FSSAI launches ‘Food Safety Concern’ to receive complaints about packed food

FSSAI has launched ‘Food Safety Concern’ on its website to receive complaints related to packed food or even food outlets including roadside eateries
FSSAI CEO Pawan Agarwal said the regulator would first forward the complaint to the restaurant or the company and follow up by sending a food inspector.

New Delhi: Upset after finding an insect in your packed food? Or may be the absence of labelling to indicate whether the food is vegetarian or non-vegetarian?
You can do something about it—complain on the website of the food safety regulator, which will ensure swift action.
With a message that safe packed food is every consumer’s right, the Food Safety and Standards Authority of India (FSSAI) has launched a section, “Food Safety Concern,” on its website to receive complaints related to packed food or even food outlets including roadside eateries.
Under this section, a consumer can complain about a product if she finds that its shelf-life had expired, or that it had been adulterated, or didn’t contain vegetarian/non-vegetarian labelling. The presence of dust particles, insects or fungus can be grounds for a complaint too. Consumers can even post a picture of the product with the grievance.
Last week, FSSAI announced a “10@10” programme to promote safe food at all places including homes, schools, offices, eateries and even religious places while commemorating the 10th anniversary of the Food Safety and Standards Act 2006.
It announced that it will launch 10 new initiatives that seek to connect people of all age groups for ensuring safe food. Giving citizens a voice and a transparent system to register their complaints is part of that programme.
“This is among one of the 10 initiatives that we launched last week and herein our focus is consumer outreach. It’s a big step towards involving public at large and it is the first time that such a step is being taken,” said Pawan Agarwal, chief executive officer (CEO) at FSSAI.
Agarwal said the regulator would first forward the complaint to the restaurant or the company named in it and follow up by sending a food inspector to the premises of the alleged offender.
“Over the time with a large number of complaints, a database would be created and we would get a general trend about a particular place or kind of food. That trend will also help us in carrying out inspections. We will also note how restaurants and companies are responding to consumers’ concerns,” Agarwal added.
FSSAI has been actively trying to enforce food safety regulations in the past year or so. It started with a ban on Nestle India Ltd’s Maggi noodles in June 2015. It also said it was examining the possibility of regulating quality of water piped to household taps to hold municipal authorities and agencies such as state water supply boards accountable for the quality of water they supply.
In May, the food regulator banned a potentially cancer-causing chemical, potassium bromate, used widely as an additive in brands of packaged breads and the bread used in ready-to-eat burgers and pizzas. The FSSAI decision came after a study by the Centre for Science and Environment (CSE) named it as one of two chemicals that could cause cancer.

Himalayan Blues water bottles banned

GUWAHATI, Sept 2: Himalayan Blues (with added minerals), a packaged drinking water, has been declared unsafe for human consumption by the food analyst to the Government in terms of the provisions of the Food Safety and Standards Acts, 2006. 
The sample of Himalayan blues (with added minerals) packaged drinking water is microbiologically unsatisfactory with respect to total viable colony count at 37°C in contravention to standard as laid down in Regulations of the Food Safety and Standards (Food Products Standards and Additives) Regulations, 2011 and declared un-safe in the interest of public health, a press release said. 
The notification issued by the Commissioner, Food Safety, Assam prohibit the manufacture, storage, distribution and sale of Himalayan Blues (with added minerals) Packaged Drinking Water manufactured by Himalaya Drops, Village-Ratanpur, P.O. Digheli, district Nalbari, Assam. The designated officers, Food Safety of the districts are directed to strictly enforce this prohibition.

Trichy railway station food vendors briefed on hygiene, quality


Trichy: The commercial department of the Trichy railway division, in association with the health department, conducted a training programme here on Thursday for food and beverage vendors and license holders who are running food stalls on the premises of the Trichy Junction railway station on maintaining quality and hygiene in food products.
According to officials, there are around 70 licence holders in the station and more than 200 vendors have been engaged with each licensee. The chief aim for holding the training was to give a clear picture of what they are and what they really should be, officials said.

Excise Officials Raid Liquor Chocolate Manufacturer In Hyderabad

FSSAI had banned liquor chocolates in 2015.

HYDERABAD: Excise officials today raided a liquor chocolate manufacturing facility in Hyderabad.
Acting on a complaint that liquor chocolates was being manufactured in violation of rules, the excise officials conducted checks at a facility in Mallepally. They also seized liquor bottles in large numbers during the raid.
The Excise Department has identified about 100 companies that are manufacturing liquor chocolates in and around Hyderabad. Sources said they would be served notices.
Many chocolate cafes in the city sell liquor chocolates, the sales for which pick up during the festive season.
The manufacturers and sellers came under the scanner of the department in the wake of recent clarification by the Food Safety and Standards Authority of India (FSSAI) that liquor chocolates are strictly prohibited in India and its sale is illegal.
FSSAI has classified chocolates into eight varieties in which liquor chocolates are not included.
The FSSAI also clarified that even imported chocolates containing alcohol is not permitted in Indian markets.

போதை நெடி
கிருஷ்ணகிரி மாவட்டம் காவேரிப்பட்டணத்தை சேர்ந்தவர் வெங்கட். இவருக்கு சொந்தமாக காரிமங்கலம் அடுத்த கேத்தனஅள்ளி பிரிவு ரோடு பகுதியில் 6 ஏக்கரில் மாந்தோப்பு உள்ளது. இந்த தோட்டத்தில் கடந்த சில மாதங்களுக்கு முன்பு தீப்பெட்டி தொழிற்சாலை அமைப்பதாக கூறி கட்டிடம் கட்டப்பட்டது. இங்கு அந்த பகுதியை சேர்ந்த ஆண்களோ, பெண்களோ யாரும் வேலைக்கு செல்லவில்லை.
இதுகுறித்து பொதுமக்கள் விசாரித்த போது பீகார் மாநிலத்தை சேர்ந்த 20–க்கும் மேற்பட்டோர் பணியில் ஈடுபட்டு வருவது தெரியவந்தது. மேலும் அந்த தொழிற்சாலையில் இருந்து இரவு நேரங்களில் போதை நெடி வீசியது. இதுகுறித்து பொதுமக்கள் தர்மபுரி மாவட்ட போலீஸ் சூப்பிரண்டு பண்டி கங்காதருக்கு தகவல் தெரிவித்தனர். இதையடுத்து அவர், கலெக்டர் விவேகானந்தன் மற்றும் உயர் அதிகாரிகளுடன் ஆலோசனை நடத்தினார்.
பாக்கு தொழிற்சாலை
இதுகுறித்து விசாரணை நடத்தி நடவடிக்கை எடுக்க தர்மபுரி மாவட்ட உணவு பாதுகாப்பு துறை அலுவலர்களுக்கு கலெக்டர் உத்தரவிட்டார். அதன்பேரில் நேற்று காலை உணவு பாதுகாப்பு துறை நியமன அலுவலர் பிருந்தா மற்றும் அலுவலர்கள், காரிமங்கலம் போலீஸ் இன்ஸ்பெக்டர் கனகேசன் தலைமையிலான போலீசார், அதிரடிப்படை போலீசார் அந்த தொழிற்சாலையில் திடீர் சோதனை நடத்தினர்.
அப்போது அந்த தொழிற்சாலையில் போதை பாக்கு தயாரிப்பது தெரியவந்தது. இதனால் அதிர்ச்சி அடைந்த போலீசார் மற்றும் அதிகாரிகள் மற்றும் போலீஸ் இன்ஸ்பெக்டர் கனகேசன் ஆகியோர் தொழிற்சாலையில் இருந்த வடமாநில தொழிலாளிகளிடம் விசாரணை நடத்தினர். அப்போது இரவு நேரங்களில் போதை பாக்கு தயாரிப்பதாக தெரிவித்தனர். இதையடுத்து சுமார் 5 டன் எடையுள்ள போதை பாக்குகள் மற்றும் போதை பொருட்கள் தயாரிக்க தேவையாக ஒரு டன் புகையிலை தனித்தனி அறைகளில் வைத்து இருப்பது தெரியவந்தது.
பொருட்கள் பறிமுதல்
இதையடுத்து தொழிற்சாலையில் தயாரித்து விற்பனைக்காக வைத்து இருந்த ரூ.50 லட்சம் மதிப்பிலான 5 டன் போதை பாக்கு, போதை பாக்கு தயாரிக்க பயன்படும் 1 டன் மூலப்பொருட்கள் பறிமுதல் செய்யப்பட்டன. மேலும் தொழிற்சாலையில் இருந்த ஒரு வேன், 2 லாரிகளும் பறிமுதல் செய்யப்பட்டன. மேலும் போதை பாக்கு தயாரிக்கும் தொழிற்சாலைக்கு உணவு பாதுகாப்பு துறை அதிகாரிகள், போலீசார் சீல் வைத்தனர்.
இந்த சம்பவம் குறித்து உணவு பாதுகாப்பு துறை நியமன அலுவலர் பிருந்தா காரிமங்கலம் போலீசில் புகார் செய்தார். அதன்பேரில் போலீஸ்–இன்ஸ்பெக்டர் கனகேசன் மற்றும் போலீசார் வழக்குப்பதிவு செய்து விசாரணை நடத்தி வருகின்றனர். காரிமங்கலம் பகுதியில் போதை பாக்கு தொழிற்சாலை கண்டுபிடிக்கப்பட்ட சம்பவம் அந்த பகுதியில் பரபரப்பை ஏற்படுத்தியது.

மாந்தோப்பில் ரகசிய பான் தொழிற்சாலை..! திடுக் ஆய்வு

தருமபுரி : தருமபுரி மாவட்டம் காரிமங்கலத்தை அடுத்துள்ள முதலைப்பட்டி எனும் கிராமத்தில் மாந்தோப்பிற்குள் ரகசியமாக செயல்பட்டுவந்த பான், குட்கா தொழிற்சாலையை அதிகாரிகள் கண்டுபிடித்து சீல் வைத்தனர்.
முதலைப்பட்டி கிராமத்தில் மாந்தோப்பில் பான் மற்றும் குட்கா பொருட்கள் தயாரிக்கும் தொழிற்சாலை ரகசியமாக செயல்பட்டு வருவதாக தருமபுரி மாவட்ட ஆட்சியருக்கு ரகசிய தகவல் கிடைத்ததை அடுத்து, அந்த கிராமத்தில் ஆய்வு மேற்கொள்ளும்படி மாவட்ட உணவுப் பாதுகாப்பு நியமன அலுவலர் மருத்துவர் பிருந்தாவுக்கு கலெக்டர் விவேகானந்தன் உத்தரவிட்டார்.

நாகை மாவட் டம் சீர் காழி அருகே வைத் தீஸ் வ ரன் கோ வில் மேல வீதி யில் ஒரு நாடி ஜோதிட நிலை யம் உள் ளது. இங்கு கேர ளாவை சேர்ந்த ஒரு குடும் பத் தி னர் நேற் று முன் தி னம் மாலை ஜோதி டம் பார்க்க வந் த னர். அப் போது அவர் க ளுக்கு ஜோதி டம் பார்த்த நாடி ஜோதி டர், பரி கா ர மாக 27 பேருக்கு உணவு வழங்க வேண் டுனெ கூறி னார். இதை ய டுத்து ஜோதிட நிலை யத் திற்கு எதிரே உள்ள ஒரு ஓட் ட லில் விளக் கு முக தெருவை சேர்ந்த 27 பேருக்கு உணவு வாங்கி கொடுத் த னர்.
அந்த உணவை சாப் பிட்ட 27 பேருக் கும் இரவு முதல் நேற்று காலை வரை வாந்தி, வயிற் றுப் போக்கு, மயக் கம் ஏற் பட் டது. பாதிக் கப் பட்ட அனை வ ரும் வைத் தீஸ் வ ரன் கோ வில் அரசு மருத் து வ ம னை யில் சேர்க் கப் பட் ட னர். அங்கு அவர் க ளுக்கு தீவிர சிகிச்சை அளிக் கப் பட்டு வரு கி றது.

Intensive drive to ensure food safety

The food safety wing has begun an intensive drive to ensure food safety standards in hotels and restaurants during the festival season.
Following a directive of the Commissioner of Food Safety, the drive will be carried out under K. Anil Kumar, Joint Commissioner of Food Safety (Administration and Legal), D. Ashrafudin (Jt. Commissioner, Enforcement) and G. Gopakumar, who will be in charge of three zones in the State, and will engage 17 squads of food safety officers for inspections.
In Thiruvananthapuram district, 34 food businesses were inspected at Neyyattinkara, Kovalam, Vembayam, Varkala and Killipalam, and the operations of Crescent Hotel at Kowdiar, Madan tea stall at Thycaud, the production unit of MRA Bakery at Killipalam and another bakery unit at Vembayam have been stopped by officials for serious violations of safety standards.
Fine was imposed on 23 eateries and improvement notices were served on 24 others. Officials also destroyed one lot of ‘Bombay Sweet,’ which was found to contain non-permitted or banned synthetic colours, from an outlet at Thycaud.
Similar raids are being carried out by the special squads in all districts, an official release said here on Friday.

Penalty imposed on defaulting Food Business Operators

Two Food Business Operators; one from Kalighat, Diglipur and one from Billiground, Mayabunder were adjudicated for violation of various sections of Food Safety and Standard Act, 2006 by the Adjudicating Officer (District Magistrate), Mayabunder, N&M Andaman. A penalty of Rs.10,000/- was imposed on each Food Business Operator.
Also, three petty Food Business Operators were compounded and a penalty of Rs.1000/- was imposed on each by the Designated Officer (Food Safety), N&M Andaman for contraventions of different sections, rules and regulations of the Act. An amount of Rs.23,000/- in total was realized as fine from the offenders during the month of August.
Further, the Food Business Operators of the district have been advised to strictly abide by the Food Safety and Standards Act, Rules and Regulations made thereunder, and if anyone found violating, will be dealt as per law.

Staff crunch hits Vadodara Municipal Corporation's health raids

VADODARA: While the health department's food safety branch at the Vadodara Municipal Corporation (VMC) may have become aggressive with checking at eateries across the city, it is plagued by vacancies. The department is now looking to recruit more hands, but will still fall short of the required manpower.
The department currently has posts of 10 food safety officers out of which one is vacant. Sources said that as per the norms set by the state government, one food safety officer should be appointed for a population of one lakh. Going by this yardstick, the VMC should have 17 such officials.
Attempts were made to recruit officers as per the standards under the act, but the proposal in this regard did not get through the standing committee of the civic body. A fresh proposal has now been brought to create two more posts of food safety officers. The civic body plans to have one officer for each of the 12 administrative wards in the city. The committee will decide on it later this week.

Awareness-cum-IEC prog by DFSO SA held

On the direction Of Commissioner Food Safety A & N Islands, the District Food Safety Office South Andaman organised an awareness-cum-IEC activities at Panchayat Samity Hall, Hut Bay, Little Andaman, on 28/08/2016 for the food business operators (FBOs) of the Grain Dealers Association and Mid Day Suppliers of Little Andaman. The programme started at 1000 hrs and 1500 hrs respectively. In the meeting of Grain Dealers wherein 130 persons attended. The assembled gathering was apprised of the various provisions of the Food Safety and Standards Act, 2006 Rules and Regulations, 2011. On the same day another meeting of mid day suppliers were conducted, wherein 39 persons attended the programme. The participants were informed about the various provisions under the Act as well as precautions to be taken care off in the procurement, storage, preparation, serving, washing and all other food safety aspects related to Mid Day Meal Schemes.
In another meeting, on 29th August’ 2016 at 1000 hrs at the same venue, a first of its kind meet in A & N Islands was conducted on the request of M/S Riflex Industries involved in manufacture, sale and distribution of desiccated coconut powder located in different locations of A & N Islands. The workers of the industry had attended awareness cum IEC programme, on various aspects of food safety to be followed in food industry as per the Food Safety Act’2006, Rules & Regulations’ 2011. This exclusive programme conducted for the management and their employees at Unit-1 located in Hut Bay, Little Andaman, wherein 58 persons participated the programme. The participant keenly involved in a group discussion on the entire process of the making of desiccated coconut powder and their active participation made the meet very successful.
The meeting was conducted by the Food Safety Department, South Andaman and the programmes were supervised by Shri. Mammen Abraham, District Food Safety Officer, South Andaman and managed by Smt. Sangeeta Naseem, Shri. Tahseen Ali and Shri S.S. Santhosh, Food Safety Officers alongwith Shri Ravi Kumar, Helper.
The Food Business Operators have been advised that if they are interested in conducting awareness camps for their benefit may kindly contact the District Food Safety Officer, South Andaman with their demands. The department may be contacted for all food safety related matters at telephone number 03192-231024 on all working days from 0900 to 1700hrs.

‘Serve quality food’

The Tamil Nadu Food Safety and Drug Administration Department would conduct a meeting on September 1 asking the hostel wardens and managers at private college hostels to ensure quality food served to students.
District Designated Officer M. Kavikumar said that as per the Food Safety and Standards Act, 2006, quality food should be prepared and served to the students in educational institutions. Also, the kitchen, store room and ingredients should be maintained properly and workers should follow guidelines while preparing food. To create awareness on the existing rules and ensure quality food is served, a meeting would be held at the Collectorate at 10 a.m. on Thursday, he added. He said that queries can be raised during the meeting and get it rectified.

Concern over contaminated food items

SILCHAR, Aug 31: Residents of Barak Valley, especially Silchar, have been facing the problem of consuming contaminated and cheap quality food items, as a result of which health conditions of the people have been affected badly. A frontline leader and members of Grahak Suraksha Samiti (GSS), Cachar, have stated it at a press-release that responsible citizens, activists and concerned people should help in spreading awareness campaigns regarding food safety. Thorough checking of food items at various levels of production and distribution by the Food Safety Officer is necessary as to protect people for consuming contaminated, harmful and cheap quality food items.
Consumers have been complaining about the poor quality of food items which loosely at wholesale shops. The members of the Samiti have mentioned it in particular that it is the duty of the Food Safety Officer to keel a vigilant eyes on both distributor and presenter shops. A regular checking will help in eliminating the problems that have crept up the body of food safety and security. Food items should be sent to government laboratory for examining various components of the food items. Consumption of contaminated food can prove fatal and so it is mandatory to check all the elements of a food item by authorities concerned.
Law is a very powerful instrument through which corruption and its practitioners can be eliminated so that people no longer have to live in fear of consuming contaminated food items. Quite surprisingly, for many years, there is dearth of food safety officers in the district, which in turn has lead to increase in the number of unscrupulous food merchants, distributors and sellers. The Samiti has made such appeals for a number of times and this has becomes a plea of last resort. They have also pressed upon the need of a designated Food Safety Officer who can shoulder the responsibility.
In the district of Cachar, the officer has been given an extra responsibility to look after other districts of Karimganj, Hailakandi, Dima Hsao and Karbi Anlong in terms of food safety. Naturally, it becomes tough for one officer to focus on other places in addition to his own. Cheap food items are available in not only in wholesale shops, but also at various restaurants, confectionary shops, tea and in pan shops and while distribution milk. The Samiti members have alleged that 60% food sellers and distributors have no valid registration certificate to prove their authenticity. It is to be noted that registration and license has to be obtained from the Food Safety Officer.
The Samiti members cautioned that if a person dies after consuming food from these unregistered shops, it will be easier for the distributors and sellers to escape from the grip of law. Members of GSS have opined that there is an urgent need for a computer assistant and office staff assisting a Food Safety Officer. It is also impossible for a Food Safety Officer to visit various markets and collect samples and then take action in case of contaminated food items. The consumers’ body has mentioned it in particular that discussions should be held in this regard at high levels. The issue has been repeatedly brought to notice of the Deputy Commissioner by GSS.

How unlicenced slaughter houses pose grave problem in India

Greater proportion of the income derived from slaughter-houses should be spent on their upkeep, efficient running and improvement.” I can quote much more in the same vein. This isn’t something NGT (National Green Tribunal) has said. It is a quote from a Committee set up in 1955 (report submitted in 1957) by the ministry of food and agriculture, on slaughter-houses and meat inspection practices. Under Prevention of Cruelty to Animals Act (1960), there are the 2001 Prevention of Cruelty to Animals (Slaughter House) Rules. Section 3(1) states, “No person shall slaughter any animal within a municipal area except in a slaughter-house recognized or licensed by the concerned authority empowered under the law for the time being in force.” The Rules go on to specify amenities in slaughterhouses and lairages and processes for slaughter. Under the Food Safety and Standards Act of 2006, we also have the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations of 2011. From Schedule 1 of this, a Central license will be required for “all slaughter-houses equipped to slaughter more than 50 large animals or 150 or more small animals including sheep and goats or 1000 or more poultry birds per day.” We thus have a dual FSSAI (the Authority under FSSA) and municipal registration/licence for the high-end and only a municipal registration/licence for others.
There is no getting away for some kind of registration/licence—with slaughterhouses divided into ovine (sheep), caprine (goats), suilline (pigs), bovine (cattle), poultry and fish. Those are actually FSSAI registration heads, not municipal. We have FSSAI data from last year, when the health minister gave a written reply to Rajya Sabha. Sixty-two slaughterhouses are registered with FSSAI. Twenty are from UP. Every other state has less than ten. Assuming all those who should get registered under FSSAI do so, this is a remarkably small number. Through department of animal husbandry, dairying and fisheries, because of a RTI query, we also have data (for 2014) on number of registered slaughterhouses. This is “as reported by states/UT governments” and is therefore about municipal ones. The total number comes to 1,623, with more than 100 in Andhra Pradesh (183), Maharashtra (316), Tamil Nadu (130) and UP (285). Bengal has a mere 11. We want registration because amenities and conditions improve and clearly, these are gross under-estimates.
There have been writ petitions and special leave petitions in the Supreme Court since 2001. To quote from a 2014 Order of the Supreme Court, “We notice that there is no periodical supervision or inspection of the various slaughter houses functioning in various parts of the country. Action Taken Reports would indicate that, in many States, slaughter houses are functioning without any licence and even the licenced slaughter houses are also not following the various provisions as well as the guidelines issued by the MoEF, which we have already referred to in our earlier orders.” There is also Central Pollution Control Board (CPCB), which tell us there are 3,600 authorised slaughterhouses, compared to that other figure of 1,623. If we go back to something like 1992, that 3,600 figure becomes more specific, because we have a CPCB industry document on slaughterhouses, meat and sea-food processing. This tells us, “As reported by the Ministry of Food Processing, a total of 3,616 recognized slaughter-houses” exist. With that cut-off of 100, there are 343 in Andhra Pradesh, 633 in Karnataka, 715 in Kerala, 261 in MP, 282 in Maharashtra, 380 in Rajasthan, 183 in Tamil Nadu and 407 UP. Rather remarkably, Bengal still has 11. These are recognised/registered slaughterhouses. Therefore, the two sets of numbers (from 1992 and 2014) should be comparable.
With the exception of Bengal, where the figure 11 is frozen in time, the story is one of decline in numbers, across states. Unless slaughterhouses are deliberately de-registering themselves, and an explanation can be advanced for that, what’s probably occurred is that some have simply closed down, unable to comply with better standards and enforcement. It is no different from the pharmaceutical firms story. Indeed, there should be fewer small slaughterhouses and more large ones. But the picture gets muddier if you bring in cases before National Green Tribunal, Principal Bench or otherwise. That happens because environmental clearances and pollution control norms are required. (By the way, some NGT cases involve not just municipal bodies, but panchayats too.) One such case was for UP and CPCB told NGT out of 126 slaughter-houses in UP, only one possessed all requisite clearances. In the same case, UP Pollution Control Board (UPPCB) reported 58 slaughterhouses. Even on recognised/registered ones, we seem to have no clear handle on the numbers. It gets worse if you bring in unregistered ones. Unless it is a slaughterhouse outside a municipal area, unlike other segments of the economy where informal doesn’t necessarily mean illegal, in this case unregistered is identical with illegal. I have seen figures that there are 40,000 slaughterhouses. They are not only illegal, some are ancient.
There is one in Tangra Kolkata Municipal Corporation is now modernising and it is more than 150 years old. For all one knows, the one Robert Clive constructed in 1760 still exists. The Tannery Road/Pottery Road complex in Bengaluru is also ancient. We do have a municipal governance problem.

FSSAI commemorates decade of Food Safety & Stds Act with 10 initiatives

The Food Safety and Standards Authority of India (FSSAI) commemorated ten years of the Food Safety and Standards Act, 2006, and revealed its future plans with ten initiatives aimed at making the public and the food industry partners and an aware society.
The document released by FSSAI said, “The future of food safety and nutrition lies in an integrated approach, collaborations, engagement and surround impact.”

Apply FSSAI circular on duty-free shops: HC


A bench led by justice SC Dharmadhikari held that the duty free shops constitute a retail channel “different” from the domestic market, and the goods sold at duty-free shops could not be considered as imports. 
The Bombay high court on Wednesday directed the Centre and the state government to ensure the implementation of the recent FSSAI circular that exempts duty-free shops from its food import quality control checks.
This was after the court observed that food, beverages, liquor etc. sold at duty-free shops at airports across the country are beyond the purview of domestic food safety regulations and thus, are not required to meet the guidelines of Food Safety and Standards Authority of India (FSSAI).
A bench led by justice SC Dharmadhikari held that the duty free shops constitute a retail channel “different” from the domestic market, and the goods sold at duty-free shops could not be considered as imports.
The bench was hearing a petition filed by DFS against the customs department’s decision to confiscate their goods on the ground that they had not been verified by FSSAI.
Appearing for the petitioners, senior advocate Janak Dwarkadas argued that the DFS goods cannot be governed by domestic food regulations since the products sold there are “not technically on Indian soil.”
Meanwhile, appearing for FSSAI, advocate Rui Roderigues, told the high court that till the time the new import regulations are notified, it had no objection to keeping duty-free shops outside the ambit of Food Safety Standards Act 2006.

Incidentally, following several representations by DFS, FSSAI had issued a notification in May this year, announcing that the duty free retail outlets at airports would be exempted from its food import regulations.
However, the petitioners told the court on Wednesday that despite the above notifications, the customs department was hesitant to clear their consignments.
Appearing for the petitioners, senior advocate Janak Dwarkadas argued that the DFS goods cannot be governed by domestic food regulations since the products sold there are “not technically on Indian soil.”
He said that “DFS were not importing these goods into the country through customs but were selling them at the airports only for personal consumption and thus, they had “no liability to get each batch of their products tested by FSSAI.”
“These products are meant only for international passengers either entering or leaving India. These same passengers can take a flight that is not even three hours long, and land at Dubai or any other country where the FSSAI does not get an inspection done, and purchase these same products. As long as they are following the customs regulations in terms of stipulated quantity and items on the list, there should not be a problem,” he said.
Meanwhile, appearing for FSSAI, advocate Rui Roderigues, told HC that till the time the new import regulations are notified, it had no objection to keeping DFS outside the ambit of food safety standards Act 2006.

India puts a ban on ginger imports from Nepal

Says Nepali gingers have high pesticide residue
PANITANKI (INDIA), Sept 1: India has put a ban on import of gingers from Nepal, arguing that they have high pesticide residue and that Chinese ginger was being exported in the name of Nepali product.
Not a single consignment of ginger from Nepal has entered India since Tuesday. The decision has come in the middle of the harvesting season. Exporters say local farmers will lose their major international market following restriction on import by the southern neighbor.
India's Food Safety and Standards Authority has dispatched a circular to all its custom points along Nepali border, informing officials there that pesticide-laced Chinese gingers, which are mixed with Nepali gingers, are being exported into the Indian market, according to Panitanki Customs Point.
While the letter undersigned by the authority's director Bimal Kumar Dubey states that pesticide residue has been found in ginger imported from Nepal and China, it did not imply that there should be ban on the import. "It is our duty to stop import of hazardous products," said a custom official. "This will continue until there is another circular." the official added.
Officials of Nepal Ginger Producers and Entrepreneurs Association said that the Indian officials are allowing entry of trucks carrying gingers whose customs formalities were completed by Monday. “They have told us not to export ginger anymore," Indra Budhathoki, general secretary of the association, said. "The Indian side has warned that it will stop trucks loaded with gingers from entering into India from Tuesday," he said. 
Budhathoki said that the Indian side has assured them that they would take further decision on the issue only after completing lab test of India-bound gingers.
The nearest food laboratory is in Kolkata of West Bengal state and it takes at least a week to complete lab test of food products.
Earlier, Indian traders had complained that Chinese ginger was mixed in Nepali gingers. They had also complained that there is high pesticide residue in the Nepali products.
Nepali traders also admit that Chinese ginger was making its way to India via Nepal. They, however, added that only those involved in smuggling of goods across the border are involved in the anomaly.
Ginger is the second largest farm export from Nepal after cardamom. Volume of ginger export was already going down due to price volatility in the Indian markets. 
Though officials of Mechi Custom Office said that they were unaware of the import ban, Plant Quaratine Office at Kakarbhitta confirmed about the ban.
“Indian officials say that that there has been excessive pesticide residue in Nepali gingers and that Chinese gingers was being exported via Nepal," Bhanudatta Mishra, a quarantine officer, said. "That is why it has put a ban on import of gingers from Nepal.
According to Mishra, the Indian side has asked exporters to either bring lab test report from Kathmandu, or wait till the lab test results come from Kolkata.
The Indian restriction will hit farmers hard. Farmers are ready to send their produce to the market. Ginger farming is done in around 3,770 hectare of land in Taplejung, Panchthar, Ilam and Jhapa. Nearly 55,000 tons of ginger is produced in these districts annually.
Until four years ago, Nepal was the fourth largest ginger producer in the world.

No pesticide limits prescribed for veggies, fruits sold in State

Enforcement of food safety during Onam to go toothless
The absence of prescribed limits on the use of chemical pesticides for various crops could hinder the government move to step up enforcement of food safety during the Onam festival season, experts feel.
The Food Safety and Standards Authority of India (FSSAI) has not prescribed the Maximum Residue Level (MRL) of many of the pesticides used on vegetables and fruits.
This, according to official sources, poses legal hurdles in cracking down on the indiscriminate use of pesticides by domestic farmers and curbing the import of pesticide-contaminated items from other States.
MRL is the legally permitted level of pesticide residue in food items. The MRL value is fixed on the basis of a rigorous evaluation. It acts as an indicator of the correct use of pesticides and ensures compliance with legal requirements for food safety.
“It is a matter of concern that the majority of pesticides that have been detected in vegetables, fruits, spices and condiments do not have MRL values,” says a senior scientist associated with pesticide safety.
“This makes a mockery of the periodic monitoring of food items for pesticide residue,” he said.
The State government conducts regular surveillance sample testing of food items and the reports are published on the official website. But in the absence of MRL values, officials are hamstrung in taking legal action.
“For example, Profenophos is a typical highly neurotoxic insecticide registered for use only in cotton. But it has been detected in chilli, chilli powder, curry leaf, coriander leaf, mint leaf, cardamom, cumin seed, fennel seed, and curry powders. The FSSAI has not fixed the MRL for this insecticide in any of these commodities, because its use is not approved in any of these crops,” says an official.
Vice Chancellor, Kerala Agricultural University (KAU), P. Rajendran said the multiplicity of pesticides used for various crops posed a problem in regulation. “Fixing the MRL value for a pesticide used on a crop is a complex, time- consuming process, often taking years. To complicate matters further, pesticide manufacturers come up with new products every now and then, by changing the formulation.”
Under a special food safety drive for the forthcoming Onam festival season, the Pesticide Residue Research and Analytical Laboratory under KAU is screening samples of vegetables and fruits collected from markets across the State.

FDA seizes adulterated food items

PANAJI: Food and Drug Administration (FDA) officials detained a consignment of defective and adulterated banana and tapioca chips on Saturday at Konkan railway station, Margao. The consignment booked by a Kerala-based firm AB, Chips Chalad Kannur for Goa market was brought via Konkan railway.
A team of FDA officials led by food safety officer Rajiv Korde, found the products misbranded and did not meet the provisions of the Food Safety and Standards Act 2006. They were also defective in labeling requirements and suspected to be adulterated with artificial colour.
The consignment estimated to cost 1.3 lakh was seized from the possession of one Sivagurunath. A sample has been sent for analysis to the FDA lab at Bambolim. The claimant of this consignment is M/s Universal Alliance Group, Quepem.

The team, which consisted of Tekalong Jamir, Paiwang Konyak, Kelengu-u Rutsa, Peter Rana, Aliba Ozukum, P. Mhonbeni Ezung, and Ayeho Sumi, covered various topics such as National Food Security Act (NFSA) 2013, RTI, Lokayukta, Consumer Awareness, Food Safety & Standard Act 2006, Child Protection, and Human Rights.
On Food Safety & Standard Act (FSSA) 2006, the team presented that over the years the need for change and modification of the Prevention of Food Adulteration Act 1954 & Rules 1955 was felt and thus the Food Safety and standard Act 2006 was made for laying down science based standards for articles of food and to regulate the manufacture, storage, distribution and sale of food, to ensure safe and wholesome food for human consumption. “This is an Act to ensure prevention of fraudulent, deceptive or unfair trade practices which may harm the ‘Consumer’ and unsafe, contaminated or sub-standard food.” In implementing the Act, the Food Safety and Standard Authority of India (FSSAI) was constituted on September 5, 2008.
The FSSA was implemented in Nagaland in 2012 and accordingly the State government has prohibited the preparation, sale, exposure for sale of unsafe food items, including imported foods in the state.
The team further stressed that it is every citizen’s right and duty as a consumer to question the distributor of food as every consumer is buying for consumption. “Food safety means an assurance that the food is acceptable for human consumption according to its intended and standard means the relation to any article of food as in the standard notified by the Food Authority,” they stated.

Food officials to inspect water in college hostels

COIMBATORE: A week after 64 students of the Government Women's Polytechnic College were treated for diarrhoea at the Coimbatore Medical College and Hospital, the food safety department has ordered inspection of all college canteens and hostel mess. Meanwhile, the food safety department has confirmed that water contamination was the reason for illness of Government Women's Polytechnic College students.
Designated officer of the food safety department, Coimbatore, O L S Vijay told TOI that as a preventive measure, the department would carry out inspections at all college canteens and hostel mess. "We will be checking the standard of hygiene at the canteens and mess, and if anything concerning the safety of students is identified we will give them notice," said Vijay. "In case colleges do not act, we will issue an improvement notice, and colleges will have to respond within 15 days," he added. 
While the food safety department will be inspecting all canteens after the incident at the Government Women's Polytechnic College, the department, as a routine, conducts random checks at two canteens, said Vijay. "We collect two samples every month, and carry out tests. At the same time, we ensure that the colleges renew their licences on time," the officer said. The maximum period given to a college to run canteens is five years. 
The culture reports of the water and food samples collected from the college revealed that the water was the reason for the students' illness. This is the third time in the last five years that contamination of drinking water at the college has caused illness to the students.
"We collected two samples of drinking water- one at the college main building and another at the hostel. Both samples were found to have yeast, moulds, Escherichia Coli and coliform bacteria," said an officer of the food safety department. "The presence of Escherichia Coli and coliform bacteria are the reason for the illness. Faecal contamination and human or animal blood traces could be the reason for the presence of these bacteria," the officer added.
The food safety department also pointed out that the water samples did not have chlorine. "If the water had been chlorinated, the infection could have been prevented. There should be 2ppm (part per million) of chlorine," the officer added. 
The department also found that annual maintenance works were not carried out for the water filters installed at the college building and mess. "The college authorities have been asked to replace the filters, and after that we will collect samples of water again and test them," a food safety official said.
As a result of the report confirming that the drinking water contamination was the reason for the students' illness, the food safety department has asked the college to clean and whitewash the sump. "A chlorine test kit has been provided to the college. They can test if the water supplied to the college has been chlorinated or not," the official of the food safety department said.

Community kitchen gets food safety certification

BENGALURU: The Art of Living International Centre’s community kitchen has become one of the first mega ashram kitchens in the country to be awarded an ISO 22000 certification for maintaining high standards in food safety and cleanliness.The certification was awarded after an extensive audit of the food safety management practices at the Ashram premises.
The community kitchen dishes out about 23,000 meals on an average every day and 8.4 million meals per annum.
“Food safety is linked to the presence of food-borne hazards in food at the point of consumption. Since food safety can get compromised at any stage in the food value chain, it is essential that the hazards are identified and adequate control measures are put in place at each stage, which we have done at our premises,” said Venkatesh T V, administrator, Ved Vigyaan Maha Vidya Peeth, in a release issued on Saturday.

FDA seizes 750 kgs of mava, two vehicles detained

The Goa state Food and Drugs Administration (FDA) on Sunday intercepted and seized a van and a bus carrying 750 kilos of unlabeled mava/kalakand in Panaji and Margao.

FDA officials had initially detained a Maruti Eco van at Panaji that was carrying around 55 kilos of unlabeled kalakand packed in two boxes of 40 kilos and 15 kilos each. 
Upon interrogation, Rama Chaudhary, resident of Karaswada, Thivim who was driving the car disclosed there was a larger consignment that was arriving by an interstate Pune to Goa non air conditioned bus. 
The bus was then intercepted at the Margao interstate bus terminus where the additional consignment was found. 
The packages were found stored in the non-air-conditioned bus below the passenger seats and not in the conventional luggage compartment. The entire consignment was pulled out of the bus in the presence of Chaudhry who disclosed that the consignment was brought from one Gujarat-based supplier, M/s Vahanvati Sweet Mart at Mehesana, Gujarat. There were no documents with the consignment. 
In a statement issued by the FDA, Director Salim Veljee said, “A total of 25 plastic bags, each containing 30 kgs of mava/kalakanand (totaling 750 kgs worth around Rs 1.50 lakh), which was brought under a misdeclaration/wrongly label declaration labeled as ‘Vahanvati Special Barfi’ was found. The bags did not contain any particulars of the date of packing, etc and all the 25 bags were unloaded from the bus and confiscated.” 
Improper storage of milk-based food articles or its raw materials during transportation are unfit for consumption on account of its high risk of spoilage and microbial contamination, he said. 
“The Maruti vehicle as well as the person accompanying the said vehicle have been detained for further interrogation and investigation in the manner to identifying the names of the person for whom the said mava / kalakand raw material were brought from Gujarat are on,” said Veljee, adding 
that those involved will be booked under the Food Safety and standards Act, 2006 and the Rules and Regulation. 
The FDA enforcement team consisted of Food Safety Officers Rajaram Patil, Shailesh Shenvi and Shivdas Naik.

FSSAI proposes new standards for frozen veggies, jams

According to the draft, standards have been framed for canned tomatoes, tomato juice, frozen beans, cauliflower, peas and spinach
Food regulator FSSAI has proposed new standards for frozen vegetables and processed fruit products, including commonly used canned tomatoes, frozen peas and jams.
In a draft regulation, the Food Safety and Standards Authority of India (FSSAI) has invited suggestions from all stakeholders.
"The framing of standards for new products is a continuous process. In this, we have drafted quality norms for commonly used frozen vegetables and fruit products," FSSAI CEO Pawan Agarwal told PTI.
According to the draft, standards have been framed for canned tomatoes, tomato juice, frozen beans, cauliflower, peas and spinach. Similarly, the regulator has come out with benchmarks for jams, fruit jellies and marmalades.
The standards relate to limits for metallic contaminants in these products.
In the draft, FSSAI has specified that these products will have to follow the packaging and labelling norms of the regulator. Food additives used in these products should be permitted by the regulator.
Recently, FSSAI came out with a host of initiatives to promote safe food at homes, schools, offices, eateries and religious places, besides a national survey for assessing milk quality.
The idea of launching the 10 new initiatives is to create "a culture of food safety" in the country.
Commemorating the 10th anniversary of enactment of the Food Safety and Standards Act 2006, FSSAI had said the new initiatives would focus on safe and nutritious food at home, school, workplace, religious places, on trains and railway stations, at restaurants and other places.
FSSAI will provide a green book to every household and create a dedicated website for safe/nutritious food at home.
Similarly, for schools, it will prepare a negative list of high fat, sugar and salt foods (commonly referred to as junk food), seeking to ensure food safety and nutrition. It plans to make licence from FSSAI compulsory for food businesses involved in mid-day meal scheme.
