New Delhi: Government has granted a breather to businesses for procuring license/registration till 4 February to implement Food and Safety Standards Act 2006. But food business operators involved at various levels are having no less complaints and questions.
The modern law in place of half a dozen laws is more comprehensive and transparent. However, the law suffers practical difficulties. Thus, the law is unlikely to be implemented by 4 February. Bhaskar Business’ K K K Kulshreshta presents a report on strengths and weaknesses of the new Food Act.
Applied to regulate the business of food items, new Food and Safety Standards Act 2006 is designed as a whole and comes into force to do away half a dozen laws. Scope of new law

Entrepreneurs churning Rs. 12 lakh annually are only required to register under the law. They are considered petty food business operators. Those garnering more than Rs. 12 lakh are required to procure license. Those in dairy and poultry entrepreneurs shall be judged whether there’s is small business on basis of volume.
Old law to be ineffective
The new law has forced seven old laws as ineffective – Prevention of Food Adulteration (1954), Food Product Order (1955), Meat Food Product Order (1973), Vegetable Oil (Products) Control Order (1947), Edible Oil Packaging Regulation Order (1988), Solvent Extracted Oil, D-Oil Mill and Edible Floor (Control) Order (1967), Milk and Milk Product Order (1992). With effect of new law, inspection and compliance at various levels by many departments would be scrapped.
Framework for new legislation
To effect the new law, an independent statutory body Food Safety and Standard Authority of India (FSSAI) has been established. Similarly, a state level body State Food Safety Authority has been constituted. The entire system at centre level works under the Ministry of Health and Family Welfare.
FSS regulations are to regulate the food business from farm to fork . In the interest of safe food to consumers all the stake holders needs to follow hygiene standards to improve their business.. Enforcement needs to be given encouragement . FBO s needs training, guidance and support to implement standards by all stake holders concerned.
