Sealed sago factories not to be reopened without permission:HC

The Madras High Court today made it clear that when factories are sealed by Food Safety officer on account of adulterated sago, it should not be reopened without the permission of the court.
The First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice T S Sivagnanam directed the Government that l sago which fails the tests must actually be handed over to the food safety department officer for appropriate action in accordance with law, as on return of it to manufacturers such sago is often sold at discounted price.
The bench gave the direction on a PIL filed by Kallakurichi Vellalapatti Vivasayigal Munnetra Sangam in Namakkal district.
The bench made it clear that wet starch is sold in the market, which also creates a problem, which is purchased by the manufactures at discounted value and then sold after adding the chemicals the sale of wet srarch should be banned.
Earlier a frist bench had directed the Officer, Food and Safety Department, Salem District, to be present in the Court after filing an affidavit to assist the court.
The Farmers association in its PIL alleged that the Tamil Nadu Tapioca Natural Sago Manufacturers Association of Salem who are predominant manufacturers in the entire country and suppliers of sago, was purchasing Tapioca from the farmers has started adding acid and other chemicals in order to make the sago look attractive which is highly harmful to public.
The petitioner said the states Maharashtra, Bihar, Madyapradesh,Rajasthan, Uttar Pradesh and Gujarat are the states. However, mixing of acid and other chemicals in Sago which resulted ultimately in reduction of demand.
Dr T Anuradha, Designated Officer, Food Safety Department, Salem, appeared in person today before the Bench as per the order of it.
She submitted that it emerges that when tapioca is to be processed, the skin has to be removed, but in some of the cases, the small manufacturers may not have the process to do so and without removing the skin, they process it and give it to the larger manufactures. Apart from that, the allegation is that, to whiten the sago, various harmful chemicals are used.
The sago is scrutinized by the Erode district collector through a nine-test process, and where the tests failed the sago is returned to the manufacturers.
The bench also directed the Assistant Public Prosecutor to hand over the list of cases which are already initiated and charge sheet filed to the registrar of the High Court, who will submit a report as to what steps have been taken to expeditiously deal with the cases and adjourned the case to November 17.

Madras High Court directs government to ban adulterated sago

Chennai: The Madras high court has recommended to the government to pass an order within a week banning adulterated sago. The First bench comprising Chief Justice Sanjay Kishan Kaul and Justice T.S. Sivagnanam, before which a petition filed by Kallakurichi Vellalapatti Vivasayigal Munnetra Sangam, Namakkal, came up for hearing, directed the authorities not to reopen sago factories, sealed on charges of manufacturing adulterated sago.
The bench said when tapioca was processed, the skin had to be removed. But in some cases, small manufacturers may not have the process to do so and without removing the skin, they processed it and gave it to large manufactures. Besides this, it was alleged that when whitening the sago, various harmful chemicals were being used.
Wet starch sold in the market created problems as local manufacturers purchased them for a low price. Chemicals were added to it and then sold. Hence, wet starch should be banned. The government should issue necessary orders on sale of wet starch. The court directed the food safety department to monitor the factories. It adjourned the matter to November 17.

HC for banning sale of wet starch

Observing that the sale of wet starch should be banned, the Madras High Court on Monday directed the State government to issue necessary GOs in a week.
Hearing a plea which alleged mixing of chemicals in wet starch, the First Bench comprising Chief Justice S.K. Kaul and Justice T.S. Sivagnanam said, “It is pointed out that wet starch is sold in the market, which creates a problem, as it is purchased by manufacturers at discounted value, chemicals added and then, sold. It is, thus, agreed that sale of wet starch should be banned.”
The Bench also directed that sago, which fails the nine-level tests by authorities, should not be returned to the manufacturers but to the Food Safety Department for appropriate action.
On the submission of the Food Safety Department’s Designated Officer T. Anuradha, who was present in the court in connection with the case, it emerged that some small manufacturers, who did not have facility to remove the skin from tapioca, sold it to larger manufacturers.
There was also an allegation that various harmful chemicals were mixed with sago to whiten it.
Even as it directed the Food Safety Department to monitor the factories and manufacturers to ensure that the orders complied, the Bench also directed the Assitant Public Prosecutor to produce a list of cases registered against sago manufacturers over the issue. The Registrar of the High Court would submit a report.
“We make it clear that when the factories are sealed by Food Safety Department on account of adulterated sago, no such factory will be opened without the leave of the court.,” the Bench said.

HEALTH AT RISK - Only 16% of food adulteration cases in TN end in conviction

As Awareness Spreads, Complaints Up, More Samples Tested
Just 16% food adulterators were con victed in the state over the past two years even though there has been a rise in the number of complaints of con taminated food in the market.
Statistics from Tamil Nadu food safety department shows it collected 3,531 food samples from across the state since 2013 and found 1,308 (37%) to be unsafe, substandard or misbranded. However, the department has succeeded in proving only 219 cases in court. In 2014-15 alone, food items like salt (177 samples), oil (169) and cereals (147) failed in quality tests conducted by the department.
While food safety officials say they collected fines of `40.69 lakh from violators over the past two years, consumer activists say most food adulterators go scot free after paying a meagre fine. “The low conviction rate is dis turbing,“ said Consumer Association of India representative G Santhanarajan. “Hazardous chemicals in food items pose severe health risks, in cluding cancers, but there are no efforts to punish violators. Consumers have become more aware after the Maggi saga.“
There has been an increase in the number of food samples tested by the department: 658 in 2013-14 to 2,873 in 2014-15.This is mainly because more customers have lodged complaints.
In Chennai, there are only 25 food safety officers (FSOs) to monitor more than 70,000 food businesses. According to Food Safety and Standards Act, each FSO has to collect at least four food samples every month, but an FSO in Chennai collects only one sample per month. This means the department collects an average of 300 samples a year.
Officials say they take random samples and conduct inspections based on complaints. “Many cases are pending before the courts, which delay the conviction of violators. In some cases, they find loopholes in the cases and get away,“ said an official.

Software to monitor Food Safety Act implementation

THIRUVANANTHAPURAM: The state food safety department is set to launch Management Information System (MIS) software for speedy and effective coordination. With the introduction of the software, Kerala would become the first state in the country to computerize monitoring and implementation of food safety provisions.
The pilot project would be launched in Thiruvananthapuram on Monday. "The department is crippled due to staff crunch. But it is hoped that the implementation of the software would help in better co-ordination among enforcement officials. The officials spent hours recording proceedings," said food safety commissioner T V Anupama.
Developed by Invis Multimedia, it would aid food safety officials in uploading details of inspections including photographs and informing higher officials about raids. After the launch in the capital, the software would be introduced in other districts. The software would play major role in functioning of food labs too as it could indicate forthcoming workload at the time of sample collection itself.
"The complexity of the Food Safety Act and the detailed procedures of enforcement were a real challenge, but we completed it with 100% accuracy," said Sudheesh Radhakrishnan, head of software development at Invis Multimedia. A team comprising joint commissioners K Anil Kumar, D Sivakumar, D Ashrafudeen and research officer G Gopakumar was formed to work along with the web application development team. The idea was to develop a web-based application to connect officials in offices and fields across the state, through the software.
Officers with the food safety department have already been given an initial training on the software. The department also plans to develop a mobile interface which could help field officers operate through tablets and smartphones.

Gurgaon food safety officer arrested for accepting bribe

GURGAON: City vigilance bureau has arrested a food safety and drug officer on Monday for allegedly accepting a bribe of Rs 30,000 in lieu of granting a catering license to the complainant. The complainant offered the bribe after informing the vigilance about the demand and an alleged agent of the officer was arrested while accepting the bribe on his behalf. The accused officer was later arrested from his office.
According to the vigilance team, the complainant, Jitender Kathuria, approached the vigilance bureau in sector 15 and informed about the bribe demand. The vigilance team tapped the conversation between the accused officer and the complainant where the accused was demanding bribe. After which according to the instruction of the bureau Jitender offered the bribe to the agent of the officer, Puran Khanna. After the agent confessed that he was accepting the bribe for the accused officer, Daya Kishan Sharma, he was arrested from his office.
According to the bureau the complainant identified as Jitender Kathuria reached in sector 15 vigilance bureau's office claiming that food safety and drug inspector was demanding Rs 30, 000 for granting catering license to him. The vigilance team heard conversation on phone and formed a special team headed by inspector Ramesh Kumar for raid with duty magistrate Naib Tehsildar Sanjeev Singla and they went to civil hospital.

Hotel Association Fears Random Inspection By BMC Will Lead To Raid Raj

Mumbai: The Hotel and Restaurant Association of Western India (HRAWI) has come out in strong condemnation of BMC’s decision to conduct random checks at star hotels and Grade – I hotels in the city to inspect their cleanliness and health aspects. The civic body’s health department plans to draw hotels and restaurants for inspection by lottery system and officers will visit respective establishment premises unannounced. Ironically, barring the star category and Grade – I restaurants, the BMC has no such plans for the rest of the hotels and restaurants in the city.
Questioning the motive, the association has opined that this is nothing but a harassment tactic. “If the BMC were really serious about health and sanitation issues, they would be addressing the issue of unlicensed eateries that don’t follow any procedures and prepare food in filthy conditions. The water they use, the storage condition, the constant exposure to dust, the pests that run in and out from these stalls don’t seem to concern the BMC at all. In this context, targeting the Grade – I restaurants and star hotels is curious,” says Mr. Gurbaxish Singh Kohli, Vice President, HRAWI.
The 65 year old HRAWI is one of the oldest and the most efficient industry associations. Asserting a tradition of proactive partnership with the government, it has drawn attention to the long practice of self regulation followed by city restaurants and has stated that the BMC’s decision to pick only star and Grade – I restaurants is arbitrary and illogical. “We have always been compliant to food safety standards and the services have only improved over time. Our families and friends eat at our restaurants as often as guests do. But without a framework or plan, the inspectors will turn up at the busiest time and disrupt normal functioning. Random raids, as we have seen in the past, go on to serve only one purpose, and that is harassment. We hope BMC will withdraw the decision,” said Mr. Bharat Malkani, President, HRAWI.
Mr. Malkani also pointed out that maintaining hygiene standards is the function of Food Safety and Standards Authority of India (FSSAI) and the BMC should be focused on curbing food cooked and sold without adopting any hygiene or health guidelines rather than creating a raid raj.
“Being penalized for forming a vital factor of the organized sector, this discrimination of facilitating the unorganized roadside eateries only shows that we get harassed and victimized as the soft targets,”said Mr. Kamlesh Barot, past president, HRAWI.

DANGERS OF AN ADULTERATED HEALTH: THE CASE OF MILK ADULTERATION IN INDIA

Recently, the issue of wide spread adulteration in food products has gained spotlight once again in India, after the news of food regulations violations in Nestle’s Maggi noodles gained notice. It is important for the public to recognise, as they surely do, that this is not an isolated case, and that this is only symptomatic of large scale adulteration that plagues the whole market of food products. To say that we have a lack of regulations in place would be incorrect, for the Food Safety and Standards Authority of India does prescribe an elaborate number of regulations that all food products must adhere too. However, despite this, rampant flagrance of such regulations constantly occurs. The case of the Maggi noodles caught the public eye, quiet fittingly so, for it is after all a very powerful brand and impacts a large number of consumers.
However, it is important also to note that even if Maggi was not declared “unsafe” for consumption by the FSSAI, it would still be junk food, and would never qualify as a healthy food product. Even without having violated regulations, Maggi was never a nutritious intake for people. Thus, when focusing on the problem of adulteration in the country, one realises that the enemy lay much closer to home. This is because while it is comparatively easier for authorities like FSSAI to levy checks and regulations on packaged food products, unpackaged products that sell in the markets, if adulterated, often escape notice. And in a country where the majority of the population is rural, it is crucial to note that most of daily food items consumed by Indian households are sold unpackaged. Vegetables with false coloring on them and whitened, adulterated milk are being constantly consumed by the people, making us perhaps victims of health complications we are often not even aware of on an everyday basis.
With regard to this, it is very significant and at the same time extremely worrying that water, milk and oil (which are consumed by almost every single household daily, it is safe to generalise) are three of the most adulterated food products in the country. In 2012-13, the Food Safety and Standards Authority of India conducted a survey, where in it deduced that milk was by far the most adulterated food item in the whole country. It showed the shocking statistics of a whopping 68.4% nation-wide milk adulteration.
Milk adulteration is an issue that has a deeper, much more lasting impact, because its effects are insidious. The same report by FSSAI, referred to above, also pointed out that the main adulterants, apart from water, are generally chalk, paint and chemical whiteners. Milk is a regular part of the Indian diet and a chief source of protein for us even more because a large section of the country is vegetarian.
It is understandable that it is much harder to regulate milk adulteration because it is often sold unpackaged, but that does not absolve the Food Safety and Standards Authority of India of its responsibilities. And while it does do substantial work to regulate, loopholes remain and hence it is imperative that the FSSAI sets up a body to conduct nation-wide checks on milk adulteration particularly, and ensure regular testing of unpacked food items like milk.
With regard to this, it is relevant that the Supreme Court of India had, as back as in November 2014, directed the Centre to legislate so as to amend the Food Safety and Standards Act, in order to increase the maximum penalty possible if found guilty of milk adulteration to a life sentence, from the current penalty, which is a maximum of six months. While some may argue that a life sentence is too harsh a penalty for milk adulteration, it is without doubt true that the current penal provisions have completely failed to act as deterrent, and an amendment in the law, as per the Supreme Court’s directions, seems a necessary precaution.
It is worth noting that while the Centre has not yet introduced or enacted any such amendment, states of Uttar Pradesh, West Bengal and Odisha have already legislated in this direction. Not only should other states follow in the same direction and legislate for this, but the Centre should also do what is due, and bring forth amendments to the existing laws. As a concluding thought, it would be effective to view this problem of milk adulteration within the context of the fact that approximately 70% of health related deaths in India are from food and water borne diseases. To curb this menace, and for a healthier society, we must ensure that a necessity like milk is always a positive source of nutrition and not a dangerous substance harming us instead.

‘The matter got blown out of proportion’

SURESH NARAYANAN, MD, Nestle India
Maggi is safe and all set for a comeback, says Suresh Narayanan, MD of Nestle India
September 7, 2015:
Even as the courts have given a clean chit to Nestle on the Maggi controversy, its appears to be a long and winding road for the global food giant to get back the noodles on the popular list of Indian households. Bloomberg TV India caught up with Suresh Narayanan, the new MD of Nestle India, and asked about the way forward and what it will take to bring Maggi back on the shelves.

After the FSSAI order on banning Maggi, how do you react to the recent court verdicts in favour of Nestle?
Number one — there is no victor and there is no vanquished. There is no sense of elation or victory in what has happened.
I am sure there is a sense of relief…
There is certainly a ray of hope that we can move forward, in the context of what we are. This is kind of vindicating some of the stands that the company has taken in fact, in the court and with the FSSAI. And I think it is also very clear to me — and Nestle’s stand is very clear on this — that the primacy for food quality and safety in this country is a regulator. So, there is no question of walking away from that ambit. Obviously, the matter is with the High Court and the court will be giving us guidance on the sampling process. Then we will take it to three accredited laboratories across the country. We have the first testing done — all going well. We start the manufacturing, do one more rounds of test, and, hopefully, I have the product in the hands of the consumers for whom really this whole journey is being undertaken.

So, the first round of testing is over out of the three rounds, which is required?
Not as yet. I think what’s happening is that the court in fact gave us six weeks. So, there were some clarifications being sought in terms of the number of samples to be taken. That clarification would be available to us relatively soon. Then the sampling process happens, the analysis process happens and I hope that by the end of September we will manage to get the analysis done as well. Then we start the manufacturing, do a round of testing which is basically five samples per variant of what people use. And if that happens, it is on to commercial.
It’s interesting to know at this point of time that you will be going ahead and testing the variants as well. So, it is going to be the entire portfolio of Maggi coming back together. Is it?
Absolutely. The pillar on which Nestle stands is quality. From farm to fork our products are 100 per cent safe for consumers.
They were, they continue to be, and they will be. As far as I am concerned, I think all that we are putting together as an organisation is to ensure the best experience to the consumer and the safety of the product are never ever compromised at any point in time.

From the consumer point of view, there has been a fear psychosis and a question mark over the quality of packaged food. When FSSAI raised an issue Nestle didn’t think they should go back and reply to what FSSAI had said at that point in time? Why just hold a press conference and recall goods?
First, as Nestle, we focus on face-to-face interactions with the regulator. It is not true to say that we were not engaging in that conversation. That conversation was going on and the issues that came up were the issue regarding the lead (content). And there, we said something very simple and clear. There are three aspects to the whole testing process.
First infrastructure — as lead and heavy metal testing requires the right kind of infrastructure. We have equipment that measures it in parts for billions against standard of parts for million. Secondly, there is a protocol of doing the test. And thirdly, it is the competence of the people who are doing the test. All that we said was the results of the laboratories that you had are from non-accredited laboratories. Those tests cannot be seen and deemed to be reliable in terms of establishing the veracity and the safety of the products. And so let us go ahead and have a dialogue on this. Now the fact is that between that time and subsequently, the matter unfortunately got considerably blown out of proportion.
There was confusion in the minds of consumers and therefore we chose the withdrawal process and soon we also had the ban put on us.

'Nirapara' Products Face the Axe

THIRUVANANTHAPURAM:The Food Safety Commissioner has slapped a ban on the manufacture, storage, sale and distribution of ‘Nirapara’ brand chilli powder, turmeric powder and coriander powder.
“The analyses of the spices powders, manufactured by KKR Food Products, Kalady, have revealed the presence of added starch,” Food Safety Commissioner T V Anupama said on Friday.
“Though the Food Safety Wing had issued notices under the Food Safety and Standards Act of India (FSSAI) after analysing the samples, the manufacturer continued to sell the adulterated spices powders, claiming them to be pure in the packets and in media advertisements,” the commissioner said.

FDA seizes mawa being transported sans refrigeration

Margao: A four-member team of the Food and Drugs Administration (FDA) led by FDA inspector Rajiv Korde on Saturday confiscated 340 kilos of unlabelled mawa at the Margao Konkan Railway station.
The FDA team comprising Korde and food safety officers Flavia D'Costa, Richard Noronha and Madhav Kawalekar, seized the mawa that had arrived by the Goa Express train from Miraj. "The mawa was being transported without any refrigeration facility," said Veljee.
He added, "On August 31, I had written to the South Central Railways as well as the Konkan Railways not to bring food items such as meat and milk-based products which require to be refrigerated at a controlled temperature as the railways do not have any cold storage facilities like an ice-box. Despite writing to them, they still continue to transport food articles which need to be refrigerated. I have also written to the Food Safety and Standards Authority of India, New Delhi, to take up this issue with the railways ministry."

Three model ration shops on anvil in Tiruchi district

These shops will have several customer-friendly arrangements
In an effort to enhance the customer satisfaction, the Co-operative Department plans to set up three model ration shops in rural areas of the district.
Besides changing the overall look of the ration shops, the move will focus on providing customer-friendly facilities. Provision of furniture, waiting arrangements for customers, creating drinking water facilities, and establishing “first come first serve” set up were among part of the proposals mooted in the model ration shop proposal.
K.C. Ravichandran, Joint Registrar, Co-Operative, told The Hindu that the department had been trying to step up facilities in all 1,136 ration shops gradually.
In the initial phase, three ration shops in rural parts of the district would be created with all necessary facilities for customers.
The selection of ration shops would be done within a few days.
The shops would have all facilities such as chairs, spacious seating arrangements, waiting hall, and so on.
If there were no fans, they would be provided with them. He said the department was committed to ensure the parameters of hygiene stipulated by the Food Safety and Standards Act 2006 in all ration shops. A circular would soon be sent to the salesmen of all ration shops in the district to improve the cleanliness.
Five days from 20th to 24th of every month were considered as lean days for all ration shops in view of loading stocks for the next month.
The lean days should be utilised for cleaning the ration shops.
The surroundings should be kept neat and clean. Two days at least could be allotted for cleaning the shops every month.
Five lean days every month to be used for cleaning the shops
‘First come first serve’ will be the norm in these outlets

FSSAI to associate with more agencies to keep tab on food safety

The FSSAI would associate with central and state government agencies, consumer organisations, NGOs and other institutions for undertaking surveys and food quality tests, etc under its IEC activities.
In an attempt to have stricter vigilance over food products after incidents like Maggi noodles and other similar packaged products which were found hazardous to human health, Food Safety and Standards Authority of India (FSSAI), which functions under Union Health Ministry, has decided to outsource surveys and food testing to various organisations related to food safety.
Under a funding scheme, the FSSAI would associate with central and state government agencies, consumer organisations, non-governmental organisations (NGOs) and other institutions, including government universities and colleges working in the area of food safety for undertaking surveys and food quality tests, etc under its Information, Education and Communication (IEC) activities.
New surveys
Till now, in a bid to ensure food safety, the FSSAI by itself conducted surveys of enforcement and administration of the Act in various parts of the country. They searched, collected and analysed relevant information relating to food consumption and exposure of individuals, risks, incidence and prevalence of biological risks, contaminants in food and residues of various contaminants, etc.
The food safety authority has also been undertaking activities and programmes for dissemination of Information, Education and Awareness in this regard through the media and also through association with different organisations and institutions.
"However, recognising that effective enforcement of the provisions of the Food Safety Act and the rules and regulations primarily rest with the states and union territories. There also a need for greater focus on these activities. The need for a scheme in this regard does not need to be overstated," a senior official in the FSSAI said.
"The most important and critical stakeholder in food safety is the consumer, who is directly impacted by the safety of food in the country. It is necessary for the authority to stay engaged with the consumers and apprise them of the emerging trends in food safety so that their concerns are appropriately reflected in the food safety system in the country. Keeping this in mind, the scheme has been framed for inviting and processing proposals from various agencies, NGOs, schools, colleges and universities working in the area of food safety," the official added.
The organisations will be given a free hand to carry out testing of ingredients in key food products and undertake surveys on various aspects of food safety, including surveys on parameters like hygiene being followed by food business operators as per Schedule IV of the FSS (Licensing and Registration) Regulation, 2011.
"The organisations which will join handds with the FSSAI will also be doing capacity building and skill enhancement of small food business operators or street food vendors. Innovative projects, which will involve the community in promoting food safety practices, raising hygiene levels, inculcate habit of reading food labels etc, awareness campaigns on food safety, including importance of reading food labels, detection of adulteration, hygienic practices, selection of food for consumption etc in schools and colleges for students, teachers and parents will also be undertaken," said the official.

Food Importers meet FSSAI Chairman with concerns, assured of early resolution

Food Importers meet FSSAI Chairman with concerns, assured of early resolution
A delegation led by Amit Lohani, Founder and Director of the Forum of Indian Food Importers (FIFI), the apex body representing food importers across India, met Ashish Bahuguna, the newly appointed Chairman of the Food Safety and Standards Authority of India, on September 1. "We presented him with various concerns of the trade and the ambiguity faced by FIFI members and sought his suggestions to the issues raised by us," informed Lohani about the purpose of the meeting.
As a forum for international foods importers, FIFI has been working very closely with FSSAI since its inception to evolve better understanding of food laws and create healthy trade environment for compliance. Over the years, imported products have also encouraged the Indian food industry to develop and manufacture food products matching international standards.
The major concerns voiced by the FIFI delegation at the meeting with the FSSAI chairman were chiefly about the issues related to FFAI norms. Members of the delegation comprising V.N. Dalmia of Dalmia Continental, Rajneesh Bhasin of Borges International, Rakesh Banga of Farmland Foods and Uday Chugh of Vriddhi Specialty flagged off trade concerns related to:
Clarity on Food Code and CODEX: FIFI members expressed the view that the trade feels that since Product Approval is no longer part of the process after being struck off by the Supreme Court recently, the norms and guidelines of the Indian Food Code should now be followed. With more than 4,000 categorizations of products, the IFC norms are extensive enough to cover in its ambit almost all the products imported in India. Members impressed upon Bahuguna to follow the IFC norms for import clearances. "This would come as a massive relief from the current ambiguity in trade after the PA clause was struck off by the Supreme Court," was the collective view of the delegation.
According to the press note issued by FIFI on the outcome of the meeting, Bahuguna assured the delegation of resolving this issue and put in place guidelines for a more transparent process to facilitate trade. Members felt that he was very positive on the early resolution of the ambiguity on the matter.
Labeling concerns: FIFI members highlighted their concerns on getting the NOC from FSSAI. "Due to minor errors / deficiencies in labeling, sampling is not done and the consignment languishes awaiting clearance and NOC from FSSAI," pointed out the delegation.
The suggestion put forward was that any minor deficiency should be viewed sympathetically and the importer should be given the permission to re-label the product. It was put forward that keeping in view the approved granted by the High courts in several such cases, the order of destruction or re-export should only be used for products which fail the basic safety aspects for human consumption.
In his reply, Bahuguna is reported to have stated that there are a few judgments in favour of relabeling but there has also been one judgment favouring the FSSAI’s point of view. "We are trying to understand the legal ramifications on the subject," is what Bahuguna told the delegation.
FBO Licence: Members expressed their anguish over delay and red tape in obtaining the licence. "The whole process of granting licence smacks of the abuses rampant in the days of License Raaj. Officers ask for favours and minor mistakes are blown out of proportion," pointed out the delegation.
It was therefore suggested that the primary domain of FSSAI should be FBO registration and not licensing, which encourages corruption. The focus should be on traceability of the FBO and the safety of food article sold by him. Annual renewal of licence should be discontinued and a one-time registration process should be initiated.
The delegation, in its release, said that it was happy to note that the Chairman absolutely and unequivocally supported our concern. "He assured us that this would be resolved and that there is no reason why documents are required during the renewal of licences.
SOP of Import: It was pointed out by the delegation that custom duty before the withdrawal of samples at certain ports is at the discretion of officers. The minimum time taken for withdrawal of samples is two days, which sometime exceeds to more than five days. After the withdrawal of samples, getting the receipt of the test results takes an average of 10-12 days from the date of sampling. Even the process of sample withdrawn in Delhi is different than that in Mumbai, resulting in delay in clearance. It was pointed that whereas officers in Mumbai do not ask for the delivery order (received from shipping line post customs clearance) for sample withdrawal, delivery order is asked for in Delhi.
It was suggested that the FSSAI should maintain process parity at all ports. The total time frame for withdrawal of samples till the delivery of test results should not exceed five days. In the case of any delay, the importer should be allowed to take the shipment out on an indemnity bond. It was also brought to light that the cost of delay causes loss to the consumers to the tune of Rs 15,000 daily on account of demurrages and detentions, which is borne by foreign shipping lines.
The delegation was assured that FSSAI was aware of this concern and was in the process of issuing clarity on SOP of import clearances so as to bring more parity at different ports.
Other issues related to the timeframe for sampling, testing, etc, and on having a negative ingredients list were also raised. The meeting, according to members of the delegation, was fruitful and productive and raised expectations of a quick resolution of all the major concerns articulated by FIFI. "This was one of the most positive meetings we have had in FSSAI since VN Gaur’s time. The Chairman listened and clarified on all our concerns and gave positive feedback on issues raised by us," said Lohani.

Nirapara brand of powdered spices banned

The Commissioner of Food Safety has banned the manufacture, storage, sale, and distribution of the Nirapara brand of chilly, turmeric, and coriander powder, manufactured by KKR Food Products, Kalady, under relevant provisions of the Food Safety and Standards Act of India, to protect the interest of consumers.
The decision was taken by the authorities as the spices powders sold under the Nirapara brand were found containing added starch. Food Safety Commissioner T.V. Anupama directed the manufacturer to recall all banned products from the market and file a compliance report with the Commissioner.
Food safety officials, as part of their routine food inspection and sampling work, had collected random samples of Nirapara brand of spices powders from different parts of the State on different dates. The samples analysed at the State Analysis Lab had found that the samples contained added starch.
Following an appeal from the manufacturer, the samples were reanalysed at a referral lab but the results were the same. At least 30 cases of the same nature are pending before adjudicators in different districts in the State.
The officials decided to push ahead with the ban of the products as despite notices sent under Section 46 (4) of the FSS Act, adjudications filed and fines imposed, the manufacturer has continued to sell adulterated spices powder, an official statement here said. All Assistant Commissioners of Food Safety have been directed to inspect godowns of distributors and retail outlets and seize the products for the effective implementation of the ban.

Government planning a treat for restaurant industry

The industry seems upbeat, at least with the reassurances by the government since the result on ground will take some time to materialize.
NEW DELHI: The AAP government has decided to address the long-pending demands of the restaurant industry in Delhi by offering them an environment conducive to ease of doing business. This includes a simplified licensing process and planning tourism hubs with focus on hospitality and dining.
The industry seems upbeat, at least with the reassurances by the government since the result on ground will take some time to materialize. A three-member committee headed by finance secretary SN Sahai is looking at various aspects of ease of doing business and is expected to submit a report on the licensing structure to the chief minister in the coming days.
Government sources said that at present a restaurant requires 15-16 licences, some of which may not even be relevant and the National Restaurant Association of India (NRAI) has been asked to revert with details on each. "Talks are on with departments. The committee is working on a report and will submit it to the CM soon," said a source.
The association has met several people in the government, from the tourism minister to senior bureaucrats and says that there is definite interest in simplifying the system. "We discussed setting up of 15 tourist hubs with the tourism department. These will give huge leverage to dining and, hence, promote the industry as well. The tourism minister has also asked the municipal corporations and NDMC to allow use of open spaces for serving food," said Riyaaz Amlani, president, NRAI.
The changes introduced in the past six months include making the licence renewal process online, in turn reducing human interface which, sources claim, has resulted in a definite reduction in corruption. The government has allowed setting up of microbreweries, though Kumar says there are still lose ends to tie up. There is a definite agenda for restaurant-based tourism hubs while a special committee is looking at the licensing process.
"This is for the first time that so many steps are being taken and we are glad. The result will take a while to show but at least there is movement towards ease of doing business. Not only will this encourage the industry but also increase government revenue," said Prakul Kumar, secretary general of NRAI.
Restaurateurs say that multiplicity of agencies, especially for granting licences, is a major point of corruption other than leading to harassment. "While the Centre and previous governments have been talking about ease of doing business, nothing much has changed on ground. Counting all the licensing, permissions and registrations, there are 15-odd types of clearances we require leading to inspector raaj," said Kumar.
"Several issues are local like dealing with civic agencies. An example is the health licence given by the corporation. When there is Food Safety and Standards Authority of India, why do we need this additional licence?" said Kumar.

FSDA finds stale pethas being sold to visitors

Agra: Tourists have two things on their wish list when they visit the city: see the Taj Mahal and buy petha sweets. But reputation of Agra pethas has taken a severe beating as Food Safety and Drug Administration (FSDA) officials found nearly 300kg of the product sold in local shops across the city to be stale.
During the first phase of crackdown, FSDA found that some shops, besides selling stale sweets to unsuspecting tourists, were using aluminum instead of silver foil (warak) on their product. Consumption of aluminium poses health hazards.
The FSDA has collected seven samples from various shops in the last two months. They have sent them to the divisional food analysis lab at Lucknow and Varanasi.
The food quality watchdog started investigating the quality of pethas in the city after a leading sweetmeat chain in the city complained of various shops mushrooming in the city by misappropriating their brand name. They said people had opened fake outlets and were selling substandard sweets to unsuspecting tourists. As per law, misbranding can draw a fine of up to Rs 10 lakh.
FSDA officials raided various shops in Agra Cantonment, Tajgang, Sadar and Balugang. They said they would begin another phase of crackdown on petha shops shortly. They said they will begin their second pase of crackdown shortly to uphold the quality of sweets.

Patanjali noodles riding on Ramdev’s marketing

Mumbai, 4 September
At the launch of Patanjali Ayurved’s atta
noodles on Thursday, Baba Ramdev, yoga guru and co- founder of the company, was not only seen having the noodles himself but urging others to do so. Though a yoga guru having instant noodles might seem at odds, it points to the savvy marketer that Ramdev is.
Apart from plugging into the need for ahealthy noodles option in the absence of Maggi, Ramdev has done everything a smart brand ambassador would. This isn’t the only instance when the 49- year- old yoga guru has weaved his magic on promotion and branding. In the 18 years since he co- founded his ayurvedic company along with scholar Balakrishna, he has virtually carried the Patanjali brand on his shoulders.
A recent CLSA report says the unlisted Patanjali Ayurved, which, at the end of 2014- 15 had revenue of about ₹ 2,500 crore, spends practically nothing on advertising and sales promotion. By comparison, the average advertising and sales promotion costs for fast- moving consumer goods (FMCG) companies are nothing less than 12- 15 per cent of sales.
Experts say Ramdev embodies what Patanjali is all about. “ The difference between him and regular brand ambassadors is he lives the brand. There is no gap between what he espouses and what Patanjali wishes to communicate. While personality- led brands aren’t uncommon in advertising — the late Steve Jobs personified what Apple stood for and Richard Branson lends his charisma and charm to Virgin — I don’t think there are any examples of it in ayurveda,” says Kiran Khalap, co- founder, Chlorophyll Brand and Communications Consultancy.
In many respects, Ramdev is also among the busiest FMCG brand ambassadors.
He promotes Patanjali products during his yoga sessions and discourses, weaving it cleverly into his narrative and ensuring his followers also become users of his products.
According to NChandramouli, chief executive of TRA, publishers of the annual Brand Trust Report ( which measures the level of trust in a product or personality), Patanjali Ayurved broke into the list for the first time this year, featuring among the seven most trusted ayurveda brands in the country.
“Baba Ramdev was the only spiritual leader to figure in our top 21 personality list, at number 16 this year. This is the first time in the four years since we launched the report that a spiritual leader has featured on our personality list, otherwise dominated by Bollywood and cricket players,” Chandramouli says.
With ad agency DDB Mudra now working with Patanjali Ayurved to promote some of its products, Ramdev’s aura might only be enhanced. Madhukar Kamath, group chief executive and managing director of DDB Mudra, says the scale of Ramdev’s business attracted his agency to Patanjali.
“They have a great product, a modern manufacturing process, a wide distribution network and a large number of loyal followers, who are also users of the brand. What more would you want from an FMCG company?” Kamath asks.
With Patanjali growing (it has plans to enter almost every FMCG category and increase its reach from 177,000 outlets to two million), Ramdev is unlikely to get any respite from his endorsement duties.

Nestle can send fewer samples: Bombay HC

MUMBAI: In a further relief for Nestle India, the Bombay HC on Friday clarified that five samples each from among the available nine Maggi variants can be sent for lead testing to three laboratories. So the company need not send five samples each from 750 stored cases of these variants as mentioned in an order last month, while lifting the nationwide ban on sale of the two-minute popular snack.
There are nine approved variants of Maggi of which six are available for the tests, lawyers said later. Hence the samples to be sent for testing now would be 30 each to three labs. The HC said the tests can be done within six weeks starting September 5.
A bench of Justices V M Kanade and B P Colabawalla made this modification to its order. The move came after senior counsel Iqbal Chagla, appearing for Nestle India, pointed out that the court's intention was for samples from each or available variants to be tested and not from each stored case of the not destroyed noodles. The latter would have result in a huge number of samples.
"There are 592 batches in the 750 cases, which would result in 2,960 samples, and for three labs it would mean 8,880 samples to be sent." The company had moved the court after spotting few "typographical errors" in dates and numbers mentioned in the order passed on August 13 when the bench had set aside the June 5, 2015, ban imposed on Maggi sale by Food Safety Standards Authority of India (FSSAI) as being without following principles of natural justice.
The HC, after hearing Chagla and Mahmood Pracha (counsel for the FSSAI CEO), accepted the clarifications sought by Nestle to the typos and to the provisions of the food safety under which the tests were to be done. The HC had, while allowing Nestle's plea against the ban, however, "in public interest" directed that Maggi samples be sent to three certified laboratories for lead testing and, when found to be within limits, manufacturing could resume. The FSSAI had banned Maggi after 30 samples out of 70-odd were found to have high lead content.
Among the "typographical errors" were that the company had issued its press release about withdrawing products on June 5, not June 4 as recorded, and that nine variants have approvals, not eight, and that Maggi Masala Oats is the tenth variant which is pending approval.
The HC judgment, which had come as a victory for Nestle, however allowed the company to begin manufacturing of its popular instant snack only after three labs certify within six weeks that lead content in Maggi is within permissible limits. And the company may sell even the newly manufactured products of all other variants once they are tested and found to contain lead within permissible limits.
The HC in its order had clearly held that FSSAI had "no unfettered discretion to decide what standards have to be maintained by manufacturers of proprietary foods" and "could not impose a ban on the grounds that the lead found in the product of the petitioner was beyond what was represented in its application for product approval, though it was below the maximum permissible limits laid down under the regulations".

Bombay high court reduces number of Maggi noodles samples for test

Nestlé India now has to test 45 samples within the next six weeks before it can get the go-ahead to resume sales

Mumbai: The Bombay high court on Friday admitted Nestlé India Ltd’s plea to reduce the number of samples to be tested to 45 across three accredited laboratories. According to the court’s earlier order, 3,750 samples had to be tested.
“By an order passed today, the court was pleased to allow Nestlé India’s application praying for bringing out certain factual corrections in the judgement dated 13 August 2015 and for seeking clarity on certain aspects of sampling for tests to be conducted in accordance with the directions of the court. The court has allowed that five samples of each variant be sent to the three accredited laboratories for testing,” Rajesh Batra, counsel for Nestlé, said.
On 28 August, Nestlé had moved the court to allow it to send five random samples of each of the nine variants to three accredited laboratories, instead of sending five samples for each of the 750 batches of all nine variants, as directed by the court in its 13 August order.
The 13 August ruling, which was in Nestlé’s favour, had set aside the 5 June ban by the Food Safety and Standards Authority of India (FSSAI) on the sale and manufacture of Maggi noodles in India.
However, it had directed Nestlé to test 3,750 samples. Based on the test results, the company would be allowed to resume manufacture and sale of Maggi noodles, the court had said.
Following the hearing on Friday, the company now has to test 45 samples within the next six weeks before it can get the go-ahead to resume sales. The sampling procedure will be decided by the food safety officer, the court said.
Meanwhile, with the country’s largest noodles brand off the shelves, yoga guru Ramdev has launched his own brand of atta noodles from his consumer packaged foods company, the Patanjali Group. These noodles are a healthy alternative to Maggi noodles, Ramdev claimed.
Also, ITC Ltd, maker of Yipee noodles, has launched a fresh campaign for its noodles, which talks about the safe and hygienic environment and quality standards the company uses in manufacturing the product.
Nestle has also launched three commercials on its official YouTube channel Meri Maggi as it looks at keeping the brand alive in the minds of its consumers. Bringing Maggi noodles back to retail shelves was a priority, Nestlé India managing director Suresh Narayanan said in August in an interview to television channel CNBC TV18.
