We want to test 31 more Maggi noodle samples: government

The government on Monday told an apex consumer forum hearing its Rs 640-crore class action suit against Nestle India that it would like to test 31 more samples of Maggi instant noodles, after which the matter was posted for hearing on Tuesday.
"We have identified 31 samples from different batches in a Food Safety and Standards Authority of India (FSSAI) godown, which we would like to test and videograph the proceedings," the government counsel told a bench of the National Consumer Disputes Redressal Commission (NCDRC), consisting of Justice V.K. Jain and Justice B.C. Gupta.
The counsel said there was a need to test samples from different batches as noodle samples already drawn had expired while the class-action suit hearings progressed.
"This class action suit is not just about the lead and monosodium glutamate contents. It is about the government representing consumers of the country regarding mislabelling, misbranding and other unfair trade practices resorted to by Nestle," the lawyer added.
Senior counsel Iqbal Chagla, representing Nestle India, and the government's counsel had heated arguments over more tests proposed by the government, after which the consumer forum posted the matter for Tuesday.
"Considering Maggi noodles is back in the market after it has passed necessary tests as mandated by the Bombay High Court, what is the need for fresh tests," Chagla asked.
If NCDRC orders another round of tests, it could affect the consumers who are purchasing the product and raise questions, he added.
Tests were conducted on October 15 on 13 samples of Maggi noodles from nine batches on a request by the government's counsel.

Troubles of Nestle India are unlikely to be over soon, as the government on Monday sought further testing of 31 batches of its popular Maggi instant noodles at an accredited laboratory to check safety of consumption.
A bench headed by Justices VK Jain may pass an order on the proposed testing on Tuesday. It has also asked the government to identify an accredited lab where such testing could be done.
The government told the apex consumer forum, which is hearing its Rs 640-crore class action suit against Nestle India, that it would like to test 31 more samples of Maggi instant noodles.
“We have identified 31 samples from different batches in a Food Safety and Standards Authority of India (FSSAI) godown, which we would like to test and videograph the proceedings,” additional solicitor general Sanjay Jain said.
“This class action suit is not just about the lead and monosodium glutamate contents. It is about the government representing consumers of the country regarding mislabelling, misbranding and other unfair trade practices resorted to by Nestle,” the lawyer added.
However, Nestle opposed any further testing claiming that it was uncalled for and that the court did not have jurisdiction to allow it.
Nestle India requested the court that they wait until the report of the earlier testing was presented and any further testing may be based on the findings in that report.
“The government is asking for further testing in the hope that they can get something against us. There are 3,500 reports from all over that have given us a clean chit. The three labs under the Bombay HC’s directive also handed us a clean record. Any further testing will bring us back to where we started. We consented to the earlier testing of samples which were their own but they are still not happy,” senior counsel Iqbal Chagla representing Nestle India argued.
“Considering Maggi noodles is back in the market after it has passed necessary tests as mandated by the Bombay HC, what is the need for fresh tests,” he asked, while criticising the fact that in a case like this, where the interest of thousands of consumers was being represented by the government, it was surprising to see that not a single consumer had come up with a complaint.

The firm’s failure to disclose the presence of risk-increasing ingredients was deceptive and misleading, the complaint filed through the consumer affairs department said, while accusing Nestle India of promoting noodles containing excessive lead as healthy with the sole aim of enhancing profits.
After a five-month ban on its Maggi instant noodles by the national food watchdog Food Safety and Standards Authority of India, Nestle relaunched its product in the market on November 9.

Post Maggi blues: All F&B product launches on hold

If food and nutraceutical companies, tired of the long wait to get their products approved by the national regulator, were rejoicing at the new-found freedom to go to the market when they pleased, they have got it all wrong. The Food Safety and Standards Authority of India (FSSAI)'s August 26 circular, stating it was no longer possible for the regulator to continue with the process of product approvals, was not meant to be a signal for free-for-all launch, it is learnt.
Without spelling it out, that circular was about indefinitely putting on hold all product launches, a cause of worry, a source pointed out. The notification followed a Supreme Court order questioning the approval procedures of the regulator.
In such a scenario, the FSSAI headquarters here, a hub of frenetic activity during the summer months leading up to the Maggi noodles ban, is quieter. After the attention it drew from the case linked to Swiss food major Nestle, the corridors of the regulatory office now have closed-circuit television cameras at various angles. The controversy regarding alleged corruption by some FSSAI officials added to the urgency of installing those around the building.

As for the real business they are there for, officials are busy moving files on framing regulatory frameworks that might bring a semblance of order to the food sector, including resuming the process of product approvals. But that would take time, perhaps another year or more. Till such time, there can be no product launch unless it was approved earlier, said an official.
Under the Food Safety and Standards Act, every non-standardised or proprietary food such as noodles, pasta, mayonnaise, sauces and syrups can be launched only with the regulator's approval. So far, 362 standards have been prescribed, and the regulator has plans to standardise another 300 within a year, a step that could ease the burden on food companies, as the number of approvals required will go down significantly. Approvals are not required for standardised products.
"Section 22 of the Act is clear… The August circular of FSSAI did not change the provisions,'' the source said. If anybody releases any product that is poorly covered under Section 22, enforcement agencies are authorised to destroy, confiscate or remove those. The recent controversy around Patanjali atta noodles not having FSSAI approval has brought the subject to focus once more.
FSSAI, which has even discussed the option of refunding the approval fee, currently at Rs 25,000, in case of delay in clearance, has often found applications lacking data on shelf life stability. Estimates suggest a large majority of applications do not mention "for how long a product will remain good". For now, the food sector is worried as to how long the indefinite hold-up would continue in product launch.
According to an executive linked to the beverage sector, the regulatory body has been left without a well-laid guideline. The change in top ranks of the FSSAI has added to the confusion, he said. Yudhvir Singh Malik, who was chief executive during the Maggi probe, was shifted to Niti Aayog as additional secretary. Former agriculture secretary Ashish Bahuguna was brought in as chairman after the post had been vacant for long. "The current deadlock over issuing product approvals and launch of new products by companies is going to persist for a few more months," he said.
"We are in complete darkness,'' said another executive from the sector. The whole system is vague and blurred for us now, he pointed out. Yet another top food company official referred to "lack of enough dialogues between the company and the regulator" as the primary cause of worry.

Maggi, Ramdev and FSSAI: The travails of a regulator without teeth

The Food Safety and Standards Authority of India (FSSAI ) is giving sleepless nights to Indian food manufacturers. First, it was the Maggi controversy, and more recently the row about yoga guru, Ramdev 's Patanjali noodles being launched without the regulator's approval.
Nestle, the manufacturer of Maggi Noodles, won a legal battle against FSSAI when the Mumbai High Court quashed the ban against Maggi. Months later, the Supreme Court also endorsed the High Court judgement of asking the regulator to change its food regulatory laws. The food regulator had asked food manufacturers to get recipe by recipe clearance for even those products that have already been approved.
In the case of Patanjali Noodles, the food regulator's claim has been that the FMCG company may have taken approval to launch other products but not for noodles specifically. Noodles as per the regulator requires prior approval, whereas Patanjali Ayurveda claims that it has licence under the pasta category and that noodles comes under the pasta category. Patanjali Noodles claims that it is yet to receive a legal notice from FSSAI and the deadlock continues.
Amidst all these controversies and confusion, the one thought that comes to everyone's mind is whether the FSSAI really is the ultimate food standards authority in India. And the answer is yes: head honchos of food companies unanimously agree that FSSAI is indeed the ultimate food standards authority in India and no food product can be launched without its nod or the FSSAI licence number (which is found in the rear side of the packaging of all food products).
So, what really is the procedure to obtain a FSSAI license? If a company is to launch a product like pasta, explains A. Mahendran, MD, Global Consumer Products, it needs to declare the ingredients that have gone into making the pasta. "If the ingredients are in accordance with the specified ingredient list of the regulator, then the company gets the FSSAI licence number. However, if the company uses ingredients which are unique and are not part of the regulator's list, then it will come under the proprietary products category and will require prior approval to launch the product."
In the non-proprietary category (products for which the regulator has an approved list of ingredients), the regulator doesn't even verify the product prior to launch, adds the head of a leading food company. The regulator can verify the product months after launch and in case of any discrepancy, it can take the company to task.
The regulator has standards for several categories of food. The standard for butter, for instance, is 82 per cent dairy fat, salt and water. Similarly, for a product like dairy whitener, only 18 per cent sugar content is allowed. However, there are several categories of milk and milk-based products, vegetables, fish and alcoholic beverages for which the regulator has come up with standards only this year. There are a host of other categories of food products for which the regulator is yet to come up with standards.
There is no doubt that the country's food regulator has to get its act in place on setting up sound food standard norms. Several of the existing norms, agree the honchos, are ambiguous and conflicting.
But then, FSSAI as an organisation is also in its infancy. It was launched as recently as 2006, and more importantly, the FSSAI does not have the judicial powers to punish offenders.
Perhaps it is time to empower the FSSAI for bringing in more transparency in the food sector.

Earlier, top FSSAI officials had claimed that Patanjali's instant noodles was launched without its product approval and accordingly slapped a notice to the Baba Ramdev-promoted product for not securing necessary permission from the food regulator.
Food Safety and Standards Authority of India (FSSAI) has asked Patanjali Ayurved to respond to its notice within 15 days, to which Baba Ramdev on Saturday said that the organisation would get back to them in just five days.
"Why in 15 days? We will reply to the notice in just five days once we receive it," Ramdev told reporters in Kolkata's adjoining Howrah district (near Kona) while inaugurating a Patanjali Ayurved facility.
Earlier, top FSSAI officials had claimed that Patanjali's instant noodles was launched without its product approval and accordingly slapped a notice to the Baba Ramdev-promoted product for not securing necessary permission from the food regulator.
"Patanjali Ayurved has not flouted any FSSAI norms. It has not done anything which is illegal or against the system…We have already followed their existing guidelines and if they form any new guideline, we will follow that too," Ramdev said.
"We have not received any notice from the authorities. We will send our legal reply once we get the notice. But let me tell you one thing - we have got the license to produce and sell the 'atta' instant noodles," he added. Asked about the pro-active approach of the FSSAI, Ramdev said: "I would not make any comment on the issue. Every agency has to be proactive and aggressive in their work - I am also proactive in what I do. If all central government agencies become active like this, our nation will make much progress."

Baba in the Soup for Selling Noodles With Pasta Licence

NEW DELHI: Baba Ramdev’s Patanjali Ayurved has been issued a showcause notice by the Food Safety and Standards Authority of India (FSSAI) for launching its instant noodle brand without the requisite permission from the food regulator.


Reacting to the development, Ramdev said in Kolkata on Saturday said that his company was yet to receive any notice from the food regulator.
“So far we haven’t received any notice. When the notice comes, we will give a reply as per law. We will reply to the notice at the earliest. But we assure you that we have the licence to manufacture and sell noodles.”
Patanjali spokesperson S K Tijarawala also said the company hadn’t received any FSSAI notice. “I am not aware of any such notice issued to Patanjali, since we have not received it. We have followed all the rules and guidelines of FSSAI, which we have stated earlier as well”.
The food regulator has asked Patanjali to respond within 15 days. The company had said in a statement earlier that it had followed all the guidelines and regulations of the FSSAI while launching its instant atta noodles and other products. According to the company, it had obtained a licence to sell pasta. The company had also said that according to FSSAI guidelines, pasta and noodles fell in the same category.
In an internal order on November 17, FSSAI chairperson Ashish Bahuguna asked for action to be taken against the company for launching the noodle brand without the regulator’s permission.
After receiving the licence for selling pasta, Patanjali entered into agreements with various companies that have licences for making noodle, it had further said. The company further said that FSSAI had already admitted that it was no longer possible for it to continue with the process of product approval, which was facilitated through an advisory in May 2013, following a Supreme Court order in August.
Patanjali launched its atta noodle earlier this week in 70 gram packs priced at Rs 15, cheaper than competitors, aiming to taking on the market leader, Nestle. Nestle India’s Maggi noodle is now back on shelves five months after FSSAI had banned it, stating that it contained execessive lead content and monosodium glutamate, a claim the company has disproved in court.

Nestlé sells 45 mn Maggi packs within two weeks of relaunch

New Delhi: Nestlé India on Monday said it has started production of Maggi noodles at its Pantnagar, Uttarakhand factory, the fourth of the five plants where it produces the noodles brand in India. The local arm of the Swiss packaged foods company said it has sold 45 million packs of the popular snack within two weeks of its relaunch.
Nestlé India relaunched Maggi on 9 November—after a gap of more than six months.
On 5 June, India’s food safety regulator Food Safety and Standards Authority of India (FSSAI) ordered the company to withdraw all nine variants of the instant noodle brand, calling them unsafe and hazardous for human consumption. It cited the excess lead content and traces of monosodium glutamate (MSG), a flavour enhancer, as reasons.
On 13 August, the Bombay high court set aside the ban, contingent to fresh tests and also said sales could proceed only after the output of the factories was tested.
On 5 November, Nestlé India said its Maggi noodles received clearance from three laboratories certified by the National Accreditation Board for Test and Calibration Laboratories (NABL).
Before the relaunch, Nestlé India resumed production of Maggi noodles at three factories—Nanjangud (Karnataka), Moga (Punjab) and Bicholim (Goa), earlier this month. The company is yet to get regulatory clearance to resume production of noodles at Tahliwal (Himachal Pradesh).
“We are yet to start production in Tahliwal (Himachal Pradesh) and are engaging with the authorities and other stakeholders for necessary clearance. While sales are allowed in most states, in some, where we still require necessary clearance, we are engaging with the authorities,” the company said in a statement. Nestlé India is yet to receive clearance from a few states.
The firm is selling the noodles only in 200,000 retail outlets across 600 cities and towns. It has a reach of 3.9 million retail outlets.
“The re-launch has had a refreshing effect upon employees and across the supply chain as thousands of farmers, distributors, suppliers and retailers are happy to be part of this. Today, the entire ecosystem including our employees and stakeholders are extremely happy and humbled to have been able to return to the consumers their favourite MAGGI Noodles Masala. We are hopeful that this journey will help us re-calibrate, re-charge and re-focus on the brand,” Nestlé India managing director Suresh Narayanan said in the statement.
In the quarter ended 30 September, Nestlé India’s profit fell 60% from the year-ago period to Rs.124.2 crore on account of lower sales.
The net profit came on the back of a Rs.64.4 crore loss, the first in 15 years, in the three months ended June. That loss was caused by a one-time charge of Rs.451.6 crore related to the recall of Maggi noodles from the Indian market.
Equity analysts remained cautious even after the relaunch of Maggi noodles that accounted for about 30% of the company’s revenue in the year ended December 2014.
In a report, equity brokerage firm CLSA retained a sell rating on Nestlé India as the recovery in business is expected to be gradual and revenue will remain around 20% below consensus between 2015 and 2017 (calendar years).
In an investor presentation on 20 November, Nestlé India said its strategy would entail fixing issues with current brands, renovating and extending existing brands into adjacent categories and exploring newer categories depending on the opportunity, margin, differentiation.
“Volume growth is an important priority for management now,” it added.

At one store in Nungambakkam, the 15 packets that had been stocked on Friday disappeared in a day, most bought by a single customer, staff said. A supermarket at Egmore too reported that the noodles had been selling rapidly since their re-entry earlier this week. Another one at Kilpauk had well-stocked shelves with packets of single servings and four and six-packs. However, as of now, only the ‘Maggi Masala’ variant seemed available.
The single-serving packet, which looks much like it did earlier, has a manufacturing date of November 2015 and a message on the front that says: “Our commitment to goodness you can always trust. With quality ingredients.” Vishnu Prasad, who works as a product consultant in the city, and is delighted at the re-launch, said he had bought seven of the single packets and three of the four-packs of the noodles as soon as they became available at a store near him. “My first introduction to noodles was Maggi, and when I was in college, nearly every meal was Maggi. Every time I took a flight I ate at the Maggi counter before boarding. I missed it when it was banned — I did not try any other noodle brand,” he said.
Nestle India, which manufactures the product, had re-launched Maggi noodles on November 9 and commenced sales in several parts of the country after tests — as mandated by the Bombay High Court — had come back clear with lead below the permissible limits. However, the snack was not initially available in Tamil Nadu.
Nestle had also tied up with online portal Snapdeal for home delivery of the noodles, but this service too was not available in Chennai at first, going by tweets. On November 17 and 18, Snapdeal_Help, the official support handle of the portal, had tweeted to two customers who asked about Maggi in Chennai, replying: “Sorry, Maggi is not available in Chennai as of now’ and ‘Maggi has still not been cleared by government, thus it’s not available’. But as of Sunday, delivery to Chennai pin codes was available on the portal. Bigbasket.com, an online grocery store, however, displayed Maggi noodles as ‘out of stock.’
Senior food safety officials said there was no issue with the sale of the noodles as this was a newly manufactured, fresh product. “The banned product was withdrawn and new products have come in. And so, the ban does not apply anymore. In any case, we are going to take a few samples of the new product and test the tastemaker,” an official said.
Another official said the company had intimated the Food Safety Department before commencing sales. “By next week, we will take a few samples for tests. The ban on the old product was only for three months and it expired in September,” he said. On Reliance noodles, which had also been banned in June by the government, he said test reports said they were safe, but the product had not yet been re-launched.

Early this week, Baba Ramdev really did seem to have all the answers. The news of Maggi returning to supermarket shelves should have gladdened my maida-deprived heart, but the Food Safety and Standards Authority of India's (FSSAI) ruined the moment for us all, by calling the Bombay High Court's (HC) order 'erroneous'.
Later, news outlets exploded with the news of Baba Ramdev's plan to launch Patanjali atta noodles, followed by a line of khadi yoga wear, with a special aim to challenge sports conglomerates like Nike and Adidas. But, familiar villain FSSAI played spoilsport again by claiming that the noodles did not have the requisite approval for a launch. Seriously, what does one have to do to have a warm bowl of comforting (albeit questionable) noodles in this country?
The real problem, I realised, was my overdependence on global brands. Didn't that one American sports company — guilty of making the words 'Just do it' so popular that it gets thrown at you by well-meaning friends and family before every life-changing decision you make — deserve a firm beating down? And why do we have to look at a Swiss brand for atta noodles? This unexpected discovery of my hidden addiction to all things global made me quite aghast.
So, to remedy that, I vowed to do a crash course on all things Bharat, Patanjali style, in honour of the man who answered my most pertinent questions that week. If not Maggi, Patanjali atta noodles it must be. No to multinational sports brands? Then say yes to khadi. Oh, and why didn't I win a Pulitzer yet? Just as Ramdev had rationalised his Nobel Peace Prize denial, I too had to look at the mirror and know I was 'black'.
My plan was simple. I would visit three Patanjali stores in the city to observe and learn. My first stop was the Chembur outlet. Finding the store itself was a breeze, with Ramdev grinning down from posters hanging outside. Inside, I was surrounded by those who seemed totally at ease shouting out words like 'Pachak Ajwain Aloevera' and 'Peedantak Taila'. And, just as the shopkeeper looked over at me, I quickly glanced over the hideously green (forgive me Baba!) bottles of amla juice and sachets of 'premium detergent', for a product name behind which I could hide my utter ignorance. I eagerly enquired about the atta noodle which, I was told, was yet to make an appearance in the market. The lady at the counter must have noticed how upset the news had left me, for she handed over an A4-sized products' list.
If you've ever, at some point in your life, wondered about how large a brand Patanjali is, the product list can be something of a revelation. The list is broadly classified into categories such as pachak/ digestives, eye care and bakery (maida free). And if you harbour any doubts about the efficiency of the 35 products listed under the category 'Medicines', just try saying them out aloud — you will probably feel cured by the end of each enunciation. There are names like Madhupashini Vati, Mukta Vati, Sanjeevani Vati and the controversial conception and infertility pill, Putrajeevak Beej, which I learnt with a tinge of disappointment doesn't quite guarantee a son. Like a true Indian, though, I continued to soldier on.
My sense of wonderment continued at a Ghatkopar outlet. I spotted a herbal, rakhtchandan-based sindoor, asatofedia and mixed fruit jam (not fit for diabetics, the label said. My heart soared with pride at the honesty of it all). The only time I snapped out of my trance was when the shopkeeper looked horrified at my timid request for an English version of the product list.
I ended my sojourn in Dadar. The store began to accommodate an evening rush of customers, calling out for bel and amla candy. I enquired about bulk orders and was told that I will have to place orders beforehand, for there were "too many to handle". I tried to strike up a conversation with the youngest customer at the store — a college girl. "I am getting these products for my mother. I have my reservations about them," she said. I smiled beatifically at her, comfortable in the knowledge that it's only a matter of time before she too gets lured by that all-pervasive Baba charm.
I have purchased a couple of Ramdev's yoga CDs, followed him on Twitter and chuckled while thrashing Maggi and the FSSAI on Facebook. Meanwhile, I anxiously await the noodles' launch in the market. Nirvana is surely just a fortnight away.

ஆய் வின் போது ஆலை யில் உற் பத்தி செய் யப் பட் டி ருந்த எண் ணெய் மாதிரி சேக ரித்து அதை உணவு பகுப் பாய்வு கூடத் திற்கு அனுப்பி வைத் த னர். இந்த ஆய் வில் எண் ணெ யில் கலப் ப டம் செய் யப் பட் டது உறு தி யா னது. கலப் பட எண் ணெய் உற் பத்தி செய் யும் ஆலை உரி மை யா ளர் க ளுக்கு, விரை வில் நோட் டீஸ் வழங்க உள் ள தாக அதி கா ரி கள் தெரி வித் த னர்.
இது குறித்து உணவு பாது காப் புத் துறை அதி கா ரி கள் கூறு கை யில்,‘‘ சேலம் மாவட் டத் தில் கடலை எண் ணெய், தேங் காய் எண் ணெய், சன் பி ள வர் ஆயில், ரைஸ் பி ரான் ஆயில், நல் லெண் ணெய் உள் ளிட்ட எண் ணெய் களை உற் பத்தி செய் கின் ற னர். இதில் தேங் காய் எண் ணெ யில் ‘பாம் கெர் னல்’ என்ற ஆயிலை கலக் கின் ற னர்.
கடலை எண் ணெய், சன் பி ள வர் ஆயில், ரைஸ் பி ரான் ஆயி லில் பாமா யில் கலக் கின் ற னர். இவ் வாறு கலப் ப டம் செய் யும் எண் ணெய் யில், அந்த எண் ணெய் வாச னை யுள்ள சென்ட், அதன் பேக் கிங் மேல் அடிக் கின் ற னர். இதன் மேல் சென்ட் அடிக் கும் போது, பேக் கிங் கில் என்ன எண் ணெய் உள் ளதோ, அந்த எண் ணெய் யின் வாசனை அடிக் கும். இது வாடிக் கை யா ளர் களை ஏமாற் றும் தந் தி ர மா கும். மேலும் கலப் ப டம் எண் ணெய் உற் பத்தி செய்து, அதன் பேக் கிங் கில் போலி படம் போட்டு விற்று வரு கின் ற னர். இது சட் டத் திற்கு புறம் பா ணது.

டிரை வர் குமா ரி டம் நடத் தப் பட்ட விசா ர ணை யில் பகீர் தக வல் வெளி யா கி யுள் ளது. இது போன்று சரக்கு ஏற்ற செல் லும் டிரை வர் கள், பெங் க ளூர் சென் ற தும் ஓரி டத் தில் லாரியை நிறுத்தி வைக்க வேண் டும். அங்கு வரும் ஒரு வர், அந்த லாரியை எடுத் துச் செல் வார்.
பின் னர் 5 மணி நேரம் கழித்து, லோடு டன் லாரியை கொண்டு வந்து ஒப் ப டைப் பார். பின் னர், அந்த லாரியை எடுத் துக் கொண்டு மதுரை சென் ற தும், குறிப் பிட்ட நபர் போனில் சொல் லும் இடத் தில் லாரியை நிறுத்த வேண் டும். அங்கு ஒரு வர் வந்து லாரியை எடுத் துச் செல் வார். பின் னர் 3 மணி நேரம் கழித்து சரக்கு இறக் கப் பட்ட லாரி வந்து சேரும். அதன் பின், அந்த நப ரி டம் வாட கையை வாங் கிக் கொண்டு திரும்பி வர வேண் டும். இதில், யார் புகை யிலை பொருட் களை ஏற்றி அனுப் பு கி றார் கள். யார் பெற் றுக் கொள் கி றார் கள் என்ற விவ ரம் ஏதும் தங் க ளுக்கு தெரி யாது என டிரை வர் தெரி வித் துள் ளார்.

இதை ய டுத்து லாரி யு டன், 100 பண் டல் க ளில் இருந்த ரூ.8.80 லட் சம் மதிப் பி லான புகை யிலை பொருட் களை அதி கா ரி கள் பறி மு தல் செய் த னர். பறி மு தல் செய் யப் பட்ட புகை யிலை பொருட் கள் மற் றும் டிரை வர் குமாரை, சேலம் மாவட்ட உணவு பாது காப்பு துறை நிய மன அலு வ லர் டாக் டர் அனு ரா தா வி டம் வணி க வ ரித் துறை அதி கா ரி கள் ஒப் ப டைத் த னர்.

ஆய் வுக்கு செல் லும் போது சேலம் மாவட்ட உணவு பாது காப்பு நிய மன அலு வ ல ருக்கு உரிய பாது காப்பு அளிக்க வேண் டும் என சேலம் காவல் து றைக்கு சென்னை உயர் நீ தி மன் றம் உத் த ர விட் டுள் ளது.
நாமக் கல் மாவட் டம் கல் கு றிச்சி வெள் ளா ளப் பட் டி யைச் சேர்ந் த வர் சந் தி ர சே கர். இவர் விவ சா யி கள் முன் னேற்ற சங் கத் தின் செய லா ள ராக உள் ளார். இவர் கடந்த ஜூன் மாதம் சென்னை உயர் நீ தி மன் றத் தில் மனு ஒன்றை தாக் கல் செய் தார். அதில் ஜவ் வ ரிசி உற் பத் தி யில் கலப் ப டம் நடப் ப தால், சம் பந் தப் பட் ட வர் கள் மீது உணவு பாது காப் புத் து றை யி னர் நட வ டிக்கை எடுக்க உத் த ர விட வேண் டும் என தெரி வித் தி ருந் தார்.
இந்த மனுவை விசா ரித்த சென்னை உயர் நீ தி மன் றம், சேலம் மாவட்ட உணவு பாது காப் பு துறை நிய மன அலு வ லர் அனு ராதா நேரில் ஆஜ ராகி விளக் கம் அளிக்க வேண் டும் என உத் த ர விட் டது. அதன் படி கடந்த ஜூலை 27ம் தேதி அனு ராதா, உயர் நீ தி மன் றத் தில் ஆஜ ராகி ஜவ் வ ரிசி கலப் ப டம் குறித்து ஆலை க ளில் ஆய்வு செய்து, சம் பந் தப் பட் ட வர் கள் மீது நட வ டிக்கை எடுத்து வரு வ தாக தெரி வித் தார். இதை ய டுத்து இந்த வழக்கு விசா ரணை ஒத் தி வைக் கப் பட் டது.
கடந்த 17ம் தேதி மீண் டும் இந்த வழக்கு விசா ர ணைக்கு வந் தது. அப் போது ஆஜ ரான அனு ராதா, கடந்த அக் டோ பர் 29ம் தேதி ஆத் தூர் அடுத்த வளை ய மா தே வி யில் உள்ள ஜவ் வ ரிசி ஆலைக்கு ஆய் வுக்கு சென் ற போது, ஆலை யின் உரி மை யா ளர் மற் றும் அவ ரது ஆத ர வா ளர் கள் 60க்கும் மேற் பட் ட வர் கள் சூழ்ந்து கொண்டு எங் களை சிறை பிடித்து பணி செய் ய வி டா மல் தடுத் த தா க வும், இது போன்ற செயல் கள் நடப் ப தால் தங் க ளுக்கு உரிய பாது காப்பு அளிக் க வேண் டும் என் றும் கேட் டுக் கொண் டார்.
இதை ய டுத்து எங்கு ஆய் வுக்கு சென் றா லும், மாவட்ட நிர் வா கம் மற் றும் மாந கர, மாவட்ட போலீ சார் அனு ரா தா வுக்கு பாது காப்பு அளிக்க வேண் டும் என்று நீதி ப தி கள் உத் த ர விட் ட னர். இந்த உத் த ரவு தக வல் மாவட்ட நிர் வா கம் மற் றும் மாந கர, மாவட்ட காவல் து றைக்கு அனுப்பி வைக் கப் பட் டுள் ளது. இது குறித்து சேலம் மாவட்ட உண வு பா து காப் புத் துறை அலு வ லர் டாக் டர் அனு ராதா கூறு கை யில்,‘‘ நான் ஆய் வுக்கு செல் லும் போது போலீஸ் பாது காப்பு அளிக்க வேண் டும் என்று சென்னை உயர் நீ தி மன்ற உத் த ர விட் டுள் ளது. இதற் கான உத் த ரவு நகல் இது வரை எனக்கு வந்து சேர வில்லை. அந்த உத் த ரவு நகல் வந் த வு டன், மாவட்ட நிர் வா கம் மற் றும் மாந கர, மாவட்ட போலீஸ் அதி கா ரி களை சந் தித்து, கடி தம் வழங்கி ஆய் வுக்கு செல் லும் போது போலீஸ் பாது காப்பு அளிக்க வேண் டும் என்று கேட்க உள் ளேன்,’’ என் றார்.

HC admits plea against revocation of ban order

A Division Bench of the Kerala High Court on Thursday admitted a writ appeal against a single judge’s verdict revoking an order of the Food Safety Commissioner banning the manufacture, storage, selling and distribution of the Nirapara brand of chilly, turmeric and coriander powders.
The Bench comprising Chief Justice Ashok Bhushan and Justice A.M. Shaffique, while admitting the appeal by the State government, made it clear that it shall be open for the Food and Safety Commissioner to take samples of the products and initiate such other measures as permitted under the law.
Quashing the order of the Food Safety Commissioner, a single judge had observed that in the absence of any finding that the banned foods were unsafe for human consumption, prohibition effected was unwarranted and was done in excess of the jurisdiction vested with the Commissioner of Food Safety. The pre-requisite of exercise of the power under Section 30(2) (a) of the Food Safety and Standard Act was the satisfaction that the food article was unsafe for human consumption. The single judge had passed the verdict while allowing a writ petition filed by KKR Food Products, Kalady, manufacturer of the Nirapara brand of spices.
The appeal also pointed out that gluten which was present in the starch and added by the manufacturer was medically proved and accepted to be injurious to those who were allergic to it.

Food Safety can collect Nirapara samples: Kerala High Court


Kochi: Kerala High Court on Thursday permitted the state food safety department to go ahead with the collection of samples of Nirapara products in accordance with the norms. The court admitted an appeal filed by the state seeking to uphold the ban imposed on some of the products of Nirapara.
A division bench comprising Chief Justice Ashok Bhushan and Justice A.M. Shaffique observed, “it shall be open for the food safety department to take samples of the product and take such other measures as permissible under law.”
The state moved the court against the single judge’s order which set aside a prohibition order issued by the commissioner of food safety.
The commissioner had banned the sale of Nirapara brand chilly, turmeric and coriander powder after finding that they were adulterated with cheap starch powder.
Chief secretary Jiji Thomson filed the appeal arguing that Nirapara was a habitual offender. He also sought to quash the observation made by Justice Muhammed Mustaque that “a substandard product can also be sold provided the consumer knows what the contents are.”
This finding would jeopardize the objective of the FSS Act as it is opposed to maintenance of uniform standards of the food products and would violate the provisions of FSS regulations 2011, he said and sought quashing of the observation.The Food Safety Act prohibits the manufacture, storage, sale or distribution of any article of food which is misleading or substandard, the state argued.

Govt to change quality norms for procurement of pulses

Given the difficulties faced in pulses procurement aimed at the creation of a buffer stock, an inter-ministerial group (IMG) monitoring prices of essential commodities has decided to make changes in the quality norms, which would help agencies like farmers' cooperative Nafed, Food Corporation of India (FCI) and Small Farmers' Agribusiness Consortium (SFAC) in stepping up purchase of lentils from farmers.
Sources told FE that the IMG, comprising the officials including from the ministries of food, consumer affairs and agriculture, in a meeting on Wednesday, has decided to make changes in the quality norm for the procurement of pulses so that these agencies could purchase about 1 lakh tonne of pulses for the buffer stocks in the current year.
It has been decided that the agencies would follow norm decided under the Fair Average Quality (FAQ) — relating to foreign matter permissible, percentage of broken matter, etc. for the purchase of pulses from the farmers. As reported by FE, Nafed was finding it difficult to procure pulses from farmers to create a buffer stock because of stringent Food Safety and Standards Authority of India (FSSAI) quality norms.
“The issue of quality specifications was resolved and the procurement of essential commodities is expected to pick up in the coming weeks. With the new arrivals, the situation is expected to further improve,” a food ministry statement late on Wednesday said.
After a directive from the ministry to purchase 35,000 tonne of pulses this season (July-June), farmers’ cooperative Nafed began purchases of arhar dal from the farmers in Rajasthan a few weeks ago. However, sources said, of 39 samples picked up by the Nafed team, only two could meet the FSSAI norm of less than 1% foreign matter presence.

Within this the increase in pay will be 16% ,63% in allowances & 24% in pension; in FY17, financial impact to be 0.65% of GDP

A 23.55% pay hike has been recommended for central government employees by Justice A K Mathur in hisSeventh Pay Commission report that was submitted to Finance Minister Arun Jaitley today.
Within this the increase in pay will be 16% ,63% in allowances & 24% in pension
A minimum salary of Rs 18,000 and a minimum increment of 3% has also been recommended. Maximum salary will be Rs 2,25,000.
The recommendations will directly impact 50 lakh central government employees and 54 lakh pensioners.
One Rank One Pension has been recommended for central govt staffers as well as armed forces
A breakup of the integral recommendations of the Seventh Pay Commission52 allowances will be abolished and for defence personnel 36 allowances will be merged.
"In the 900-page report of Seventh Pay Commission, we've heard all parties, seen hardships of people," said Justice Mathur
Total financial impact in FY 2016-17 is likely to be Rs 1,02,100 crore, which is 0.65% of GDP.
The Pay Commission report has to be implemented from January 1, 2016.

தேனியில் ரூ.1 கோடி மதிப்புள்ள புகையிலை பொருட்கள் பறிமுதல் 2 குடோன்களுக்கு சீல் வைப்பு

தேனியில் உணவு பாதுகாப்பு துறை அதிகாரிகள் மற்றும் போலீசார் நடத்திய அதிரடி சோதனையில், ரூ.1 கோடி மதிப்புள்ள தடை செய்யப்பட்ட புகையிலை பொருட்கள் பறிமுதல் செய்யப்பட்டன.
இந்த சம்பவம் குறித்த விவரம் வருமாறு:–
புகையிலை பொருட்கள்
தேனி நேரு சிலை அருகே நேற்று காலை ஒரு லாரியில், தமிழக அரசால் தடை செய்யப்பட்ட புகையிலை பொருட்கள் கொண்டு வந்து இறக்கப்படுவதாக தேனி மாவட்ட போலீஸ் சூப்பிரண்டு அலுவலகத்திற்கு தகவல் கிடைத்தது. அதன் பேரில் தேனி போலீஸ் இன்ஸ்பெக்டர் முத்துக்குமார் தலைமையில் போலீசார் சம்பவ இடத்திற்கு வந்தனர்.
அவர்களது சோதனையில் லாரியில் இருந்து இறக்கி வைக்கப்பட்டு இருந்த மூட்டைகளில் தடை செய்யப்பட்ட புகையிலை பொருட்கள் இருப்பது தெரியவந்தது. இதையடுத்து லாரியில் 11 மூட்டைகளில் இருந்த புகையிலை மற்றும் பான்மசாலா பொருட்களை போலீசார் பறிமுதல் செய்தனர்.
இதற்கிடையே தேனி பழைய பஸ் நிலையம் அருகில் உள்ள ஒரு குடோனில் தடை செய்யப்பட்ட புகையிலை மற்றும் பான்மசாலா பொருட்கள் அதிக அளவில் பதுக்கி வைக்கப்பட்டு உள்ளதாக மாவட்ட கலெக்டர் வெங்கடாசலம், போலீஸ் சூப்பிரண்டு மகேஷ் ஆகியோருக்கு ரகசிய தகவல் கிடைத்தது.
ரூ.5 ஆயிரம் அபராதம்
அவர்களுடைய உத்தரவின் பேரில் உணவுப்பாதுகாப்பு துறை நியமன அலுவலர் மீனாட்சி சுந்தரம் தலைமையில் அதிகாரிகளும், தேனி போலீசாரும் சம்பந்தப்பட்ட குடோனுக்கு சென்றனர். அந்த குடோன் பூட்டப்பட்டு இருந்ததால், அதன் உரிமையாளரான தேனியை சேர்ந்த குமரேசனை அழைத்து வந்து திறந்தனர்.
அப்போது உள்ளே 50 மூட்டைகளில் புகையிலை மற்றும் பான்மசாலா பதுக்கி வைக்கப்பட்டு இருப்பது தெரியவந்தது. மேலும் தடை செய்யப்பட்ட பட்டாசுகள் மற்றும் பிளாஸ்டிக் தம்ளர்கள் குவித்து வைக்கப்பட்டு இருந்தன. இதையடுத்து வருவாய்த்துறை அதிகாரிகள் மற்றும் நகராட்சி அலுவலர்கள் அங்கு வந்தனர்.
அங்கிருந்த சுமார் ரூ.20 ஆயிரம் மதிப்புள்ள தடை செய்யப்பட்ட பிளாஸ்டிக் தம்ளர்களை பறிமுதல் செய்யப்பட்டதுடன், குடோன் உரிமையாளருக்கு ரூ.5 ஆயிரம் அபராதம் விதிக்கப்பட்டது. பின்னர் அந்த குடோனுக்கு உணவு பாதுகாப்பு துறை அதிகாரிகள் சீல் வைத்தனர்.
ரூ.1 கோடி மதிப்பு
அதேபோன்று தேனி கடற்கரை நாடார் சந்து பகுதியில் உள்ள சில குடோன்களிலும் அதிகாரிகள் குழுவினர் சோதனை நடத்தினர். அப்போது அங்குள்ள ஒரு அறையில் மூட்டை மூட்டையாக புகையிலை பொருட்கள் இருந்தன. இதையடுத்து அந்த குடோனில் உள்ள அறையினை வாடகைக்கு எடுத்து பொருட்களை வைத்திருந்ததாக கூறப்பட்ட நவரத்தினவேல் என்பவரிடம் போலீசார் விசாரணை நடத்தி வருகின்றனர். அத்துடன் குடோனுக்கும் அதிகாரிகள் சீல் வைத்தனர்.
பின்னர் பெரியகுளம் சாலையில் ரவி என்பவருக்கு சொந்தமான குடோனில் இருந்தும் புகையிலை பொருட்கள் பறிமுதல் செய்யப்பட்டன. இதன்படி அதிகாரிகளின் சோதனையில் சுமார் 90 மூட்டை புகையிலை மற்றும் பான்மசாலா பொருட்கள் பறிமுதல் செய்யப்பட்டன.
இதன்படி பறிமுதல் செய்யப்பட்ட புகையிலை பொருட்களின் மொத்த மதிப்பு ரூ.1 கோடி வரை இருக்கும் என்று அதிகாரிகள் தெரிவித்தனர். அதிகாரிகளின் இந்த அதிரடி சோதனை தேனியில் பரபரப்பை ஏற்படுத்தியது.

Hope FSSAI working on regulations: Food Processing Minister

With yoga guru Ramdev-promoted Patanjali becoming the latest firm to face regulatory issues, Food Processing Minister Harsimrat Kaur Badal on Thursday hoped that the Health Ministry and FSSAI are working on regulations, which ensure removal of “roadblocks and speed breakers”.
The minister said she has already raised the industry’s issues related to Food Safety Standards Authority of India (FSSAI) with the Health Ministry and they are working on the same.
“FSSAI doesn’t come under my ministry. What FSSAI does, I cant comment on it, but I think they are working towards ensuring that roadblocks and speed breakers, which were in place, are removed so that hygienic and safe food is available and industry can carry on with innovations and there is no stalling back and I am sure FSSAI is working on that,” Ms. Badal told reporters on the sidelines of an PHD event here.
The minister also said that she has been informed that the industry’s concerns will be taken care of.
She also declined to comment on Patanjali Atta Noodles issue and said it is a matter between the Ministry of Health and Ramdev.
However, she added: “I am sure that the (health) ministry is looking into it to ensure these kinds of roadblocks are not there.”

Will Sort Out Issue of Approval for Patanjali Noodles with Food Safety Regulator: Ramdev

Yoga guru Ramdev's Patanjali had strongly denied the FSSAI's claims that its instant noodles were not approved.
NEW DELHI: Clarifying his stand on the approval for the sale of Patanjali noodles, Ramdev today said that the company representatives will call on the Food Safety and Standards Authority or FSSAI officials to sort out the issue amicably.
"Our representatives are going to the FSSAI headquarters with original copies of the selling licence, along with the manufacturer's licence. It seems there is an issue of lack of coordination and it could be resolved by sitting together," Ramdev said.
FSSAI had yesterday said that Ramdev's Patanjali instant noodles was not approved by it, a claim the yoga guru had rejected.
"We have got approval from FSSAI. Those who are doing contract manufacturing for us have got approval, too. They have the manufacturing licence."
Minister of Food Processing Industries Harsimrat Kaur Badal declined to comment, saying it's a matter "between the Ministry of Health and Baba Ramdev". However, she added: "I am sure that the (health) ministry is looking into it to ensure these kinds of roadblocks are not there."
The food safety regulator had stated that it wasn't possible to continue with process of product approvals, which was facilitated through an advisory in May 2013, following a Supreme Court ruling in August this year that upheld an order of Bombay High Court on the issue.
According to FSSAI's May 2013 advisory, food products covering a broad spectrum including "novel foods, functional foods, supplements, irradiated, genetically modified foods, foods for special dietary uses or extracts or concentrates of botanicals, herbs or of animal sources" should apply for product approval.
The High Court had ruled that the advisory does not have any statutory backing, but FSSAI had approached the Supreme Court against the verdict.
After the controversy surfaced yesterday, the Congress took a dig at the yoga guru, saying he has developed a new asana called "Noodle asana" which allows him to produce noodles without any regulation.
Patanjali had launched 'atta noodles' earlier this week in 70 gram packs priced at Rs. 15, claiming it to be cheaper than competitors', with an eye to take on market leader Nestle's Maggi, which is back at shelves five months after FSSAI had banned it.

Food Safety Commissioner can issue ban orders: State

The State government on Wednesday filed an appeal in the Kerala High Court against a single judge’s verdict setting aside an order of the Food Safety Commissioner banning the manufacture, storage, selling and distribution of Nirapara brand of chilly, turmeric and coriander powders.
In its appeal, the government contended that the Food Safety Commissioner had the power to issue such prohibition orders necessary for the implementation of the provisions of the Food Safety and Standards Act, including the matters related to public health as well as consumer interest. The quashing of the order without consideration of the functions and duties of the Commissioner was improper.
The Food Safety Commissioner was duty bound to ensure that the products manufactured and supplied by KKR Food Products, Kalady, manufacturer of the Nirapara brand of spices conformed to the standard specified under the Food Safety and Standards Act and the Commissioner was, therefore, justified in issuing a ban order.
Besides, Section 30(2)(a) of the Act did not in any manner restrict or regulate the power of the Food Safety Commissioner to prohibit the manufacture, sale, storage, distribution of food articles which did not conform to the standards fixed..
The government said that gluten which was present in the starch and added by the manufacturer was medically proved and accepted to be injurious to those who were allergic to it.
Therefore, it could not be said that starch mixed with the product did not harm the consumers allergic to it. So, it could not be said that the substandard food article produced by the manufacturer were neither unsafe nor injurious to health as defined under the Act.
The single judge had observed that that there was no finding in the order that the banned foods were unsafe for human consumption. The statutory provision under the FSS Act clearly delineated proportionate measures in the case of food which was found unsafe for human consumption and food of substandard which was fit for human consumption.

Government Files Plea Against Single Judge Order on Nirapara

KOCHI: The State Government has filed an appeal challenging the single judge’s order which set aside a prohibition order issued by the Commissioner of Food Safety banning sale of Nirapara products.
The government also sought to set aside the observation that “a substandard product can also be sold provided the consumer must know what the contents are”.’’
This finding would jeopardise the objective of the FSS Act as it is opposed to maintenance of uniform standards of the food products and would violate the provisions of FSS Regulations 2011 and hence the observation has to be set aside,’’ it was stated in the petition.
Terming Nirapara a habitual offender manufacturing and supplying adulterated/sub standard food products in the market, the government submitted that Single Judge should not have exercised its discretionary jurisdiction under Article 226 of the Constitution of India in favour of such a company.
‘’’Powers are conferred on the Food Safety Commissioner to issue such orders necessary for the implementation of the provisions of the Food Safety and Standards Act (FSSA) including matters related to public health as well as consumer interest. The Act prohibits manufacture, storage, sale or distribution of any article of food which is misbranded or substandard or containing extraneous matter. It clearly indicates that extraneous matters (including foreign starch) must be absent in chili powder, coriander powder and turmeric powder. It specifically prohibits sale of turmeric containing any extraneous matter. Despite all these provisions in Act, the learned Single Judge held that there is no prohibition for the sale of substandard food article’’ the government submitted.
“Since the prohibition order has been passed when the remedial and preventive measures provided in the Act has become ineffective in curbing the continuous violation and also to give effect to the mandate of the Act, the single judge ought to have considered whether such an order was necessary to give effect to the provisions of FSSA.
Perpetual violation of the provisions of the Act is explicit and hence setting aside the order without consideration of the functions and duties of the commissioner is improper and hence the judgement is bad in law,” the government submitted.

Maggi plant workers in quandary as FSSAI moves SCA

NAINITAL: Two days after the Food Safety Standards Authority of India (FSSAI) moved the Supreme Court over the ban imposed on Maggi, workers at the Rudrapur plant of Nestle are in a quandary over their future.
Former contractual workers of the plant were forced to work as rickshaw pullers and perform other odd jobs fearing that production at the plant would be delayed, thereby dashing their hopes of re-employment.
As one interacts with these workers, a number of whom are migrants, working at the plant was not only a matter of pride but also a steady source of income. They say they have pinned their hopes on the Bombay high court's recent order giving a clean chit to Maggi and hoped that production resumes soon.
Stating that there were reports that the matter was being taken again to the Supreme Court, Ramesh Jha, a former contractual worker, said, "This may hinder the start of production in SIDCUL (State Industrial Development Corporation of Uttarakhand Limited), Udham Singh Nagar plant of Nestle. We fear that the process will get delayed far more than we expected."
Apart from on-roll employees of the company, over 1,100 contractual workers, vendors, transporters and other associates of the organization were hoping for a breakthrough in the ongoing freeze but the same seems to have been marred now.
Production units of Nestle in SIDCUL had halted production after the ban. All five units in the factory used to produce around 300 tonnes of Maggi noodles per day.
State food safety commissioner Raelier had on Monday written a letter to the Food Safety and Standards Authority of India (a copy of which is with TOI) asking the central body to clarify if the ban imposed on June 5 was still active or not.
Ban on the noodles and suspension of its production in SIDCUL production plant had provoked Lalta Prasad, a contractual worker hailing from Bareilly in Uttar Pradesh, to commit suicide in June this year as he was rendered jobless.
The Food Safety Department of the hill state had decided to ban Maggi on June 3 after objectionable amounts of monosodium glutamate (MSG) was found in the product.

Ramdev spars with food regulator over noodles sale permit

NEW DELHI/MUMBAI: After Nestle's Maggi, Baba Ramdev's Patanjali Yogpeeth has locked horns with India's food safety regulator over its newly launched instant noodles, saying it had all necessary licences to sell the snack.
Reacting to Food Safety and Regulatory Authority of India (FSSAI) chief Ashish Bahuguna's statement that the noodles didn't have mandatory product approvals, Patanjali said it had committed no violation as it had a relabelling licence - which allows it to sell noodles manufactured by other companies which have a valid licence.
"We categorically state that we have followed all FSSAI rules and guidelines with regard to Patanjali atta noodles. We have committed no violation," Patanjali spokesperson S K Tijarawala said. Company officials went a step further, questioning the premise on which FSSAI had flagged the product which was launched on Monday, a week after Maggi returned to shelves.
"Mr Bahuguna does not know what he is talking about. First, according to a court order, FSSAI does not have a product-approval system in place at present. Second, noodles come under the pasta category, according to FSSAI norms, for which we have all licenses," a senior Patanjali executive TOI.
Experts say the only issue that may now emerge would be over the relabelling licence that Patanjali is relying on.
Bahuguna, who confirmed that he had sought action over Patanjali noodles, did not comment on the issue further but told TOI that "product approvals are not taking place since the Supreme Court had in August quashed the product approval advisory issued by the FSSAI."
"We are now in the process of framing new regulations. Once the regulations are in place and standards prescribed, product approvals can take place," he said.
In May 2013, FSSAI had issued an advisory that stated food products covering a broad spectrum needed to apply for product approvals. The advisory was, however, struck down by the Bombay High Court in August 2014. The verdict was later upheld by the apex court, necessitating the framing of new regulations.
FSSAI has been fighting a long-drawn battle with food companies in the country over product approvals, after it allegedly found traces of excess lead and undeclared monosodium glutamate (MSG) in packs of Maggi noodles in June. Earlier this week, FSSAI had moved the Supreme Court against the Bombay High Court ruling that lifted the ban on Maggi. It appealed against the manner in which the HC faulted its testing process.
The Patanjali spokesperson said since FSSAI had notified on August 26 that its advisory had 'ceased' to be operation, the company had applied and got its relabeling licence on October 15. Hence, there was no need for it to apply for a product approval licence, he added.
Patanjali has acquired license from FSSAI for relabeling in the pasta category based on which it has entered into agreements with several companies that possess licenses to manufacture noodles, it said in a statement.
The instant noodles brand is just one of several new launches that Ramdev's Patanjali is planning in the near future which range from 'yogawear' apparel to health drinks. We will be a Rs 5,000-crore company this year. We have grown by over 150% over last year," Ramdev had told TOI recently.

Pasta or noodles? Baba Ramdev's Patanjali and FSSAI spar

The statement said that FSSAI had granted Patanjali a "relabelling licence", under which they had given contracts to manufacturers who had the appropriate licence for noodles to make this product.
After Baba Ramdev's instant atta noodles got into trouble for not having the appropriate licence from the Food Standards and Safety Authority of India (FSSAI), his company Patanjali Ayurved spoke out, saying there was no violation of food regulator's rules on their part.
Baba Ramdev's spokesperson S K Tijarawala put up a statement on social media defending Patanjali's position, saying there was no contravention of any of the food regulatory body's rules. The statement said that Patanjali had received a licence from FSSAI in the "central category" for pasta. According to the FSSAI's own definition, the statement continued, noodles come under the pasta category.
The statement said that FSSAI had granted Patanjali a "relabelling licence", under which they had given contracts to manufacturers who had the appropriate licence for noodles to make this product.
The statement also said that according to the Bombay High Court, FSSAI did not have the authority to give "product approval", something which the director (product approval) had admitted in a statement on 26 August, 2015.
This referred to a Bombay High court order from 2014, upheld by the Supreme Court in August this year, quashing a product advisory on food safety norms issued by the FSSAI, in May 2013, which required packaged food, beverages, health drink and supplement makers to disclose any ingredient or formulation change to the regulatory body. The high court had found that the advisory lacked any legal force, and had to be ratified by the parliament.
Though the FSSAI chairperson Ashish Bahuguna did not reply to dna's queries over phone or email, it was learnt that the body had caught upon the smallest of details in their rules to crack down on Patanjali; the category for pasta includes noodles but not instant noodles. The latter would be any noodles that claims to be cooked in two to three minutes, as Patanjali atta noodles has branded itself. According to media reports, Bahuguna himself wanted "appropriate action" taken into the matter.
Both Patanjali and the FSSAI seem to be locking horns on the change one word can bring to the definition and categorisation of a product. Baba Ramdev, too, in his interviews to TV channels said that his company had not done anything illegal in producing and launching these noodles. However, according to sources, Ramdev is himself on the job, ensuring that all obstacles are ironed out as the noodles hit the shelves.

The Food Safety and Standards Authority of India (FSSAI) has decided to issue a notice to Patanjali Ayurved on the atta noodles that it launched earlier this week, reportedly without the required approvals.
As reported by The Indian Express Wednesday, the FSSAI said the noodles brand launched by yoga guru Ramdev had not obtained mandatory approvals.
While Patanjali cited its licence to manufacture pasta, Ramdev said in Kolkata that there was “some confusion” that would be resolved.
“All units manufacturing Patanjali Atta Noodles have licence and product approval. Patanjali Ayurved has also obtained permission from FSSAI for selling the product. There has been some confusion which we will sort out,” he told a TV channel.
But the FSSAI maintained that instant noodles is a pre-cooked item — though the packet of Patanjali noodles does not mention the word ‘instant’, it takes three minutes to cook which entails prior cooking — and hence does not come under its definition of pasta. Besides, the masala mix too requires approval.
“Noodles and instant noodles are different products, even in codex (internationally accepted food standards) the standards for the two are different. Instant noodles is pre-cooked, so it cannot be manufactured under a licence for pasta. The masala mix by itself is a non-standardised item so it requires product approval from us. There are 10 companies in the country right now which have licence to manufacture instant noodles. Neither Patanjali nor Aakash Yog are in that list,” said FSSAI chairman and acting CEO Ashish Bahuguna.
Asked what his next step would be given that Patanjali noodles do not hit the stores till next month, he said: “We will ask for a clarification from them, we will issue a notice.” Patanjali has said it holds licence for a range of products including pasta, which by FSSAI’s norms is a generic name that includes noodles.
