Nestle awaits test results before resuming Maggi production

New packets will have to be tested again in three laboratories; these laboratories are specified by the court

Its patrons are looking forward towards a quick comeback. Its raw material suppliers are counting days to get out of “the misery” that they are in caused by the ban on its production and sell in the country. But Maggi noodles will not be available for sale before the festive season is over this year. And although Nestle India and the country’s food safety regulator – Food Safety and Standards Authority of India (FSSAI) have fought over the instant noodles’ quality for the past four months at various forums. The controversy, at last, may end without another round of legal battle.

Samples of the instant noodles are being tested in three laboratories in Mohali, Jaipur and Hyderabad on orders of the Bombay High Court. Nestle India will not have to seek permission from the court to start producing Maggi noodles if samples test for less lead than is permissible.

The court had on August 13 quashed the ban on production, distribution, sales and export of Maggi noodles. On clarifications sought by Nestle over resumption of production, the court said if lead was found to be at lower than 2.5 parts per million the company could start manufacturing immediately.

The new packets will have to be tested again in three laboratories specified by the court before they can be sold.

“The petition stands disposed as per the order passed by the Hon’ble Court. The order is abundantly clear that manufacturing at the first stage and selling in the second stage could begin once the testing is in place for each of the stages. There is no requirement to approach the Hon’ble Court for the order to operate further. The order intelligently does not make it cumbersome for the Petitioner to approach the court again”, Zakir Merchant, partner, Khaitan & Co. said.

“We can start manufacturing if lead is found within permissible limits. The products will then undergo fresh tests at the three laboratories. Once the tests confirm lead within permissible limits, we can proceed with sales,” a Nestle India spokesperson said.

“The company can start production as soon as the reports come in, provided the lead content is under the permissible level,” said Ashish Prashad, partner, Economic Laws Practice.

According to Paras Spices, the largest supplier of spices for Nestle in India, as soon as the test reports come in production will start at Nestle's Moga factory at Punjab. “According to our estimates, production of Maggi should start by the end of October,” said Dharmendra Gill of the Ludhiana-based Gilco Flour Mill, another supplier to Nestle.

“A total of 90 samples that comprise six variants of Maggi noodles are to be tested. This process has commenced,” the Nestle spokesperson added.

Since the ban, most of the raw suppliers of Maggi noodles are suffering huge loss of business. While, Paras’s sales has dipped 45%, Gilco had to cut down more than 50% of its production. To maintain quality, Nestle India recently ended their 12 year old association with the third party manufacturer of Maggi noodle - SAJ Food Products. Nestle procures some 90% of the noodle in their five plants across India. According to Suresh Narayan, the company is leaving no stones unturned to regain trust of the consumers and Maggi noodles will be back on shelves within this year.

Malayalam daily slapped with legal notice over story on pesticide use in Tamil Nadu

CFFI states that no analysis had been performed by the Food Safety and Standards Authority of India.
 

The Crop Care Federation of India (CCFI) has slapped a legal notice on popular Kerala daily, Malayalam Manorama, over a story it published titled ‘Centre asks Tamil Nadu to curb use of pesticides’.

The story was published on the daily's website on September 24 and it stated that an analysis had confirmed high levels of pesticide in the vegetables grown in the state. CCFI now states that no analysis had been performed by the Food Safety and Standards Authority of India (FSSAI).
A report in Deccan Chronicle states that CCFI had sent a legal notice stating the report was ‘false and fabricated’. The CCFI says that FSSAI and the Kerala Agricultural University didn’t respond to the legal notice with any data. CCFI alleges that the analysis by the (FSSAI) had not even taken place hence there is no data of pesticide contamination.
Recently, numerous stories have been doing the rounds in the media in Kerala about how there were high levels of pesticides found in the vegetables grown in Tamil Nadu. These vegetables are sold in Kerala say reports.
The CCFI alleges that the news report in Malayalam Manorama had distorted facts, adds the Deccan Chronicle report. It is waiting for the parties to revert to their legal notice.

‘PDS distributors’ claims not based on facts'

The Kerala State Civil Supplies Corporation has denied claims by Kerala Ration Wholesale Distributors’ Federation that the Corporation’s stand hampered the release and wholesale distribution of rice meant for the Public Distribution System.A press release from Supplyco cited its managing director A. T. James as saying that the Corporation had only implemented existing rules in the wake of the discovery that there were serious leakages in the supplies.

The wholesale distributors have come out in protest with the implementation of the rules against the leakages, the press release said. It was issued in the wake of a protest march organised by the ration distributors on Monday.
The release said the Supplyco management was only following the rule that all wholesale ration distribution depots must be brought either under Food Safety and Standards Authority of India or the Department of Food and Civil Supplies. A Supreme Court ruling in 2011 had also issued a directive to implement end-to-end computerisation of the PDS. The Corporation management was only implementing changes that are needed to achieve the aim of total computerisation, the release said.
As part of these efforts, Supplyco had begun work for door-to-door distribution of supplies to ration outlets. The ration dealers had alleged that they had been denied permission to take delivery of rice from mills. However, Supplyco said that the process had been computerised and dealers could take delivery of stocks.

FSSAI chairman to hold additional charge of CEO; Sandhya Kabra shifted

The churning in the rank and file of FSSAI that started with shifting of CEO YS Malik continues with Ashish Bahuguna, chairman FSSAI, taking up additional charge of chief executive officer of the body. Not only that, the much-in-news Product Approval division has a change in Dr Rubeena Shaheen from J&K replacing Sandhya Kabra. Shaheen is an MBBS doctor with MS in public health. Kabra will now look after only QA/Legal issues.

Meanwhile, FBOs (food business operators) state that the changes would not help in pacifying the anguish of food industry. The newly-formed National Joint Action Committee of 12 different food industry organisations states that the officers behaving in an arbitrary manner should be shifted out of FSSAI. 

Bahuguna, former union agriculture secretary, was appointed as chairman FSSAI in July this year. He would continue to hold the position of CEO till a formal appointment which could take few months. 

On September 23, Malik was moved out and shifted as additional secretary in Niti Aayog. He was believed to be the man behind the ban of global giant Nestle's popular noodles brand Maggi, while, Bahuguna, IAS officer of 1978-batch of Rajasthan cadre, retired in February this year from agriculture ministry. 

FSSAI, ever since it took action on Maggi noodles, has found itself in continuous controversy for its alleged arbitrary way of functioning. As a result, the CEO was first shifted out of the apex food regulator and now Sandhya Kabra was shunted out of the Product Approval job. According to sources, it was direct fallout of continuous pressure from FBOs on health ministry.

Further the FSSAI has appointed new advisors for various jobs. Anil Kumar, formerly with the Bureau of Indian Standards (BIS) has been given charge of advisor on standards while Sunil Bakshi, formerly with National Dairy Development Board, has been entrusted with the charge of advisor on regulations and Codex. 

Also, according to sources, Sanjay Dave, former advisor, FSSAI, was likely to join the apex food regulator in the same capacity. His duties will be prescribed later.

முக் கி ய மாக பச்சை மிள காய், காலி பி ள வர், முட்டை கோஸ், கத் த ரிக் காய், தக் காளி, குடை மி ள காய், கொத் த மல்லி உள் ளிட்ட வற் றில் நச் சுப் பொ ருட் கள் அதி க ளவு கலந் துள் ளது தெரி ய வந் துள் ளது. இதில், டெல் லி யில் நச் சுப் பொ ருட் களின் அளவு அபா யக் கட்டத் தில் உள் ளது. சுமார் 41 மாதி ரி களை ஆய் வுக்கு உட் ப டுத் தி ய தில் அனு ம தித்த அளவை விட அதிக அள வில் நச் சுப் பொ ருட் கள் இருப் பது தெரி ய வந் தது. இவற் றில் 31 மாதி ரி கள் காய் க றி க ளா கும். டெல் லி யில் கிடைக் கப் பெ றும் பெரும் பா லான காய் க றி கள் யமுனா ஆற் றிற்கு அரு கில் உள்ள பகு தி களில் விளை விக் கப் பட்டவை ஆகும்.

இதே போல் குர் கா னில் 24 மாதி ரி களில் நச் சுப் பொ ருட் கள் இருப் பது கண் ட றி யப் பட்டது. இவற் றில் 11 மாதி ரி கள் காய் க றி க ளா கும். மும் பை யில் 38 மாதி ரி களில் 25லிலும், ஐத ரா பாத் தில் 51 மாதி ரி களில் 27லிலும், ஜெய்ப் பூ ரில் 10 மாதி ரி களில் 7லிலும் நச் சுப் பொ ருட் கள் இருந் தன என் பது குறிப் பி டத் தக் கது.
