Food Safety Officer R.V. Ravi inspecting a bakery in Udhagamandalam on Monday.
Officials from Food Safety and Drug Administration Department in The Nilgiris conducted a surprise raid in the baking and manufacturing units of two bakeries in Udhagamandalam on Monday and destroyed baked items prepared and kept under unhygienic conditions.
Food Safety Officer for The Nilgiris R.V. Ravi said that the raid was conducted based on complaints from public that ‘varkey’ and other bakery products such as cakes were made under unhygienic conditions and that it posed a threat to public health.
On Monday, the raid was conducted in two manufacturing units at Bombay Castle area in the town.
The units had their bakeries at another place in the town. “We found the raw materials and products kept in poor conditions and destroyed the raw materials and finished items,” he said.

Pin in burger, Wendy's faces food safety issues

After a customer allegedly found a worm in a Wendy's burger a few months ago, the US-based chain recently had another customer, who allegedly discovered a pin in a burger patty served at its store in Gurgaon.
NEW DELHI: Wendy's, one of the world's largest burger chains, has run into food-safety issues here after opening its first restaurant in Gurgaon. After a customer allegedly found a worm in a Wendy's burger a few months ago, the US-based chain recently had another customer, who allegedly discovered a pin in a burger patty served at its store in Gurgaon. Wendy's said the issue was brought to their notice and was resolved.
"Nothing is more important than the quality and integrity of our food, we follow stringent procedures and supplier protocols. This was brought to our attention some time ago and was fully resolved at that time," said a Wendy's spokesperson to a questionnaire sent by TOI.
After the worm issue, problems for Wendy's started when a 24-year-old man ordered two burgers at its store in Gurgaon's Sector 29. He said he had discovered the pin when he bit into one of the burgers.
"The pin was in my mouth and by the time I realised, it had broken into two," he said. "The Wendy's management was very nice and they assured me that such an incident would never happen again. They were in touch with me even after the incident."
When asked whether it has overhauled its back-end operations after the twin x incidents, Wendy's did not respond. It also did not answer queries on its sourcing procedures in India. International burger chains operating in India usually have third party vendors from where they source their ingredients.

Former peanut company CEO sentenced to 28 years for salmonella outbreak

The building of the now-closed Peanut Corporation of America plant is pictured in Blakely, Georgia on January 29, 2009
The former owner of a peanut company in Georgia was sentenced to 28 years in prison on Monday for his role in a salmonella outbreak that killed nine people and sickened hundreds, a rare instance of jail time in a food contamination case.
Stewart Parnell, 61, who once oversaw Peanut Corporation of America, and his brother, Michael Parnell, 56, who was a food broker on behalf of the company, were convicted on federal conspiracy charges in September 2014 for knowingly shipping salmonella-tainted peanuts to customers.
Contamination at the company's plant in Blakely, Georgia, led to one of the largest food recalls in U.S. history and forced the company into liquidation.
U.S. District Judge Louis Sands gave Michael Parnell 20 years in prison. Mary Wilkerson, 41, a former quality control manager at the plant who was found guilty of obstruction, was sentenced to five years in prison.
Stewart Parnell faced life in prison and his brother faced about 24 years.
The Justice Department described Stewart Parnell's sentence as the largest in a food safety case.
Before the judge issued the sentences, Stewart Parnell said; “This has been a seven-year nightmare for me and my family. I’m truly, truly sorry for what’s happened.”
At Monday's hearing in Albany, Georgia, the relatives of several victims described their suffering and asked for stiff sentences.
Jeff Almer, of Brainerd, Minnesota, said his mother, Shirley Almer, died after eating tainted peanut butter in 2009.
"My mother died a painful death from salmonella, and the look of horror on her face as she died shall always haunt me," he said.
"I just hope they ship you all to jail," Almer said.
During the seven-week trial last year, prosecutors said the Parnell brothers covered up the presence of salmonella in the company's peanut products for years, even creating fake certificates showing the products were uncontaminated despite laboratory results showing otherwise.
The Parnells have said they never knowingly endangered customers, and their supporters asked a judge on Monday to show mercy.
"No one thought that the products were unsafe or could harm someone," said Stewart Parnell's daughter, Grey Parnell. "Dad brought them home to us. We all ate it."
An official with the Centers for Disease Control and Prevention testified at the trial that the company's peanut products sickened 714 people in 46 states, including 166 of whom were hospitalized.

International burger chains operating in India usually have third party vendors from where they source their ingredients.
In an interview with TOI earlier, Sanjay Chhabra, director of Sierra Nevada Restaurants, the franchisee for Wendy's in India, had said the company is looking to open 40-50 restaurants in India at a cost of Rs 2 crore each. India's burgeoning $13-billion branded QSR (quick service restaurant) market has attracted nearly all major international burger chains including Johnny Rockets, Carl's Jr, Fat Burger and Burger King, who have come in and opened their stores here. The sector is expected to grow by around 26% year-on-year, according to Crisil.
While Nestle's recent Maggi ban has sparked off food-safety issues here, in markets such as the US, QSR chains have had to pay hefty compensations to consumers for lapses in food-safety. The most memorable incident is the Liebeck versus McDonald's case. In 1992, 79year-old Stella Liebeck bought a cup of take-out coffee at a McDonald's drive-thru in the US and spilled it on her lap. She sued the burger chain as the coffee was not having the prescribed temperature and was awarded around $2.5 million by the jury for punitive damage (burns).

Food safety tools sharpened

The Health Department took a major step forward in the enforcement of food safety regulations across the State when it entered into a memorandum of understanding with the Central Food Technological Research Institute, Mysuru, for enhancing the State’s laboratory capabilities.
Kerala is the first State to enter into a formal agreement with the CFTRI, one of the referral labs for food analysis under the CSIR, for the enforcement of Food Safety and Standards Act (FSSA), Health Minister V.S. Sivakumar, who formally inaugurated the MoU signing function, said.
He said the State would strictly enforce the mandatory FSSA licence/registration for food-related businesses. Anganwadis, school canteens, hostels, and mass feeding or mass food distribution by religious organisations and institutions would be brought under the ambit of the FSSA.
Strict enforcement
The concept of food safety and the public’s right to safe and hygienic food have been gaining much ground in Kerala in recent times, especially after the food safety wing began strengthening the enforcement of regulations guiding food safety, Health Secretary K. Ellangovan said.
An increasing number of judicial pronouncements in recent times in the enforcement of food safety has boosted the awareness of consumers and the confidence of food safety enforcement officials.
Improving labs
Enhancing the capability of the State laboratories in the scientific analysis of food and various aspects of what makes a food safe or unsafe for consumption is thus the natural step forward in ensuring food safety.
Director of the CFTRI Ram Rajasekharan said the State’s commitment to ensuring food safety would inspire others to do more in the area of food safety
Under the terms of the MoU, which will initially be for 18 months, the CFTRI will lend its technical capabilities in modernising and strengthening the State analytical laboratories in Thiruvananthapuram, Ernakulam, and Kozhikode.
Scientists’ training
Over 100 scientists and laboratory staff in the State laboratories will undergo training at the CFTRI, which has the expertise to conduct over 250 chemical and biological tests in the area of food analysis.
Some of the areas that the State food safety wing has specified include tests for detecting the presence of antibiotics/hormones in meat and poultry, formalin, mercury in fish, trans fats and acrylamide in fried foods, and safe limits for food additives/preservatives. The CFTRI will also conduct food-related studies for the State as and when requested.
The MoU was signed by Commissioner of Food Safety T.V. Anupama and CFTRI administrative officer Mallika P. Kumar.

The sinking ship of the desert

"Tourists say that one of the most enchanting experiences you can have in India is to ride through the desert on camel back." Photo of a camel in the Thar Desert.

Despite legal strictures on the slaughter of camels for meat, police turn a blind eye as several animals are killed during the festival of Bakrid
The Indian camel, the single humped or Dromedary, is the pride of Rajasthan and thousands of poor families are dependant on it for their travel across the desert. They are low maintenance animals, subsisting on dry grass and shrubs .
However, this iconic animal is disappearing before our eyes. In Rajasthan the camel has become expensive and rare with less than 50,000 animals and has been declared an endangered species by the International Union for Conservation of Nature and Natural Resources (IUCN).
In some of the more remote villages, camels are still used by the post offices to deliver mail. Camels carts are used to deliver goods, in banking and to draw water out of deep water wells. Entire families and their household equipment migrate on their backs. It is a common sight to see camel caravans with large bags filled with grass used for feeding horses, oxen, water buffalo. Tourists say that one of the most enchanting experiences you can have in India is to ride through the desert on camel back and camp out under the stars.
With falling numbers, the price of a camel has soared and a sturdy male now fetches up to Rs 50,000. In the last ten years, the camel population has reduced by a fourth due to illegal slaughter outside the State during Id-ul-Adha or Bakrid.
The camel is smuggled in large numbers to the States of Kerala, Tamil Nadu, Andhra Pradesh and Karnataka and through Bihar to Bangladesh as camel meat is considered a delicacy. Once a luxury for the rich, over the last few years, the festival demand has become more widespread with an illegal market for camel meat now in Hyderabad to which the Municipality turns a blind eye.
Illegal trade
So how does the camel find its way to the southern markets? The trade is largely controlled by gangs from Bhagpat in Uttar Pradesh. Camels are bought by these traders at weekly bazaars in Rajasthan and even the famed great Pushkar mela, which used to be a celebration of the camel. The animals are then taken by road through Haryana, either on foot or crammed into trucks with their legs tied. In Baghpat, they are slaughtered and the meat sent to Meerut and Hyderabad. I have had occasion to intercept several such animals in Delhi and Jhajjar enroute to Meerut and Baghpat.
Other camels are sent to Bangladesh via Bihar. The traffic before Id is so heavy that every night NGOs such as People For Animals intercept trucks crammed with camels.
Though Karnataka has forbidden the entry of camels, the smugglers bring them in on the pretext of offering children joyrides. The Kerala High Court has ruled that camels are not meat animals and hence cannot be killed and eaten. The Food Safety and Standards Authority of India (FSSAI) has also banned the killing of camels and the consumption of camel meat. But the police turn a blind eye to the groups of camels being taken across India.
The slaughter of camels at Bakrid also contravenes religious injunctions because only the sacrifice of goats is sanctioned. Today it is camels, tomorrow it might become fashionable to kill tigers for this day.
Apart from all the legal reasons the camel cannot be killed for Bakr-Id because:
1) Camels belong in the deserts of Rajasthan. They are marched 2000 kms in a cruel way and can never be called healthy and killing them is thus against Islamic teachings.
2) The Koran allows killing of animals as a justification only for food.
3) One is supposed to befriend an animal before offering it for sacrifice — this is never done for a camel.
4) The killing of a terrified animal is something the Prophet would never allow.
5) Bakrid refers to the killing of a ram by Ibrahim when God replaced the son with a goat. Why kill camels which cannot even be legally eaten?
Tardy courts
The Chief Kazi to the government of Tamil Nadu, Dr Salahuddin Mohammed Ayub, has discussed the issue of banning the slaughter of camels for meat with his congregation and said he was prepared to talk to the government committee organised for this purpose in Chennai. Despite a ruling by the Madras High Court last month setting up a committee to regulate camel slaughter and directing that the committee should hold its first meeting within a week and place preliminary recommendations, the Secretary for Animal Husbandry has refused to convene the committee till after Bakrid — too late for the camels now in Tamil Nadu facing illegal slaughter.
The Rajasthan government in July, 2014 passed an Act declaring the camel a State animal. This was followed in March 2015 with the Rajasthan Camel (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Bill, 2015, which banned the slaughter, trading and unauthorised transportation of camels. No camels can be sold at weekly bazaars and certainly no “farmers” from outside Rajasthan are allowed to buy the animals.
However, everytime illegally transported camels and poachers are caught, the courts intervene to release them — back to the poachers. The seized animals spend a couple of nights in shelters or jails and then, for reasons best known to the judges, are given back to the poachers.
The impact of the loss of camels in India will be most severe on our vulnerable western border in Jaisalmer. This region routinely used by smugglers of drugs and arms is patrolled by the Border Security Force (BSF) which uses camels ideally suited to the terrain. The forces are now finding it difficult to replace ageing animals.
The slaughter of this iconic animal, full of temperament and pride must stop before it is too late. The camel has become another victim to our inability to enforce laws in India.

Food Safety Act is for citizens' benefit, says Bombay HC

MUMBAI: Observing that the Food Safety and Standard (FSS) Act is meant for the benefit of citizens and has direct nexus to right to life, the Bombay high court upheld the constitutional validity of the 2006 law, its provisions and the rules framed under it.
"This is a social legislation and provides for solution to the problems which would be a creation of nobody else but the members of the society,'' said a bench of the HC while dismissing a bunch of petitions filed by restaurant owners and others who challenged the Act for being "violative of fundamental rights to equality, trade and life.''
Association of the Traders claiming to carry on business in various foods, Indian Hotel & Restaurant Association, Mumbai Mewa Masala Merchants Association, a registered Association of the retailers - wholesalers of dry fruits and spices had moved the HC in 2012 to set aside provisions of the Food Safety Act. Though not make clear the foundation of the challenge, the traders said the Act had "vague and excessive'' provisions that affected their business and could be prone to abuse.
The HC found no merit in the challenge but in fact said, "we cannot lose sight of the evil which is sought to be remedied by this Act...Humans have a tendency to deal in food products which would not be safe for human consumption...''
The court suggested that it was "every citizen's fundamental duty to nurture such morals, ideals and discipline'' to eliminate the availability of unsafe food in the market through "sheer social responsibility.'' The court went by the legal concept of construing a law that makes it effective, rather than voiding it. The HC held that every officer and authority in charge of implementing the FSS Act that governs food safety and regulates manufacture, storage, sale and import food safe for human consumption in India have an "onerous responsibility'' and must not derelict either.
The HC said that the Act "serves a pivotal role in securing the citizens a minimum degree of purity in food and preserve public health. It is aimed at preventing fraud on the consumers and those who are guilty of endangering human life by indulging and dealing with the unsafe food are required to be dealt with iron hands.''
"If the provisions intend to curb such social evil, we are of the considered opinion that the challenge as raised by the petitioners on every count ought to fail.''

Bombay High Court upholds the Constitutionality of Food Safety and Standards Act 2006 [Read the Judgment]

In a significant judgment rendered by the Bombay High Court on 16.09.2015, the constitutionality of the Food Safety and Standards Act 2006 has been upheld. Several merchant, traders, hoteliers and dealers in food items had moved the High Court under the collective of associations like ‘The Association of Traders carrying the various business of Food Items’ , ‘Mumbai Mewa Masala Merchants’ Association’, ‘AHAR-Indian Hotels and Restaurant Association’, impugning the provisions of the Food Safety and Standards Act, as ultra vires the Constitution of India.
The essence of the assail against the vires of the Act was that the provisions of the same were vague, abstract and unworkable and that unfetterd and unguided powers were conferred on the authorities under the act which were capable of being put to abuse. It was also urged that the Act suffers from the vice of excessive delegation, as the standards are extensively laid down by Rules and Regulations framed by the executive wing.
At the very outset, the Court observed that the writ petitions were premature and anticipatory in nature, as none of the petitions had factual averments regarding any adverse evil or civil consequences resulting from the implementation of the Act. It was observed that “the challenge to the constitutional validity of the Act must be on the basis of certain and definite set of facts and not on apprehension. The challenge to the constitutionality of the Statute cannot be raised in abstract or vaccum” . Reliance was placed on the decision of the Supreme Court in Sant Lal Bharati vs. State of Punjab (1988) 1 SCC 366 for such proposition.
Nonetheless, the Court proceeded to consider the contetions of the petitioner on their merits. Before doing the same, the legislative background of the Food Safety and Standards Act was examined. It was found that it was an ‘Act to consolidate the laws relating to food and to establish food standards’. The Act was a comprehensive code replacing the earlier legislations covering the field, viz, the Prevention of Food Adulteration Act 1954,and the various orders relating to food products issued under the Essential Commodities Act 1955, which all stood repealed by virtue of Section 97 of the Act. It was found that the the act was a ‘welfare legislation aimed at preventing health hazard which would be caused by consuming adulterated food’ and that the provisions of the Act ought to be construed in the light of its welfare intent and beneficial purposes. Special reference was made to the Preamble of the Act and also to Section 18 thereof enumerating the general principles to be followed in the administration of act, for gathering the intent and object of the impugned statute. Sections 26 & 27, pertaining to the responsibility of food business operators and the lheir liability in case of default, were also adverted to for such purposes.
Before considering the specific contentions of the petitioners, the Court made a reference to the observations of the Supreme Court in State of Uttar Pradesh vs. Kartar Singh AIR 1964 SC 1135 in the context of examining the constitutionality of the Prevention of Food Adulteration Act, the predecessor of the FSSA Act. It was observed therein that the the rule has to be struct down as imposing unreasonable or discriminatory standards, it could not be done merely on any a priori reasoning, but only as a result of materials placed before court by way of scientific analysis. It is obvious that this can be done only when the party invoking the protection of Article 14 makes averments with details to sustain such a plea and leads evidence to establish his allegations.
Setting the tone as above, the contentions were put to juducial scrutiny. Section 31 of the Act was the licensing provision, enjoinig the stake holders of food business to obtain license and registration from the ‘designated authority’. As per Section 36, the said ‘designated authority’ should not be below the rank of a Sub Divisional Officer. The contention was that the Sub Divisional Officer was an authority under the Revenue Code, who lacks proficiency and understanding of the technicalities pertaining to food business, and empowering an officer unaquantied with the scientific and technical aspects of food business was arbitrary and unreasonable, leading to the infraction of Article 14 of the Constitution of India. However, the said contention was repelled holding that Section 36 merely specifies the rank of the designated authority and does not designate the Sub Divisional Officer as the authority. Moreover, Rule 2.1.2 of the Food Safety and Standards Rules framed by the Central Government specifies that the authority shall possess and bachelors degree in Science with Chemistry and ensures that such officers possess requisite knowledge and proficieny. Hence, the apprehensions were rejected as unfounded.
The next contention was the Act contained several undefinied expressions of generic import, like ‘petty manufacturer’, ‘hawker’, ‘itinerant vendor’, ‘temporary stall holder’, ‘tiny business operator’, who were excluded from the requirment to obtain license to indulge in food business as per Section 31. It was contended that such expressions were riddled with vagueness and ambiguities, and were capable of being abused. However, the argument did not receive acceptance by the Court. It was held that the expressions were not vague and ambigous. An Act would not become unconstitutional merely because certain terms and expressions are left undefined. The words contained in the Act are to be understood in the light of the entirety of the Act and with due regard to the ordinary connotatiojn of the words, and the understanding they have in common parlance, and not in isolation. Reference was made to the Constitutional Bench decision of the Supreme Court in Sakhawant Ali vs. State of Orissa AIR 1955 SC 166. Further submissions to the effect that the licensing conditions under Section 31 are rigorous and cumbersome and would bring about a “license raj” were also repelled as untenable.
Also, it was contended that the Act confers excessive coercive powers on the designated authorities and that the same would affect the right to carry on trade and profession and earn livelihood, guaranteed under Articles 19(1)(g) and 21 of the Constitution of India. Section 34 empowered the designated authority to issue emergency prohibition orders and notices which take immediate effect, without issuing any show cause notices. The Court repelled such contentions stating “we are completely in agreement with the contention as urged on behalf of the food authority in para 12 of the reply that Section 34 would be applicable in an emergency which would require immediate solution of a problem where there is a danger of health risk, such as food poisoning or danger of death of the consumers by consumption of adulterated or unsafe food. These provisions are absolutely essential and in such an emergent situation, without these provisions the effective implementation of the legislation cannot be achieved”.
The offences and penalties imposed under the Act were also held to be proper, just and reasonable. Following the law settled by the Supreme Court in Andhra Pradesh Grain and Seed Manufacturers Association v Union of India AIR 1971 SC 2346, it was stated that a statute could provide for absolute and strict liability for an offence without reference to any state of mind like intention, malice, recklessness, negligence or knowledge. A statutory crime need not contain a specific state of mind as is ingredient. It was held that the statute imposing restrictions upon traders will not be deemed unreasonable merely because it makes a departure from the normal structure of statutes enunciating offences and prescribing punishments. The Court also rejected the argument that the adjudicatory mechanism provided under Sections 68 and 70 were not effective. The bar of civil jurisdiction as per Section 72 was also held to be reasonable, as the parties are not left bereft of remedies by the Act as the same provides alternate and efficacious forum for adjudication of disputes.
Taking a cue from the observations of the Supreme Court in Centre for Public Interest Litigation vs Union of India and others AIR 2014 SC 49, the Court held that “the provisions of FSS Act and the Rules and Regulations framed thereunder are required to be interpreted and applied in the light of the Constitutional principles and an endeavour has to be made to achieve appropriate level of protection of human life and health”. Any food article which is hazardous or injurious to public health is a potential danger to the fundamental right to life guaranteed under. It was also observed that the Food Security and Standards Act is a mechanism to implement Article 47 of the Constitution of India, which casts the duty on the State to raise the level of nutrition and the standard of living and to improve public health. Thus it was held that the restriction imposed on the conduct of business by traders in foodstuffs by the provisions of the Act cannot be deemed unreasonable, as the Act was enacted to deal with the great social evil and for ensuring public welfare especially in the offences against public health. It was held that adulteration and misbranding of foodstuffs is a rampant evil and a statute calculated to control that evil is indisputably in the interest of the general public. Thus, the writ petitions were dismissed holding that the provisions as impugned in these writ petitions are legal, valid and intra vires Articles 14 and 19 (1) (g) of the Constitution of India.

How Junk Food Is Killing Kids in Kashmir

With the changing lifestyle and changing food habits among people especially children and youth, the rate of diseases occurrence have shot up from thirty to eighty percent by these trendy habitual eating stuff. According to National Health Cell, junk food is the main cause of different diseases which includes obesity, chronic ailments and kidney disorders.
Fareen Khan, a 12th class student from Tangmarg was admitted in the emergency ward of SKIMS after she complained of severe abdominal pain.
“We admitted her in the hospital as she was in severe pain. She was injected first but the pain did not stop, later on, the doctor advised to put her on glucose drip. The main reason for her frequent abdominal pain is because she takes a lot of junk food like chips and cold drinks,” said Haleema Akhtar, the mother of the patient.
“She eats one to two spicy chips daily which resulted in her frequent abdominal pain. The doctor has advised her to not take such food items as it will cause her more problems”, she added further.
Junk food contains high levels of calories from sugar or fat with little protein, vitamins and minerals. It has little nutritional value and contains excessive fat, sugar, salt and calories which are very harmful for the human body.
Nearly 40000 deaths occur yearly due to junk food and nearly ten lakh people get severe ailments like obesity, heart diseases, stomach ulcers, Kidney stones and even cancers.
“From the last 10 years there is increase in number of patients who are suffering from kidney disorders, abdominal pains and heart ailments and the main reason for occurrence of these ailments is because of changing food habits. Young patients mostly suffer from abdominal pains. There are nearly 5-10 such patients who are admitted in the emergency ward for treatment,” said a doctor at SKIMS hospital.
“A doctor can advise patient not to take such food stuff but he cannot force it on the patient. The people must understand that junk food is not good for our health and there are so many instances where patients have lost their lives. So, people must have to take care of their food habits,” he further added.
A Scripps Research Institute study in 2008 suggested that junk food consumption alters brain activity in a manner similar to addictive drugs like cocaine and heroin.
In 2013 Delhi High Court banned Junk food sale in schools across India. In the judgement Food Safety and Standards Authority was directed to implement its guidelines on making wholesome nutritious food available to school children, but this was implemented only in schools of Delhi and centrally certified schools of other parts of India. In Kashmir there was nothing practical on part of this judgment.
“I know junk food is not good for health but I can’t stop myself from taking it,” said Adfar Masood, an engineering student from Illahi Bagh, Buchpora.
“I am trying my best to minimize the level of taking this food stuff in my daily routine as they cause harmful diseases,” he added further.
Director of SKIMS, Dr. Showkat Zargar, also a well known gastroenterologist of the Kashmir said ,“ yes there is an alarming increase in the number of patients who are mostly of young age suffer from abdominal infections and pains by consuming a lot of junk food which is not good for health. Every year there is sharp increase in number of cancers and other related diseases because of changing food habits among people.”
“Children especially falling in the age group of 5-18 years tend to have more attraction towards junk food. We have to generate awareness at schools, colleges and universities so that students can understand the harmful effects of taking junk food. Parents also should keep off their children from taking such food stuff,” he added more.

Amla drink banned

Amla drink that was manufactured by a private firm in Namakkal and sold across many districts was banned after laboratory test reports found it to be unsafe and substandard.
Recently, the Collector, corporation commissioner and the food safety officer received many complaints that a particular product sold in the market is causing health issues. Based on it, T. Anuradha, District Designated Officer, Tamil Nadu Food Safety and Drug Administration Department, inspected the company’s distribution office on Meyyanur Main Road and took samples. The samples were sent to the Government Food Laboratory at Udayapatti. Reports confirmed that instead of 120 ppm of Benzoic acid that was allowed in ready-to-serve beverages, 950 ppm was present.
Also, the expiry date for the concentrate product was given as six months whereas the expiry date is maximum of one month for the products. Hence, the report declared that the product was ‘unsafe, substandard and misbranding’.
A notice was served to the manufacturer and the distributor asking them to stop production and other activities. They were asked to rectify the defects and submit samples of the products to the Food Safety Officer and based on the reports they would be permitted to re-start production. Since another product, alo vera drink comes under non-standardised FSSR category, they were asked to obtain approval for the product.

Bombay High Court junks challenge to provisions of food safety Act

Recently, three petitions filed by city-based food merchants, traders and hoteliers had called various provisions of the Centre’s food Act.
A MONTH after suffering a judicial setback in the Supreme Court, India’s food regulator received a shot in the arm after the Bombay High Court, dismissing a challenge to several provisions of the Food Safety and Standards (FSS) Act, observed that those who endangered human life with unsafe food should be dealt with “iron hands”.
The SC, last month, had junked an advisory, issued by the food regulator in 2013, which had mandated that manufacturers must take approvals for products already existing in the market.
Recently, three petitions filed by city-based food merchants, traders and hoteliers had called various provisions of the Centre’s food Act “arbitrary” and sought that these be set aside. Their Right to Equality was being violated, they had contended. On Wednesday, Justices S C Dharmadhikari and G S Kulkarni upheld the food Act’s validity in a 109-page judgment.
Justice Kulkarni said, “We cannot lose sight of the evil which is sought to be remedied by this enactment. The mischief which is sought to be remedied is nothing but a sheer creation by us, humans, who have the tendency to indulge and deal in food products which would not be safe for human consumption and/or likely cause a grave impact on human health. Every person, even the person dealing in such unsafe food, is likely to be the victim.”
The legislation, in the court’s view, pertains to food safety and serves a “pivotal role” in securing the citizens a minimum degree of purity in food, and hence, secures public health.
“It is aimed at preventing fraud on the consumers. Those who are guilty of endangering human life by indulging and dealing in unsafe food are required to be dealt with iron hands,” the court observed.
The three petitioners, namely, Association of Traders, Mumbai Mewa Masala Merchants and Indian Hotel and Restaurant Association (Ahar), had moved the HC in 2012, challenging provisions, rules and regulations of the food Act.
The first two petitioners, the court felt, had a common ground — “extensive powers” given to the food authority that violated the petitioners’ rights to operate freely. Their main grievance revolved around the licensing provision of the Act. The food Act’s Section 31 mandates a person to carry out food business only with a license, for which, the person needs to apply to a “designated officer”.
The petitioners claimed that such power given to the designated officer, a sub-divisional officer, was “arbitrary”. They reasoned that merely being a revenue officer meant that the officer was bereft of knowledge about the food business or food industries. The officer could only be entrusted with the work of revenue collection under the provisions of the Revenue law, they claimed.
Another aspect was in relation to the food safety officer. The petitioners claimed that the law provided that if a complainant failed to prove a case against the officer, he had to pay Rs 50,000 to Rs 1 lakh as fine.
Another contention was that a penalty of about Rs 5 lakh could be imposed on business operators for selling food which did not meet quality standards, they added.
Therefore, a penalty could be imposed on the basis of a report prepared by the food safety officer, without giving a showcause notice to the shop owner concerned, they said.
Ahar claimed that each and every provision of the Act was ambiguous, blurring its applicability to hotels and restaurants. The law imposed huge penalties, prosecution and imprisonment and would operate overall on the whims and fancies of the officers appointed under the Act, it said.
The arguments did not hold water with the court. Before dismissing the petitions, the court observed, “The FSS Act has been enacted for the benefit and welfare of the citizens and has direct nexus to the Right to Life as enshrined under Article 21 of the Constitution.”

College Shows Door to Food Supplier

CHENNAI: Following test results that confirmed that the food served at the private canteen for doctors of Madras Medical College situated on the Rajiv Gandhi Government General Hospital premises was of poor quality, the college authorities have cancelled the canteen contract, and have temporarily entrusted the operation of the facility with the State Public Works Department.
The move was triggered by an incident a month ago in which four post graduate doctors of the MMC suffered a bad bout of food poisoning after having lunch from this canteen. Following this, the college authorities filed a complaint with the Food Safety Department officials, who conducted inspection and collected samples that were found to be of poor quality.
“We had collected five varieties of samples from the canteen like sambar, curd and coconut chutney etc that were sent to the King Institute in Guindy for analysis. The results showed that the food was of substandard quality. After discussing the matter with our higher officials, we will initiate steps to sue the contractor,” an official from the Food Safety Department told City Express.
“After receiving the report from the Food Safety Department, we asked the PWD to call for fresh tenders, the work for which is progressing. The building now is under the control of PWD, who are overseeing the functioning,” medical college dean Dr R Vimala said.
According to a PWD official, this is not the first time a canteen contractor has faced action for operating the facility in unhygienic conditions. “There have been instances earlier, too. We had sealed the building twice earlier. But it was soon caught up in litigations, which made it impossible for us to do anything,” the official said.

Telangana, AP List Steps to Curb Artificial Ripening of Fruits

HYDERABAD: Apart from creating awareness about the ill effects of the use of calcium carbide to ripen fruits artificially, the governments of Andhra Pradesh and Telangana have decided to initiate criminal proceedings against vendors using calcium carbide and to cancel their licences.
The AP government has brought the food business operators dealing in fruits business under the purview of Food Safety Regulation, while the Telangana government has decided to punish the erring fruit vendors with imprisonment up to six months and a fine up to Rs 1 lakh.
The two governments filed affidavits before the High Court on Wednesday, explaining the steps taken by them to ensure availability of chemical-free fruits.
While treating a PIL as a suo motu case based on a news item published in a vernacular daily, a division bench comprising acting chief justice Dilip B Bhosale and justice SV Bhatt had earlier directed both states to come up with a comprehensive action plan to curb the menace of artificial ripening of fruits by vendors using calcium carbide.
The Telangana government, in its affidavit, submitted that it initiated two-pronged strategy to curb usage of calcium carbide for ripening of fruits and creating awareness among traders about its ill effects.
Of the 15 samples lifted from the fruit markets of Jambagh, Moazzam Jahi Road and Darulshifa in the city and Gaddiannaram fruit market in Ranga Reddy district, all of them were found unsafe for human consumption. Action against the traders is under process. Another 34 samples were lifted from other districts and they too were found unsafe.
In order to ensure availability of chemical-free fruits, the government has proposed an action plan under the provisions of Food Safety and Standards Act, 2006 which included having posters in major fruit markets indicating that sale of artificially-ripened fruits is an offence punishable with imprisonment up to six months and fine upto Rs 1 lakh, notice to indicate prohibition of sale of artificially ripened fruits, creating awareness about the ill effects of carbide ripened fruits, conducting inspections every month and collection of at least two fruit samples from retail outlets, empowering local bodies to grant or cancel trade license etc., the Telanganae government explained.

FSSAI to conduct study on consumption patterns of caffeine drinks

"Consumption of Caffeinated/Energy drinks in India has shown an upward trend during the past decade"
NEW DELHI, SEPTEMBER 18:
In a bid to review the caffeine standards proposed for energy drinks, the Food Safety and Standards Authority of India (FSSAI) is set to do a study on the consumption patterns of these drinks keeping in mind various target and consumer groups especially to look at addictive behaviour patterns and food safety issues.
The food safety regulator has called for an expression of interest from suitable agencies to conduct this survey. This comes at a time when the food safety regulator had banned several key energy drink brands in the country in May after they were found to have a combination of caffeine and ginseng.
“Consumption of Caffeinated/Energy drinks in India has shown an upward trend during the past decade. FSSAI seeks to undertake a study on the consumption pattern of these drinks among the young people in the country, particularly the school and the college students, young professionals, among others,” the food safety regulator said.
The food safety regulator also said it wants to understand the usage pattern, preferences and attitude of the consumer groups towards their consumption in view of various studies recently conducted internationally in this regard.
As per the proposed draft Standards notified by the food safety regulator, caffeinated beverages are classified as water based non-alcoholic flavoured drinks and, “shall contain more than 145 mg per litre and up to 320 mg per litre total caffeine from whatever sources it may be derived in the formulation of the product.”
In the EOI, the food regulator has identified teenagers and youngsters which includes students, young professionals, managers and office goers in the age group of 15-45 years as target respondents. The FSSAI expects this final study to be submitted by February next year.
