Supreme Court dismisses SLP filed by FSSAI on Canola Oil “relabelling”
The Supreme Court had recently dismissed the Special Leave Petition (SLP) filed by the Food Safety & Standards Authority of India (FSSAI) against the interim order of the Bombay High Court on Canola Oil labelling.
The High Court had ruled in favour of Dalmia Continental Pvt. Ltd. (DCPL) by issuing a stay order against FSSAI’s labeling guidelines for Canola Oil and ordered release of DCPL’s Canola Oil consignments blocked at port.
According to sources privy to the hearing held in January, the judges, Justices Jagdish Singh Khehar and Sharad Arvind Bobde did not even entertain the request of FSSAI to be allowed to withdraw their SLP so that they could continue on final arguments in the Bombay High Court.
After hearing the matter, the Supreme Court ruled that DCPL was in full compliance with existing laws and that FSSAI had no case for mandatory “relabelling” of Canola Oil as ‘Rapeseed Oil – Low Erucic Acid.’
V Giri and Dheeraj Nair appeared for DCPL. The advocates stated that by dismissing the SLP, after hearing the matter at length, the Supreme Court left no recourse for FSSAI to proceed with final arguments on merit in the Bombay High Court. Hence, in appealing an interim order of the Bombay High Court, FSSAI lost the case in totality.
Earlier the Bombay High Court on September 16, had ruled in favour of DCPL and against the FSSAI, by issuing a stay order against FSSAI’s labelling guidelines for Canola Oil and ordering release of all DCPL’s Canola Oil consignments blocked at port.
The writ petition was filed by DCPL in the Bombay High Court against the labelling guidelines issued by FSSAI requiring all Canola Oil to be labelled as ‘Rapeseed Oil – Low Erucic Acid.’ Imported Canola Oil labelled as Canola Oil was blocked at ports by FSSAI if it was not labelled Rapeseed Oil – Low Erucic Acid.
This latest order of the Supreme Court represents a major victory for the industry which had concertedly resisted “relabelling” of Canola Oil as Rapeseed Oil – Low Erucic Acid, according to DCPL.
Industry take
The requirement to label Canola Oil as ‘Rapeseed Oil – Low Erucic Acid’ is discriminatory since the same labelling requirements are not imposed by FSSAI on other types of oil. In the Standard for Vegetable Oils of the Codex Alimentarius Commission, ‘Rapeseed Oil – Low Erucic Acid’ is the product category and ‘Canola Oil’ is the synonym mentioned in brackets. Several other oils are presented in the same manner in Codex. For example, ‘peanut/groundnut oil’ and ‘corn oil’ are mentioned in brackets alongside their respective product categories ‘Arachis Oil’ and ‘Maize Oil.’ However, both peanut/groundnut oil and corn oil are not labelled and marketed as per these product category names.
Low Erucic Acid Rapeseed Oil has varying definitions the world over. The EU definition requires a maximum of 5% erucic acid in Low Erucic Acid Rapeseed, whereas the limit for Canola Oil is 2%. Therefore, the two oils differ from one another and their names cannot be used interchangeably.
The term ‘Canola’ is widely recognised amongst Indian consumers as one of the healthiest oils in the market. Rapeseed oil, however, is associated in India with its high erucic acid version, which is considered toxic and injurious to health. Canola Oil has been imported into India under this name since 2007 and is also one of the most preferred cooking oils in USA, Canada, Mexico, Australia, Japan, South Korea, China and several other countries.
This order is the latest in a slew of adverse orders issued by high courts across the country against FSSAI, which has been acting in a rogue, increasingly arbitrary and obstructive manner with regard to food imports, with huge repercussions to consumers, retailers, importers, restaurants, hotels and food service industries.
Hundreds of containers worth thousands of crores of apples and other fruits, olives, canola oil, beer, wine, spirits, chocolates, fresh meat, seafood, pasta-sauce, mayonnaise, candy, juices, potato chips, spices, soymilk, gluten-free products and gluten, cocoa, compound chocolate and pre-mix for the dairy industry are among the goods blocked at ports due to one or the other objection by FSSAI, according to an industry source.
HRAWI backs FSSAI’s decision to extend deadline for FBO registration
Hotel and Restaurant Association of Western India (HRAWI) on behalf of the hotel industry has welcomed the Food Safety and Standards Authority of India (FSSAI)’s decision to further extend the deadline for obtaining Food Business Operator (FBO)’s license by six months to August 4, 2015. The order has come in the wake of several requests made by the association to the ministry. As per the earlier order all food businesses, from roadside eateries to restaurants, were to comply before February 4, 2015 or face rigorous punishments. The extended deadline is applicable for FBOs seeking conversions and renewals for existing license / registration under repealed order.
Bharat Malkani, president, HRAWI said, “The changes required in obtaining the licenses for FBOs as per the regulations are yet to be fully understood. Awareness on procedures and protocols is still lacking. It is a herculean task in itself and with the sheer number of FBOs the job is doubly cumbersome. Hence, we sought this extension from the government and hope to meet the deadline in August.”
“As an association, representing members of the hotel industry, we will work in the best interests of the industry. We understand and realise the basic premise or the intent of the Food Safety and Standards Act is to ensure international standards of hygiene. On this we are in full concurrence with the Government and extended our co-operation. However, hoteliers will take some more time to be fully compliant. We will take full efforts towards achieving standards that are at par, if not better, with the world,” added Malkani.

Testing and tasting, the way ahead for food safety
Kochi:
Hotels, Malls, Bakers Sign Up With Labs For Quality Checks
Believe it or not, food safety and hygiene are the prime concern of star hotels, popular malls and bakeries. Thanks to a series of raids by the food safety department last year, they are regularly sending samples of water, food and packaged snacks to private labs to ensure quality .
Earlier, labs only used to get weekly and monthly samples of drinking water and the one used in bathrooms. Over the past 12 months, many hotels have signed up with labs to continuously test samples.
“We get all kinds of food including burgers, doughnuts, chips, murukku, appams and several other locally-made products that are sold fresh. Most of the food is locally outsourced and hence the hotels and malls don't want to take a chance,“ said a quality assurance manager at a private lab.
“Public awareness on hygiene and health has increased. Different associations have lined up initiatives to publicize the standards of different food items. Some stopped artificial colours and flavours, but it hasn't gone down well with the people,“ said assistant commissioner of food safety intelligence (central region) Beena V K, adding that Food Safety Standards of India (FSSAI) has made it mandatory for companies to provide nutritional facts for packaged foods.
Quality Control analyst Shivadas B Menon termed it a good trend. “Microbiological tests will reveal the level of hygiene in kitchen staff. Since many hotels are manned by migrants, it is important to iron out basic hand wash techniques,“ he said, adding that the government should choose a PPP model to ensure cleanliness.
District food safety officer K Ajith Kumar said that officials are looking at food adulteration and the practice of reusing old oils that may prove toxic for some consumers.“We are yet to conduct any fresh raids this year because of National Games,“ he said.Junior health inspector M M Sakkeer, who is a part of the team that conducts raids, said: “We do not permit toilets in the kitchen. We look at the quality of chicken and meat and its quality .“
The president of Kerala Bakers Association admitted that most bakers have chosen the outsourcing route. “The `vada' and `ada' are made at home and we draw a line to ensure quality . Bakers are being trained on what should not be added in food,“ he said.
After being on the receiving end of raids and bad publicity, Kerala Hotels and Restaurants Association (KHRA) has activated its health monitoring forum that organizes talks by food safety officials. “We do check that the lessons taught are being implemented by our members. We point out flaws in sanitation, food preparation and preservation,“ said district president M P Shiju.
Even star hotels are collecting kitchen staff swabs for tests to prevent the spread of infection. Taj Gateway executive chef Jaffer Ali said surprise checks are part of internal audit. “Twice a month, we collect hand and utensil swabs to check microbial presence. Most of the checks are random and all reports go directly to the top management as it is mandatory under ISO certification,“ he said.
NATIONAL GAMES - Squad ensures safe food for athletes
Kochi:
Three squads of the food safety department are monitoring the food being supplied to athletes and officials participating in the National Games.Food safety officials said that they have cleared the Games menu for all days and are collecting samples twice a day from each venue. “We have not received any complaint on the quality so far. But, there have been some complaints regarding taste. It is quiet natural as people are coming from different parts of the country. Every day the menu is fixed,“ said senior food inspector of the mobile vigilance squad in Ernakulam Abdul Majeed T A, adding that all raw ma terials were purchased earlier and random sampling was done to screen items.
There are four members in each squad and officials are available 24 hours a day. “We have been on duty since January 28 and will be there till the Games conclude,“ said Beena V K, assistant commissioner, food safety intelligence, central region.
The squad is also checking the 13 hotels where participants and other officials are accommodated.
“These hotels, as well as two places, where the catering agency prepares food are under our observation. Earlier, we had finished pre-inspection procedures,“ said K Ajith Kumar, assistant food safety commissioner, Ernakulam.
Implementation of Food Safety Act tardy in J&K: SC
‘Expedite trial against erring companies in food adulteration case’
JAMMU, Feb 8: In an embarrassing situation for the concerned authorities in Jammu and Kashmir, Supreme Court has observed that implementation of Food Safety and Standards Act has been tardy in the State and has sought detailed report from the Government in this regard.
This observation was made by the Apex Court of the country while hearing Special Leave Petition (SLP) filed by Kashmir valley based Khyber Agro Farms Pvt Limited and connected applications arising out of order passed by J&K High Court in a Public Interest Litigation (PIL) on food adulteration.
The J&K High Court had imposed Rs 30 crore penalty on three companies including Khyber Agro Farms Pvt Limited after their products were found unfit for human consumption as per the reports of Central Food Laboratory, Kolkata.
After hearing counsels for all the parties in these SLPs, a bench of Apex Court comprising Justice Ranjan Gogoi and Justice C Nagappan observed, “it has been brought to our notice that the implementation of the provisions of the Act in the State of Jammu & Kashmir has been somewhat tardy”.
“If the Act is in force in the State, there must be strict implementation and the State Government must ensure the same”, the bench said, adding “when the matters come up on the next date, the State of Jammu & Kashmir will file a report before this court with regard to the state of implementation of the provisions of the Act including the manpower available to ensure such implementation”.
Stating that the Special Leave Petitions (SLPs) will remain pending, the Apex Court said, “the interim orders passed in the present Special Leave Petitions will remain in force. It will naturally be open for the Authorities under the Food Safety and Standards Act, 2006 to take such action as may be warranted in law from time to time”.
“The trial against the petitioners under the provisions of the Act, which are stated to be presently pending, shall be expedited and completed within an outer limit of six months”, the bench directed, adding that the matters be listed after the trials against the petitioners in the present Special Leave Petitions are concluded.
“Needless to say, the trial court will conduct the trial and conclude the same without, in any manner, being influenced by any finding, observation or view that has been recorded by the High Court in the orders dated 30th January, 2014, 13th February, 2014 and 24th March, 2014 in the Public Interest Litigation No.1 of 2012”, the Supreme Court further directed.
It is pertinent to mention here that for effective and smooth implementation of Food Safety and Standard Act 2006 in Jammu and Kashmir, the State Government in the month of July last year had constituted a Steering Committee headed by the Chief Secretary as its Chairman.
The eight-member committee comprises Administrative Secretaries of Health and Medical Education, Rural Development, Housing and Urban Development, Consumer Affairs and Public Distribution an Law Departments, Controller Drugs and Food Control Organization, J&K and Deputy Commissioner of Food Safety Kashmir/Jammu.
However, according to the official sources, much headway could not be made in the implementation of the provisions of the Act although some steps were initiated in this regard following strictures from the State High Court in the PIL on food adulteration.
In the capital cities, food adulteration is still continuing particularly on festive seasons due to lack of vigorous campaign in this regard from the concerned authorities.
UNHYGIENIC CONDITION IN PRIVATE SLAUGHTERHOUSE - Role of animal husbandry, food safety, MC officials under scanner
The role of officials of the Animal Husbandry Department, Food Safety Standard (FSS) and Municipal Corporation (MC) is under the scanner for giving a free run to a Shoghi-based private slaughterhouse. Two recent joint inspections during the bird flu scare has exposed that the slaughterhouse is not being run as per FSS norms as reports have pointed out blatant shortcomings there.
The six-member team’s report of the slaughterhouse, run by the Goels Food World, Shoghi, which is with The Tribune, revealed that the slaughterhouse was compromising on health and hygiene as 20-30 dead birds were lying on the dirty floor. Also, the slaughterhouse had no rendering facility.
Besides, the staff used no protecting gears and thhe effluent treatment facility was non-functional. It had no veterinarian to conduct the ante-mortem and post-mortem of the birds and cull the dead or unfit birds, the inspection revealed. Though the slaughterhouse was being run since 2006, the unit was registered as a food technology unit.
The inspection was carried out on August 6, 2014, and followed by another inspection on December 27, which found similar shortcomings.
The report also exposed the paperwork being done by the government agencies. The six-member team included officials from the Animal Husbandry Department, MC, veterinary officers, Pollution Control Board, but no official from the Directorate of Health and the FSS was involved.
Neither the MC-run slaughterhouse here nor the private slaughterhouse was quarantined for bird flu, as mandated under the FSS rules and WHO norms for bird and swine flus, revealed health experts.
The Municipal Commissioner, Shimla, said they had issued a notice to the private operator to stop the unethical practice of selling uncertified meat in the municipal limits after the joint inspection report pointed out the shortcomings at the slaughterhouse. “We have set up a modern slaughterhouse and monitor it daily but we cannot check the private one directly as it falls outside the limits of the corporation,” he added.
The operator of the private slaughterhouse had procured a health certificate signed by a veterinary doctor, Dr Ashish H Deogade, on December 30, 2014. It stated that 4,076 birds were fit for human consumption, though it was mandatory that the certificate is issued on a day-to-day basis by the government agency, as per a recent direction of the apex court on slaughterhouses, claimed veterinary experts.
Dr KS Pathania, Director, Animal Husbandry, said he was not aware as to who had authorised the private veterinarian to issue health certificate and the matter should be probed. But the department had asked the Goels Food World to employ full-time veterinarian registered with the veterinary council of HP and improve hygiene. However, it has got no response from the owner so far, he added.
When Naveen Goel, who runs the private unit, was quizzed about the condition of the slaughterhouse, he claimed that they had a full-time veterinarian and supplied healthy meat. “We are adding an AC van for supply, an effluent treatment plant and are improving shortcomings pointed out in the inspection,” he added.

FDA busts milk adulteration racket in Mira Rd, 2 held
The Thane unit of the Food and Drug Administration (FDA) busted a gang involved in milk adulteration at two places in Mira Road early on Friday morning.
While two people identified as Ramana Papakpoli Shetty and Majgiri Kobal were caught red handed, the FDA team seized 131 litres of adulterated milk.
Acting on a tip-off, a FDA team led by Food Safety Officers Manek Jadhav and Gopal Mahore carried out simultaneous raids at two residential apartments in Nutan Complex and Shanti Nagar area of Mira Road at about 6 a.m. on Friday.
According to FDA officials the accused would buy branded milk packets from distributors. They would then remove about 100 to 200 ml milk from each packet and then refill it with tap water before sealing it using hot wax.
"The drive to flush out the unscrupulous elements from the region will continue, however citizens too should check the seal of milk packets before consuming,” appealed FDA officials.
The duo who are presently in the custody of the Mira Road police have been booked under the regulations of the Food Safety and Standards Act,(FSSA) 2006, and relevant sections of the IPC.
The samples of the adulterated milk has been sent for lab testing.
Plea to protect salt industry
The Tamil Nadu Foodgrains Merchants Association has appealed to the Food Safety Commissioner, Kumar Jayant, to protect the Tuticorin salt industry by instructing Food Safety and Standards Act officials not to initiate action against salt manufacturers till the standards are revised as per Tamil Nadu’s climatic and environmental conditions.
In a memorandum submitted to the Commissioner, the president of the association, S. P. Jeyapragasam, pointed out that salt producers followed different procedures in Gujarat and Tamil Nadu. In Gujarat, salt was produced directly from seawater whereas producers used seawater pumped from borewells in Tamil Nadu. Sodium chloride content in Gujarat salt was 96 per cent and it was 92 per cent in Tuticorin salt. As the Act specified 96 per cent as sodium chloride content in salt, Food Safety and Standards Act officials initiated action against Tuticorin producers for ‘substandard’ salt. Mr. Jeyapragasam said that around 50,000 families were dependent on the Tuticorin salt industry, which was spread over an area of 25,000 acres.
The association also drew the attention of Mr. Jayant to the difficulties faced in processing coriander. Traditionally, traders fumigated coriander using sulphur to remove insects. As a result of this, sulphur content would be high in coriander immediately after fumigation. But coriander powder was used for cooking only after it was pulverised. As officials did not allow the use of sulphur, the coriander trade in Tamil Nadu and Kerala was affected with the entry of the commodity from Maharashtra and Karnataka. It appealed to the Commissioner to allow fumigation of coriander using sulphur till such time an alternative was found for fumigation.

HC asks govt to file affidavit on qualification of food inspectors
JAIPUR: The Rajasthan High Court on Thursday asked the government to file an affidavit before it stating that the food safety officers in the state are fulfilling the required qualifications to tackle the menace of food adulteration. This came after a report by the state government stating there were no cases of synthetic milk being sold in the state but only cases of sub-standard (milk mixed with water) being sold.
A division bench of acting Chief Justice Sunil Ambwani and Prakash Gupta issued the order while hearing a petition on the reports of milk adulteration in the state. The court had taken suo motto cognizance of the report in 2005 following reports that synthetic milk was being sold in the state and issued notices to all the 33 district collectors and CMHOs to file reports after taking random sample tests.
The report was submitted in the court on Thursday by additional advocate general Dharam Veer Tholia. He said not a single case of synthetic milk was reported in the samples collected by a special team constituted for the purpose. However, it said a few cases of sub-standard milk (milk mixed with water) and misbrand (no proper display of manufacturing and expiry etc) was found.
The court also asked why there is no food safety appellate tribunal in the state. Then Tholia replied that the government could not constitute the tribunal as the high court has not appointed the presiding officers for the tribunals.
The court-appointed counsel for petitioner Dr P C Jain then raised the issue of qualification of the food safety officers. He said the food safety officers are not adequately qualified to tackle the issue of adulteration and the court asked the government to file the affidavit on March 26.

Bird Flu Scare Brings Out The Poor Quality Of Poultry
Bird Flu Scare Brings out Poor Quality of Poultry
According to World Health Organization (WHO) most bird flu viruses do not infect people except the A (H5N1) and A (H7N9) viruses. Though some new virus have been discovered yet the most common virus that infects human being either from dead or alive poultry is the A (H5N1) and A (H7N9) so controlling the disease in birds is important. However, people need to understand that the disease mostly spreads from poultry to poultry. The virus can infect only those people who are in direct contact with the infected birds. The disease rarely spreads from one person to another. Most cases of bird flu in humans are a result of direct contact with the infected birds or surfaces that are contaminated with secretions or excretion from infected birds.
Bird flu has been reported from all over the world particularly from China (Hong Kong), Japan, Britain, USA, Egypt, Germany, Italy and Libya. Japan and Hong Kong have culled lakhs of birds. China and India have both banned the import of poultry from the USA. In India Kerala culled 3lakh ducks followed by Chandigarh where the ducks in the Sukhna Lake were found to be infected with the A (H5N1) virus strain. While Tamil Nadu stopped the inflow of poultry from Kerala Uttar Pradesh stopped inflow of poultry from other states.
Since Chandigarh is close to Simla, the death of 300 chickens the fear of the spread of bird flu gripped them even though later the birds tested negative for bird flu. However, the bird deaths brought to light how Health, Food Safety Standard (FSS) Regulatory Authority, municipal bodies and Animal Husbandry Department are playing with consumers’ health.
Since Himachal has put chicken and meat on the essential commodities list, it falls on the Food Safety Authority to ensure quality supply of these items but consumers say that their health is being endangered as there is no mandatory testing and checking as required under the Food Safety and Standards (FSS) Act, 2006. Private suppliers have a free hand as they are not checked by authorities and so they supply cheap and poor quality chicken to make quick money. They are also breaking all health and safety norms as they
- Get certificates from unauthorized veterinarian doctors
- Transport meat in pick-up vans, packed in unhealthy gunny bags instead of chilled vans
- Do not cull birds imported from Haryana and Punjab even for three bacterial infections, and use chemical sprays to de-feather the birds
Since chicken supplied from Municipal slaughterhouses is 15% to 20% higher, the shopkeepers also do not care and mix both good and bad quality chicken for selling to consumers. In Himachal the Directorate of Health Safety and Regulation is responsible for implementing the Prevention of Food Adulteration Act, 1954, and Rules 1955 and Food Safety Standard Act, 2006.
Food Safety officials say that it is the responsibility of the district administration to check all slaughter houses including the MC ones. This case may be related to Simla only but the story can be true for most of India as the condition of slaughterhouses and irregularities is a common factor in many other states in India.
According to health experts, lack of information and knowledge about the virus is adding to the scare. Though duck consumption dropped in Kerala there is no need to panic as Kerala has taken all steps to curb the spread of virus. The samples from Himachal were not found to be infected.
Poultry in Chandigarh is also unaffected and is safe for consumption. The government has taken all possible precautionary measures to check any spread of virus in birds and all is under control say officials.
Health organizations like the WHO, FDA and AIIMS in India support the evidence that bird flu cannot be spread by cooking food. However, those food business operators, who serve cooked poultry in their restaurants and catering businesses, must ensure that meat is not left partially cooked or served raw. Experts say, poultry should be cooked for at least half an hour at 70°C so it is safe for consumption.
Food Safety & Standards Regulations mentions; Paultry should be cooked thoroughly (core temperature 75° C for at least 15 seconds or an effective time/temperature control e.g. 65°C for 10 minutes, 70°C for 2 minutes).
Here are some tips given by Centers for Disease Control and Prevention that FBOs can follow in order to ensure they are serving the consumer disease free meat and eggs. Ensure that your employees are following these precautions.
- Wash hands for 20 seconds with soap and warm water after handling raw poultry and eggs
- Clean cutting boards and other utensils thoroughly with soap and hot water so that poultry does not contaminate other foods
- Use cooking thermometer to make sure poultry is being cooked at 75°C s consumers are likely to prefer that poultry is cooked at a higher temperature. Eggs should be cooked till the whites and yolks are both firm

U.S. FDA Commissioner Margaret Hamburg to step down
WASHINGTON (Reuters) - Dr. Margaret Hamburg, who as commissioner of the U.S. Food and Drug Administration (FDA) for almost six years has overseen public health initiatives ranging from tobacco control and food safety to personalized medicine and drug approvals, is stepping down, the agency said on Thursday.
Hamburg, one of the longest-serving FDA commissioners in the modern era, told Reuters in an interview that her decision was prompted by the heavy demands of the job and the sheer length of time she has held the position.
"This is a very challenging job full of opportunities to make a huge and enduring difference," she said, "but it is 24/7 and there are really really difficult decisions to make."
The 59-year-old, nominated by President Barack Obama and confirmed by the U.S. Senate in May 2009, was last year named the world's 51st most powerful woman by Forbes magazine.
Hamburg's resignation comes at a crucial time for the FDA as Congress pushes initiatives to speed new drug development, and food safety advocates, backed by Obama, back the creation of a separate agency combining the food safety functions of the FDA and the U.S. Department of Agriculture.
Under Hamburg, the agency introduced multiple measures to speed new products to the market. In 2014, the FDA approved 51 new therapies, the most in almost 20 years. In a blog post on Wednesday, Hamburg called the achievement "a testament ... to FDA's innovative approaches to help expedite development and review of medical products that target unmet medical needs."
A spokesman for the White House, Josh Earnest, told reporters at a briefing that Obama's nomination to replace Hamburg would have impeccable scientific credentials and merit bipartisan support. The nominee must be confirmed by the Republican-controlled Senate.
Late last month, the agency named Dr. Robert Califf, a prominent cardiologist and researcher from Duke University, to oversee its drug, medical device and tobacco policy. Califf is viewed by many as a potential successor to Hamburg, whose resignation takes effect in March.
Dr. Stephen Ostroff, the FDA's chief scientist, will fill Hamburg's position until a new commissioner is named.
CAREER IN PUBLIC HEALTH
A long-time public health official with extensive experience fighting AIDS and tuberculosis, Hamburg, who graduated from Harvard Medical School, previously served at the National Institutes of Health before becoming New York City's health commissioner. That public health focus endeared her to patient advocates.
"Commissioner Hamburg, from day one, has been committed to being a champion for patients," said Ellen Sigal, founder and chair of Friends of Cancer Research. "She has fostered the growth of science and innovation across the agency and really changed how FDA and industry collaborate."
Under Hamburg, the FDA, which oversees products representing more than 20 cents of every dollar spent by U.S. consumers, has proposed measures to improve nutrition by limiting dangerous trans-fats in food and requiring restaurants to post calorie counts on menus. It also has beefed up inspections of food and drugs from overseas.
"She really had an active and visible role on the global stage not only from a medical products perspective but from a food safety perspective," said Erica Jefferson, former acting assistant commissioner for media affairs.
During her tenure the FDA has confronted major public health issues, including the rise of antibiotic-resistant bacteria, the abuse of opioid painkillers, the emergence of electronic cigarettes and the outbreak of Ebola and other infectious diseases.
Her ride has not always been smooth. She faced hostile questioning by Republicans in Congress following a fungal meningitis outbreak in 2012 that killed dozens of people and sickened hundreds more.
In 2011, then Health and Human Services Secretary Kathleen Sebelius overruled the FDA's decision to allow an emergency contraceptive known as Plan B to be sold over the counter to young teenagers. Hamburg insisted Plan B was safe for use and it was approved two years later.
Hamburg, whose mother was the first African-American woman to earn a degree from Yale University School of Medicine, was never a crusading commissioner in the way of one of her predecessors, Dr. David Kessler, who fought to bring tobacco under FDA regulation. The FDA eventually gained authority over tobacco in 2009.
Hamburg's tenure has disappointed some drug watchdogs, who say the FDA has too often succumbed to industry pressure.
"Throughout Hamburg's tenure, the FDA has grown even more cozy with the industries that it regulates," Public Citizen said in a statement.
Yet it was Hamburg who, in 2011, revoked approval for Roche Holding AG's drug Avastin as a treatment for metastatic breast cancer after the company failed to prove that the benefits outweighed the risks. The drug remains on the market for certain types of colon, lung, kidney and brain cancer.
And she began a crackdown on poor-quality generic drugs and drug ingredients from India, China and elsewhere.
FSDA TN seizes 58 bottles of popular powdered health drink, soft drinks
As part of a food safety campaign, Food Safety and Drug Administration (FSDA), Tamil Nadu, conducted several raids and patrols in Coimbatore and Namakkal districts of the state recently, seizing food products past their best before dates, sold in both retail and wholesale shops, and warning outlets maintaining poor hygiene. Most of the confiscated items were beverages, which included powdered health drinks and soft drinks.
While 58 canned bottles of a popular powdered health drink, well past their best before dates, were confiscated from Coimbatore, FSDA raided and seized soft drinks from Namakkal district. During the campaign, some bakery items past their expiry dates were also found.
The FSDA explained it as a continuous process that started after receiving complaints and conducting investigations. According to FSDA, there is a tendency to sell food items past their best before dates at a discount to minimise losses. But under the regulations of FSSAI, selling of any food products past their best before dates can invite fine or punishment.
Hygiene was another problem reported by designated officers from the field. They alerted food business operators, especially, bakeries, to ensure necessary hygiene in the premises.
Kumar Jayant, commissioner of food safety, Tamil Nadu, said, “FSDA of Tamil Nadu is conducting raids and patrols in different parts of the state to check food safety, as part of a continuous process started after consumer complaints and departmental investigations. Every district designated officer is directed to conduct immediate and secret raids, according to the investigation reports and complaints received in each district.”
K Tamil Selvan, FSDA district designated officer, Namakkal, said, “Our team is conducting continuous patrol and raids in different parts of the city as per complaints and investigations. We alerted bakery business operators about the hygiene and products sold from their shops to avoid adulteration and selling expired food products.
Only 40 per cent of food business operators obtain licence
A day after the deadline for obtaining licence and registration certificate by Food Business Operators (FBOs) was extended till next year, only 40 per cent of the FBOs have completed the procedure in the district
As per the Food Safety and Standards (Licencing and Registration of Food Business) Regulations, 2011, it is mandatory that traders whose annual turnover is less than Rs. 12 lakh need to obtain registration certificate from the District Designated Food Safety Officer by enclosing a challan for Rs. 100 along with the application. Traders whose annual turnover is more than Rs. 12 lakh has to obtain licence by paying Rs. 2,000 or Rs. 5,000, depending upon the productivity.
There are about 28,000 food business operators in the district. But so far, after the online system was introduced in July 2013, only 1,790 have obtained licence while 9,565 have received registration certificates.
Operators include all food manufacturers, hotels, restaurants, food transporters, wholesalers, distributors and food processing units.
After the Act was implemented from August 5, 2011, operators were asked to complete the procedure within a year.
But they were given three extensions with final deadline given till February 4, 2015.
But operators are reluctant to go for licence or registration as they fear of inspections by Food Safety officers.
Adulteration in food items, use of banned chemicals and violation of the act by many operators continues in the district and hence operators are avoiding the procedure.
Banned tobacco products seized
Food safety officers displaying banned tobacco items which were seized in Udhagamandalam on Thursday.
With complaints relating to the availability of banned tobacco products in various parts of the district mounting, officials of the Food Safety Department cracked down on a wholesale outlet inside the municipal market here on Thursday.
They found banned tobacco products worth Rs. 45,000 in the shop.
Stating that they were seized and destroyed, Food Safety Officer D.Sivakumar told The Hindu that the raid followed a tip-off. Pointing out that it was one of the biggest seizures, he said that without the cooperation of people, the ban could not be enforced effectively.
People should come forward to expose violators.
He added that surprise checks would be carried out frequently.

Stern action:Food safety officials examine an illegal mineral water making plant in Erode on Thursday.
The plant was operating during night hours
Officials of the Bureau of Indian Standards (BIS) sealed a water plant located at Lakshmi Narayanan Nagar in the city limits on Thursday.
The owner had reportedly ran away after learning about the inspections being conducted a team of BIS officials from Coimbatore.
The BIS team recommended the Food Safety Department to initiate appropriate action since the plant was functioning without ISI certification.
According to a senior official of Food Safety and Drug Administration, the plant was functioning unauthorised after its failure to secure an ISI certification. The unit had been operating during night hours, the official said. The plant was one among the seven units that were ordered to close down during an inspection last year. The other units had revived production after securing the ISI certification, officials said.

Food safety hit: Govt extends regn deadline again
Chennai:
Despite protests from consumer activists, the Food Safety and Standards Authority of India (FSSAI) has extended the deadline for food outlets to enroll with the food safety department till August 4, 2015.The earlier extended deadline expired on Wednesday .
The Food Safety and Standards Act, 2006 has set new licensing and registration norms for food businesses -hotels, restaurants, canteens, hostels, roadside eateries, dairy shops, tea shops, meat shops, juice shops and vegetable and fruits vendors.
The latest extension is the fifth since the implementation of the act on August 5, 2011. Bimal K Dubey , director (enforcement) said they have received several representations from food operators to extend the deadline for obtaining the license and registration by another year. “But we have decided to extend the deadline by six months, up to August 4, to ensure more food businesses to renew or convert existing licences or registrations.“
As per the act, a licence is compulsory for any food business with an annual turnover of more than `12 lakh. Those with a lower turnover must register with the state food safety de partment.
While traders welcomed the extension of the deadline, consumer activists said the extension could not be justified. T Sadagopan, a consumer activist said FSSAI is diluting the importance of the act. “The lethargic attitude of government has resulted in poor enforcement. The enrollment of food operators will remain low if there is no enforcement by authorities.“
Tamil Nadu Hotels Association Secretary R Srinivasan said only 20% of the food operators in the state have been enrolled under the Act. “We have been asking the government to amend the existing act in consultation with food operators. Many provisions in the act are not suitable for Indian conditions.“
Statistics show less than 10,000 of the 50,000 restaurants in the city have enrolled with food safety department. A food safety official admitted that numerous extensions have dampened the spirit of the act.
