FSSAI for setting up equipment to test quality in outlets selling milk
Keeping in view the reports about milk adulteration and subsequent directions from the Supreme Court, Food Safety and Standards Authority of India (FSSAI) has decided to facilitate food business operators (FBOs) from the milk trade in setting up infrastructure for milk testing at their premises.
In this regard, according to a circular issued by the apex food regulator, FSSAI wants vendors to install such infrastructure to enable the consumer, bulk or individual, to test the milk for any kind of adulteration.
The circular says, “Concerns were raised time to time about quality of milk and milk products sold, particularly in festival time. The FSSAI, therefore has decided to facilitate setting up of infrastructural facilities to enable the customers, bulk and individual to test these products.”
The aim is to give easy access to consumers to the testing equipment so that the safety and quality of the milk can be ensured at the shop.
With regards to that the apex food regulator has sought information regarding equipments for milk testing, conventional and rapid, to test quality of milk and milk products.
The equipments found suitable will be put on demonstration before the consumers and regulatory officers.
Metropolitan cities will be the first to have the mechanism in place, where milk outlets are present. The FSSAI aims at setting up of the facilities during the current festive season.
It is pertinent to mention here that during the festive season, the quality related to milk and milk products always remains a matter of concern while FSSAI feels that this setup will help the shop-owners and others to establish their credibility.
It may be noted that the apex court had directed the Union government to put in place stringent penalties for milk adulteration after which the ministry of health decided to amend the sentence for milk adulteration to make it more harsher.

FSSAI CEO transfer: Friend informed Yudhvir Singh Malik
NEW DELHI: It was a friend's call through which Yudhvir Singh Malik got to know about his transfer from food safety regulator FSSAI, where he served as CEO for just about a year but brought it into limelight with the Maggi ban.
Malik, who took charge of his new posting as Additional Secretary at NITI Aayog today, refused to get into the "reasons" for his sudden transfer, but sources said he was not in the know till the night of September 22 - the date on which the orders were issued.
When contacted, Malik told PTI: "As a civil servant, I should not get into the reasons of my transfer. As soon as I got orders from the government, I moved on to join the new assignment given to me."
Sources in the Food Safety Standards Authority of India (FSSAI) said everyone in the organisation was in dark about Malik's transfer.
"... none of us were aware about this, infact even Malik himself had no idea. He attended the office on September 22 as any other day," a source said.
"Malik himself came to know about his transfer when one of his friends, a bureaucrat, called him late in the night on September 22 to ask why he was being transferred," the source added.
Malik, a 1983 batch IAS officer of Haryana cadre known for his upright attitude, was not the favorite of the industry.
He had also handled the critical issue of land acquisition in Haryana.
At FSSAI, after the Maggi ban, Malik faced criticism from both, government and the industry.
Food Processing Minister Harsimrat Kaur Badal had said that the food regulator has created an environment of "fear" in the industry.
The minister also said that actions taken by the FSSAI were discouraging innovations in the food processing sector.
Despite all the criticism, FSSAI under Malik continued to remain vigilant regarding food safety issues and keep on issuing advisories.
During his tenure, the regulator issued advisories for neutraceuticals, issued guidelines to regulate salt, sugar and fat in food products sold or served at eating joints.
It was during his tenure only that regulator started working on framing the standards for alcohol products including whiskey, among others.
Centre asks TN to curb use of pesticides
Thiruvananthapuram: The Food Safety and Standards Authority of India has issued an order asking Tamil Nadu not to use pesticides excessively on vegetables, recognising Kerala’s battle against poisonous vegetables coming from Tamil Nadu.
Following a report from the food safety commissioner of Kerala, the authority conducted its own tests and found out that vegetables from Tamil Nadu contained pesticides above permissible limits, after which it took the action.
The fact that even in tests conducted in Tamil Nadu it was found that pesticides were used excessively on vegetables was a setback to the state, which until now was not willing to accept Kerala’s stand.
An inspection by food safety officials of Kerala in farms in Tamil Nadu had found out that pesticides were used in a big way on vegetables at different stages of farming and even after harvesting them.
Food safety commissioner T.V. Anupama had submitted to the government a report prepared by a committee headed by joint food safety commissioner K. Anil Kumar along with evidence. Though Chief Minister Oommen Chandy and Health Minister V.S. Sivakumar wrote a letter to Tamil Nadu along with this report, the neighbouring state did not act on it.
Following this, the food safety commissioner approached the Food Safety and Standards Authority of India urging it to intervene in the matter. Former minister Binoy Viswam too wrote a letter to the authority with the same demand.
The authority took a stand that it cannot act only on the basis of a report from Kerala, and it assigned Dr K.K. Sharma to conduct a detailed inquiry. Then samples of vegetables were collected from Tamil Nadu and they were scientifically tested at Tamil Nadu Agricultural University in Coimbatore and Kerala Agricultural University in Vellayani, which confirmed excessive use of pesticides.
Following this, as per sections 20 and 21 of the Food Safety and Standards Act, the authority issued the order to take preventive measures to reduce the use of pesticides in vegetables and fruits.

FDCA to strengthen online regulatory system to up food safety in Gujarat
In a move to strengthen the overall regulatory system in the state, the Gujarat FDCA (Food and Drugs Control Administration) is soon planning to adopt and implement its renowned IT software and online application system namely the XLN software across its food division, to ensure food safety measures in line with that of drugs. With this move, the state regulators aim to have a more systematic approach towards regulating and controlling over 2 lakh registered food business operators (FBOs) across the state under the Food Safety & Standards Regulations, 2011
It is understood that Gujarat FDCA is already in the last leg of finalising the project, which is expected to go on floors soon, with an investment of Rs 40 lakh for hardware and software development along with skill appraisals and training of food officials for the same. If things go as planned, the regulators hope to see the online food monitoring and licensing system to begin its operation successfully within a year’s time.
Interestingly, unlike NIC (National Informatics Centre), which usually undertakes online or IT application projects for the government agencies, this time the Gujarat Informatics Ltd (GIL) will be doing this project for the state regulators. Dr Hemant G Koshia, commissioner, FDCA, Gujarat, stressed that since NIC was overloaded with additional work from across the country with a surge in e-governance initiatives undertaken nationwide, they decided to get the assistance of GIL.
“Our main purpose is to implement and start the operations of this system at the earliest, so that we can improvise and boost the standard of our food safety initiatives. Like our previous endeavours targeted in safeguarding the health of the citizens through IT intervention and e-governance initiative for the drug safety, we are more than excited to adopt the same for food as well. This is sure to bring in easy and efficient dissemination of all the vital information in time, upgrading our regulatory capacity while bringing in better transparency in our work culture. Most importantly it is targeted to achieve the best consumer safety measure, as health of our citizens is our prior concern,” he added.
Right now all the regulatory and monitoring functions of food related activities are conducted through taluka, corporations and district level offices. Once the IT application or software is linked through it will aid in faster delivery of services with easy access to test results for regulatory purpose and less bureaucratic hurdles for the stakeholders.
Currently out of the 2 lakh registered FBOs, nearly 50,000 are registered as manufacturers whereas the rest of the 1.5 lakh FBOs are registered as wholesalers, retailers or hawkers. It is important to note that Gujarat is a major hub for spices and condiments as well as food processing units, especially with it being one of the major producers and exporters of potatoes and mangoes from the country. In fact, Dr Koshia informed that Gujarat had the country’s largest number of food processing units especially once dedicated to potato chips or fingers, which are manufactured and distributed globally for consumption.
With this project underway, the Gujarat FDCA becomes yet again the first state regulator to conceptualise and implement such a well-planned and structured e-governance initiative in the country for food safety.
China to introduce stronger food safety law from October 1: CFDA official
China is all set to introduce a stronger food safety law from October 1, 2015, according to a senior official from China Food and Drug Administration (CFDA).
Guo Wenqi made the remark at a seminar on food safety and rule of law in Guangzhou, capital city of south China's Guangdong Province.
In April, the Standing Committee of China's National People's Congress (NPC), the country's top legislature, adopted an amendment to the 2009 Food Safety Law with the heaviest civil, administrative and criminal penalties yet for offenders and their supervisors.
According to Guo Xiaoguang, head of CFDA Bureau of Investigation and Enforcement, the CFDA has been working with a dozen agencies, including financial institutions, taxation and fiscal departments, on dealing with serious food safety violators.
Enterprises that violate the revised law may face restrictions on loans, taxation, bidding and land use. The CFDA will also provide bigger rewards to whistleblowers.
Hua Jingfeng, deputy head of Public Order Administration at the Ministry of Public Security, said, "We encourage tip-offs from the public and food industry associations."
He said the ministry wants trained police specialised in food crime and so far 21 provincial public security departments have set up food safety teams.
Guan Yingshi from the SPC said people's courts are taking measures to promote public awareness of food safety law. For example, trials of some notorious food crimes will be on live broadcast.
The Supreme People's Procuratorate will take action over neglect of duty in food production as well as safety supervision.
"By analysing the underlying causes of the cases through investigations and trials and drawing lesson from them, the SPP will be able to give advice and help businesses set up regulations and fix loopholes," said Huo Yapeng of the SPP.

NEW DELHI: The outgoing chief of the Food Safety and Standards Authority of India(FSSAI) Yudhvir Singh Malik has suggested that he was completely in the dark about his shift to Niti Aayog, the latest in a growing list of bureaucrats to be taken by surprise by sudden transfers.
Malik, who has been at the FSSAI for just about a year, was transferred late on Tuesday and will take up his new position as an additional secretary in the Niti Aayog on Thursday.
Asked by ET how he came to know about his transfer, he said: "Never ever in my 30-year career have I been called by someone and asked if I have been transferred. I said, 'I don't know'."
He declined to comment on possible reasons for his transfer, especially if it was his hardline stance during the Maggi noodles controversy, which cost him his job.
Malik, a 1983 batch IAS officer of Haryana cadre, was the man behind the ban of Nestle's popular noodle brand Maggi for having higher than permissible levels of lead, and faced opprobrium from the food industry, especially the multinational food companies, for the manner in which the FSSAI went about its business.
The FSSAI also drew fire from within the government too, with Union Food Minister Harsimrat Kaur Badal criticising it for fostering an "inspector raj" that put at risk companies' expansion plans and defeating the Modi administration's Make in India initiative.
Malik declined to comment when asked if pressure from multinational firms had anything to do with his transfer, only saying he would take up his new role with dedication.
Representatives of five industry associations CII, FICCI, ASOCHAM, PHD Chamber and AIFPA, whose members include top domestic producers and the Indian arms of international food and beverage makers such as Britannia, Coca-Cola and Mondelez, had raised concerns at a meeting with the health secretary, to resolve the "crisis" sparked by the Maggi ban. It is understood the ministry of food processing, PMO and other ministries wanted issues related to food safety and standards to be resolved at the earliest.
FSSAI, which comes under the Ministry of Health & Family Welfare, had banned Swiss-based Nestle's Maggi noodles in June, stating that the snack was 'unsafe and hazardous' after its tests found the presence of lead above permissible limits and flavour enhancer monosodium glutamate. However, the ban was later lifted by the Bombay High Court.

Till now no decision has been taken by the government on approaching the SC on upholding the ban.
Twice in the last 40 days, outgoing Food Safety and Standards Authority of India (FSSAI) CEO Y S Malik recommended on file that the Central government should move a Special Leave Petition (SLP) in the Supreme Court against the Bombay High Court’s order on Maggi. The last time was less than a week before his removal from the food safety authority late on Tuesday night. Till now no decision has been taken by the government on approaching the SC on upholding the ban.
The decision to move him to the Niti Aayog came exactly nine months after he took charge of the FSSAI, a tenure during which the authority took on several corporates including the decision to ban nine varieties of the Maggi instant noodles. The ban was lifted by the high court on August 13. Nestle subsequently filed a petition for revision of the order for typographical errors. The revised order was issued on September 4 and uploaded on its website September 16.
Sources in the FSSAI said that first after the August 13 order, and then again after the September 4 order, Malik noted on the file that the government had adequate ground to move an SLP in the apex court seeking upholding of the ban.
When contacted, Malik refused to comment on the matter. He is due to join Niti Aayog on Thursday.
Sources claimed that FSSAI’s pro-activeness in the matter of Maggi did not go down well within the government, which apparently viewed the move as one that would spoil the investment climate in India.
The move to remove Malik on the eve of PM Narendra Modi’s US visit seemed to further indicate the NDA government’s discomfort with “targeting” the MNCs.
The order to ban Maggi was issued on September 5, minutes before the company held a press conference announcing voluntary withdrawal of the product. The Bombay High Court held that adequate opportunity had not been given to the company to present their case.
However, sources in the health ministry said that the fact that there were apprehensions about the Maggi case marring the investment climate was informally conveyed to officials in the food authority. Sources added that the government preferred that the HC order go unchallenged.
In the recent past, there were several other instances when FSSAI turned down applications for new product approvals, including that of a Singapore based company that wanted to introduce what it called a “chocolate compound” with a 61% carbohydrate and 33% fat content.
It had also rejected a slew of products already on sale by companies like Kellogg’s and Starbucks and also issued repeated instructions to state food safety officials to disallow sale of any products that lacked proper product approvals.
Salem FSDA official complains of harassment
T. Anuradha, Designated Officer of the Tamil Nadu Food Safety and Drug Administration Department , has preferred a complaint with the City Police Commissioner against a businessman and two others on Tuesday alleging that she was abused and threatened over phone, for banning production of two juices of the company run by the former.
Banned
Official source said that the District Collector received complaints about addition of high amounts of preservatives in the drinks amla and aloe vera juice produced by the manufacturer.
Following the complaints, TNSFDAD slapped a ban on these drinks.
Harmful to health
Official sources said that it has been proved in the tests that these two juices contained high amount of ascorbic acid and benzoic acid, which are harmful to health.
The source said that the details of the ingredients were also not mentioned on the bottles.
Based on the test reports, the officials slapped a ban on the production and marketing of amla and aloe vera juice and notice was issued to the company.
The company was also instructed to destroy the stocks.
Phone calls
Following this action, Ms. Anuradha was said to have received phone calls from R. Sivakumar, managing director of the company abusing and threatening her.
His two other supporters were also said to have threatened her over telephone. Besides, a cable TV was used to spread false reports about the officer.
Health Department
Ms. Anuradha brought this to the notice of the district administration, and also the health department authorities and sought their nod for preferring a complaint against all the three.
She preferred the complaint with the City Police Commissioner on Tuesday against all the three and also against the cable TV.
HC notice to Haryana on tobacco ban
CHANDIGARH: The Haryana government's decision to ban sale and purchase of tobacco products in the state, has come under the scanner of the Punjab and Haryana high court. On Wednesday, Justice Paramjeet Singh issued a notice to the state government to file a reply on the issue by October 14.
The court was hearing a bunch of petitions filed by Dharampal Satyapal Limited (DS Group), Trimurti Fragrances Private Limited (producers of Zafrani Zarda) and Smokeless Tobacco Association, a registered body of chewing tobacco manufacturers, traders, dealers and suppliers. The petitioners have challenged the September 3 order, imposing total ban on manufacturing and sale of chewable tobacco in the state.
The petitioners told the high court that the Haryana government order was without jurisdiction in terms of the Food Safety and Standards Act, 2006, and also in conflict with the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003, which dealt with the provisions of manufacture and sale of all types of tobacco products.
They submitted that while passing the order, the Haryana government had failed to take cognizance of the fact that tobacco in any food was prohibited by the above regulation, which makes it very clear that tobacco was not a food product. The petitioners cannot be punished arbitrarily and be made to close their business of selling and manufacturing of chewable tobacco on the basis of presumption that chewable tobacco caused damage to health of consumers without getting corroborative evidence from any study being carried out by state of Haryana, they argued.
On September 3, state food and drugs administration department had issued notification, under which, sale and purchase of tobacco products was prohibited for one year in the interest of public health. The ban also includes mix of other ingredients such as heavy metals, anti-caking agents, except to the extent of specifically permitted as ingredients, silver leaf, binders, flavours, scents, fragrances, prohibited chemicals or any one of these ingredients.

He further submitted that the petitioners cannot be punished arbitrarily and be made to close their business of selling and manufacture of chewable tobacco on the basis of presumption that chewable tobacco causes damage to health of consumers without getting corroborative evidence from any study being carried out by state of Haryana is illegal, without jurisdiction and violative of principles of natural justice.

Market checking intensified ahead of Eid
SRINAGAR, SEPTEMBER 23:
At Tangmarg, a team headed by SDM Tangmarg also conducted market checking at Tangmarg and Kunzer markets. During the market checking, a fine of Rs. 15,000 was imposed upon the shopkeepers for violating the provisions of Food Safety and Standards Act 2006 and Essential Commodities Act. Two quintals of rotten vegetables were destroyed and 4 kg of Polythene was also seized.
Fine of Rs 70000 imposed in Ganderbal
The Court of Adjudicating officer under Food Safety Act (FSA)-2006, Additional District Magistrate Ganderbal, Syed Shahnawaz Bukhari today imposed Penalty of Rs 70000 on different food business operators, who were selling/manufacturing “misbranded and substandard” food items to the consumers.
Meanwhile, the Additional District Magistrate Ganderbal directed the concerned department to ensure routine market checking in the district, so that quality food is made available to the general public.

Man behind Maggi ban moved out of FSSAI, shifted to Niti Aayog
Malik, a 1983 batch IAS officer of Haryana cadre, was appointed to the post of Chief Executive Officer in Food Safety and Standards Authority of India (FSSAI) under Health and Family Welfare Ministry, only in September last year.
The Appointments Committee of Cabinet(ACC) headed by Prime Minister Narendra Modi has approved the appointment of Malik as Additional Secretary in the Niti Aayog, an order issued by Personnel Ministry said.
He has been appointed in the newly created post by cancelling the appointment of Keshni Anand Arora, his batch mate from the same cadre.
It was during Malik's tenure that samples of Maggi noodle samples were subjected to lab tests which found that it contained added Monosodium Glutamate (MSG) and lead in excess of the permissible limit.
FSSAI had on June 5 banned the instant snack that has had a level of global resonance that's unprecedented for the Indian food regulator.
However, the ban was later lifted by the Bombay High Court with the condition that manufacturing and selling would be allowed only after fresh tests.
The ACC also approved appointments of Kavita Gupta and Kiran Soni Gupta as Textile Commissioner and Additional Secretary and Financial Adviser in Ministry of Youth Affairs and Sports respectively.
In a First in Karnataka, 2 Shopkeepers Convicted Under Food Safety Act
BENGALURU:Four years after the Food Safety and Standards Act come into effect, officials of the State Public Health Institute have succeeded in getting conviction for the accused in a case in Karnataka.
According to official sources, two owners of a provision store in Yellapur of Uttara Kannada district, were sentenced to three months’ simple imprisonment and penalised for Rs 10,000.
The convicted are Umesh and Sripad, proprietors of Sri Lakshmi Provision Stores. They were recently punished under Section 59(1) of the Food Safety and Standards Act, for selling artificially coloured tur dal.
Confirming that this was the first conviction after the FSSA Act came into force in August 2011, officials of Public Health Institute (PHI) appreciated the efforts of Arun V Kashibhat, In-charge Designated Officer, Uttara Kannada District.
“Keep up your public interest and safety towards people in the future also,” the Institute told Kashibhat.
The colour may cause harm to intestine or brain, a medical officer of the institute said.
According to PHI, the number of samples analysed found unsafe is 248, sub-standard is 154 and mis-branded is 272, out of 5,863 samples collected in 2013, 2014 and the first six months of 2015.
The samples collected including rice, tea powder, butter, water, tomato sauce and others.
In most parts of the state, the packaged drinking water was found unsafe as the drinking water plants are not following the ISI standards.
Non-ISI drinking water plants in dock
2013: 36 cases in Shivamogga, Kalaburagi, Bijapur and Bagalkot.
2014: 11 cases in Ballary, Haveri and Ramanagaram.
2015: 16 cases in BBMP North, Tumakuru and Yadgir.
In all three years, a total penalty of Rs 2,27,500 was recovered, besides cases being filed against non-ISI plants.
■ The total number of non-ISI drinking water plants seized across the state are 42 in 2013 and 34 in 2014.
■ Number of non-ISI plants dismantled are 74, 46 and 58 in 2013, 2014 and 2015 respectively. Electricity supply was disconnected to 82, 76 and 88 non-ISI drinking water plants.
4,000 rotten eggs destroyed in Salem

Notices issued to traders, bakery owners, poultry unit owners
About 4,000 rotten and broken eggs being transported from Namakkal to Salem city were seized and destroyed by the Tamil Nadu Food Safety and Drug Administration Department officials in the city on Tuesday.
The representatives of Egg Traders’ Association of Salem city sometime ago brought to the notice of T. Anuradha, District Designated Officer, the arrival of rotten eggs from Namakkal district. They were being supplied to the roadside eateries, night stalls and bakeries functioning in the city. All the efforts taken by the association to check the transportation of rotten eggs went in vain.
Ms. Anuradha sought the cooperation of the association members in identifying the vehicles transporting the rotten eggs. As such, association members spotted three vehicles transporting rotten eggs at Seelanaickenpatti in the city on Tuesday morning and informed the Food Safety officials.
Ms. Anuradha and the team rushed to the spot. While two of the vehicles managed to give a slip, the officials inspected the third vehicle which was transporting about 4,000 rotten and broken eggs worth Rs. 6,000 from Buthansanthai in Namakkal district.
As the rotten eggs contained bacteria and were not fit for consumption, all the eggs were seized and destroyed instantly.
The officials issued notice to the egg trader, who was travelling in the vehicle, and the driver. Notices were also issued to the poultry unit owners of Buthansanthai too.
Later, the officials spotted one of the vehicles, which gave a slip, in front of a bakery at Poosaripatti. The vehicle was unloading the rotten egg stock.
The officials seized about 200 eggs and destroyed them. Notices were issued to the egg trader and also the bakery owner.
Ms. Anuradha later told The Hindu that stringent action would be taken under the Food Safety Act against those involved if they continued to indulge in marketing and purchase of rotten eggs, which posed serious health problem to people.

Officials from Food Safety and Drug Administration Department in The Nilgiris conducted a surprise raid in the baking and manufacturing units of two bakeries in Udhagamandalam on Monday and destroyed baked items prepared and kept under unhygienic conditions.
Food Safety Officer for The Nilgiris R.V. Ravi said that the raid was conducted based on complaints from public that ‘varkey’ and other bakery products such as cakes were made under unhygienic conditions and that it posed a threat to public health.
On Monday, the raid was conducted in two manufacturing units at Bombay Castle area in the town.
The units had their bakeries at another place in the town. “We found the raw materials and products kept in poor conditions and destroyed the raw materials and finished items,” he said.
The units were warned to maintain quality of food items and to maintain baking units clean and neat. Dr. Ravi said that they would continue action against such units in the town as they are much sought after by people of the town and are in demand among tourists, too.

After the worm issue, problems for Wendy's started when a 24-year-old man ordered two burgers at its store in Gurgaon's Sector 29. He said he had discovered the pin when he bit into one of the burgers.
"The pin was in my mouth and by the time I realised, it had broken into two," he said. "The Wendy's management was very nice and they assured me that such an incident would never happen again. They were in touch with me even after the incident."
When asked whether it has overhauled its back-end operations after the twin x incidents, Wendy's did not respond. It also did not answer queries on its sourcing procedures in India. International burger chains operating in India usually have third party vendors from where they source their ingredients.

Former peanut company CEO sentenced to 28 years for salmonella outbreak

The former owner of a peanut company in Georgia was sentenced to 28 years in prison on Monday for his role in a salmonella outbreak that killed nine people and sickened hundreds, a rare instance of jail time in a food contamination case.
Stewart Parnell, 61, who once oversaw Peanut Corporation of America, and his brother, Michael Parnell, 56, who was a food broker on behalf of the company, were convicted on federal conspiracy charges in September 2014 for knowingly shipping salmonella-tainted peanuts to customers.
Contamination at the company's plant in Blakely, Georgia, led to one of the largest food recalls in U.S. history and forced the company into liquidation.
U.S. District Judge Louis Sands gave Michael Parnell 20 years in prison. Mary Wilkerson, 41, a former quality control manager at the plant who was found guilty of obstruction, was sentenced to five years in prison.
Stewart Parnell faced life in prison and his brother faced about 24 years.
The Justice Department described Stewart Parnell's sentence as the largest in a food safety case.
Before the judge issued the sentences, Stewart Parnell said; “This has been a seven-year nightmare for me and my family. I’m truly, truly sorry for what’s happened.”
At Monday's hearing in Albany, Georgia, the relatives of several victims described their suffering and asked for stiff sentences.
Jeff Almer, of Brainerd, Minnesota, said his mother, Shirley Almer, died after eating tainted peanut butter in 2009.
"My mother died a painful death from salmonella, and the look of horror on her face as she died shall always haunt me," he said.
"I just hope they ship you all to jail," Almer said.
During the seven-week trial last year, prosecutors said the Parnell brothers covered up the presence of salmonella in the company's peanut products for years, even creating fake certificates showing the products were uncontaminated despite laboratory results showing otherwise.
The Parnells have said they never knowingly endangered customers, and their supporters asked a judge on Monday to show mercy.
"No one thought that the products were unsafe or could harm someone," said Stewart Parnell's daughter, Grey Parnell. "Dad brought them home to us. We all ate it."
An official with the Centers for Disease Control and Prevention testified at the trial that the company's peanut products sickened 714 people in 46 states, including 166 of whom were hospitalized.

While Nestle's recent Maggi ban has sparked off food-safety issues here, in markets such as the US, QSR chains have had to pay hefty compensations to consumers for lapses in food-safety. The most memorable incident is the Liebeck versus McDonald's case. In 1992, 79year-old Stella Liebeck bought a cup of take-out coffee at a McDonald's drive-thru in the US and spilled it on her lap. She sued the burger chain as the coffee was not having the prescribed temperature and was awarded around $2.5 million by the jury for punitive damage (burns).
"Nothing is more important than the quality and integrity of our food, we follow stringent procedures and supplier protocols. This was brought to our attention some time ago and was fully resolved at that time," said a Wendy's spokesperson to a questionnaire sent by TOI.
After the worm issue, problems for Wendy's started when a 24-year-old man ordered two burgers at its store in Gurgaon's Sector 29.He said he had discovered the pin when he bit into one of the burgers. "The pin was in my mouth and by the time I realised, it had broken into two," he said. "The Wendy's management was very nice and they assured me that such an incident would never happen again. They were in touch with me even after the incident."

Food safety tools sharpened
The Health Department took a major step forward in the enforcement of food safety regulations across the State when it entered into a memorandum of understanding with the Central Food Technological Research Institute, Mysuru, for enhancing the State’s laboratory capabilities.
Kerala is the first State to enter into a formal agreement with the CFTRI, one of the referral labs for food analysis under the CSIR, for the enforcement of Food Safety and Standards Act (FSSA), Health Minister V.S. Sivakumar, who formally inaugurated the MoU signing function, said.
He said the State would strictly enforce the mandatory FSSA licence/registration for food-related businesses. Anganwadis, school canteens, hostels, and mass feeding or mass food distribution by religious organisations and institutions would be brought under the ambit of the FSSA.
Strict enforcement
The concept of food safety and the public’s right to safe and hygienic food have been gaining much ground in Kerala in recent times, especially after the food safety wing began strengthening the enforcement of regulations guiding food safety, Health Secretary K. Ellangovan said.
An increasing number of judicial pronouncements in recent times in the enforcement of food safety has boosted the awareness of consumers and the confidence of food safety enforcement officials.
Improving labs
Enhancing the capability of the State laboratories in the scientific analysis of food and various aspects of what makes a food safe or unsafe for consumption is thus the natural step forward in ensuring food safety.

Under the terms of the MoU, which will initially be for 18 months, the CFTRI will lend its technical capabilities in modernising and strengthening the State analytical laboratories in Thiruvananthapuram, Ernakulam, and Kozhikode.

Over 100 scientists and laboratory staff in the State laboratories will undergo training at the CFTRI, which has the expertise to conduct over 250 chemical and biological tests in the area of food analysis.
Some of the areas that the State food safety wing has specified include tests for detecting the presence of antibiotics/hormones in meat and poultry, formalin, mercury in fish, trans fats and acrylamide in fried foods, and safe limits for food additives/preservatives. The CFTRI will also conduct food-related studies for the State as and when requested.

The sinking ship of the desert

Despite legal strictures on the slaughter of camels for meat, police turn a blind eye as several animals are killed during the festival of Bakrid
The Indian camel, the single humped or Dromedary, is the pride of Rajasthan and thousands of poor families are dependant on it for their travel across the desert. They are low maintenance animals, subsisting on dry grass and shrubs .
However, this iconic animal is disappearing before our eyes. In Rajasthan the camel has become expensive and rare with less than 50,000 animals and has been declared an endangered species by the International Union for Conservation of Nature and Natural Resources (IUCN).
In some of the more remote villages, camels are still used by the post offices to deliver mail. Camels carts are used to deliver goods, in banking and to draw water out of deep water wells. Entire families and their household equipment migrate on their backs. It is a common sight to see camel caravans with large bags filled with grass used for feeding horses, oxen, water buffalo. Tourists say that one of the most enchanting experiences you can have in India is to ride through the desert on camel back and camp out under the stars.
With falling numbers, the price of a camel has soared and a sturdy male now fetches up to Rs 50,000. In the last ten years, the camel population has reduced by a fourth due to illegal slaughter outside the State during Id-ul-Adha or Bakrid.
The camel is smuggled in large numbers to the States of Kerala, Tamil Nadu, Andhra Pradesh and Karnataka and through Bihar to Bangladesh as camel meat is considered a delicacy. Once a luxury for the rich, over the last few years, the festival demand has become more widespread with an illegal market for camel meat now in Hyderabad to which the Municipality turns a blind eye.
Illegal trade
So how does the camel find its way to the southern markets? The trade is largely controlled by gangs from Bhagpat in Uttar Pradesh. Camels are bought by these traders at weekly bazaars in Rajasthan and even the famed great Pushkar mela, which used to be a celebration of the camel. The animals are then taken by road through Haryana, either on foot or crammed into trucks with their legs tied. In Baghpat, they are slaughtered and the meat sent to Meerut and Hyderabad. I have had occasion to intercept several such animals in Delhi and Jhajjar enroute to Meerut and Baghpat.
Other camels are sent to Bangladesh via Bihar. The traffic before Id is so heavy that every night NGOs such as People For Animals intercept trucks crammed with camels.
Though Karnataka has forbidden the entry of camels, the smugglers bring them in on the pretext of offering children joyrides. The Kerala High Court has ruled that camels are not meat animals and hence cannot be killed and eaten. The Food Safety and Standards Authority of India (FSSAI) has also banned the killing of camels and the consumption of camel meat. But the police turn a blind eye to the groups of camels being taken across India.
The slaughter of camels at Bakrid also contravenes religious injunctions because only the sacrifice of goats is sanctioned. Today it is camels, tomorrow it might become fashionable to kill tigers for this day.
Apart from all the legal reasons the camel cannot be killed for Bakr-Id because:
1) Camels belong in the deserts of Rajasthan. They are marched 2000 kms in a cruel way and can never be called healthy and killing them is thus against Islamic teachings.
2) The Koran allows killing of animals as a justification only for food.
3) One is supposed to befriend an animal before offering it for sacrifice — this is never done for a camel.
4) The killing of a terrified animal is something the Prophet would never allow.
5) Bakrid refers to the killing of a ram by Ibrahim when God replaced the son with a goat. Why kill camels which cannot even be legally eaten?
Tardy courts
The Chief Kazi to the government of Tamil Nadu, Dr Salahuddin Mohammed Ayub, has discussed the issue of banning the slaughter of camels for meat with his congregation and said he was prepared to talk to the government committee organised for this purpose in Chennai. Despite a ruling by the Madras High Court last month setting up a committee to regulate camel slaughter and directing that the committee should hold its first meeting within a week and place preliminary recommendations, the Secretary for Animal Husbandry has refused to convene the committee till after Bakrid — too late for the camels now in Tamil Nadu facing illegal slaughter.
The Rajasthan government in July, 2014 passed an Act declaring the camel a State animal. This was followed in March 2015 with the Rajasthan Camel (Prohibition of Slaughter and Regulation of Temporary Migration or Export) Bill, 2015, which banned the slaughter, trading and unauthorised transportation of camels. No camels can be sold at weekly bazaars and certainly no “farmers” from outside Rajasthan are allowed to buy the animals.
However, everytime illegally transported camels and poachers are caught, the courts intervene to release them — back to the poachers. The seized animals spend a couple of nights in shelters or jails and then, for reasons best known to the judges, are given back to the poachers.
The impact of the loss of camels in India will be most severe on our vulnerable western border in Jaisalmer. This region routinely used by smugglers of drugs and arms is patrolled by the Border Security Force (BSF) which uses camels ideally suited to the terrain. The forces are now finding it difficult to replace ageing animals.
The slaughter of this iconic animal, full of temperament and pride must stop before it is too late. The camel has become another victim to our inability to enforce laws in India.

Food Safety Act is for citizens' benefit, says Bombay HC
MUMBAI: Observing that the Food Safety and Standard (FSS) Act is meant for the benefit of citizens and has direct nexus to right to life, the Bombay high court upheld the constitutional validity of the 2006 law, its provisions and the rules framed under it.
"This is a social legislation and provides for solution to the problems which would be a creation of nobody else but the members of the society,'' said a bench of the HC while dismissing a bunch of petitions filed by restaurant owners and others who challenged the Act for being "violative of fundamental rights to equality, trade and life.''
Association of the Traders claiming to carry on business in various foods, Indian Hotel & Restaurant Association, Mumbai Mewa Masala Merchants Association, a registered Association of the retailers - wholesalers of dry fruits and spices had moved the HC in 2012 to set aside provisions of the Food Safety Act. Though not make clear the foundation of the challenge, the traders said the Act had "vague and excessive'' provisions that affected their business and could be prone to abuse.
The HC found no merit in the challenge but in fact said, "we cannot lose sight of the evil which is sought to be remedied by this Act...Humans have a tendency to deal in food products which would not be safe for human consumption...''
The court suggested that it was "every citizen's fundamental duty to nurture such morals, ideals and discipline'' to eliminate the availability of unsafe food in the market through "sheer social responsibility.'' The court went by the legal concept of construing a law that makes it effective, rather than voiding it. The HC held that every officer and authority in charge of implementing the FSS Act that governs food safety and regulates manufacture, storage, sale and import food safe for human consumption in India have an "onerous responsibility'' and must not derelict either.
The HC said that the Act "serves a pivotal role in securing the citizens a minimum degree of purity in food and preserve public health. It is aimed at preventing fraud on the consumers and those who are guilty of endangering human life by indulging and dealing with the unsafe food are required to be dealt with iron hands.''
"If the provisions intend to curb such social evil, we are of the considered opinion that the challenge as raised by the petitioners on every count ought to fail.''
