The Karnataka High Court Circuit Bench in Dharwad on Tuesday upheld the ban on gutkha.
A
single-judge bench of Justice B S Patil upheld the ban on gutkha while
dismissing the petition filed by Ghodavat and three other companies
challenging the ban. The court had completed the hearing on the petition
on June 11.
In its judgment, the court said that the state
government has the right to impose ban on food items containing tobacco
and nicotine under the Food Safety and Standards Act, 2006. Hence its
notification banning gutkha was well within the framework of law.
The
ban on gutkha was a ‘wise decision’ on the part of the government,
Justice Patil said. Advocate General Ravivarma Kumar argued on behalf of
the government while advocate Raghavan represented the petitioners.
