No check on sale of food supplements in Noida

With city residents getting more health conscious, protein supplements used to gain mass have become popular. While there is some legitimate distribution, an unorganised industry of questionable products has also surfaced for these supplements. This is beyond the purview of the Drugs and
Cosmetics Act and these products are sold over-the-counter at pharmacies. Though a majority of youngsters are tech-savvy and prefer to purchase these supplements from the internet, many rely on the neighbourhood retail stores and pharmacies to buy cheaper versions.
A retailer in Surajpur claimed that he sourced protein supplements from the Navyug Market in Ghaziabad. “I sold 4-5 supplements till a few months ago, but now I sell around 20 bottles weighing 1 kg each every month,” said Vinod, salesman at the Rathi Medical Stores.
Nearly eight such pharmacies are located along a single stretch in Surajpur alone. Several such stores are also located in some sectors of Noida, Ghaziabad and the Trans-Hindon Area.
In a market near Nayee Basti in Ghaziabad, several wholesalers sell nearly 200-300 containers of supplements every month. However, none of them was willing to disclose their names nor of the manufacturer.
Vinod Sharma, a trader in Navyug Market, said, “These supplements are quite expensive. But when youngsters get to know that cheaper brands are available, they buy these without checking the ingredients.”
Meanwhile, protein supplements also have their drawbacks.
Abhishek Chaudhary, former U-17 cricket player for Uttar Pradesh, said, “I have been working out for several years and my diet was always under supervision. Gym instructors insist on using weight-gain supplements for quick results. However, the liver and kidney cannot produce enough hormones to break down additional proteins beyond 30 gm per day. I don’t use these supplements.”
AK Jaiswal, food inspector, Gautam Budh Nagar district, said, “We do hear about such illicit products but unless the manufacturers are based in the district, I can’t do much. The sale of these products continues unchecked as the Food and Safety Standards Authority of India has allowed retailers to sell these products without a licence till February 2014.”

Disguised as cinnamon, cassia marketed through retail outlets

Activities of various government departments, and the pace at which decisions on vital issues related to people's health are taken, show they are not serious about the real problems of the people, rather they try to shift the responsibility of their duties on others.

It is a known fact that Kerala is the largest producer of cinnamon and the biggest producer of Ayurvedic medicines in the country. Cinnamon is used in more than twenty Ayurvedic medicines. Cassia and cinnamon are permitted to be imported into the country for domestic consumption and for export processing as well. The botanical name of cassia is Cinnamomum Cassia Blume and that of Cinnamon is Cinnamomum Zeylanicum BreynI. Normally the Cassia is misnamed and mistaken as cinnamon and marketed to the consumers through retail outlets. Cassia reportedly creates health problems like kidney and lever damages.
After receiving some representations, the Spice Board, Kochi, informed the Director of Foreign Trade, Govt of India, New Delhi that the Cassia is far below than Cinnamon, and that the traders misuse and get an opportunity for their monetary benefits by wrong declaration of the product. Therefore, it was suggested that Cassia should be listed as ‘restricted item’ for imports.
Leonard John, a Cinnamon planter from Kannur, Kerala, wanted to know the action taken by the Government of India under the Right to Information Act (RTI) pertaining to ban on import of Cassia from China and Indonesia. He found that no checking and implementation of the order of Food Safety and Standard Authority of India (FSSAI), New Delhi has been done and no action has been taken on the report.
According to the Spice Board, India requires 12,000 MT of True Cinnamon for domestic use and export. India produces 2,000 MT of True Cinnamon and rest is imported from Sri Lanka which produces, 70,000 MT per year from 67,000 acres of land at Rs.200 per kg. It is used in more than 20 Ayurvedic medicines.
Cassia, the fake cinnamon is product of poisonous trees from the forests and harmful to health of human beings. A rough distinction can be made between two types of Cinnamon. Sri Lanka’s Cinnamon only contains low levels of Coumarin which are safe from risk of assessment perspective. By contrast, Cassia Cinnamon contains high levels of Coumarin and large amounts of this Cinnamon should not be eaten. It is to be mentioned here that True Cinnamon cultivation has reduced within ten years in Kannur from 1000 acres to 700 acres, and in Malapuram district, it has reduced from 200 acres to 10 acres.
It is strange that Indians are not able to purchase Cinnamon at Rs. 350 per kg and USA is able to sell it to us at Rs. 4,500 per kg. Millions of Indians are forced to buy Cassia instead of True Cinnamon and the people engaged in plantation of True Cinnamon are left to die unnatural death.

Centre to ban sale of junk food and fizzy drinks near schools after summer vacation

The junk is being taken out of school education across the country. After summer vacations are over this year, children will begin their new academic session in schools that do not have junk food outlets within 500 yards in any direction. This revolution in the making was revealed in the Delhi High Court on Wednesday when the Centre said that draft guidelines on regulating sale of junk food and aerated drinks in and around school premises would be ready by July.



Additional Solicitor General Rajeeve Mehra, representing the Centre, told the court that private firm AC Nielsen ORGMARG Pvt Ltd is in the process of framing norms to regulate availability of junk food and carbonated drinks within 500 yards of schools. The senior law officer assured the court that the draft guidelines on making quality and safe food available in school canteens would be in place by July 21. These guidelines will be crucial because there is no official definition of junk food now.

This has created much ambiguity among schools over what food products it should make available to children within its premises. The guidelines will thus clear the confusion and define what food is healthy and what is not healthy.

"We would seek the opinion of food processing companies after making the draft guidelines and prepare the final guidelines soon,"Mehra said.



Most, if not all, schools are kindly disposed to the proposed move. Principal of Laxman Public School Usha Ram said, "We are all up for banning junk food in school premises. We don't sell junk food in our school. In fact, we were the first one to introduce a Mother Dairy stall in our campus which offers health milk products. "Principal of Apeejay School, Pitampura, D. K. Bedi echoed this view, saying: "It will be excellent if junk food is totally banned in schools. Schools should only offer healthy food like juices and milk products to children. "After recording submissions of the Centre's counsel, a bench comprising Chief Justice D. Murugesan and Justice Jayant Nath posted the next hearing in the matter for July 22. The Delhi government also displayed urgency in taking 'unhealthy food' off the shelves of city schools. The counsel representing the Delhi government, Anjum Javed, said that the Lieutenant Governor has the power to issue directions to city schools but that can be done only after the Centre frames guidelines on the issue.

Status report Meanwhile, the Centre also filed a status report in court, explaining why it has taken so long to complete the study in the matter. It told the court, however, that all the research has been completed now.

Assuring the court that all the fieldwork has been done and now it would not take much time, Mehra said, "We are pleased to share with you that we have been able to incorporate date from Meghalaya and Assam, due to which the study had to be extended. We have now completed the survey in both North-Eastern states, which was quite difficult due to the prolonged closure of schools in these regions."In January last year, the court had given six months to the Food Safety and Standards Authority of India (FSSAI) to frame guidelines on banning sale of junk food and aerated drinks in and around educational institutions.

The court was hearing a PIL filed in 2010 by Rakesh Prabhakar, a lawyer for an NGO called Uday Foundation, seeking a direction banning sale of junk food and aerated drinks in and around schools. The petition said, "It is time we change the way kids eat in schools. Such a ban will set new standards for healthy food. On one hand, children are taught in classroom about good nutrition and on the other hand we continue to make junk food available to them."

A welcome idea The schools also welcomed the idea of banning junk food and carbonated drinks in and around school premises and advocated only the sale of healthy foods in school premises.

Earlier, the court also asked the FSSAI to consult the All India Food Processors' Association (AIFPA) and restaurant associations for framing the guidelines. AIFPA, in its application, had said that it deals with processing of fruits and vegetables, meat and fish, milk and milk products and also the manufacturers of biscuits and confectionery products. It also said that it may give some advice to the FSSAI.

Two districts in Tamil Nadu — Kancheepuram and Cuddalore — have been selected for a pilot study on screening food-borne diseases. All systems will be in place within a month, and screening will begin.
This modest exercise is part of a bilateral agreement between the United States and India to participate in a Global Disease Detection Program (GDD). The GDD is the principal and most visible programme of the Centre for Disease Control and Prevention, Atlanta, CDC) to develop and strengthen global capacity to rapidly detect, accurately identify, and promptly contain emerging infectious disease that occur internationally.
P.Gunasekaran, Director, King Institute of Preventive Medicine, Guindy, says in case of an outbreak in these two districts, food samples will be collected by the Primary Health Centres, and sent to Madras Medical College (Referral Centre). The positive samples will then be sent to King institute (Reference centre), for confirmation.
Subsequently, further tests will be done at the National Institute of Cholera and Enteric Diseases, Kolkata. Likewise, Quality control samples will be received by the King Institute from Kolkata will be processed and sent to the eight referral centres in Tamil Nadu. King Institute, which has been a centre for food-borne pathogen detection for over 50 years now, has been selected as a key partner in the Global Foodborne Network – GDD programme.
“The King Institute has contributed considerably towards active screening of Salmonella and Cholera, food samples and human specimens, and that is one of reasons that we were chosen to participate in the programme,” Dr. Gunasekaran says.
“There have been a large number of food borne outbreaks reported from various states of India. The Integrated Disease Surveillance Programme has documented at least 255 food-borne disease outbreaks,” Dr. Gunasekaran explains.
“However there is very little data on the causes for the outbreaks. This can be improved by setting protocols for collecting sample methods and testing at the reference centres,” he says.
To effectively detect the diseases and their causes, infrastructure should be strengthened and health staff trained specifically on these aspects.
The CDC, the GDD Program and the WHO in India, according to him, are collaborating on the area of Food Borne Diseases in Tamil Nadu, especially on in building resources, including human resources at the State. Training programmes are being organised on laboratory diagnosis and epidemiological investigation of food-borne diseases.
The commonest causes of food-borne infections are pathogens like Salmonella, Vibrio cholera, and bacillus cereus. The symptoms of food poisoning are vomiting, diarrhoea, abdominal pain, and dehydration.
“These are common, or expected symptoms, but the clinical state will change depending on the severity of infection,” Dr. Gunasekaran explains.

If the government records are any indication, the low land behind the cluster of commercial buildings in front of the Government Medical College Hospital here hides a pond that once used to be a perennial source of freshwater, spread over nearly half-an-acre.
The ground reality is, sadly, different. The once-famed public pond, ‘Cheruvakarakonam Kulam,’ is now little more than a depression in the land.
It is chock-full of raw sewage and urban refuse. Weeds and wild growth have almost levelled the pond. Its existence was almost forgotten till a civic minded citizen alerted the Vigilance and Anti-Corruption Bureau of its plight.
Vigilance probe
On the basis of his petition, the agency investigated the causes behind the pollution and environmental degradation of the pond.
Investigators said they found that at least five hotels in the locality illegally piped raw sewage and waste water directly to the pond. The managements also used it as a ‘convenient garbage dump hidden from public eye’ to save on their overhead expenses.
Filthy water to drink?
Investigators said they ‘were shocked’ to find that at least one hotel management had sunk a well near the sewage-laden pond and pumped the water back to their establishment for use.
The VACB requested the office of the Commissioner of Food and Safety to examine the water samples drawn from the well.
The officials there chemically examined them and reported that the water was ‘unfit for human consumption.’
Investigators said hundreds of customers, including doctors, patients, and helpers, who frequented the establishment, had over the past few years unsuspectingly consumed the harmful cocktail of bacteria, coliform, and heavy metals.
Encroachments
The VACB also found that at least six local residents had encroached upon the pond and appropriated 16 cents for private use.
The agency has recommended that they be prosecuted under section 7 (a) of the Kerala Land Conservancy (Amendment Act).
They have also recommended action against the errant hotels under the Food Safety and Standard Act.
The VACB has requested the Municipal authorities to dismantle the sewage lines laid illegally by the hotels and fill the well. It has also suggested that the pond be cleaned and walled to insulate it against future encroachments and wanton degradation.

Guidelines on junk food sale near schools by July: Centre to HC

The Centre today informed the Delhi High Court that draft guidelines on regulating sale of junk food and aerated drinks in and around school premises would be ready by July this year.
Appearing before a bench of Chief Justice D. Murugesan and Justice Jayant Nath, Additional Solicitor General Rajeeve Mehra said private firm AC Nielsen QRG-MARG Pvt Ltd is in the process of framing norms to regulate availability of junk food and carbonated drinks within 500 yards of schools.
The draft guidelines would be complete by July 21, he said.
The senior law officer also submitted that after the draft guidelines were prepared, the food processing companies would be consulted for their opinion and then the final guidelines will be prepared.
After recording submissions of the Government counsel, the bench fixed July 22 for further hearing of the matter.
Meanwhile, the Delhi Government counsel submitted that the Lt Governor has the power to issue directions to city schools but the same can be done only after the Centre frames guidelines on the issue.
The court was hearing a PIL filed by Rakesh Prabhakar, a lawyer for NGO ‘Uday Foundation’, seeking a direction banning sale of junk food and aerated drinks in and around schools.
In January last year, the court had given six month’s time to the Food Safety and Standards Authority of India (FSSAI) for framing guidelines on banning sale of junk food and aerated drinks in and around educational institutions.
The court had also asked the FSSAI to consult the All India Food Processors’ Association (AIFPA) and restaurant associations for framing the guidelines.
AIFPA, in its application, had said it deals with processing of fruits and vegetables, meat and fish, milk and milk products and also the manufacturers of biscuits and confectionery products.
It also said it may give some advice to the FSSAI.

Food safety officers swoop onshops in Tirunelveli and Tuticorin

A team of Food safety officers conducted surprise raids in shops at Tirunelveli Junction on Tuesday and seized spurious products worth Rs. 20,000, which were destroyed at the site.
The officials, led by Devika, Designated Officer, inspected the stalls selling water sachets, soft drinks and snack packets and checked if the mandatory manufacturing details were printed on them .
Manufacturing date
"As some of the snack packets showed the month of manufacturing as May 2013, they were also seized and destroyed," said A.R. Sankaralingam, Food Safety Inspector.
Tuticorin
Spurious soft drinks on sale in several shops in the town were seized and destroyed by a team of Food Safety Officers during surprise raids. Many shopkeepers were found selling products past their expiry dates. Besides, ISI certification marks, manufacturing dates and brand labels were missing on many products, M. Jagadish Chandrabose, Designated Officer, who led the operation, said. Additives and food colours, which were not permitted, were detected in ice creams, fruit squashes, sherbets, flavoured milk and other food items. Food products and soft drinks worth Rs. 30,000 were seized and destroyed at the site, he said. The officials also conducted raids in fruit shops and warned the shopkeepers of stern action if mangoes were ripened artificially using calcium carbide.
Packaged drinking water samples were collected and despatched to the government laboratory in Guindy, Chennai, for testing. The raids were conducted on a directive of Food Safety Commissioner Kumar Jayanth, Dr. Chandrabose said.

பொதுமக்களுக்கு சுகாதாரமாகவும், உடல் நலத்துக்கு கெடுதல் விளைவிக்காத வகையில் பழரசங்கள், குளிர்பானங்கள் விற்பனை செய்யவேண்டும் என்பதற்காக தமிழக உணவு பாதுகாப்புத் துறை ஆணையர் குமார் ஜெயந்த் உத்தரவின்பேரில், மாவட்ட ஆட்சியர் ஆஷிஷ்குமாரின் வழிகாட்டுதலின் பேரில் இந்தச் சோதனைகள் நடத்தப்பட்டன.

மாவட்டத்தின் அனைத்து பகுதிகளிலும் இதுபோன்ற சோதனை தொடர்ந்து நடைபெறும். காலாவதியான உணவுப் பொருள்கள் இருப்பது கண்டுபிடிக்கப்பட்டால் சம்பந்தப்பட்டவர்கள் மீது உரிய நடவடிக்கை எடுக்கப்படும் என்றார்.

Shake sherbet: Disciplinary drive soon

Following reports of the unhygienic manner in which shake sherbet(Kulukki sarbath) is prepared, the Kochi Corporation and the District Medical department are jointly planning to monitor the unhealthy drinks sold across the district. The officials said that a disciplinary drive will be conducted in the coming days against unhealthy drink sellers mushrooming in the city.
  District Medical Officer in charge (DMO) Haseena Mohammed said the health inspectors have been directed to take stern action against wayside shops, where shake sherbet is being sold in unhygienic conditions. A report will be submitted before the district collector and local government authorities so that stringent action can be taken against offenders, she said.
 “Unauthorised wayside eateries supplying stale food are mushrooming in the city. The shortage of pure drinking water makes the situation even worse. The DMO has no right to take any action against shop owners who sell unhealthy drinks. We will ask the district collector to take further action,” she said.
The Kochi Corporation Health Standing Committee chairperson T K Ashraf said the Corporation has already formed a squad and commenced a strict drive against unauthorised eateries and unhealthy food suppliers. The squad under the Health Department has identified hundreds of unauthorised shake sherbet shops in and around the city, he said.
“The Food Safety Department has identified several drinks especially shake sherbet as not only unhealthy but also served in unhygienic conditions,” said Chief Food Safety officer Satheesh Kumar.
He added that the department has submitted a report requesting strict action against such vendors.

City anchor: Many spurious ‘growth’ drugs being pumped into market: FDA

Days after Bombay High Court upheld the Food and Drug Administration (FDA) ban on the telecast of an advertisement endorsing a 'body growth formula powder', the FDA said there are many such deceptive products in the market that the public should be wary of. Officials said in the past year, the FDA has initiated action against around 10,000 such advertisements.
"Many of these products, the advertisements of which are telecast on TV at early hours, are spurious and are known to be not only useless but also have side effects. These include drugs promising height and weight growth, increase in libido and so on. However, as per the Drugs and Magic Remedies (objectionable advertisements) Act, 1954, manufacturers are not even supposed to advertise these products even if they are effective," said K B Shende, joint commissioner, FDA (Maharashtra).
Following an FDA directive to TV channels to stop advertisements of various products that promise height and stature growth, the manufacturers of a drug called 'Step Up Body Growth Formula', moved court challenging the directive. The HC, however, on Friday said the purpose of the Act was to prevent people from resorting to self medication.
In 2011-2012, the FDA had initiated action against 677 people across the state for flouting norms stipulated in the Food and Safety and Standard Act of India 2006, these included food grains, oil, milk and milk products, packaged food, drinks and tobacco products.
Shende said the number of complaints from the general public was less despite the prevalence of spurious drugs and products in the market.
"There has been a decline in the way such products are advertised over the past two years. However, people should be more forthcoming in their complaints. More importantly, people must be aware and not fall for the claims of these products. The FDA takes suo motu action against defaulting manufacturers as well as specific action from consumers as and when they come," he said.

“We are migrating towards online licensing and regn”

Food & Drug Administration (FDA), Maharashtra, is the number one in licensing and registration of food business operators (FBOs) under the FSS (Licensing & Registration) Regulations, 2011, among all the states in the country. Mahesh Zagade, food safety commissioner, FDA, Maharashtra, delves into the details in a quick conversation with Abhitash Singh. Excerpts:

Food and Drug Administration (FDA) Maharashtra is said to be facing manpower problem. What steps are being taken to sort out this problem?
First of all, there is no manpower problem. It is continuous ‘upgradation’ to face the emerging challenges. But we are managing with the existing ones very efficiently. And if we get more manpower it will be beneficial for us.

The deadline for licensing and registration for FBOs has been extended by FSSAI. What various initiatives will be taken by Maharashtra FDA to complete the procedure on time?
Even as the deadline for licensing and registration is extended, we are continuing with the process at a rapid pace. We are the number one in the country in licensing and registration and continue to maintain the slot. We will not be waiting till last date for the deadline. In order to complete the procedure before February 4, 2014, we are also migrating towards online licensing and registration.

Tell us about the separate budget for FDA, which is being talked about.
It’s already there in place.

What steps should be taken in order to provide safe food to the people of Maharashtra?
Implement the Food Safety & Standards Act, 2006, strictly in the state. We need to enforce and implement it in letter and spirit.

What steps should the food industry in the state take to improve the quality of food?
In order to improve the quality of food, the food industry should indicate contents, ingredients, products’ nutrition value, manufacturing date, best before, MRP and follow Schedule (4) of the Food Safety and Standards Act, 2006.

Even Maharashtra has banned gutkha in the state under the FSS Act. However, some people are still involved in illegally selling it. What steps is the FDA taking against them?
We are filing the First Information Report (FIR) against them. We are the only state in the country to destroy gutkha worth Rs 14 crore, even if it is banned in 17 other states.

Check its licence before feasting at a roadside stall

Street food vendors selling chole kulche and paranthas, road-side eateries, restaurants, hotels, food processing units, etc., will now have to either obtain a food safety licence or register themselves with a government agency failing which they will be fined.
The Delhi government has finalised a government agency, which will oversee the process of granting licences and registering the vendors under the Food Safety and Standard Act 2006. The matter will get a final nod in a cabinet meeting to be held next week.
Health minister AK Walia on Monday held a review meeting wherein it was decided that the entire process of granting licences and registering the vendors will start within two months. Food safety licence is in addition to all existing licensing requirements from different government agencies.
“We have shortlisted a government agency that will be in charge of the entire process. We are hoping to start it soon. A place has been identified for its office. But we will first take an approval from the cabinet,” said Walia.
“The Act is supposed to ensure street food vendors observe better hygiene standards,” added Walia.
According to officials, those who fail to get a licence will have to either close down their business or shell out heavy penalties ranging from Rs. 25,000 to Rs. 10 lakh if they continue without licence or registration.
Officials said that the state government has already missed the last deadline for registering and issuing licences to street vendors. The deadline has been revised to February 2014 by the Food Safety and Standards Authority of India, which was set up in 2008, after the Food Safety and Standards Act was passed in 2006. It became active only after regulations of the Act were notified in 2011.
 Food businesses with an annual turnover of below Rs. 12 lakh will have to get registered while those with a turnover of Rs. 12 lakh and more will have to obtain a licence. As per the regulations, fee for a year’s registration is Rs. 100, while that for licences range from Rs. 2,000 to Rs.7,500.
The National Association of Street Vendors of India (NASVI) welcomed the move, stating that at least this will give some sort of identity to the vendors. “We have started a survey to identify street food vendors along with the Food and Safety Department in an attempt to register them,” said a spokesperson.

Registration or licence must for food sellers soon

NEW DELHI: To enhance accountability for those in food business, Delhi government is all set to make it mandatory for them to seek registration, procure a licence from the department or face penalty.

According to the proposed policy, any food vendor, inclusive of roadside eateries, restaurants, hotels and food processors, with a turnover of up to Rs 12 lakh a year has to register themselves with the government. Those with larger turnover will have to obtain licence from the government.

A one-year registration will cost vendors Rs100. The licence, however, is expected to range from Rs 2,000 to Rs 7,500. The government said that the act aimed at ensuring that street food vendors observe better standards of hygiene.

Once the policy is notified, anyone found defaulting will have to either close down the business or shell out heavy penalties ranging from Rs 25,000 to Rs 10 lakh depending upon the gravity of the offence.

Sources said that Delhi government premium body DSIIDC will oversee the process of granting licence and registering the vendors under the Food Safety and Standard Act 2006. The proposed policy is expected to placed before the Delhi cabinet in the coming week.

The decision to go ahead with the plan was taken in a review meeting headed by health minister AK Walia on Monday. Sources said that the process of granting licence and registering the vendors will start within two months' time. Food safety licence is in addition to all existing licensing requirements from different government agencies.

License of several eateries in Mumbai suspended for flouting FSSAI norms

 
15 April, 2013 : Restaurants, supermarkets and manufacturing units are among 43 food-vending establishments in Mumbai whose licences have been suspended for not complying with the new Food Safety and Standards Authority Act of India (FSSAI).




While the restaurants did not conduct the mandatory periodic health checkup of workers, the food chains failed to label food correctly (not mentioning if it contained non-vegetarian ingredients or food items that could cause allergies). “If hygiene checks are not conducted regularly, there are chances of infectious diseases spreading in the community. Many establishments have their licences suspended as they didn’t conduct these check ups. Those manufacturers who have failed to conduct laboratory exams of the food items have also had their licence suspended,” said Suresh Deshmukh, assistant commissioner (food), FDA.

This is the first time the Food and Drug Administration (FDA) has used the new FSSAI to suspended licences of food-making and vending establishments. FDA has not revealed the names of the establishments that have been penalised for flouting food safety norms.

Between April 2012 and March 2013, the FDA inspected 1,158 establishments and served improvement notices to 266 that flouted FSSAI norms. Until last year, the FDA would issue warning notices while the Brihan Mumbai Municipal Corporation (BMC) suspended licences, making the process of food safety audit cumbersome. “We would send the list of eateries, food stores which were flouting norms but the civic body would never take any action making the entire exercise futile,” said an official from FDA.

It was only in August 2012 that establishments selling or manufacturing foods were given licences under the new act by the FDA. “Facilities flouting norms are given an improvement notice, after which a fresh inspection is carried out. If they have not improved, we suspend their licences,” said Deshmukh. The maximum punishment for violating the rules is a Rs. 10 lakh fine and three years’ imprisonment.

Sources in the FDA said while around 45,000 facilities in the city are under the purview of the FSSAI, the shortage of manpower, makes it impossible to carry out regular inspections. Of the 66 posts of food inspectors sanctioned, only 20 are filled.

AHAR moves HC against Food Safety Act

The Indian Hotel and Restaurant Association (AHAR), along with several restaurant and hotel owners, lashed out against the Food Safety Standards Act (FSSA) 2006 and rules 2011 for treating them as a food manufacturing unit. The AHAR has even moved the Bombay high court challenging the validity of the Act.

The petition filed by the AHAR two weeks ago, states that the norms laid by the central government are mainly for food industries and not in any way for hotels and restaurants as these provide food as per the choice or order of the customers.

AHAR has alleged that the Act has been made applicable for the hospitality industry with some stray provisions and by using some terms loosely. They said that it was not feasible for the restaurant and hotel owners to comply with the terms of the Act.

Arestaurant owner said, “We don’t process food, we only cook food. But there is no mention of the term ‘cooking’ in the Act. AHAR had earlier written to the state Food and Drug Administration (FDA) asking for clarifications.

The FDA, however, refused to help them saying they were merely an implementing body. Another restaurant owner said, “The act states that labelling packaged food with its nutritional value is mandatory. But it is impossible for us to label each container that is home delivered as it is made as per the choice of our guests. “Similarly, you cannot ask us to test the water that we are using for cooking as we get our water supply from the BMC. But yes, you can hold us responsible for hygiene and sanitation. We are ready to comply with that. But all the norms stated in the Act are meant for bigger manufacturing units.” They are also hassled by the fact that the fine levied for the violation of these norms by the hospitality industry is the same as the manufacturing unit.

Further, the act also states that one cannot sell a non descriptive food item which is not described in your license. “We are supposed to submit our menu card for licensing. But we all know ours is a tailor made business and guests can even call in for something that is not on the menu.”

Advocate Anjali Purav, who is representing the case, confirmed that the petition has been filed but refused to comment further. She said, “We will soon be getting our first date of hearing and only after that will I be able to comment.”

Meanwhile, in its first-round of inspections carried out since April 2012, the state FDA has found that around 600 of the inspected 1,060 eateries across Mumbai are not complying with the rules of the Act.

Call to plug loopholes in Food Safety Act

More than 40 packaged drinking water manufacturing units here, which are approved by the Bureau of Indian Standards (BIS), are now either on the verge of shutting down or have leased out their plants.
These units, each of which have spent at least Rs. 1 crore in capital investment and another Rs. 1 lakh every year for BIS certification, are being undercut by companies that exploit loopholes in Food Safety and Standards Act (FSSA), 2006, according to Coimbatore Region Packaged Drinking Water Manufacturers Association.
Certain companies avoid use of the words ‘packaged’ or ‘mineral’ drinking water to avoid meeting any standards even though they supply the same product given by those adopting these words, Association Secretary D. Suresh Kumar told The Hindu here on Saturday.
By using the words ‘herbal’ or ‘flavoured’ water, which have been categorised as traditional food products under the FSSA and exempt from standards, the companies are able to supply drinking water cheaply and undercut others that follow all norms.
“Such firms typically set up an RO plant in a rented house premises and spend just around Rs. 2 to 3 lakh.
“There are at least 30 such plants operating in Tirupur alone.”
The public are not aware of the distinction between these approved and unapproved companies and often buy the cheaper products, he says.
He said that of the 108 members of the association, 15 have leased out their plants and 27 have become sick and are likely to close down.
Complaints
The association, he says, has lodged complaints with the Commissioner of Food Safety and Standards Authority of India, the statutory body that enforces the FSSA, and the Bureau of Indian Standards (BIS) asking them to close the loopholes.
Mr. Suresh Kumar says they will be stepping up their campaign with the Central Government and create awareness among the public.
If no action was forthcoming, he said that these companies had little choice but to surrender their BIS certification as following these norms was proving futile.

The Food Safety and Standard Authority of India (FSSAI) has no Chief Executive Officer (CEO) for the last three months. This is not the first time that the top food regulator is subjected to such an apathetic approach from the Health Ministry, which oversees its functioning. The current FSSAI chairperson K Chandramouli was appointed four months later after his predecessor left the post. Also, no meeting of the Authority, a high-level decision making body of the FSSAI, has been held since his appointment.

Bid to step up food safety measures

New Delhi, April 14: The Food Safety and Standards Authority of India (FSSAI) plans to register and issue licences to 55 million food and beverage companies, manufacturers and vendors, including those in the unorganised sector, by February 2014.
"The exercise is part of the organisation's efforts to harmonise food safety standards," FSSAI chairman K. Chandramouli said on the sidelines of an Indian Beverage Association (IBA) seminar.
The FSSAI has also sought Rs 5,000 crore from the government in the Twelfth Five-Year Plan (2012-17) to set up food safety laboratories. The proposal is awaiting clearance.
"We do not have food and safety standards in the country which deal with food products across the spectrum. For this, we need to get the state governments and other stakeholders on board," he added.
At present, only a million licences have been issued to food and beverage operators. According to Chandramouli, the implementation of the FSSAI act continues to remain a challenge.
The FSSAI was established under the Food Safety and Standards Act, 2006, as a statutory body for laying down scientific standards for food items and regulating manufacturing, processing, distribution, sale and import of food to ensure safe consumption.
The IBA experts said the industry expected the authorities to remove the roadblocks and give faster clearances to ingredients and new products without compromising on the safety and quality.
The IBA also suggested making Codex a reference point for national food control agencies. Codex standards, guidelines and codes of practice contribute to the safety, quality and fairness of global food trade.
