Ullal food samples sent for tests

Samples of fish curry that led to food poisoning of around around 40 persons in Ullal on Saturday have been sent to Bengaluru for testing.

As many as 40 persons from different parts of Ullal got admitted to four different private hospitals on Saturday evening after consuming fish curry and other fish dishes. While some reported of vomiting, others reported of giddiness and body pain after eating the dishes.

District Health Officer Ramakrishna Rao said that he met the victims admitted in the four hospitals.

“While some say that they purchased fish from persons who came to their area in vehicles selling parts of fish discarded from a fish meal unit in Ullal, a few said the dishes were prepared using fish they had purchased from the fishing harbour,” he said.

Dr. Rao said a team of officials of the Medical Department on Sunday collected samples of the food that led to food poisoning and sent it to Bengaluru for testing. Apart from his department, Deputy Director of Fisheries and Food Safety Officer are inquiring into the cause of food poisoning.

Dr. Rao said all the 40 victims were discharged from the hospitals on Sunday evening.

SC to Centre, State : Ensure strict compliance of gutkha and pan masala ban

The Supreme Court has directed the Centre and state governments to strictly enforce regulations banning gutkha and pan masala.

The two-judge Bench comprising Justice Gopal Gowda and Justice Adarsh Kumar Goel was hearing a batch of petitions relating to the issue.

The Bench agreed with amicus curiae Senior Advocate Gopal Subramanium and made it clear that has not granted any stay of Regulation 2.3.4 of the Food Safety and Standards (Prohibition & Restrictions on Sales) Regulations, 2011, and the authorities concerned are duty bound to enforce the said regulation framed under Section 92 read with Section 26 of the Food Safety & Standards Act, 2006.

The Bench then directed the statutory authorities concerned to comply with the above mandate of law. The Bench also directed the secretaries, Health Department of all states and union territories to file their affidavits before the next date of hearing on the issue of total compliance with the ban imposed on manufacturing and sale of gutkha and pan masala with tobacco and/or nicotine. The Bench directed to post the matter for hearing on November 9, 2016, as first case.

Gutkha and pan masala has been a plague in our country for decades. It seems as if the TV commercial and commercials before movie screenings were not enough. This is a perfect example of the correct law being formulated but not being implemented. It is indeed a sad news but with the collective efforts of the judiciary and the legislative along with the law enforcing forces, the law regarding the ban of gutkha and pan masalas can be implemented and can be a huge success in our country.

50k laddus filled with worms at Vijayawada's Kanakadurga temple

VIJAYAWADA: Exposing the callousness of the temple authorities in maintaining hygiene in the kitchen , nearly 50,000 laddus were found to be filled with insects at Kanakadurga temple in Vijayawada on Sunday.

The incident created a furore among devotees.On the second day of the Dasara festivities, insects were found in the laddus at the prasadam potu (kitchen) building which is in a dilapidated condition. The laddus were kept for drying after they were prepared on Saturday night. However, the staff discovered insects in the laddus when they came to pack them. Later, they informed the higher authorities.

The food inspection authorities said that hygiene and cleanliness were completely ignored inside the building where the laddus were stored. Ironically, the temple officials were aware of the building condition and even claimed that they were making alternative arrangements shortly after the Dasara festivities.

"We will inspect the samples and initiate necessary action accordingly," said A Sundara Rami Reddy, food inspector of Vijayawada region.

Meanwhile, the incident has triggered differences among the newly-constituted temple trust board members and executive officer A Surya Kumari. "It was complete failure and negligence of the executive officer. She has to ensure food safety measures," Duggempudi Rambabu, a board member, told Express. More board members accused Surya Kumari of sidelining them with regard to the Dasara arrangements.

According to a press release, Surya Kumari clarified that the process of laddu making was being taken up in very safe and hygiene conditions. She blamed the recent rains and shortage of staff for the incident.

Food and Drugs Administration raids sweets unit, seizes goods worth over 3 lakh

NASHIK: The Food and Drugs Administration (FDA) in Nashik raided a sweetmeat factory behind K K Wagh College in Adgaon on Thursday and confiscated products worth over Rs 3 lakh as those did not meet the standard food safety rules set by International Organisation for Standardisation (ISO).

Around 3,500kg of finished product, 270kg of Mysore Pak and 540kg of low quality vanaspati ghee was confiscated. The raid was conducted at 10:30am on Thursday at Sangam Soan Papadi owned by Ramansingh Yadav. Senior FDA official said that the drive would be strict during the festive period.

A FDA official said, "The factory owner was not adhering to the rules set on food safety. The entire factory area was dirty, the articles used for preparing the sweets were spread over the floor and there was no room left for sunlight at the place of production.

He added, "The machines used for preparing the sweet were dirty and emanated a foul smell. Neither the factory workers did not go for regular medical check-up nor were they provided gloves or apron while preparing sweets."

The Vanaspati ghee that was used in sweet preparation was also of a cheap quality. The documentation necessary to run a factory were not present with the owner. The workers did not have any documents to support their employee proof.

Moreover, the containers used for storing the sweets were of bad quality and the date of manufacturing was not mentioned on those boxes as well. The samples of the products have been sent to the FDA laboratory in Pune and further action will be taken under the guidance of Additional Commissioner of the FDA Nashik, Uday Vanzari.

The official added, "Such drives will continue in the near future as well with a view that the festive period is underway. Sweets are sold in abundance during the Navratra in Dussehra and also in Diwali. The FDA's attempt will be to ensure that people get safe food for consumption. There are 10 food safety officers who have been deployed in different parts of the district to check factories of food products, restaurants, sweet marts."

Thefood safety officers of the FDA will also have to keep a watch on the food products sold en-route the Saptashringi Garh.

Govt given ‘last opportunity’ to make food testing labs functional

Jammu: The J&K high court has granted government the “last opportunity” to make the two food testing laboratories functional at Srinagar and Jammu.

A division bench of Justices Muzaffar Hussain Attar and Ali Mohammad Magrey also directed chairman Service Selection Board to appear in person before it if the selection of technical manpower for the laboratories was not completed by next date of hearing, posted in the week commencing from October 17.

Hearing a suo-moto Public Interest Litigation, the division bench rejected the compliance report filed by the Managing Director Medical Supplies Corporation in which he had “unsatisfactorily” revealed the steps taken for procuring necessary equipment for setting up of the laboratories.

The court said that it was not satisfied with the approach adopted by the MD and warned him of “appropriate action” if he failed to utilize the “last opportunity” to complete the process for procuring necessary equipments for the laboratories.

On September 9, the court had directed government to file status report by September 29 regarding steps taken to make the two food testing laboratories functional.

On June 10, the court had observed that a lot was required to be done by the government to alleviate the sufferings of the people due to food adulteration. It had ordered the government to make the two food testing laboratories functional by July 11.

Besides, the court had also directed government to fast-track appointment of technical manpower as per the Food Safety and Standard Act of 2006.

“The recruitment shall he made on fast track basis. The laboratories shall be fully equipped to make them functional,” the bench had said. It had also directed that Mobile Vans shall also be purchased and put to service.

“The authorities whosoever have been involved at different points of time in implementing the Food Safety and Standard Act of 2006 have exhibited only skin deep concern to the sufferings of people. The state authorities in order to ameliorate the lot of suffering people are required to show soul deep concern,” the court had observed during hearing in May.

“This is not the question of a small water body and its encroachment, which we can demolish and get back the water body. It concerns the health of all of us, rich and poor, ruler and the ruled. Everybody’s health is involved in this issue but there is sad state of affairs,” the court had said.

The chief secretary, BR Sharma, who had appeared before the court had in fairness admitted that the FSSA 2006 has not been implemented in the manner it had to be implemented in the state.

He however had assured the court that he will immediately take review of the all aspects concerning the implementation of the FSSA. He had also assured that without waiting for the financial assistance from the government of India, funds for setting up “technologically advanced laboratories” both at Jammu and Srinagar would be immediately provided by the state and the laboratories will be established shortly.

Man, daughter fall ill consuming curd

A man and his daughter were admitted to the government hospital in Chromepet on Friday after consuming curd purchased from a grocery shop nearby. Moses (45), a resident of Mumoorthi Nagar and his daughter Jenifer (18), purchased a curd packet from a shop near their house.

When they started consuming it, they found a black-coloured object in the curd that was later found to be a leech. Both of them developed nausea and dehydration after some time and were rushed to the hospital. They are recuperating after treatment by the doctors and likely to be discharged soon.

When he approached the Chromepet police, they refused to take action and suggested that the case may be referred to the food safety officer at Pallavaram Municipality. A complaint has been filed and an investigation is under progress, municipal officials said.

FDA seizes gutkha from manufacturing unit

NAGPUR: The Food and Drug Administration (FDA), Nagpur division, seized scented and flavoured gutkha from a manufacturing unit in city. This was the team's first ever raid on a gutkha manufacturing unit atWanjra in Parvati Nagar in the city.

The manufacturing unit was being run by the Mohammad Wajif Mohamamd Ismail. "It is for the first time that FDA conducted an operation on a manufacturing unit in the city. We seized material valued at Rs 52,500. The accused used glycerin and flavor to manufacture gutkha," said Milind Dehspande, assistant food commissioner, who also headed the three-member raiding team.

The team also included food safety officers Abhay Deshpande, Manoj Tiwari and Pravin Umap.

A dead frog in a packet of semolina distributed at an Anganwadi centre in Washim district has prompted the Maharashtra Food and Drug Administration (FDA) to conduct surprise raids across all Anganwadi centres in the state. FDA officials will now collect selective samples to keep an eye on food that children are consuming under the women and child development (WCD) scheme.

The dead frog was spotted on Monday. Dr Harshadeep Kamble, commissioner of the state FDA, toldMirror, “The incident is an eye-opener and we will notify all our district Food Safety and Standards Authority of India (FSSAI) officials to be vigilant and even collect samples of food packets that are distributed in Anganwadi centres under the scheme run by the WCD ministry. This will include raids as well as collection of selective samples. It will be a task to depute many officials for this investigation, but we will seek help and coordination from the state health department for this.”

A source from the health department, who did not wish to be named, shared, “The incident took place on Monday, where a frog was spotted in the semolina packet. The father of the six-year-old child who got the packet immediately brought this to the notice of the Anganwadi workers as well as the gram panchayat. Washim’s health officer has been directed to look into the matter. But, it is primarily the responsibility of the WCD department. Such cases can lead to food poisoning in children. A bid for nutrition cannot cost children their health. Thus, the FDA’s timely action is crucial.”

When Mirror contacted minister of state for women and child development Vidya Thakur, she assured, “The incident needs to be inquired thoroughly. The FDA’s help is appreciated. But, the officials will be asked to investigate the matter and will be sent to Washim. We will have to look into all the details.”

Seeds of discontent?

Activists protet against GM Mustard outside the Ministry of Environment and Forest in New Delhi. 

The government is within its rights to take a strategic decision to commercialise GM mustard, but not at the cost of fidelity to the law.

On September 5, the Union Ministry of Environment, Forest and Climate Change (MoEFCC) released an “Assessment of Food and Environmental Safety” for genetically modified (GM) mustard on its website, and gave the public a month to respond with comments and concerns. This review report was put together by an expert sub-committee of the ministry’s Genetic Engineering Appraisal Committee (GEAC). The public consultation is likely to be the penultimate step before the government takes a final decision on what might become India’s first GM food crop — Bt cotton seeds, though also crushed for edible oil, were not explicitly approved as food; Bt brinjal is unlikely to emerge out of the moratorium issued by former Environment Minister Jairam Ramesh any time soon.

GM mustard represents the culmination of over a decade of painstaking work by a team of Delhi University scientists led by the noted biotechnologist, Deepak Pental. Mustard, a self-pollinating crop, is difficult to hybridise, that is, cross-pollinate. Pental’s team has genetically modified an Indian mustard, Varuna, and an East European mustard line in order to cross-pollinate them. They have sought permission to commercially release the resultant hybrid named DMH-11, and to use the two GM parental lines for developing new hybrids. They claim that by virtue of being a hybrid (rather than a GM crop), DMH-11 yields about 30 per cent more than a reference mustard variety. Given India’s huge import bill for edible oil, they argue, this effort to boost mustard yields must be welcomed. Indeed, this may well be a moment for us to appreciate government-led scientific efforts — except that the case for GM mustard is not as straightforward as the government makes it seem.

Biosafety and socio-economic impact

GM mustard is resistant to the herbicide glufosinate, and thus a herbicide-tolerant (HT) crop. A farmer growing DMH-11 can potentially get rid of weeds with a blanket spray of glufosinate (sold in India by Bayer under the brand name Basta), which will kill all the plants except the mustard crop. The technical expert committee appointed by the Supreme Court in an ongoing public interest litigation (PIL) concerning GM crops had found HT crops “completely unsuitable in the Indian context” in its final, majority report. The principal reasons were that herbicides adversely impact the vast constituency of manual labourers, for whom weeding provides livelihood, and generate selective pressure for the emergence of herbicide-resistant or “super” weeds. The aforementioned MoEFCC review report on GM mustard makes light of these concerns, and simply notes that farmers are not “required to spray herbicide” on GM mustard fields — which is neither here nor there.

Second, there are concerns that the yield advantage of GM mustard has been over-estimated by comparing it with dated mustard reference varieties. Sharad E. Pawar, Fellow of the National Academy of Agricultural Sciences, has analysed the yield data of DMH-11 and shown that it has “no yield advantage over varieties and hybrids released in recent years”; a view also held by the government’s own Directorate of Rapeseed-Mustard Research.

Transparency and public participation

These and other concerns (such as over gene flow, impact on biodiversity) might have been addressed if the government had made public the details of its case for GM mustard — and by “making public”, I mean making its case freely and widely available, even to those who cannot access websites or read English. However, having uploaded the review report, the MoEFCC has made the primary data on agronomic and biosafety assessment available only to those who can visit the GEAC secretariat in New Delhi by prior appointment during working hours before October 5.

Equally serious is the fact that withholding the full biosafety dossier violates the government’s own commitments given to the Supreme Court on April 8, 2008 in the hearing on the aforementioned PIL. Consequently, we do not know, for example, if sociologists considered the impact of GM mustard on agricultural labourers; or if ecologists, toxicologists and nutritionists investigated the wider impact of potential glufosinate use on mustard fields. In April and again in August, the Central Information Commission ordered the MoEFCC to release complete information on GM mustard and other GM crops. The Commission also ordered the GEAC to disclose the agenda and full, detailed minutes of its meetings, which the Ministry had stopped doing since 2012. The Ministry continues to disregard these orders.

Thereby, the MoEFCC is reducing public participation to a farce. Denying citizens a voice in this matter is all the more serious considering that no labelling regime is in place in India. That is, if commercialised, citizens will not have the choice of opting out of GM sarson da saag, for instance.

Perhaps, developers of GM mustard and the government fear that releasing the biosafety dossier will lead them down the path of Bt brinjal, but this fear is misplaced. The government is within its rights to take a strategic decision to commercialise GM mustard despite opposition, but this cannot come at the cost of transparency and fidelity to the law. At the minimum, the full biosafety dossier for GM mustard must be uploaded on the Ministry’s website, the GEAC should disclose its full agenda notes and minutes for each of its meetings, and the window for public consultation should be extended beyond 30 days.

As the distinguished biotechnologist, mustard-breeder, and former Director-General of the Indian Council of Agricultural Research V. L. Chopra wrote some years ago, greater transparency and wider public participation may be the most effective way of “allaying fears and building confidence” in our regulatory institutions.

Surprise checks at stalls over ‘fuming’ fish curry

Action follows continued boiling of mackerel curry cooked at a house in Muvattupuzha; samples sent for examination

Taking serious note of an “ever boiling” fish curry, officials of the Food Safety Department conducted surprise checks at fish stalls in and around Muvattupuzha town.

Officials said the inspection, which began on Tuesday evening, went on till Wednesday morning. The samples collected from fish markets have been sent to the Regional Analytical Laboratory at Kakkanad for a detailed examination.

“Samples of the fish curry as well as its ingredients have been sent to the lab, and the first set of results is expected in two days,” said Abdul Majeed P.A, Circle Food Safety Officer, Ernakulam.

Preliminary investigations attributed the fumes emanating from the dish to the presence of a chemical substance.

“Hydrogen peroxide, ammonia, and formalin are some of the commonly used chemicals to preserve fish stocks, especially while they are transported. However, we are yet to confirm whether any of these chemicals caused this boiling phenomenon until the examination is over,” the official held.

The incident in question pertains to the continued fuming of mackerel curry, which was cooked at the house of one Salim at Paipra near Muvattupuzha.

According to reports, the dish continued to fume even after two days of making it.

The fish was purchased from a local stall at Muvattupuzha.

Traders deny charge

Incidentally, the Food Safety Department had earlier sounded alert on the possibility of fish wholesalers in neighbouring States treating fish using formalin to enhance its shelf life. The traders, however, have denied the charge, saying the stocks were being sent in airtight ice containers, which keep the fish fresh for up to a week.

Preservative

Meanwhile, sources said since the stocks were being brought from States as far as Andhra Pradesh, it was impossible to arrest decomposition without using a preservative.

A new handheld device to detect melamine in milk

Detecting melamine in milk has become extremely easy, quick and inexpensive thanks to a handheld melamine detector developed by researchers at the Indian Institute of Science (IISc), Bangalore. Leaf extract of a commonly seen weed parthenium along with silver nitrate is used for detecting the presence of melamine in milk. The results were published in the journal Sensors and Actuators B: Chemical.

“The presence of melamine in milk can be detected at room temperature within a few seconds through a change in colour,” says S.C.G. Kiruba Daniel from the Department of Instrumentation and Applied Physics, IISc and the first author of the paper.

“Our sensor has a very high sensitivity as it can detect melamine even at a low concentration of 0.5 ppm in raw milk.” Melamine content of more than 1 ppm in infant formula and more than 2.5 ppm in other foods should be viewed with suspicion of adulteration, says the Food Safety and Standards Authority of India.

In 2008, at least four babies in China died and around 100,000 became sick after consuming powdered milk baby food laced with melamine. Due to the presence of nitrogen, the addition of melamine to milk makes it look protein-rich.

Prior to melamine detection, the milk is processed to remove fat and proteins as they tend to interfere with detection. While most researchers had used already prepared silver nanoparticles for melamine detection, the IISc team added silver nitrate and the leaf extract in a particular ratio and at a particular pH to the preprocessed milk to synthesise silver nanoparticles.

“If melamine is present then it interferes with the synthesis and there is abrupt formation of nanoparticles leading to colour change,” says Dr. Daniel.

The change in colour depends on the amount of melamine present and, therefore, the extent of its interference with the synthesis of silver nanoparticles. “The colour change can be directly observed by the naked eye and also recorded by spectral change,” he says.

The silver nanoparticles are reddish yellow in the absence of melamine, while it becomes nearly colourless when melamine is present. Light absorption at 414 nm wavelength is a signature of silver nanopartciles. But when melamine is present the absorption of light is reduced as nanoparticle formation decreases.

“Currently, milk samples have to be brought to a central testing facility, so very less testing gets done. But all this can change with our handheld device,” Dr. Daniel says. As little as 1 ml of milk is sufficient for carrying out melamine detection.

The team is in the process of commercialising the product through a start-up that is incubated at the Society for Innovation & Development Centre at IISc.

Office of the Commissionerate of Food Safety confirms the ban on forms of chewing tobacco products from 02 October

Port Blair, Sept 28: The Office of the Commissionerate of Food Safety has confirmed the ban on use of all forms of chewing tobacco like Gutkha, Zarda, Pan Masala, tobacco leaf of food in which tobacco and or nicotine are widely used as ingredients and also Pan Masala based sugar based confectionary products from 02 October, in a press conference held at the conference Hall of Directorate of Health Services this afternoon at 04:30pm.

Addressing the press conference, the Officiating Director of Food Safety, Dr Abhijit Roy said that as per Regulation 2.3.4 of the food safety and Standard (Prohibition & Restriction on sale) Regulation, 2011 made by the Food Safety and standards Authority of India, provide that product not to obtain any substance which may be injurious to health and tobacco and nicotine shall not be used as ingredient in any food products thus the regulation will be completely implemented in the whole AN Islands as Under Section 30 of the Food Safety and Standards Act, 2006, the Commissioner Food Safety of the State/ Union Territory is empowered to prohibit the manufacture, storage, distribution or sale of any articles of food in the whole of the State/Union Territory in the interest of public health from 02 October, 2016 as the Lt Governor took interest into it.

He added that Port Authorities also informed all the ports and Jetties in the mainland like Chennai, Kolkata, Mumbai, Delhi, Mumbai, Vizag to check that no import has to be done of the above mentioned banned products.

Answering to a question he said that stock of the above products are of nearly Rs 4 crores in the market and this issue will be settled by administration.

Giving a brief on Cancers in Andaman & Nicobar Islands he said that in last one year there are nearly 144 referral cases suffering due to Oral Cancer in the islands under ANISHI scheme. He said that nearly 14% of students are addicted to tobacco in the islands.

Further answering to a question the representing Commissioner cum Secretary, Dr S P Burma said that there are many nicotine chewing gum in the market that can help the addicted people, which are also not harmful.

HC asks Maharashtra to improve quality of forensic labs

The bench directed the Union government, the Maharashtra government, and the Food Safety and Standards Authority of India to file their affidavits in response to the petition within four weeks. 

The Bombay High Court on Tuesday directed the Maharashtra government to take steps to improve the quality of forensic laboratories in the city.

The bench headed by Justice V M Kanade also observed that there existed a need to establish blood banks in each municipal ward in the city considering that the city “witnesses several accidents in a day.”

The bench was hearing a Public Interest Litigation filed by the NGO Azad Hind Seva Dal.

While the petition raised the issue of food safety and the need to set up food quality testing labs in the city, the court extended the scope of the petition to include blood banks and forensic laboratories.

Something also needs to be done to improve the quality of forensic lab in the city. 99 per cent of cases that rely heavily upon forensic evidence end up in acquittal because the results of the forensic labs are inconclusive,” the court said.

“Also, how many blood banks are presently there in the city? Are safety regulations followed? We need to have such banks in each and every ward and it is also important to ensure that safety regulations are adhered to so as to avoid contamination of the blood. This is a very crucial issue, particularly in a city like Mumbai where accidents are common. Most of the times we hear that blood is not available in hospitals,” it said.

The bench directed the Union government, the Maharashtra government, and the Food Safety and Standards Authority of India to file their affidavits in response to the petition within four weeks.

FSSAI working on scheme for maintain quality of food from farm to fork

New Delhi

In a bid to ensure the safety of food from farm to fork, the Food Safety and Standards Authority of India (FSSAI) is working on a plan (called Farm to Trade - Bridging the food standards) to ensure that safe food produce is picked by large bulk buyers from mandis who deal with processing companies.

FSSAI has compiled a list of such companies and called on them to ensure cleaning, sorting and grading of such raw produce at the mandis. The ministry of agriculture and cooperation and National Commodity and Derivatives Exchange (NCDEX) were in talks for the same recently. 

Besides, the apex food regulator consulted the Food Corporation of India (FCI) and the National Agricultural Cooperative Marketing Federation of India Ltd (NAFED) on the subject.

The issue come to the fore when a large section of the traders demanded a review into the definition of food business operator (FBO), citing their limitation in trading such commodities, raw or processed, provided by others.

Pawan Agarwal, chief executive officer, FSSAI, stated the apex regulator has been engaging such agencies like FCI, NCDEX and NAFED for the purpose.

He said, “Traders don’t want to come under the Food Safety and Standards Act, 2006. There are demands from many quarters like retail. Their concern is genuine, but there will not be any change in the existing definition of FBO. However, the regulator could look into resolving their concerns.”

“We are trying to get a solution to this situation. We had talks with NCDEX and a meeting with the ministry of agriculture, marketing and cooperation also took place recently about whether there be a cleaning, grading and sorting scheme for raw produce at mandis?,” Agarwal added.

“We are figuring out what should be done, because there were many such schemes which didn’t get traction amongst farmers in the past. We’re also looking into how to incentivise the farmers under the scheme. This will be the major focus of the scheme,” he said.

The idea is to bring the bulk buyers on board and through them educate the farmers to adopt the best agriculture practices, including post-harvest management of cleaning, sorting and grading of the raw produce.

“I think alignment is what is needed. A lot of awareness and public education is involved in the whole process,” he added.

India committed to adhering to international food safety standards: J P Nadda

Shri J P Nadda inaugurates 20th session of WHO/FAO Coordinating Committee of Asia 

“India is committed to adhering to international food safety standards.” This was stated by Shri J P Nadda, Union Minister of Health and Family Welfare at the inauguration of the 20th Session of the WHO/FAO Coordinating Committee of Asia (CCASIA), here today. He further added that there is a need for CCASIA to focus on standardization of foods/cuisines of Asian origin and popularize them internationally and facilitate their global trade.

Shri Faggan Singh Kulaste, Minister of State for Health and Family Welfare also graced the occasion.

Speaking at the event, Shri Nadda stated that CCAsia should work on the communication strategy and standardisation of processes, which shall be the contribution to Codex. There is an urgent need for enhancing awareness about the work of Codex in different countries and amongst key stakeholders, he noted. “The benefits of the work done by Codex Alimentarius could be further spread among all countries, especially in the developing countries that comprise almost 70% of the world population,” the Health Minister added.

Shri Nadda also highlighted the need for capacity building among the Asian countries. “There is a felt need for more coordinated action in the region on food standard related areas,” said Shri Nadda while underscoring the need for the Codex member countries to pool their resources and provide support to least developed countries in the region.

The Health Minister further mentioned that Codex has developed important standards and guidelines for different categories of food, national standards need to be harmonised with those of Codex to achieve an appropriate level of human health protection and fair practices in international trade. “We, in India, have already embarked on this harmonization process,” The Health Minister elaborated.

Shri Nadda again urged the Codex member countries to make Codex standard setting inclusive and continue to work collectively in this endeavor.

Addressing the participants, Shri Faggan Singh Kulaste, Minister of State for Health and Family Welfare said that it is imperative to lay down standards for food so that the food safety is ensured and the difficulties in trade of safe food are eliminated. Appreciating the work done by Codex Shri Faggan Singh further stated that the standards developed by Codex are accepted worldwide as these are science based and developed in an inclusive and transparent manner. “In essence, the Codex Alimentarius has reached every continent, and its contribution to the protection of public health and fair trade practices is immeasurable,” Shri Faggan Singh added.

Also present at the function were members of the food sector fraternity including the science community, industry and industry associations, consumer and citizen organizations, international organizations and foreign missions, experts and government officials from Central ministries and States and other key stakeholders.

SC raps gutkha makers for bending food safety law

 

Seeks compliance report by Nov 9

The Supreme Court has again come down heavily on the chewing tobacco industry for flouting the food safety laws of the country which impose a blanket ban on the sale of gutkha, khaini, zarda and other such food products containing tobacco and nicotine.

In an important judgment, the court while hearing an appeal filed by the manufacturers of pan masala, gutkha and chewing tobacco (zarda) against state government notifications issued under the Food Safety and Standards Authority of India Regulations, again directed them to strictly comply with the law.

The regulation in question — Regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) that was issued on August 1, 2011 by the apex food regulator, FSSAI, for the first time banned the sale of gutkha and other forms of smokeless tobacco on grounds that food cannot contain substances harmful to human health.

The SC’s orders came on a plea from amicus curiae Gopal Subramaniam who argued that the manufacturers of chewing tobacco are circumventing the court’s direction to implement the gutkha ban by selling the same product in twin pouches, The amicus said he was speaking for millions of users of chewing tobacco who were not present before the court but were suffering from numerous diseases due to products manufactured by the petitioners.

Subramanian brought to the notice of the court the following content in the government affidavit on the subject: “To circumvent the ban on the sale of gutkha, the manufacturers are selling pan masala (without tobacco) in one packet and flavoured chewing tobacco in another sachet often conjoined and sold together by the same vendor to defeat the purpose of the FSSAI rule. So consumers can buy the pan masala and flavoured chewing tobacco and mix them for consumption. Hence, instead of the earlier ready to consume tobacco mixtures, chewing tobacco companies are now selling gutkha in twin packs to be mixed as one.”

The apex court taking note of the submissions directed all state food safety officers concerned to ensure strict enforcement of the gutkha ban and file a compliance report by November 9.

The Health Ministry had issued orders banning gutkha sale on the basis of a report of the National Institute of Health and Family Welfare which found there were over 3,095 chemical components in smokeless tobacco products including 28 proven carcinogens.

The report further indicates a strong association between smokeless tobacco usage and incidence of oral, esophageal, stomach, pancreatic, throat and renal cancers. The Global Adult Tobacco Survey India recently showed 35 per cent of all Indiana adults used tobacco in some form. Of these, 21 per cent used smokeless tobacco, 9 per cent smoked and 5 per cent used both chewing and smoking tobacco.

SC strengthens gutkha ban, says stop the sale of all chewable tobacco

The regulation 2.3.4 states: “Product not to contain any substance which may be injurious to health: Tobacco and nicotine shall not be used as ingredients in any food products.”

CRACKING down on companies that sell pan masala and tobacco in separate pouches to circumvent the gutkha ban, the Supreme Court has made clear that it has banned the sale of all forms of chewable tobacco and nicotine, and directed authorities, including the Food Safety and Standards Authority of India (FSSAI), to strictly enforce its directions.

A bench of Justices V Gopala Gowda and Adarsh K Goel underlined regulation 2.3.4 of the Food Safety and Standards (Prohibition & Restrictions on Sales) Regulations, 2011, and noted that the prohibition on sale of products with tobacco and nicotine must be put into effect immediately.

The regulation 2.3.4 states: “Product not to contain any substance which may be injurious to health: Tobacco and nicotine shall not be used as ingredients in any food products.”

The court order on Friday, sources in the FSSAI told The Indian Express, will enable the food regulator and other enforcement agencies in the government to prosecute companies that have resorted to an ingenious way of ensuring that sales continue despite the 2011 regulation.

Contending that the notifications restrained them only from selling gutkha (raw betel nut mixed with tobacco), various companies had started selling pan masala paired with a separate sachet of tobacco.

The issue was highlighted by senior advocate Gopal Subramanium, who pointed out that although the regulation was not stayed by any court, its enforcement was lacklustre. Subramanium has been appointed as amicus curiae in the batch of petitions relating to ban on sale of gutkha and pan masala.

The senior lawyer also referred to a submission by the Ministry of Health and Family Welfare that manufacturers and tobacco companies were circumventing the ban imposed under the notifications.

“Instead of the earlier ready-to-consume mix, tobacco companies are now selling gutkha in twin packs to be mixed as one,” said Subramanium, adding that what was required was firm implementation of the FSSAI regulation that provided for a complete ban on products with tobacco and nicotine.

Accepting his plea, the bench passed the order: “In view of the above, concerned statutory authorities are directed to comply with the above mandate of law. We also direct the Secretaries, Health Departments of all the States and Union Territories to file their affidavits before the next date of hearing on the issue of total compliance of the ban imposed on manufacturing and sale of gutkha and pan masala with tobacco and/or nicotine.” The court will hear the case next in November.

According to Global Adult Tobacco Survey 2010, about 35 per cent of adults in India consume tobacco in some form or the other. The estimated number of tobacco users in India is 27.5 crore, with 16.37 crore users of smokeless tobacco, 6.9 crore smokers and 4.23 crore users of both smoking and smokeless tobacco.

Further, a report released in 2014 by the Centre for Disease Control and Prevention and the National Cancer Institute found that users in India and Bangladesh make up 80 per cent of the total smokeless tobacco users in the world.

Another report by the Health Ministry had estimated the total economic cost attributable to tobacco use from all diseases in 2011 amounted to Rs 1,04,500 crore in India, equivalent to 1.04 per cent of the country’s gross domestic product.

Kombucha, with caution

It's an age-old ferment, but a new-age fancy. Kombucha, a fermented yeast tea, which dates back 2,000 years, has become quite the `it' drink with fitness buffs in the city - being sold in flavours across several stores. But while most nutritionists and home brewers believe it to be filled with goodness - from detoxifying to immunity boosting -doctors advise caution before consumption, citing reasons from acidity to toxicity.

But whether one chooses to drink or think, the fact is that bottles of the fizzysour kombucha -made by adding a culture of beneficial bacteria and yeast to tea, sugar, and fruit juice -have begun lining the shelves of departmental stores.

In February, Pune-based market research firm Markets and Markets had estimated that the global market for kombucha is poised to grow from the half a billion dollars it was in 2015 to $1.8 billion in 2020.

Srikant Ram of Econut, one of the oldest organic food stores in Chennai, has been brewing the yeast tea for more than a decade, having found a market of regulars. "Every food culture has its set of fermented foods," says Ram. "India has the ragi porridge as well as palmyra sap, which when fermented is a health drink but when over-fermented becomes toddy ."

In Chromepet, Udhaya Raja is all set to move the manufacturing unit of his brand of kombucha, Ka, from his home to a more professional set-up. "The demand has increased since we launched in 2014. People are more aware of the health trends and are trying it out," says Raja, who now manufactures more than 3,000 bottles a month.

Bhavani ILG, retired professor of plant biology and biotechnology, says she believes in the goodness of kombucha, because "it's a natural ferment and a probiotic." Kombucha is a Chinese probiotic, just like curd, says Bhavani."A lot of Indian foods such as idlis too are ferments," she adds.

"According to traditional knowledge, kombucha is supposed to help relieve pain, improve hair growth, aid digestion, and restore gut flora," says Bhavani, but cautions that it needs to be prepared with care or can cause side effects such as acidosis."Over fermentation or unsanitary preparation of the drink poses a food safety threat," she says. "It can be toxic too when taken in large doses and is not recommended for children, people with low immunity and pregnant women."

ut cardiologist Dr Sai Satish of Apollo Hospitals, Chennai, says whether or not kombucha is great for the gut, he prefers to go with his gut. "In medical literature, the documented claims of harm far outweigh the numerous unsubstantiated claims of the drink's health benefits. There has been no study showing evidence of it being beneficial to humans," he says. "In fact, there are more studies regarding its harmful nature. There have been documented cases of hepatic toxicity and metabolic acidosis among those who consumed kombu cha. When it comes to health, there's no better brew than a brisk 45-min ute walk."

Fine imposed on hotelier

A Judicial Magistrate Court here imposed a fine of Rs. 5,000 on a hotelier, M. Suresh Kumar, for using cashew nut containing live and dead insects for making “salna” (curry) for parotta.

A statement from the Food Safety Officer, Sattur municipality, S. Narayanan, said that the Judicial Magistrate II, V. Geetha, also ordered his sentence till rising of the court on Friday.

During a surprise raid in hotels in the town on October 30, 2015, the Officer found that the cashew nuts kept in the hotel for preparing salna were discoloured and found to have mustiness.

Sample of cashew nuts was sent to Food Analysis Laboratory in Palayamkottai. The report confirmed that the sample contained live and dead insects.

Based on a proposal by Food Safety Department Designated Officer, W. Salodeesan, the Commissioner of Food Safety, P. Amutha, gave the prosecution sanction against the hotelier.
