேற்ற முன்வராமல் சட்டம் என்ற சாட்டையை சுழற்றினால் பாதிக்கப்படுவது அனைத்து தரப்பு மக்களும் தான் என்கிறார் ஜெயசீலன்.

கிராமப்புறங்களில் வாரம் ஒரு முறை அல்லது 15 நாட்களுக்கு ஒரு முறை கூடும் சந்தைகள் தான் அப்பகுதி மக்களின் அன்றாட உணவு தேவைகளை நிறைவேற்றும் களமாக இருக்கிறது. இந்த சந்தை வணிகம் காலம் காலமாக நடைபெற்று வருகிறது. பெரும்பாலும் பேரத்தின் அடிப்படையிலேயே கிராம மக்கள் இந்த சந்தையில் தங்களுக்கு தேவையானதை கொள்முதல் செய்வார்கள். இப்படிப்பட்ட நிலையில், இந்த உணவு பாதுகாப்பு மற்றும் தரச்சட்டப்படி கிராமப்புற சந்தைகள் இயங்க வேண்டும் என்ற நிலை ஏற்பட்டால் பெரும்பாலான சந்தைகள் மூடப்படும் நிலையே ஏற்படும். இதன் விளைவாக கிராமப்புற பொருளாதாரம் தாழ்வு நிலைக்கு சென்று விடும் என்கின்றனர் வணிகர்கள்.

சரம், சரமாக தொங்கும் குட்கா, பான் மசாலா: காற்றில் பறந்தது தடை உத்தரவு


கோவை :தமிழகத்தில் குட்கா, பான்மசாலா, புகையிலை கலந்த உணவு பொருட்களுக்கு அரசு தடை விதித்துள்ளது. ஆனால், கடைகளில் அவற்றின் விற்பனை தாராளமாக உள்ளது. அரசாணையை அமல்படுத்த கமிட்டி அமைக்கும் அதிகாரிகள், காலத்தை விரயமாக்காமல் களத்தில் குதிக்க வேண்டும்.
உலக சுகாதார நிறுவன ஆய்வில், "நடுத்தர வயது இளைஞர்கள், பெண்கள், குட்கா, பான்மசாலா, புகையிலை கலந்த உணவுப்பொருட்களை உட்கொள்வதால் பல்வேறு வகையான நோய்களுக்கு உள்ளாகின்றனர். புற்றுநோய் தாக்குதலில் 80 சதவீதம் லாகிரி வஸ்துகளால் ஏற்படுகிறது' என தெரிவிக்கப்பட்டுள் ளது. இந்நிலையில், பான்மசாலா, குட்கா, புகையிலை பொருட்கள் விற்பனைக்கு தமிழக அரசு தடை விதித்துள்ளது மக்களிடையே வரவேற்பை பெற்றுள்ளது.
கடந்த மாதம் 23ம் தேதி, தமிழக அரசு சுகாதாரம் மற்றும் குடும்ப நலத்துறை சார்பில் வெளியிட்ட (எண் 132) அரசாணையில், ""உணவுப்பாதுகாப்பு மற்றும் ஒழுங்குமுறை சட்டத்தின்படி, குட்கா, பான்மசாலா பொருட்கள், புகையிலை, நிகோடின் கலந்த உணவு பொருட்களை தமிழகத்தில் இருப்பு வைக்கவோ, விற்பனை செய்யவோ, ஓராண்டுக்கு தடை விதிக்கப்படுகிறது'' என, குறிப்பிட்டுள்ளது.
குட்கா, பான்மசாலா, புகையிலை பொருட்களை இருப்பு வைத்திருந்தால், முழுமையாக அப்புறப்படுத்த ஒரு மாத காலம் அவகாசம் வழங்கப்பட்டுள்ளது. அதனால் வரும் ஜூன் 22ம் தேதிக்குள் குட்கா, பான்மசாலா அப்புறப்படுத்த வேண்டும். அரசாணையை அமல்படுத்த, மாவட்ட கலெக்டர் தலைவராக கொண்ட கமிட்டி அமைக்கப்படுகிறது. உணவுப்பாதுகாப்பு பிரிவு மாவட்ட நியமன அலுவலர் ஒருங்கிணைப்பாளராகவும், எஸ்.பி., மாவட்ட வருவாய் அலுவலர், துணை இயக்குனர் (சுகாதாரம்) உள்ளிட்ட பல்வேறு துறை அதிகாரிகளை கமிட்டி உறுப்பினர்களாக நியமிக்கவும், பணிகள் தீவிரமாக நடக்கிறது. லாகிரி வஸ்துகளை தடை செய்யும் சட்டத்தை அமல்படுத்த அதிகாரிகள் திட்டமிட்டாலும், சிறிய பெட்டிக்கடை முதல், பெரிய மளிகை கடை வரையிலும் லாகிரி வஸ்து பொருட்கள் விற்பனை அமோகமாக நடக்கிறது.கோவையிலுள்ள பெட்டிக்கடைகளில் குட்கா, பான்மசாலா, புகையிலை பொருட்கள் சரம் சரமாக தொங்க விடப்பட்டுள்ளன. போலீஸ் கெடுபிடியுள்ள பகுதிகளில் மறைமுக விற்பனை நடக்கிறது. அரசின் தடையுத்தரவால், ஒரு பாக்கெட்டின் விலை 20 ரூபாயில் துவங்குகிறது. 
மக்களிடையே புழக்கத்தில் புரையோடி கிடக்கும், குட்கா, பான்மசாலா, புகையிலை பொருட்களை கட்டுப்படுத்த, அரசாணை வெளியிட்டால் மட்டும் போதாது; நுகர்வோரிடையே விழிப்புணர்வு ஏற்படுத்தி, விற்பனைக்கு முற்றுப்புள்ளி வைக்க வேண்டும். அரசாணையை அமல்படுத்த கமிட்டி அமைக்கும் அதிகாரிகள், காலத்தை விரயமாக்காமல் களத்தில் குதிக்க வேண்டும்.
கோவை மாவட்ட உணவுப்பாதுகாப்பு பிரிவு நியமன அலுவலர் டாக்டர் கதிரவனிடம் கேட்டபோது, ""கலெக்டர் தலைமையில் எட்டு துறை அதிகாரிகளையும் ஒருங்கிணைத்து ஆலோசனை கூட்டம் நடத்தப்படும். தடை செய்யப்பட்ட குட்கா, பான்மசாலா, புகையிலை பொருட்களை வெளியில் இருந்து கொண்டு வருவதை செக்போஸ்ட்களில் தடை செய்யவும், உள்ளூர் கடைகளில் ஆய்வு செய்யவும், விற்பனை செய்தால் பறிமுதல் செய்து அழிப்பது, விற்பவர் மீது நடவடிக்கை எடுப்பது குறித்து ஆலோசனை கூட்டத்தில் முடிவு எடுக்கப்படும்'' என்றார்.
தடையை மீறினால்?
தமிழகத்தில் குட்கா, பான்மசாலா, புகையிலை பொருட்கள் இருப்பு வைக்கவும், விற்கவும் ஓராண்டுக்கு மட்டும் அரசு தடை உத்தரவு பிறப்பித்துள்ளது. கமிட்டி அமைத்து கண்காணித்தாலும், இவற்றை கட்டுப்படுத்த முடியாத நிலையே உள்ளது. இந்நிலையில், தடையை மீறி இவை விற்கப்பட்டால், நடவடிக்கை என்னவாக இருக்கும் என்பது அனைவரின் கேள்வியாக உள்ளது. தடை செய்யப்பட்ட உணவுப் பொருட்களை விற்றால், அவற்றை பறிமுதல் செய்து அழிக்க வேண்டும் என்பது மட்டுமே உணவு பாதுகாப்புசட்டத்தில் வலியுறுத்தப்பட்டுள்ளது. கமிட்டியில் போலீசாரும் சேர்க்கப்பட்டுள்ளதால், லாகிரி வஸ்துகள் விற்பவர்கள் மீது போலீஸ் நடவடிக்கையும் பாயும் நிலையுள்ளது.

ரயிலில் வந்த புகையிலை பண்டல்கள் பறிமுதல்

மதுரை: சென்னையிலிருந்து மதுரைக்கு, பாண்டியன் ரயிலில் வந்த, 3 லட்சம் ரூபாய் மதிப்புள்ள புகையிலை பண்டல்களை, ரயில்வே போலீசார் பறிமுதல் செய்தனர்.
தமிழகத்தில் பான்பராக், குட்கா மற்றும் புகையிலை பொருட்களை அரசு தடை செய்துள்ளது. அதையும் மீறி விற்பவர்கள் மீது, போலீசார் நடவடிக்கை எடுத்து வருகின்றனர். தென் மாவட்டங்களுக்கு தேவையான புகையிலை பொருட்கள் ரயில்களில் அனுப்பப்படுகின்றன. சில நாட்களுக்கு முன், ரயிலில் வந்த புகையிலை பொருட்கள் பறிமுதல் செய்யப்பட்டன. நேற்றும், சென்னையிலிருந்து மதுரை வந்த பாண்டியன் ரயிலில், 60 பண்டல்கள் இருந்தன. அவற்றில் முகவரி தெளிவாக இல்லை. போலீசார் சோதனையிட்ட போது, புகையிலை பொருட்கள் (ஹான்ஸ்) இருந்தன. அவற்றை கைப்பற்றிய போலீசார், இன்வாய்ஸ் மூலம், எங்கிருந்து யாருக்கு அனுப்பப்பட்டது என, விசாரிக்கின்றனர். Shortage of food inspectors hits gutka ban implementation


 

The implementation of the much-touted gutka ban has hit a roadblock due to severe shortage of food inspectors in the State. According to health department officials, against a minimum requirement of 210 food inspectors, currently there are only 85.
Gutka ban is being implemented under the Food Safety and Standards Authority Act and requires qualified graduates of pure sciences (chemistry or biology) to serve as food inspectors. The department has placed advertisements, calling for applicants to fill the vacancies.
Meanwhile, the Health department, officials said, has approached the Home department for help to implement the ban. According to M Madan Gopal, Principal Secretary to the Health and Family Department, they had requested the Director General and Inspector General of Police (DG&IGP) to ensure that police personnel across the State apprehend those selling gutka.
“When the ban on smoking in public spaces was implemented, we got the co-operation of the police department. Similarly, we are seeking their co-operation to implement the gutka ban,” Gopal said. The Health department has also sought the support of urban local bodies (ULBs) and orders are being issued by the Urban Development department to chief officers of the ULBs to implement the ban.
Currently, the State government has sealed all gutka manufacturing units in Karnataka. On alternative employment for those working in the manufacturing units, the State has asked the owners to shift production to non-tobacco or non-nicotine based arecanut products.
‘No impact on growers’
The State government has said there will be no impact of the gutka ban on arecanut growers in the State. Horticulture department principal secretary M K Shankarlinge Gowda said the areca grown in the State is never utilised in the manufacture of gutka.
“We are likely to see only a small percentage of arecanut growers who may be impacted by the gutka ban. But, they can change their land use to plantations or other such activities. The arecanut used in the manufacture of gutka is the reject of the actual arecanut,” he said. Most of the arecanut used in the manufacture of gutka comes from outside the country and only 25 per cent is from the State.
On the Gorakh Singh Committee report, Gowda said the measures recommended in the report had already been taken and farmers in Chikmagalur and Shimoga are being encouraged to grow alternative crops. On loan waiver, Gowda said only those loans obtained from co-operative societies by arecanut growers can be waived of.
“For those who have sought loans from nationalised banks, it is the Centre which has to take the call,” he said.

Concern over easy availability of banned pan masala

Concern has been expressed over the sale and easy availability of banned substances, particularly pan masala, in the city and more significantly, the limited powers of enforcement authorities like the Excise department to initiate action in this regard.
Excise and Narcotic officials, along with members of a committee chaired by District Collector K.N. Satheesh, which met here on Friday to discuss the issue of bootlegging, illicit spirit, sale of narcotic substances and other Excise-related subjects, were told by a member about theQ availability of pan masala from the Chala market, with exact locations and the manner in which the banned stuff was smuggled here.
However, Excise officials, when asked about what action they could take in this regard, said their powers were limited to seizing such stuff during inspections at check-posts, and even then, they could not charge cases. All that they could do was to hand over the seized contraband and the carrier to the police or Food Safety officials, who would have to carry on with the rest of the procedures.
Though police and Food Safety officials were conducting raids at regular intervals, the pan masala menace was still large in the city, with the action so far against vendors and persons who smuggled these being ‘not deterrent enough’. Excise officials said they had communicated to the government to vest with them powers to take action on this issue as well.
The meeting, which decided to ask police and Food Safety officials to closely monitor the sale of pan masala and similar substances, also decided to keep an eye on and to take action against illegal sale of liquor in various parts of the district, while inspections to curb sale of illicitly brewed spirit would be intensified.
Deputy Excise Commissioner (Thiruvananthapuram) P.G. Pramod Chandran, Assistant Commissioner B. Suresh Kumar, Deputy Superintendent of Police (Narcotics, Rural) K. Raju and others were present.

ஆயிரம் மதிப்புள்ள குட்கா, பான், புகையிலை உள்ளிட்ட போதை பொருட்கள் அடங்கிய 2500 பாக்கெட்டுகள் பறிமுதல் செய்யப்பட்டன.
குட்கா, பான் பொருட்களுக்கு தமிழக அரசு தடை விதித்துள்ளது. இதையடுத்து, சேலம் சின்னக்கடை வீதி, முதல் அக்ரஹாரம், இரண்டாவது அக்ரஹாரம் ஆகிய பகுதிகளில் உணவுப்பாதுகாப்பு திட்ட மாவட்ட நியமன அலுவலர் டாக்டர் அனுராதா தலைமையில் 50 கடைகளில் அதிகாரிகள் சோதனை நடத்தினர். இந்த கடைகளில் இருந்து மொத்தம் 15 ஆயிரம் மதிப்புள்ள 2500 போதை பாக்கு பொட்டலங்கள், புகையிலை பாக்கெட்டுகள் பறிமுதல் செய்யப்பட்டன.
போதை பொருட்களை விற்ற 50 கடைகளுக்கும் எச்சரிக்கை நோட்டீஸ் அளிக்கப்பட்டது. அந்த நோட்டீஸில், உணவு பாதுகாப்பு சட்டம்&2006, அரசாணை எண் 132ன் கீழ், தமிழக அரசு போதை பாக்கு, புகையிலை உள்ளிட்ட பொருட்களுக்கு கடந்த மாதம் 23ம் தேதி முதல் தடை விதித்துள்ளது.
இவ்வகை பொருட்களை, ஏற்கனவே வாங்கி இருப்பு வைத்திருக்கும் சிறு வியாபாரிகள், விநியோகஸ்தர்கள் இம்மாதம் 22ம் தேதிக்கு பின்னர் விற்பனை செய்யக்கூடாது. இருப்பு வைத்திருக்கவும் கூடாது. மீறினால், சட்டப்பூர்வ நடவடிக்கை எடுக்கப்படும்,’’ என எச்சரிக்கப்பட்டு உள்ளது.

Sale of food products containing tobacco, nicotine banned

With the selling of gutka, pan masala and any other food product containing tobacco or nicotine as ingredients banned in the district from Friday, health officials began inspecting petty shops and seized the items that were kept for sale.
They distributed awareness pamphlets to the traders asking them not to sell the products and explained the ill affects of consumption of the products.
A team led by T. Anuradha, District Designated Officer, Food Safety Department, and Sanitary Inspectors from City Municipal Corporation inspected shops in Second Agraharam Street, Chinna Kadai Veedi, Old Bus Stand areas and other parts of the city.
They explained the provisions in the law and also the action that can be taken against them if they were found selling banned tobacco products.
A district level monitoring committee was formed on Thursday to implement the ban in the district, as traders were warned that cases would be booked against them from June 26 after initial warnings.
With consumption of tobacco, pan masala and gutka among schoolchildren increasing, headmasters and teachers will be vested with the responsibility of creating awareness among the students once the schools reopen on June 10.
The benefits of quitting tobacco and other products would be explained to the students apart from organising awareness rallies.
Officials of the education department were also told that they could inform the designated officer if the banned products were noticed being sold near school premises.

தமிழகத்தில் கடந்த மாதம் 23ம் தேதி முதல் பான்பராக், குட்கா மற்றும் புகையிலைப் பொருட்கள் விற்பனை செய்ய மாநில அரசு தடை விதித்தது. இதையடுத்து அதிகாரிகள் கடைகளில் தொடர் சோதனைகளில் ஈடுபட்டு வருகின்றனர்.
விருதுநகர் மாவட்ட உணவு பாதுகாப்புத்துறை நியமன அதிகாரி டாக்டர் கவிக்குமார் ஆலோசனையின் பேரில், சாத்தூரில் உணவு பாதுகாப்புதுறை அதிகாரிகள் நேற்று திடீர் சோதனையில் ஈடுபட்டனர். சாத்தூர் மெயின் ரோடு, ரயில்வே பீடர் சாலை உட்பட பல்வேறு இடங்களில் உள்ள பெட்டிக்கடைகள், பலசரக்கு கடைகளில் திடீர் சோதனை நடத்தினர்.

மாவட்ட உணவு பாதுகாப்பு பிரிவு நியமன அலுவலர் ஜெகதீஷ் சந்திரபோஸ் முன்னிலை வகித்தார். கூட்டத்தில் வட்டார போக்குவரத்து அலுவலர் தங்கவேலு மற்றும் வணிகவரித்துறை, சுகாதாரத்துறை, கல்வித்துறை, போலீஸ்துறை அலுவலர்கள் கலந்து கொண்டனர். பின்னர் மாவட்ட கலெக்டர் ஆஷிஷ்குமார் நிருபர்களுக்கு பேட்டி அளித்தார். அப்போது கூறியதாவது:–

இதனால் தூத்துக்குடி மாவட்டத்தில் தடைவிதிக்கப்பட்ட குட்கா, பான்மசாலா விற்பனை செய்யக்கூடாது. தற்போது கடைகளில் விற்பனை செய்யப்பட்டு வருவதை உடனடியாக நிறுத்த வேண்டும். அவர்கள் குடோன்களில் வைத்து இருக்கும் பொருட்களை ஒரு மாதத்துக்குள் அகற்றி முழுமையாக அழிக்க வேண்டும். குட்கா, பான்மசாலா ஆகியவற்றால் வாய், தொண்டை, நுரையீரல் உள்ளிட்ட பகுதிகளில் பல்வேறு நோய்கள் தாக்குகின்றன.
மக்கள் இதனை பயன்படுத்தக்கூடாது. தமிழ்நாடு மட்டுமின்றி பல மாநிலங்களில் குட்கா, பான்மசாலா தடை செய்யப்பட்டு உள்ளது. இதனை தூத்துக்குடியிலும் முழுவீச்சில் செயல்படுத்த உள்ளோம். அதிகாரிகள் மக்கள், கடைக்காரர்களை துன்புறுத்தக்கூடாது. ஏதேனும் துன்புறுத்தியதாக புகார்கள் வந்தால், அதிகாரிகள் மீதும் நடவடிக்கை எடுக்கப்படும்.
தீவிர கண்காணிப்பு
பள்ளி, கல்லூரிகள், ஆஸ்பத்திரி அருகே பான்மசாலா விற்பனை செய்யப்படாமல் தீவிர கண்காணிப்பு மேற்கொள்ளப்பட்டு தடுக்கப்படும். தடையை மீறி விற்பனை செய்தால், உடனடியாக பறிமுதல் செய்து அழிக்கப்படும்.இவ்வாறு மாவட்ட கலெக்டர் ஆஷிஷ்குமார் கூறினார்.

பான்மசாலா பொருள்கள் விற்போர் மீது நடவடிக்கை: ஆட்சியர்

தமிழக அரசின் தடையை மீறி  பான்மசாலா மற்றும் குட்கா பொருள்கள் விற்பனை செய்வது கண்டுபிடிக்கப்பட்டால் கடும் நடவடிக்கை எடுக்கப்படும் என்றார் மாவட்ட ஆட்சியர் ஆஷிஷ்குமார்.
தமிழக முதல்வர் ஜெயலலிதா ஆணைப்படி குட்கா மற்றும் பான்மசாலா போன்ற பொருள்களை தூத்துக்குடி மாவட்டத்தில் தடை செய்வது தொடர்பான ஆலோசனைக் கூட்டம் மாவட்ட ஆட்சியர் ஆஷிஷ்குமார் தலைமையில் வெள்ளிக்கிழமை நடைபெற்றது.
கூட்டத்தில் ஆட்சியர் ஆஷிஷ்குமார் பேசுகையில்,  தமிழக முதல்வர் 8.5.2013-ல் குட்கா, பான்மசாலா போன்ற பொருள்களை தமிழகத்தில் விற்பனை செய்யக் கூடாது என அறிவித்துள்ளார். இந்த அறிவிப்பு 23.5.2013-ல் அரசிதழில் வெளியிடப்பட்டுள்ளது.
தடை செய்யப்பட்ட பான்மசாலா பொருள்கள் விற்பனை செய்யப்படுவதைத் தடுக்கும் வகையில் மாவட்ட அளவில் மாவட்ட ஆட்சியரைக் கொண்ட ஒரு குழு அமைக்கப்பட்டுள்ளது.
இதில் மாவட்ட காவல் கண்காணிப்பாளர், மாவட்ட வருவாய் அலுவலர், மாவட்ட சமூக நல அலுவலர், மாநகராட்சிப் பிரதிநிதி, மாவட்ட வணிக வரி அலுவலர், வட்டாரப் போக்குவரத்து அலுவலர், உணவு பாதுகாப்புத்துறை நியமன அலுவலர் ஆகியோர் உறுப்பினர்களாக செயல்படுவர்.
இந்த அலுவலர்கள் திடீர் ஆய்வு மேற்கொண்டு குட்கா, பான்மசாலா பொருள்களின் விற்பனையை தடைசெய்தும், அவற்றை பறிமுதல் செய்தும்,  பின்னர் வழக்குப் பதிவு செய்தும் நடவடிக்கை மேற்கொள்வர். அரசின் தடை உத்தரவு இருப்பதால் பான்மசாலா மற்றும் குட்கா பொருள்களை விற்பனை செய்வதை கடைகள் நிறுத்திக் கொள்ள வேண்டும். யாரேனும் கள்ளச்சந்தையில் இப்பொருள்களை விற்பனை செய்தால் கடும் நடவடிக்கை எடுக்கப்படும் என்றார் அவர்.
ஆலோசனைக் கூட்டத்தில் உணவு பாதுகாப்புத் துறை நியமன அலுவலர் ம. ஜெகதீஸ் சந்திரபோஸ், வட்டார போக்குவரத்து அலுவலர் கே. தங்கவேலு உள்ளிட்ட அதிகாரிகள் கலந்து கொண்டனர்.

The ban on sale of gutka and pan masala will be strictly imposed in Tuticorin district from Friday.
The District Monitoring Committee, led by Collector Ashish Kumar, convened a meeting here with officials of Food Safety, police personnel and other departments to effectively act against those indulging in the illegal sale of the banned commodities.
The Collector said Chief Minister Jayalalithaa had formally announced the ban in the Assembly session on May 8, 2013 and Commissioner of Tamil Nadu Food Safety and Drug Administration, Kumar Jayant notified the ban in the gazette with effect from May 23, 2013. The ban was effective in 24 States and three Union Territories across India.
Initially, shopkeepers if found storing the product, would be instructed to remove it and warning notices would be issued until June 22. The banned items, if found in shops beyond the stipulated period, would be seized and destroyed as per instructions of Food Safety Standards Act. The committee comprising Food Safety officers, corporation authority, police personnel, transport authority, departments of Health and Education would be involved in conducting raids at public places, he said.
Commercial tax department would also join the committee to carry out mobile-checks. He also added that officials should not harass shop owners under any circumstances but continue to ensure that Tuticorin remains gutka-free district.
Citing the ill effects of chewing gutka and pan masala, M. Jegadeesh Chandrabose, District Designated Officer, Food Safety and Standards Act, said all organs of the body were affected. Gutka, he said was a composition of 700 to 4,000 chemical products and fatality due to the use of this product in the world is about 2.5 million to 3 million according to a World Health Organisation report.

Karnataka HC issues notice to state & central govt on plea against gutkha ban

BANGALORE: In an interesting development, the Karnataka high court has ordered issuance of notices to state government s well as central government in response to a petition filed by manufacturers of gutkha challenging the May 30 gutkha ban order .
Justice B S Patil officiating at the Dharwad circuit bench directed the state to file its response to a petition filed by Msrs Godavat pan Masala Products and others challenging the ban order.
The petitioners have claimed that the order issued by the office of the food safety commissioner is ultra vires of the Food Safety Standards Sct ,2006 and the Cigarette and other tobacco products (Prohibition of advertisement regulation of trade and commerce production, supply and distribution) Act 2003.
The food safety commissioner had issued ban order under regulation 2,3,4 of the Food safety and standards(Prohibition and restriction on sales) regulations 2011 holding that tobacco and nicotine are used in gutkha and pan masala as ingredients and it is expedient to ban the sale, manufacture, storage of these articles in public interest.
The state government issued another order on June 4 asking the local authorities to enforce the ban inciting the Supreme Court order and also in view of the fact that nearly 216 million people in India are using tobacco in smokeless form , resulting in carcinogenic and non-carcinogenic effects, a huge health hazard as per a global study conducted in 2009.

The Karnataka High Court has ordered issue of notice to the State government on petitions challenging the ban imposed on the manufacture, sale, storage and distribution of gutka and paan masala containing tobacco and nicotine as ingredients.
Justice B.S. Patil, sitting at the Dharwad Circuit Bench of the High Court, passed the order on petitions filed by Ghodawat Pan Masala Products (I) Private Ltd., Heera Enterprises, and Raja Nandini Foods Private Ltd., all based in Belgaum district.
Further hearing has been adjourned till June 11.
These firms claimed that the ban imposed under the provision 2.3.4 of the Food Safety and Standards (Prohibition and Restriction on Sale) Regulations 2011, was a violation of the provisions of the Food and Safety Act, 2006 and the Cigarettes and other Tobacco Products (Prohibition of Advertisement and Regulation of Sale and Commerce, Production, Supply and Distribution) Act, 2003.
The government imposed the ban with effect from May 30 while treating gutka and paan masala as “food articles”, consumption of which was injurious to health as they contained tobacco and nicotine.

Do not politicise issue, they say 

Even as the Opposition tried to pressure the government to lift the ban on gutka, a group of public health activists have urged political party representatives not politicise the issue.

Upendra Bhojani, public health expert, told reporters here on Friday that leaders were making exaggerated claims about the threat of the livelihood of arecanut farmers. Referring to the report by University of Agricultural Sciences, Bangalore, on ‘Special scheme on cost of cultivation of arecanut in Karnataka’, he said that arecanut farmers’ share in consumer rupee (how much they earn) for value-added products was only nine to 20 per cent, which is far lower than it is for other crops.

“Although it is too early, we can see that the arecanut prices have not crashed post the ban. Moreover, the government has promised to protect the interests of arecanut farmers.”

Mr. Bhojani reiterated that the ban on sale of gutka was a welcome move and not a hasty decision. “Twenty-five States and five Union Territories have already banned gutka. Other States are also expected to ban it as per the Supreme Court directive.”

Getting to the root

Explaining that gutka consumption was influenced by a variety of factors, Prathima Murthy, professor of Psychiatry and head of the De-addiction Centre at Nimhans, said several people consume gutka to reduce hunger and stress. “Addressing the root cause such as stress, will go a long way in reducing consumption of gutka,” she said.

Dr. Murthy added there is a tremendous opportunity for users to give up gutka in the wake of the ban, as it would not be easily accessible. “Several patients have come to our de-addiction centre and told us they would consider quitting as gutka is not as accessible as before.”

Withdrawal symptoms

However, she added there was a need for patients to deal with withdrawal symptoms. “People will start experiencing symptoms such as restlessness, loss of attention and cravings. These symptoms are likely to last anywhere between a week and a few months.”

Citing a case study, Dr. Murthy said a nine-year-old, who used to chew tobacco, was referred to her. The boy used to suffer from impulsivity and had difficulties in school.

Asked if people were likely to shift from gutka to other forms of tobacco such as cigarettes, Mr. Bhojani said, “The switch from gutka to cigarettes is relatively less, as not many can afford cigarettes. However, the government can play a proactive role and increase the taxation on tobacco-related products. This will go a long way in reducing consumption of tobacco products.”

1 week after ban, gutka is openly sold in shops


BANGALORE: A week after the Karnataka government banned the sale and consumption of gutka, the tobacco product is openly available in Bangalore and rest of Karnataka.
A reality check by TOI on Thursday indicates that the implementation of gutka ban is more challenging than initially thought. The move is hobbled by lack of awareness about the ban and related guidelines. Many shop owners said they haven't received any directive on the ban and what it means. Records state that the government issued gutka ban guidelines on June 1, but district administrations like Dharwad claimed they're yet to receive it. Effective implementation of the ban is important as Karnataka has to file a compliance report before the Supreme Court by June 23.
Health and family welfare principal secretary M Madan Gopal had a different take. The officer told TOI he couldn't find gutka in several areas of Bangalore he visited to see if the ban had been enforced. "If shops are found selling gutka, food safety officers will immediately raid them, seize the stock, and revoke his trading licence," he said.
The health and family welfare department has decided to seek the help of police force to implement the ban. Gopal said district surveillance officers had been redeployed as district designated officers to supervise ban enforcement.



Business as usual as shops flout ban
The Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, prescribes a penalty of up to Rs 10 lakh if anyone is found manufacturing, selling, storing or distributing products "with an adulterant that is injurious to health". If the adulterant is not injurious to health, the penalty is Rs 2 lakh. If a buyer dies after consuming the tobacco product, then the seller and/or manufacturer could face a jail term of seven years or life term.
A health expert associated with the Tobacco-Free Karnataka campaign suggested a three-pronged formula to effectively implement the ban: "Raid manufacturing companies and choke the supply route; district administrations must keep hawk's eye on retail shops; and hold de-addiction camps and awareness programmes so that gutka consumers don't switch to cigarettes and beedis."
KR Market
Shop owners in and around KR Market expressed their anger over the ban. "Gutka sales are as profitable as cigarette sales for small shop-owners like us. The government should have asked gutka manufacturing companies to ensure no harmful materials are used in it. A blanket ban will harm many lives dependent on this," said Akram Khan, a shop owner. Many others supported him and said they will continue sales till existing stocks get over. Many shops displayed rows of gutka sachets of different brands.
Basavanagudi
Afew metres from the Government PU College near Tagore Circle, a corner shop located was bustling with customers. When asked about gutka sachets, the shop owner, a senior citizen, put her hands below a table nearby and took out two packets of different brands. She had no clue about the ban. Neither did customers who buy these sachets from her. A few metres ahead, towards Gandhi Bazaar Main Road, there was another shop where rows of gutka sachets were hanging near the door. When asked about the ban, the shop owner said he was aware of it but said he hasn't received orders to stop selling these products. "I know the sale will not be allowed in the near future. But as of now, no authority has issued orders to shop owners about this. The state government should clearly inform the shop owners from when the sale should be stopped," he added.
Shivajinagar
Charging premium for gutka sachets was common in many shops here. Shop owners were aware that the product will soon be off the market and hence wanted to make the most of the available stock. A gutka packet which usually cost Rs 4 was priced at Rs 10. "We're aware of the ban. But government has no directive as to when the shops should stop selling gutka. We want to clear the stock. And when there is demand, the price will automatically go up," said a shop owner on Church Street.
Koramangala
In many areas here, the sale was restricted to inner lanes and owners of shops on the main roads said they were not selling gutka. Ramachandra K, a regular consumer, said he had no problem getting packets through the day. "If you pay some extra money to the shop owner, you will get any brand of gutka without any difficulty," he added. A shop owner said he found more users of cigarettes than gutka products and if the government had to ban, it should be cigarettes first. "From the shop-owner's point of view, the government should have consulted all stakeholders before going ahead with ban. Even after the ban is implemented, there are many ways for both customers and sellers to get on with business," he said. A nearby shop owner added he sells as many as 300 packets of gutka every day and has six brands on sale.
Rajajinagar
Shops in Rajajinagar didn't display gutka packets openly. However, when customers asked for it, show owners had no qualms in selling them. "A police official came to my store on Wednesday and asked me to stop selling gutka packets. I read about the ban in newspapers but my contention is that there's no clarity on the whole issue. The debate on the ban continues till date. What if the government revokes the ban in future?" said Raman Lal, a shopowner. He said the demand for gutka packets continues till late night as cab drivers of tech companies come to buy them.
Times View
A week after the state government banned sale of gutka, it's obviously not followed it up with action on the ground. Gutka is freely available across the state, and traders are oblivious to the fact that they are selling a banned product. It also means that supply is continuing smoothly. Though the government claims the guidelines are clear, officials implementing the ban are yet to receive them. Clearly, there's a communication gap. If the government is serious about complying with the Supreme Court order, officials should be out on the streets, implementing the ban.

Chandramouli appointment challenged; arbitrary practices led to losses


The Food Safety and Standards Authority of India (FSSAI) is under fire. A Ghaziabad- based NGO Lok Jagriti has filed a Public Interest Litigation (PIL) on May 29, 2013, challenging the appointment of K Chandramouli as chairperson of the Authority citing the reason that he did not fulfil the eligibility criteria for the post as desired under Section 5 of the FSS Act.
Under Section 5 (3) of FSS Act, the chairperson shall be appointed by the Central Government from amongst the persons of eminence in the field of food science or from amongst the persons from the administration who have been associated with the subject and is either holding or has held the position of not below the rank of secretary to the Government of India.
The petition says that the present chairman has no experience in food safety / food science and technology as prescribed under the FSS Act.
Additional charge
Further, Chandramouli has been given the additional charge of CEO since last December when the position fell vacant after former CEO S N Mohanty left the Authority.
According to the PIL, there was a case of conflict of interest as he held the position of CEO of the Authority alongside of chairperson, which has been lying vacant since December 2012, and this violated Section 5 (5) of the FSS Act. The said section says that the chairperson or members other than ex-officio members of the Authority shall not hold any other office.
The petition also criticised the health ministry for failing to take appropriate action for filling the vacant post of CEO.
Meanwhile, the High Court has directed the ministry of health and others to respond by August 17.
Misgovernance
Lok Jagriti’s Santosh Mishara said, “The Food Safety and Standards Act, 2006, is a bold and modern Act which was passed after taking into consideration the requirements of ensuring nutrition and hygiene, discarding unsafe food, and ensuring safe storage, transportation and delivery practices.”
“But, the various misgovernance issues in enforcement of the Act by the FSSAI are threatening public health. Further such food import was allowed for which no Indian standards were available,” he stated.
Closing of lab
He charged that the Central Food Laboratory at Ghaziabad, also a referral laboratory under the Act, was closed down due to the highhandedness of the chairperson of FSSAI, leading to chaos as private labs started thriving and charging exorbitant rates for simple testing of food articles. The closure, actually, requires approval of the board of the food authority.
The laboratory was to be strengthened and upgraded as National Science Risk Assessment Centre (NASRAC) for which a proposal was approved by the Food Authority Board in its 8th meeting in 2011, and was forwarded by the health ministry to the Planning Commission for suitable grant in the 12th Plan. The sub- group on drugs and health constituted by the Planning Commission has recommended an outlay of Rs 155 crore for upgradation of the laboratory.
Questionable actions
Mishara alleged that the present chairman of FSSAI in connivance with senior government officials got the CEO, FSSAI, transferred, who left the job within six months of appointment (from May to Dec 2012).
Meanwhile, the petition says that the irregular and arbitrary practices adopted by the chairperson are causing huge losses to the public exchequer and is also great impediment in functioning of the structural authorities provided under the FSS Act.
The petition adds that the chairperson, by issuing certain advisories, which otherwise are dehors the procedure, as he is not legally authorised to issue, has played with the health of the people by allowing certain additives in imported food and nutrition products which, otherwise till date, have not been allowed or safety of which has not been ascertained by the Scientific Panel constituted under this Act.
“The resultant anarchy has seriously jeopardised the health of the public and consumers and thus the safety and standards envisaged under the Act, are a far cry,” says the petition.
Licensing extension
He being the person having no prior experience or knowledge of food sciences does not seem to understand the repercussions his arbitrary actions will have on the whole food regime of this country, states the petition.
The petition charged that the extension of last date for acquiring licensing and ensuring registration of FBOs had caused huge revenue losses to the exchequer. The delay will cause a loss of about Rs 1,500 crore in terms of licensing fees, and Rs 500 crore of registration fees, which is required to be collected for operating the food business for one year only, it stated.

Sale of gutka, pan masala banned in Salem district

Shopkeepers will not be allowed to sell these products from Friday
Sale of gutka, panmasala and any other food product containing tobacco or nicotine as ingredients is banned in the district from Friday.
At the first district level meeting to discuss the modalities for effective implementation of the ban, it was decided to create awareness among the public and the shopkeepers about the ill-affects of consuming tobacco.
Shopkeepers would be asked not to sell the banned products from Friday. Inspections would be carried out from June 26 for effective implementation of the ban in the district.
District Collector K. Maharabushanam is the chairperson of the committee. City Police Commissioner, Superintendent of Police, District Revenue Officer, Deputy Director of Health Services, Chief Educational Officer, District Social Welfare Officer, Corporation Commissioner, District Commercial Tax Officer, Regional Transport Officers — Salem East, Salem West, Attur and Sankagiri, and Commissioners of Municipality, are the members.
The District Designated Officer of Food Safety Department T. Anuradha is the convener of the committee who would inspect the manufacturing units, storage godowns, and initiate legal action against violators.
The role and responsibilities of each committee member were explained and they were asked to adhere to the guidelines.
According to 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011, tobacco and nicotine shall not be used as ingredients.
According to Section 30 (a) (2) of the Food Safety and Standards Act, 2006, they are banned in the State.
Deputy Commissioner of Police (Law and Order) A.G. Babu, District Social Welfare Officer Anbu and other officials too were present.

    Rs. 24,000 fine imposed under FS&S Act

    Udhampur:- Additional Deputy Commissioner, Udhampur who is also Adjudicating Officer under Food Safety and Standard (FS&S) Act. 2006, today imposed a fine of Rs. 24,000/- in as many as six cases having been submitted to him by the Food Safety Officer of Block Tikri and Ramnagar for adjudication. 
    The accused persons had in all these cases confessed the commission of the offence under the Act and keeping in view all the attendant circumstances, penalties were imposed which were deemed commensurate with the gravity of the offences committed. The offenders were directed to deposit the penalties imposed on them in the Government Treasury under relevant head of account which they have complied with. 
    They were further directed to be careful in future and desist from carrying any such activities as are forbidden under the law of the land, so as to save the public health from being endangered thereby.

    Stakeholders should avoid marketing Gutkha

    JAMMU: The Commissioner of Food Safety issued Notification vide SRO-68 on 6th March, 2013 prohibiting manufacture, storage, sale, transportation, display or distribution of Gutkha by whatever name and Pan Masala/Zarda containing tobacco or nicotine as ingredients by whatsoever name with immediate effect in the interest of public health. However, it has been observed that availability of Gutkha and Pan Masala containing and / or nicotine continues in violation of the above said notification despite keeping the above notification in public domain through print and electronic media.
    It is therefore impressed upon all stake holders to observe and secure due diligence for compliance of the said prohibition. The enforcement officers appointed under the Food Safety and Standards Act, 2006 are hereby directed to take cognisance of any violation on this account as per mandate of law, stated Controller, Drug Food Control Jammu through a press release issued on Thursday.
    Violation of the prohibition order can invite seizure of above said product along with legal action as prescribed under the aforesaid Act.
    It is impressed upon all the designated officers and Food Safety Officers to utilise the services of Public Prosecutors available at District Headquarters for seeking necessary legal guidance in the matters arising out of implementation of the provisions of Food Safety and Standards Act, 2006 as well as pending Court cases pertaining to repealed Prevention of Food Adulteration Act, 1954, the release added.
    However, this arrangement shall apply only when the Standing Counsels appointed by the Law Department for DFCO are not able to provide the required guidance owing to their preoccupation or feasibility. It may also be noted that henceforth no excuse for eviction of offenders booked for contravention of provisions warranting legal action shall be accepted on account of default construed on this account i.e. non-availability of legal counseling. The defaulting officials shall invite strict administrative action for such lapses, the release maintained.

    Food safety body issues warning after 'shocking' fall in standards

    MAY was one of the worst ever months for serious food safety problems in restaurants, shops and takeaways.
     Health inspectors took action against 19 food businesses over hygiene and safety problems that could endanger public health last month.
    The Food Safety Authority of Ireland (FSAI) warned businesses to clean up their act as warm summer weather greatly increases the risks of food poisoning.
    It was "shocking" that such a high number of food businesses were not compliant with food law, said FSAI director of service contracts Dr Bernard Hegarty.
    "The risks for food-borne illness increase as bacteria can multiply rapidly in the warmer temperatures," he said.
    The 19 enforcement actions last month matches the previous highest monthly total recorded last October. So far in 2013, some 61 food businesses have received enforcement actions, compared with 109 in the whole of 2012, and the numbers falling short of food safety standards have risen dramatically over the last six years.
    The recession could be one factor, but also health inspectors have increased powers under new EU food regulations to take action where there is a breach of food legislation, an FSAI spokesperson said.
    Londis supermarket at 12 St Stephen's Green, Dublin 2; Chopsticks restaurant in Parnell Mall, Ilac Centre, Dublin 1; Sichuan House Restaurant at 100a Parnell St, Dublin 1; and Hong Kong Seafood Restaurant at 138 Parnell St, Dublin 1 were all served with closure orders, which were lifted when the problems were resolved.
    Pacino's restaurant in Suffolk St, Dublin 2, and Morning Star grocery store, Flower Hill, Navan, Co Meath also received closure orders that were later lifted.

    Insect, ear ring, wrappers found in soft drinks bottles of Pepsi, 7Up, Mountain Dew
    Jammu ,June 5 – Taking cue from the consumer awareness campaigns of the Govt and the Consumer related NGOs particularly Jago Gharak Jago, a young engineering student Sourabh Anand has filed a consumer complaint against Pepsi Co India Limited and Jai Beverages Limited and has sought compensation to the tune of Rs 5 Lakhs.
    In a press release issued to press said that the complaint was filed by Sourabh Anand son of Naresh Anand resident of New Plots Jammu under the J&K Consumer Protection Act before the Divisional (Consumer) Forum Jammu through Mr A K Sawhney Advocate with Mr Aseem Sawhney Advocate and Mr Pardeep Khajuria Advocates.
    Worthwhile to mention that Sourabh a student of MIET College Jammu purchased some soft drink bottles from his college canteen and found that three bottles out of 14 bottles, he purchased were adulterated.
    The bottle of Pepsi contained an insect, a bottle of Mountain Dew contained a metal earring which had corroded inside the bottle and Lehar 7UP contained a chewing gum wrapper.
    In the complaint filed against Pepsi Co India and Jai Beverages Limited, Mr A K Sawhney and Mr Aseem Sawhney Advocates the complainant has sought compensation to the complainant to the tune of Rs 5 lakhs for the mental torture, humiliation, trauma, insult and attempted loss of life, health and injury due to negligence of the manufacturers and sought that the manufacturer Pepsi Co and Jai Beverages be directed to pay costs to the complainant and further a direction not to offer adulterated and hazardous cold drinks for sale.
    It was alleged in the complaint by Mr A K Sawhney Advocate and associate lawyers that on 1.6.2013, Saturday, the complainant went to his college canteen being run in the MIET College campus and purchased beverages 14 in number which included six Lehar Mountain Dew, four Lehar 7Ups and 4 Pepsi.
    The complainant made a payment of Rs 194/- for these cold drinks bottles.
    The complainant- Sourabh Anand was offering his friends with the cold drinks/ beverages which included six Mountain Dews, four 7Ups and 4 Pepsi being a brand of respondent no. 1 when the complainant was shell shocked to notice that three bottles which include one Pepsi, one 7Up and one Mountain Dew were containing foreign matter in the sealed bottles. The said beverages' bottles which were company sealed were containing adulterated matter which was visible with a naked eye and the cold drinks, sold to the complainant were adulterated and hazardous for health.
    It was submitted before the Consumer Court that the sealed 300 ML bottle of Pepsi has a manufacturing date of 30.4.2013 and having batch no. P86 contains foreign matter, which seems to be a decomposed insect or a reptile or some creature with leaves or fish but definitely can be concluded to be adulterated under the definition of adulteration as contained in the Food Safety and Standards Act 2006.
    That the sealed 300 ML bottle of Mountain Dew has a manufacturing date of 14.5.2013 and having batch no. MD161 contains foreign matter, which seems to an ornament like an ear ring made of some metal but definitely can be concluded to be adulterated under the definition of adulteration as contained in the Food Safety and Standards Act 2006.That if the metal has corroded, the said cold drink would turn into poison and could take the life of the complaint or any one who would have consumed the said drink. The corroded particles are visible in the sealed bottle, it was alleged in the complaint.
    The sealed 300 ML bottle of Lehar 7UP has a manufacturing date of 1.4.2013 and having batch no. 7UP 08 contains foreign matter, which a floating chewing gum wrapper made up of non biodegradable polypropylene/ plastic material but definitely can be concluded to be adulterated under the definition of adulteration as contained in the Food Safety and Standards Act 2006 the complaint further alleged in the complaint.
    All the three bottles have the proper branding on its crown and the name and address of respondents no. 2 and 3 figure. As per the bottles the same have been manufactured by M/s Jai Beverages Limited having its manufacturing unit at SIDCO Industrial Complex, Phase I, Bari Brahmna Jammu and Regd office at 52, Janpath New Delhi.
    Mr Aseem Sawhney Advocate for the complainant also alleged that a reputed multinational company like Pepsi Co- respondent no 1 who owns these brands and respondents no. 2 and 3 - Jai Beverages Private Ltd which is manufacturing these beverages are supplying adulterated food material/ beverages to the consumers. In their accelerated pace to reap profits in the summer season they have become so negligent, careless and callous that they have totally forgotten about the health of the consumers. The respondents have displayed sheer negligence towards the health of the consumers and if these adulterated cold drinks had been consumed, the consumers would have suffered worst of health problems even could have caused death of a person.
    It was by sheer luck that the complainant- Sourabh Anand noticed these adulterated materials in the bottles in his purchased lot of bottles else there are several hotels, restaurants, dhabas, eateries, where these beverages are served in glasses and only God knows what poison is served to consumers on the name of these high branded beverages. Even the illiterate people who drink these beverages without even looking inside the bottles, too are being cheated by these respondents for making fast buck at the cost of the health of the consumers.
    The complainant has been very hurt and his faith, taste, choice has been shattered to learn that these companies which promote their brands through advertisements on TV, newspapers, magazines, through cricketers, film stars are actually so negligent in their manufacturing that they are ready to sell what ever dirt, filth and garbage they can offer especially in the summer season when their sales are at peak.
    In the complaint it was alleged that Complainant being a teenager/ youth; till date was an avid consumer of these high brands of cold drinks and there was craze in him for these brands, but after realizing that the manufacturers are so negligent in even manufacturing these bottles and beverages in the shape of cans, plastic bottles the complainant felt like puking and the filth in the bottles affected the heath of the complainant as to what all he was drink till date. On one side to maintain his health, the compliant like other youths visits gym and does exercises on the other side the youth is being administered such adulterated and filthy material on the name youth icons and using the advertisements exploiting the youth material. The complainant feels cheated on the name of the claims and false advertisements of the respondents, while reality is far away than truth.
    The sale of the adulterated and hazardous cold drinks to the complainant has caused mental torture, agony, pain and has shattered the faith of the complainant. Besides the complainant also suffered a health phobia as to what all he drank till date was "sweet poison due to sheer negligence of the respondents". Same are hazardous for the health and if consumed the complainant or his friends to whom he was offering the drinks would have suffered a fatal loss to his/ their health.
    The beverages are hazardous for the health of the complainant and are in contravention to the FSS Act 2006 which prescribes the standards of cold drinks/ beverages. The cold drinks bottles besides being defective are also adulterated. Further it was alleged that the cold drink manufacturers have violated good manufacturing practices, which ought to be adopted by the manufacturing companies besides have adopted unfair trade practices, manufactured cold drinks' bottles which are defective, and manufactured negligently.
    Not only manufacturing is negligent but the entire chain of supply, inspections, transport, stocking and sale is negligent. Thus cheating the consumer and keeping his life at peril by issuing misleading advertisements and exploiting the sentiments of the youth.
    Mr Sawhney submitted in the complaint that complainant has suffered through nausea, shock, mental torture, trauma, health phobia and tension. The complainant felt disparaged, humiliated and insulted in front of the friends to whom he was offering these beverages, therefore the complainant may be awarded compensation to the tune of Rs 5 lakhs so that the award may act as a deterrent for the respondents and they do not dare to play with the human health and lives in future through their callousness.
